ORDINANCE 07-18

An Ordinance Of The Town Council Of The Town Of Westfield, Indiana, Amending The Westfield Code Chapter 58, Division 10. Figures, Sec. 58-346 Through Sec. 58-355

WHEREAS, Indiana Code 9-21-1 et seq. permits the Town of Westfield, Indiana, to adopt certain traffic regulations; and

WHEREAS, from time to time, as conditions change, the traffic regulations may need to change; and

WHEREAS, the Town Council has the authority to amend the Westfield Code; and

WHEREAS, the Town Council desires to amend Chapter 58, Division 10. Figures, Sec. 58-346 through Sec. 58-363 of the Westfield Code;

NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Westfield, Indiana, as follows:

Section 1. Chapter 58, Division 10. Figures, Sec. 58-346 through Sec. 58-363 of the Westfield Code is hereby amended by the deletion of the existing language and by the addition of the language which is attached as Exhibit A and incorporated herein.

Section 2. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance.

Section 3. This Ordinance shall be in full force and effect from and after the date of its passage and such publication as is required by law.

A. Penalties

A. Each violator of the restrictions and provisions of this traffic offense shall pay a fine and penaltyto the Town of Westfield, in the sum of ten dollars ($10), if paid within seven (7) days of the date ofthe time of issuance of the traffic offense. Additional late fees shall be assessed based upon thefollowing fine schedule:

1. Unpaid between eight and fourteen (8-14) days of the date of issuance: Twenty dollars ($20)

2. Unpaid between fifteen and twenty-one (15-21) days of the date of issuance: Forty dollars ($40)

3. Unpaid between twenty-two and twenty-eight (22-28) days of the date of issuance: Sixty dollars ($60)

4. Unpaid between twenty-nine and thirty-five (29-35) days of the date of issuance: Eighty dollars ($80)

5. Unpaid after thirty-six (36) days of the date of issuance: One Hundred dollars ($100)

B. 4 Hour Parking Permits

1. The Town of Westfield Public Works Department will issue 4 Hour Parking permits to businesses in the sum of ten dollars ($10). These permits will expire on December 31st of the year of issuanceissuance. If the permit holder does not renew the parking permit by the expiration date, they mustcomply with the parking requirements of the area they are parked in, or receive a parking violation.

2. These permits are only to be used by the customers of the business in buildings located within the 2 Hour Parking Zone (See Figure 9E-3).

3. The color of the permit will change each year and will be printed with the same information on both sides. This colored permit must be in the vehicle and visible hanging from the mirror or left front dash.If the customer fails to display the hanging permit, then they must comply with the parking requirementsof the area they are parked in, or receive a parking violation.

4. Any business who has been issued a 4 Hour Parking permit and abuses the use of the 4 Hour Parking permit will be issued a fine pursuant to "Sec.58-354.Sec. A. Penalties". An example of anabuse would be a business owner or employee, instead of their customer, who uses the 4 Hour Parking permit.

C. Residential Parking Permits

1. The Town of Westfield Public Works Department will issue Residential Parking permits to residents who live in 2 Hour Parking areas. These permits will expire on December 31st of the year of issuance.If the permit holder does not renew the residentail parking permit by the expiration date, they mustcomply with the parking requirements of the area they are parked in, or receive a parking violation.

2. These permits are only to be used by the residents that live in address located within the 2 Hour Parking Zone (See Figure 9E-3). Proof of residency will be required at the time of obtaining the permit.

3. The color of the permit will change each year and will be printed with the same information on both sides. This colored permit must be in the vehicle and visible hanging from the mirror or left front dash.If the resident fails to display the hanging permit, then they must comply with the parkingrequirements of the area they are parked in, or receive a parking violation.

D. Booting/Towing

1. Any Vehicle having three (3) UNPAID parking violations in excess of sixty (60) days after the date of issuance that is found in a Parking Zone Restriction Area is subject to being restrained by havinga wheel boot installed by employees of the town of Westfield, until such time as all outstandingfines and fees are paid in full. In addition, there will be a twenty-five dollar ($25) fee for the removal ofwheel boot. It is the discretion of the Chief of Police to have motorcycles and/or any other vehicles towed to safe storage in lieu of using the wheel boot. Said vehicle will be released only afterpayment of all fines and fees are paid and full, and any costs incurred by the Town for the towingof the vehicle.

2. In the event that such a fine has not been paid within ninety (90) days of the date of the issuancethe violator may be docketed in the County Courts and prosecuted as a Class A infraction. Insuch event, the violator shall be obligated to pay any costs imposed by reason of the docking withthe County Courts in addition to the fines prescribed herein.
