The Importance of Pro-Small Business Policies and Legislation The importance of small business to our economy, job creation and innovation is documented and well known. The facts show that entrepreneurs play the central role in our economy. Consider the following: • In 2011, according to the latest data from the U.S. Census Bureau, there were 5.68 million employer firms in the United States. Firms with fewer than 500 workers accounted for 99.7 percent of those businesses, and businesses with less than 20 workers made up 89.8 percent. Add in the number of nonemployer firms – there were 22.7 million in 2012 – then the share of U.S. businesses with less than 20 workers increases to 98 percent. • According to the Small Business Administration’s Office of Advocacy, 46 percent of private nonfarm GDP is produced by small businesses, and over the period of 1993 to mid-2013, 63 percent of net new jobs were created by small businesses. During periods of economic recovery, this percentage is much higher. These and other facts covering the many contributions of small businesses to our economy are widely acknowledged in the halls of Congress. Unfortunately, however, we still have to test whether or not pro-small business rhetoric is matched by how politicians vote on legislation favorable to small business. This has become more important as U.S. entrepreneurship remains in a major slump. Start-ups and self-employment have only marginally improved since the Great Recession. In fact, according to data from the Department of Labor, self-employment in June 2014 reached its lowest level since 1986. According to the House Small Business Committee at a hearing in September 2014: “The rate of new business creation has dropped by nearly 50 percent from 1978. In 1978, there were 12 new businesses created for each existing business while in 2011 this dropped to 6.2 new firms.” Our elected officials need to be doing all they can to advance pro-growth, pro-small business policies and legislation to encourage entrepreneurial activity in America. Such legislation would aim to lift government barriers -- like a complex tax system and high taxes, burdensome regulations and policy uncertainties -- off of

entrepreneurs. Our elected officials need to focus on policies that encourage capital formation, investment and risk-taking instead of one that turn people off or away from pursuing their entrepreneurial dream. SBE Council’s “Congressional Scorecard for the 113th Congress” gauges how members of Congress vote on issues critical to small business and entrepreneurship. For the 113th Congress, SBE Council scored members of the U.S. Senate on 10 Key Votes, and members of the U.S. House of Representatives on 20 Key Votes. The Hatch Amendment repeals the 2.3 percent excise tax on medical device manufacturers imposed by the Affordable Care Act. More than 80 percent of medical device manufacturers have fewer than 50 employees. This tax is damaging innovation, investment and U.S. competitiveness, and is crippling many entrepreneurial firms in the important industry. (PASSED: 79 Yes, 20 Nay)

Roll Call Vote 49: Tax Relief and Comprehensive Tax Reform: The Grassley Amendment would protect American taxpayers from $1 trillion in tax increases and provide for pro-growth, revenue neutral tax reform. Reforming the nation’s tax code is a top issue for entrepreneurs. (REJECTED: 45 Yes, 54 Nay)

The Cruz Amendment repeals the Patient Protection and Affordable Care Act and the Health Care and Education Reconciliation Act of 2010. This was a Cloture vote on the motion to proceed to a bill that would increase the minimum wage while extending Sec. 179 expensing for small businesses. The bill is bad coupling of polcies as the minimum wage hike would damage the competitiveness and viability of many small firms and erect more formidable cost barriers to startups. The temporary extension of Section 179 is important, but not worth the trade off of damaging so many small businesses and killing jobs. (REJECTED: 54 Yes, 42 Nay)

10. S.2432. June 11, 2014. Roll Call 185: Surtax on Successful Entrepreneurs. The vote was on a motion to invoke cloture on the motion to proceed to S.2432. The bill amends the Higher Education Act of 1965 to provide for the refinancing of certain Federal student loans, and for other purposes, by imposing a surtax on wealthy entrepreneurs. Entrepreneurs need tax relief in order to invest in their businesses, not punitive tax increases that siphon their capital. (REJECTED: 56 Yes, 38 Nay)

Roll Call 14: Small Business Mergers, Acquisitions, Sales, and Brokerage Simplification Act of 2014 Policies must enable entrepreneurs to sell and create new businesses, rather than face impediments imposed by costly regulation. For individuals who want to buy businesses, government should not erect costly barriers preventing such sales. For entrepreneurs who want to sell businesses and use the capital for other productive purposes, intrusive rules are preventing productive ventures. H.R. 2274 exempts brokers involved in mergers and acquisitions of privately-owned small businesses from expensive registration requirements. Businesses making less than $25 million in annual earnings or less than $250 million in annual gross revenue would be exempt from the SEC’s expensive registration requirements. Roll Call 67: Private Property Rights Protection Act of 2014 H.R. 1944 prohibits a state or political subdivision from exercising its power of eminent domain over property to be used for economic development or over property that is used for economic development within seven years after that exercise, if the state or political subdivision receives federal economic development funds during any fiscal year in which the property is so used or intended to be used. Roll Call 69: Stop Targeting of Political Beliefs by the IRS Act of 2014To prohibit the IRS from modifying the standard for determining whether an organization is operated exclusively for the promotion of social welfare for purposes of section 501(c)(4) of the Internal Revenue Code of 1986. Roll Call 78: Achieving Less Excess in Regulation and Requiring Transparency Act of 2014 Regulatory overreach and secretive rulemakings cost the economy and small businesses more than $2 trillion annually, according to a new study by the National Association of Manufacturers. Federal regulators are out-of-control, operate by their own rules, and ignore their statutory requirements when it comes to including small business impact and engagement in rulemakings. Roll Call 85: Consumer Financial Freedom and Washington Accountability Act This package of bills would bring greater accountability and transparency to the powerful Consumer Financial Protection Bureau (CFPB). Its extensive regulatory reach is harming capital access, while its questionable programs – such as monitoring the credit card and personal financial information of American consumers and small businesses – is occurring because the CFPB

14. H.R.899. February 28, 2014. Roll Call 90: Unfunded Mandates Information and Transparency Act of 2014 This important bill improves existing law by making agencies disclose the costs of federal mandates, expediting congressional oversight of costly rules and increasing small business engagement in the regulatory process. Where agencies ignore their responsibilities, H.R. 899 provides for meaningful judicial review. Overregulation is choking small firms, undermining business confidence and investment, and holding the economy back. 15. H.R.3826. March 6, 2014. Roll Call 106: Electricity Security and Affordability ActEPA’s costly and controversial greenhouse gas rules for power plants will raise prices for all consumers and small businesses. Affordable energy costs are critical for many types of businesses, especially energy intensive ones. H.R. 3826 brings sanity to these regulations in that Congress will have more say in this specific rulemaking, and the EPA will be required to determine that the specific technologies they mandate in the rule (to reduce emissions) are feasible and usable in the commercial marketplace. 16. H.R. 2575. April 3, 2014. Roll Call 156: Save American Workers Act of 2014 H.R. 2575 amends the Affordable Care Act (ObamaCare) to redefine "full-time employee" as 40 hours rather than 30 hours as it relates to the employer mandate to provide health coverage in Obamacare. As it is, the employer mandate is a burden for small businesses. The imposition of the 30-hour rule is extreme. Job growth is suffering due to the mandate. The employer mandate should be repealed, but replacing the 30-hour rule with 40 hours is a start. (PASSED: 248 Yes, 179 Nay)

17. H.R.4438. May 9, 2014. Roll Call 211: American Research and Competitiveness Act of 2014 H.R. 4438 reforms and makes permanent the research and development (R&D) tax credit. This credit is an important tool and incentive for small firms to invest in innovations and innovative processes. (PASSED: 274 Yes, 131 Nay)

18. H.R. 4457. June 12, 2014. Roll Call 309: America’s Small Business Tax Relief Act of 2014 Realistic levels for Section 179 expensing ($500,000) expired at the end of 2013. The current $25,000 level is not practical for most small businesses that need to invest in equipment and other purchases that will help keep their firms competitive. Making permanent Section 179 expensing at the $500,000 level will enable entrepreneurs to plan and invest with confidence. Such expensing and permanency reduces complexity, burden, and costs for small businesses, which allows entrepreneurs to focus their resources and time on productive activities that benefit our economy. 19. H.R.6. June 24, 2014. Roll Call 342. Domestic Prosperity and Global Freedom Act H.R. 6 provides for expedited approval of natural gas exports to World Trade Organization countries, and requires approval for the construction, connection, operation, or maintenance of oil or natural gas pipelines or electric transmission facilities at the national boundary of the U.S. for the import or export of oil, natural gas, or electricity to or from Canada or Mexico. Enhancing incentives via bonus depreciation – in this case, making permanent a first-year depreciation deduction equal to 50 percent of the adjusted basis of qualified property, and expanding the definition of qualified property – would be a real plus for the economy, and small businesses.
