1. CONTRACTOR SHALL CONSTRUCT (SUCH CONSTRUCTION REFERRED TO HEREIN AS THE WORK) IMPROVEMENTS ON THE PREMISES IN ACCORDANCE WITH THESE CONSTRUCTION DOCUMENTS.
2. CONTRACTOR SHALL PAY AND OBTAIN ALL LICENSES, PERMITS, APPROVALS AND CERTIFICATES (COLLECTIVELY THE PERMITS) NECESSARY TO COMPLETE THE WORK IN COMPLIANCE WITH ALL APPLICABLE RULES AND REGULATIONS.
3. THE CONTRACT DOCUMENTS ARE COMPLEMENTARY AND THEY SHALL BE INTERPRETED SO THAT WHAT IS CALLED FOR BY ONE SHALL BE AS BINDING AS IF CALLED FOR ALL SHOULD, THE CONTRACTOR, OBSERVE ANY CONFLICTS WITHIN THE CONTRACT DOCUMENTS. HE SHALL BRING THEM TO THE ARCHITECT'S ATTENTION FOR DECISION AND REVISION AT ONCE. THE CONTRACTOR SHALL SECURE WRITTEN INSTRUCTION FROM THE ARCHITECT BEFORE PROCEEDING WITH ANY WORK AFFECTED BY CONFLICTS, OMISSIONS OR DISCREPANCIES IN THE CONTRACT.
4. THE CITY APPROVED CONTRACT DOCUMENTS SHALL BE KEPT AND MAINTAINED ON THE JOB SITE AT ALL TIMES DURING THE COURSE OF CONSTRUCTION. AT THE COMPLETION OF THE WORK, ALL CONTRACT DOCUMENTS SHALL BE RETURNED TO THE OWNER TOGETHER WITH A COMPLETE SET OF “AS-BUILT” DOCUMENTS.
5. AT OR NEAR “SUBSTANTIAL COMPLETION”, THE CONTRACTOR SHALL MEET WITH THE OWNER AND ARCHITECT IN ORDER TO ESTABLISH A FORMAL LIST OF CONSTRUCTION DEFICIENCIES (THE “PUNCH LIST”). ALL BUILDING SYSTEMS MUST BE INSTALLED AND OPERABLE PRIOR TO SUBSTANTIAL COMPLETION. IF THE PUNCH LIST ITEMS ARE NOT CORRECTED WITHIN TEN DAYS THEREAFTER, THE OWNER MAY HIRE AN INDEPENDENT CONTRACTOR FOR SUCH DEFICIENCIES. IF ANY ITEM CANNOT BE REASONABLY CORRECTED WITHIN SUCH TEN (10) DAYS, THE REASONS THEREFORE SHALL BE EXPLAINED IN WRITING ON THE PUNCH LIST TO THE OWNER'S SATISFACTION.
6. CONTRACTOR OR ITS DESIGNATED AND QUALIFIED REPRESENTATIVE WITH FULL AUTHORITY TO ACT ON BEHALF OF THE CONTRACTOR UNDER THIS CONTRACT SHALL AT ALL TIMES DURING THE PROCESS OF THE WORK, BE IN ATTENDANCE AT THE PREMISES AND SUPERVISING THE WORK. CONTRACTOR SHALL CAREFULLY STUDY AND COMPARE ALL DRAWINGS, SPECIFICATIONS AND OTHER INSTRUCTIONS AND SHALL AT ONCE REPORT TO THE ARCHITECT ANY ERRORS, INCONSISTENCY OR OMISSIONS THE CONTRACTOR MAY DISCOVER. CONTRACTOR SHALL DO NO WORK WITHOUT APPROPRIATE PLANS, SPECIFICATIONS OR INTERPRETATIONS.
7. CONTRACTOR SHALL CONTINUOUSLY MAINTAIN ADEQUATE PROTECTION FOR ALL WORK FROM DAMAGE AND THE ELEMENTS AND SHALL PROTECT AND TAKE ALL REASONABLE PRECAUTIONS TO PROTECT THE OWNER, THE OWNER'S PROPERTY, ANY THIRD PARTY AND THE PROPERTY OF ANY THIRD PARTY FROM INJURY OR LOSS DURING THE COURSE OF THE WORK.
8. CONTRACTOR SHALL COMPLY WITH ALL APPLICABLE RULES AND REGULATIONS OF ANY PUBLIC AUTHORITY HAVING JURISDICTION FOR THE SAFETY OF PERSONS OR PROPERTY. CONTRACTOR SHALL ERECT AND MAINTAIN AS REQUIRED BY EXISTING CONDITIONS AND PROGRESS OF THE WORK ALL REASONABLE SAFEGUARDS FOR SAFETY AND PROTECTION, INCLUDING POSTING DANGER SIGNS, PROMOTING SAFETY REGULATIONS AND NOTIFYING OWNERS AND USERS OF ADJACENT UTILITIES AND PROPERTIES.
9. CONTRACTOR SHALL PROVIDE AND MAINTAIN A WATER-TIGHT STORAGE SPACE, SECURE FROM THEFT, FOR STORAGE OF ALL EQUIPMENT CALLED FOR ON THE PLANS AND SPECIFICATIONS.
10. ALL OF THE WORK SHALL BE COMPLETED IN A PROFESSIONAL MANNER AND IN ACCORDANCE WITH THE CONTRACT DOCUMENTS WITH NEW QUALITY MATERIALS AND ENSURES THAT ALL WORK AND MATERIALS AGAINST DEFECTS IN THE MATERIAL OR THE WORKMANSHIP PER THE SPECIFICATIONS. IF A DEFECT IN MATERIAL OR WORKMANSHIP OR A DEVIATION FROM THE DRAWINGS AND SPECIFICATIONS IS LATENT, HIDDEN OR NOT READILY OBSERVABLE, CONTRACTORS WARRANTY SHALL BE EXTENDED PER THE SPECIFICATIONS FROM THE DATE OF DISCOVERY OF THE DEFECT OR DEVIATION, WITHIN A REASONABLE TIME AFTER WRITTEN NOTICE OF A DEFECT OR DEVIATION. CONTRACTOR SHALL WITHOUT EXPENSE TO THE OWNER, REMEDY AND REPAIR SAME AND ANY DAMAGE TO OTHER WORK RESULTING THEREFROM.
11. IF HAZARDOUS MATERIALS OF ANY KIND ARE ENCOUNTERED DURING CONSTRUCTION THE CONTRACTOR IS TO STOP ALL WORK IMMEDIATELY AND NOTIFY THE ARCHITECT.
12. CONTRACTOR FOR ALL TRADES SHALL, AT ALL TIMES, KEEP PREMISES FREE FROM ACCUMULATION OF WASTE ITEMS, MATERIALS AND RUBBISH CAUSED BY THEIR WORK. AT THE COMPLETION OF THE WORK, REMOVE ALL RUBBISH, TOOLS, SCAFFOLDING, SURPLUS MATERIALS, ETC. AND LEAVE PROJECT AND SITE IN A BROOM CLEAN CONDITION.
13. CONTRACTOR TO VERIFY ALL DIMENSIONS AND REPORT DISCREPANCIES TO THE ARCHITECT. DIMENSIONS OF ANY EXISTING ITEMS ARE FOR REFERENCE ONLY AND ARE PLUS OR MINUS DIMENSIONS. CONTRACTOR IS RESPONSIBLE FOR COORDINATING EQUIPMENT DIMENSIONS WITH ALL REQUIRED CLEARANCES AND OTHER DIMENSIONS. THE DIMENSIONS SHOWN ON DRAWINGS ARE TO FACE OF FINISH, CENTERLINE OF COLUMN OR FACE OF CONCRETE/CMU WALLS, U.N.O. SCALE DRAWINGS.
14. USE FIRE RETARDANT AND PRESSURE TREATED LUMBER AS SHOWN ON PLANS AND FOR ALL WOOD REQUIRED BY CODE TO MEET U.L. FIRE HAZARD CLASSIFICATION. ALL WOOD SHALL BE IDENTIFIED WITH U.L. LABEL CERTIFYING THIS CLASSIFICATION. FOR WOOD THAT COMES IN CONTACT WITH CONCRETE OR C.M.U. PROVIDE PRESSURE TREATED LUMBER.
15. ALL PENETRATIONS THROUGH FIRE RATED ASSEMBLIES MUST BE SEALED TO MEET U.L. AND ALL GOVERNING CODES.
16. THE CONTRACTOR SHALL BE RESPONSIBLE FOR LOCATING ALL EXISTING UNDERGROUND UTILITIES WHERE ENCOUNTERED AND MAKE ALL NECESSARY ARRANGEMENTS FOR SUPPORT, SHORING, RE-ROUTING OR UTILITY DISCONNECT AS REQUIRED BY APPLICABLE CODES AND/OR WITH PRIVATE UTILITY COMPANIES.
17. ALL TEMPORARY BRACING, SHORING OR SUPPORT SHALL BE DESIGNED TO SUSTAIN ALL CONSTRUCTION LOADS, SOIL PRESSURE, LATERAL AND OTHER LOADS TO WHICH THE STRUCTURE MAY BE SUBJECTED TO.
18. LARGE SCALE DRAWINGS TAKE PRECEDENT OVER SMALLER SCALE DRAWINGS.
19. SUBMIT FIRE SPRINKLE AND FIRE ALARM PLANS AS REQUIRED TO THE FIRE DISTRICT FOR REVIEW AND APPROVAL PRIOR TO INSTALLATION. THE FIRE PROTECTION CONTRACTOR IS RESPONSIBLE FOR ALL DESIGN, DRAWING, PRINTING, PERMITTING AND INSTALLATION OF FIRE PROTECTION SYSTEM.
20. ALL REQUIREMENTS AND REGULATION PERTAINING TO HANDICAPPED ACCESSIBILITY AND O.S.H.A. MUST BE INCORPORATED INTO THE WORK EVEN IF NOT LISTED INDIVIDUALLY OR SEPARATELY IN THE DRAWINGS.
21. SHOP DRAWINGS ARE MEANT TO COMPLIMENT AND TO CLARIFY THE CONSTRUCTION DOCUMENTS. CONTRACTOR SHALL REVIEW SHOP DRAWINGS PRIOR TO SUBMITTAL TO THE ARCHITECT. NOTIFY THE ARCHITECT FOR CLARIFICATION PRIOR TO SUBMITTAL. SHOP DRAWING LITERATURE SHALL BE SUBMITTED FOR ALL STEEL FABRICATION, MILLWORK, DOORS AND HARDWARE, PAINT, CEILING, TILE PLUMBING FIXTURES AND FITTINGS, HVAC EQUIPMENT AND CONTROLS AND ELECTRICAL FIXTURES AND GEAR.
22. THE ARCHITECT ASSUMES THE GENERAL CONTRACTOR HAS INCLUDED IN HIS BID THE HIGHEST QUALITY AND GREATEST QUANTITY FOR THE PURPOSE OF RESOLVING ANY CONFLICTS IN THE CONSTRUCTION DOCUMENTS WHICH ARE IMPLIED OR UNDEFINED.
