CML Handbook: A 2016 Update - 2 Compulsory Conveyancing/General Group Study

Further to the introduction of Compulsory Conveyancing CPD in January 2014, the Society has once again organised a series of lunchtime Conveyancing CPD events for 2016. The events will take place over the course of the year and in various locations to make them as accessible as possible to all conveyancing solicitors. All sessions will run for 1 hour, cost £35 and attract 1 Compulsory Conveyancing/General Group Study hour EXCEPT for the CML Handbook: A 2016 update – which will run for 2 hours, cost £60 and attract 2 Compulsory Conveyancing/General Group Study hours.

In addition to the lunchtime sessions, the Society will also be offering Comprehending Conveyancing workshops (3 over the course of 2016) and the Conveyancing Conference in October 2016 – full details of these events are also included in this brochure.

The Society has organised this practical, free of charge CPD seminar to highlight some of the most important areas members should be aware of in relation to Cyber Crime and Cyber Security. There will be input from a range of highly experienced and expert presenters including:

- Cyber Crime Centre, PSNI;- Banks;- Insurers;- Legal professionals;- Law Society Regulatory function.

Topics to be covered will include how to protect your business from fraud, current fraud threats and prevention advice, case studies and the insurance implications of cyber fraud.

To coincide with the establishment of the Legal Services Agency Northern Ireland (LSANI) in 2015 a series of new subordinate legislation was enacted by the Department of Justice to introduce Civil Legal Services under the Access to Justice (NI) Order 2003. The new Regulations repeal the Legal Aid (General) Regulations (NI) 1965 and the Legal Advice and Assistance Regulations (NI) 1981 and replace them with updated and consolidated Regulations which also introduce a number of significant new provisions.

This practical series of seminars has been designed to ensure that all civil legal aid practitioners in both the Lower and Higher Courts have an enhanced working knowledge of the requirements of the new legislation to include:

- where to find the relevant legislation and supporting material issued by LSANI; - the scope of, and the different forms of, civil legal services which are available;- the procedures for applying for and making decisions about the funding of civil legal services;- the assessment of a client’s financial resources to determine eligibility and the provisions relating to waiver of limits;- client care issues where a client is to receive civil legal services and in particular solicitors’ obligations under the

Solicitors’ (Client Communication) Practice Regulations 2008;- matters which may arise during the currency of a civil legal aid certificate such as seeking authorities for counsel and/

or the cost of disbursements, the suspension, discharge and revocation of a certificate;- where legal aid is refused the processes for review and appeal to include the operation of the new Appeals Panel;- the legislative provisions relating to costs and cost protection;- the operation of the Statutory Charge;- the provisions of the Civil Legal Services (Remuneration) Order 2015 and the Agency‘s policy on the late submission of

claims for fees.

The OCP is the department of the High Court with responsibility for the administrative work associated with Part VIII of the Mental Health [Northern Ireland] Order 1986. The OCP is responsible for the appointment of ‘Controllers’ – persons who have court authority to manage the finances and property of someone who, through mental incapacity, is unable to manage their own affairs.

Session 1 Consents for charitable companies Wednesday 9 March 2016

Under the Charities Act (Northern Ireland) 2008, some changes to a charitable company’s articles of association must be approved by the Charity Commission for Northern Ireland before they take effect. For example, there are three regulated alterations:

• any change to the statement of the objects (purposes) of the charity;• any change to what happens to the charity’s property on winding up;• any change which authorises the charity’s funds or property to be used to benefit the directors or members or

organisations connected with them.

Unless the articles of association of a charitable company state that the consent of the Commission is required for all proposed changes, charitable companies are free, in most cases, to make any changes which are not regulated alterations.

Regulated alterations require the consent in writing of the Commission before a special resolution making the alteration is passed by the charity. This seminar will look in detail at the law behind consents and provide an overview of the Commission’s processes when considering a request for consent.

Session 2 Requesting a scheme (cy-près) Wednesday 2 November 2016 Sometimes charities need to adapt the way they operate to reflect changes in society or the context in which they work. Some charities may have the power in their governing document to make changes, while others may be able to use specific provisions set out in the Charities Act (Northern Ireland) 2008 (as amended). Otherwise, it is necessary to apply to the Commission to request a scheme. A scheme is a legal document, made by the Commission, which changes, replaces or extends the trusts of a charity. Under section 26 of the Charities Act (Northern Ireland) 2008, the Commission can make a scheme to change the purposes of a charity where the current purposes:

Following the enactment of the Human Trafficking and Exploitation (Criminal Justice and Support for Victims) Act (NI) 2015, the Society has organised practical briefings for members to ensure that legal professionals are aware of the changes to the legislation.

The legislation has made some significant changes to the legislative framework around human trafficking and slavery, servitude and forced or compulsory labour. Amongst other things it creates new offences and increases the maximum sentence for human trafficking and slavery-type offences to life imprisonment. The Act also makes provision in respect of

As part of the Society’s Compulsory Conveyancing CPD programme, the 2016 Conveyancing Conference has been organised for Wednesday 26 October 2016.

Following on from the success and very positive feedback from the 2015 Conference, the programme will cover current conveyancing issues relevant to all those who undertake conveyancing transactions. The session will be delivered by Sheena Grattan. Sheena is a practising Chancery barrister in Northern Ireland specialising in private client work. Previously she was a senior lecturer in the Law School of Queen’s University, Belfast lecturing in Equity (including Trusts), Land Law, Inheritance and the Law and Revenue Law, having started her career as a solicitor in private practice.

Sheena is the author of several legal texts including Succession Law in Northern Ireland (SLS), and, with James Kessler QC, Drafting Trusts & Will Trusts in Northern Ireland (Bloomsbury). She is a founding member of the STEP: Northern Ireland branch and in 2012 was the recipient of a STEP Founder’s award for outstanding achievement.
