CARDHOLDER CONDITIONS OF USE
AnyuseoftheNABVisaPurchasingCardorNABVisaCorporateCard(intheseconditions‘Card’)issuedtoyoutooperatetheAccountissubjecttothefollowingConditionsofUse.TheseConditionsofUseapplyinaccordancewiththeNABPurchasingandCorporateCardFacilityTermsandConditionsunderwhichtheCardwasissued,availableathttps://www.nab.com.au/business/business-cards/nab-purchasing-and-corporate-cards.IntheseConditionsofUse‘theAccount’meanstheaccountinthenameoftheCustomerestablishedbytheCustomerinaccordancewiththeNABPurchasingandCorporateCardFacilityTermsandConditions.
CapitalisedtermsotherwiseusedintheseTermsandConditionshavethemeaninggiventothemintheNABPurchasingandCorporateCardFacilityTermsandConditions.
1. Issue of a Card
1.1 (a) AnyCardissuedbyNationalAustraliaBankLimitedABN12004044937(‘NAB’)toyouisforuseontheAccountasagentfortheCustomersubjecttotheseConditionsofUse.TheCardisissuedontheunderstandingthateachpresentationbyyouconstitutesarequestbytheCustomerforcredittobeextendedtotheCustomerinaccordancewiththeNABPurchasingandCorporateCardFacilityTermsandConditions.
(b) ‘Customer’meansthecompanyorpersonsauthorisingtheissueofaCardtoyou(andbeingthe‘Customer’asdefinedintheNABPurchasingandCorporateCardFacilityTermsandConditions).
1.2 NABmayattimesissueanewCardtoyouwhichwillalsobesubjecttotheseConditionsofUse.
1.3 YouagreetheCardisthepropertyofNAB.
2. Use of a Card
2.1 ACardwillnotbeacceptedunlessitcarriesyoursignatureandisusedduringtheperiodshownontheCard.

2.2 (a) ACardwillnormallybehonouredbybanksandmerchantsdisplayingtherelevantcardschemesign.
(b) However,applicablecardschemepromotionalmaterialdisplayedonanypremisesdoesnotmeanthatallgoodsandservicesavailableatthosepremisesmaybepurchasedwithyourCard.NABisnotliableforanyrefusalofanymerchantorbanktoacceptorhonouryourCard.
(c) Subjecttoanyapplicablelaw,NABwillnotberesponsibleforgoodsorservicessuppliedtoyou.Anycomplaintsmustberesolvedwiththemerchant.InsomecircumstancesNABmaybeabletolodgeaclaimtorequestarefundfortheCustomerunderthecardscheme’srulesfordisputedtransactions-knownas‘chargebackrights’.DetailsaboutchargebackrightsandtheproceduresfordisputingtransactionsareintheNABPurchasingandCorporateCardFacilityTermsandConditions.YoushouldcontactNABimmediatelyaboutanydisputedtransaction.
2.3 Theminimumormaximumamountofacashadvancemayvaryfrombanktobankandschemetoscheme.NAB’sminimumamountforacashadvanceconductedoverthecounterataNABbranchisA$20.
2.4 YourCardmayonlybeuseduntilsuchtimeasNABcancelsyourCard,whichitmaydoatanytime.WewillnotifytheCustomerifwedoso,butwedonotneedtodosobeforetheCardiscancelled.ExamplesofwhenNABmaydothisincludebutarenotlimitedtowhereNABbelievesonreasonablegroundsyourcontinueduseofyourCardmaycauselosstotheCustomerorNAB,ortheCustomerisindefaultoftheNABPurchasingandCorporateCardFacilityTermsandConditions.TheseexamplesareforguidanceonlyanddonotlimittheabilityofNABtocancelyourCard.YoumustnotusetheCardonceitiscancelled.WhenNABnotifiestheCustomerthattheCardhasbeencancelled,theCustomerwillnotifyyou.IfNABortheCustomeradvisesthattheCardhasbeencancelled,youundertaketoreturnthatCardtoNABortotheCustomer.FromthedateofnoticeofcancellationtheCardmaynotbeusedandnofurthercreditapplicabletotheCardwillbeextendedbyNABtotheCustomerontheAccount.

2.5 (a) Youmay,withtheCustomer’sconsent,applytouseyourCardinNAB’selectronicbankingfacilities.UponreceiptoftheCardorCardAccountDetails,whicheverisreceivedfirst,theuseoftheCardandCardAccountDetailswillbesubjecttotheNABPurchasingandCorporateCardsElectronicBankingConditions.However,noteclause6.5andtheguidelinesonsecurityinclause6.6intheNABPurchasingandCorporateCardsElectronicBankingConditionsapplyimmediatelyuponreceiptofthePersonalIdentificationNumber(‘PIN’).
(b) IntheeventofaconflictbetweentheseConditionsofUseandtheNABPurchasingandCorporateCardsElectronicBankingConditions,theNABPurchasingandCorporateCardsElectronicBankingConditionsshallprevail.
Forthepurposesof2.1oftheNABPurchasingandCorporateCardsElectronicBankingConditions,youmayonlynominatetheAccount.
2.6 ACardmustnotbeusedforanyunlawfulpurpose,includingthepurchaseofgoodsorservices,prohibitedbylocallawinthecardholder’sjurisdiction.
2.7 “Internationaltransactions”aretransactionswherethemerchant,financialinstitutionorentityprocessingthetransactionislocatedoutsideAustralia.Internationaltransactionsareeither‘singlecurrency’(thetransactionismadeinAustraliandollars)or‘multicurrency’(thetransactionismadeinacurrencyotherthanAustraliandollars).
Thewayinternationaltransactionsareprocessedandappearonyourstatementofaccountdependsontherelevantcreditcardschemeandthetypeoftransaction.AnyinternationaltransactionswhichNABdebitstoyourAccountmayincurfeesandbesubjecttootherexchangeratecosts.FurtherinformationaboutinternationaltransactionsissetoutintheNABPurchasingandCorporateCardFacilityTermsandConditions.
3. Credit limit
3.1 ThecreditlimitapplicabletotheCardissuedtoyoutoaccesstheAccountistheamountnotifiedtoyoubyNABortheCustomer.Youmustnotexceedthecredit

limitapplicabletotheCard.TheamountavailableunderanyoneCardatanytimemaybelessthanthiscreditlimit.Forexample,NABmaydecidenottoallowtheCardtobeusedtocompletetransactionsthatwillcausetheoutstandingAccountoftheCustomertoexceedtheoverallFacilityLimit.
4. Lost and stolen Cards, and unauthorised use of Cards
4.1 (a) IfyourCardislostorstolenwithinAustraliayoumustimmediatelynotifyNABbycalling1800033103(withinAustralia),oranyothermeansNABmakesavailabletoyou.IfyourCardislostorstolenoutsideAustralia,youmustnotifyabankdisplayingtheappropriateschemesignornotifyVisabycalling14105819994(callreversecharges,24hoursperday).
Ineithercase,youmustalsonotifytheCustomer.
(b) Whererequested,youandtheCustomermustgiveNABallinformationyouandtheCustomerhaveabouthowthelossoccurred.
(c) YouacknowledgethattheCustomermayhaveliabilityfortransactionsmadebyuseoftheCarduntilNABreceivesnoticefromyouortheCustomer.
4.2 You should immediately notify the Customer of any unauthorised mail, telephone, or Internet order arising from the use of the Card and Card Account Details.
5 Variation
5.1 SubjecttoanyapplicablelaworindustrycodeofconductincludingtheBankingCode,theseConditionsofUsemaybevariedbyNABbynoticeinwritingtotheCustomerortoyouasagentoftheCustomerorbyadvertisementinthenationalorlocalpressnolaterthanthedaythevariationtakeseffect.WemaynotifytheCustomer(oryouastheCustomer’sagent)atthetimesandinthesamemannerasnotificationofchangesintheNABPurchasingandCorporateCardFacilityTermsandConditions.TheCustomermusttellyouaboutanychangeassoonaspossible.

Your NAB Corporate Card or NAB Purchasing Card and your personal information
WhenyouapplyfororuseinanywayyourNABCorporateCardorNABPurchasingCard,personalinformationaboutyoumaybecollected,usedanddisclosedbyNationalAustraliaBankLimited(‘NAB’)foravarietyofpurposesassetoutinNAB’sPrivacyNotification.
InadditiontothecircumstancesdescribedintheNABPrivacyNotification,personalinformationrelatingtotheuseofyourcard(suchastransactionschargedtoyourcard)mayalsobecollected,usedandpassedonby:
• merchantswithwhomyourcardisusedandtheirfinancialinstitutions;
• creditcardschemeorganisations(suchasVisaInternationalServiceAssociation),theirrelatedorganisationsandtheirserviceproviders;and
• NationalAustraliaBankGroupcompaniesandtheirserviceproviders,
includingsothatthisinformationcanultimatelybeprovidedbyNABtotheNABcustomerwhoisliablefortheuseofyourcard(“Accountholder”).ThisinformationisdisclosedtotheAccountholdertobetterinformthemaboutthetransactionswhicharechargedtotheiraccount.
TransactioninformationthatmaybedisclosedtotheAccountholdermaybeverydetailedandmayinclude,forexample,thenatureandamountofhotelchargeschargedtoyourcardortheitinerary,datesandclassoftravelchargedtoyourcard.
IfyouhaveanyquestionsorconcernsabouthowtheAccountholderusesordisclosespersonalinformationaboutyouthatitreceivesfromNAB,youshoulddiscussthiswiththeAccountholder.

NAB PURCHASING AND CORPORATE CARDS ELECTRONIC BANKING CONDITIONSTherightsandobligationsoutlinedinthesetermsandconditionscomplywithboththeePaymentsCodeandtheBankingCodetotheextentthattheyareapplicable.Theyapplytobothacardholderandanaccountholderforelectronicbankingthatisusedwithcertaintypesofbankingfacilities(seeclause1.3forfurtherinformationaboutwhetherthesetermsandconditionsapplytoyourfacility).
1. Application of NAB Purchasing and Corporate Cards Electronic Banking Conditions
1.1 When do these terms and conditions apply?
Thesetermsandconditionsarebindingonyoufromwhicheverofthefollowingoccursfirst:
(a)inrelationtoacardwhichisnotacreditcard,byapplyingforthecardtobeissuedandlinkedtoanynominatedaccount;
(b)theaccountholderoranycardholderconductsanEFTtransactiononanynominatedaccount;
(c)subjecttoclause1.1(d),anycardholderreceivestheircard;or
(d)inrelationtoacreditcard,uponreceiptofthecardorcardaccountdetails,whicheverisreceivedfirst.
However,noteclause6.5andtheguidelinesonsecurityinclause6.6applyimmediatelyuponyoureceivingorselectingthePIN.
1.2 Terms and conditions relating to EFT transactions
ThesetermsandconditionsapplytoEFTtransactionsonyournominatedaccounts.Theseinclude,butarenotlimitedto,EFTtransactionsinitiatedbyyou:
(a)atNABATMsusingyourcardandPIN;
(b)atATMsprovidedbyotherinstitutionsusingyourcardandPIN;
(c)atEFTPOSfacilitiesprovidedbymerchantsusingyourcardandPIN;

(d)usingyourcardaccountdetailsthroughotherelectronicequipment;
(e)whereacreditcardisusedthrougha‘swipe-only’devicethatdoesnotrequireamanualsignature;and
(f) atacontactlessreaderusingacreditcardorcarddetails.
Thismayincludetheuseofcarddetailsinconjunctionwithawearabledeviceormobilephone.
1.3 Other terms and conditions
ThesetermsandconditionsapplywheretheletterofofferortermsandconditionsofyouraccountrefertotheNABPurchasingandCorporateCardsElectronicBankingConditions.Theydonotcontainalloftheconditionsrelevanttotheuseofcardsortheaccount.
Separatetermsandconditionsexistfor:
(a)creditcardsissuedbyNABandforthecreditaccountwhichmaybeusedinconjunctionwiththesecreditcards;and
(b)anyofthenominatedaccountswhichcanbeaccessedusingyourcard.
Ifthereisanyinconsistencybetweenthesetermsandconditionsandthetermsandconditionsapplyingtoyourcardornominatedaccount,theseNABPurchasingandCorporateCardsElectronicBankingConditionsapplytotheextentanyinconsistencyexistsinrespectofEFTtransactions,exceptfornoticeofcancellationorrevocationofanyelectronicbankingfacility.
Ifaletterofofferortheconditionsofanaccountrefertootherelectronicbankingtermsandconditions(suchastheCommercialCardsElectronicBankingConditions)thenthoseothertermsandconditionswillapplytoelectronicbankingarrangementswithNABforthataccount.
1.4 Accountholder to ensure distribution
Accountholdersmustensurethateachcardholderisprovidedwithacopyofthesetermsandconditionsbeforeanyoftheeventsreferredtoinclause1.1occur.

2. Limits on EFT transactions
2.1 Nominated accounts
Yourcarddetailsand/orcardand/orPIN(oryourcardaccountdetails)mayfromtimetotimeenabletransactionstobemadeoncertainNABaccountswhichyouhavenominatedforusewithNAB’sPurchasingandCorporateCardsElectronicBankingConditions.
2.2 Number and type of accounts
ThereisalimittothenumberandtypeofaccountswhichcanbeaccessedbymeansofelectronicbankingfacilitiesusedinconjunctionwithNABPurchasingandCorporateCardaccounts.Sometypesofelectronicequipmentmayalsonotallowaccesstoalltypesofaccounts.
ForcardsunderaNABPurchasingandCorporateCardFacility,thenominatedaccountwillbetheaccountapplyingtothatfacility.UnlessNABotherwiseadvises,nootheraccountsmaybenominatedunderclause2.1.ForfurtherinformationpleasecontactNABusingthe‘CustomerService’detailsshowninthe‘Summaryofimportantinformation’atthefrontofthisdocument,orbyanyothermeansNABmakesavailabletoyou.
2.3 Amounts withdrawn or transferred
NABreservestherighttolimittheamountwhichmaybewithdrawnortransferredfromanominatedaccountbywayofcertainEFTtransactions.
A‘daily’limitappliesfrommidnighttomidnightAustralianEasternStandardTimeorAustralianEasternStandardSummerTime(whicheverisapplicable).
NAB Debit cardholders
AdailylimitappliestoallpurchasesandwithdrawalsofcashundertakenusingyourcardandPIN.
NAB Visa Debit or Credit cardholders
AdailylimitappliestoallATMcashwithdrawalsortothecashcomponentofatransactionmadeatanEFTPOSterminalunderclause3.3.

Youwillbeadvisedofthesespecificlimitswhenissuedwithacard,andyouwillbesubsequentlyadvisedofanychangetotheselimits.ThelimitsadvisedbyNABarenotanundertakingbyNABtosolimittheamountswithdrawnortransferredbyuseofNAB’scardbasedelectronicbankingfacilities.However,theadvisedlimitdoeslimityourliabilityforunauthorisedtransactions(seeclause6).
2.4 Valid and irrevocable authority
Youruseofacard,cardaccountdetailsorPINthroughelectronicequipmenttoinitiateanEFTtransactionisanunchangeableordertoNABtoprocesstheEFTtransaction.NeitheracardholdernoranaccountholdermayrequestNABtostoporaltertheEFTtransaction.However,theaccountholder’sliabilityfortheEFTtransactioncouldbelimitedintermsofclause6.3.
3. Card based electronic banking facilities
3.1 NAB ATMs
Subjecttothetermsandconditionsapplyingtoyournominatedaccount,yourcardandPINenableyoutouseNAB’sATMsasdeterminedbyNAB.
NAB’sATMsallowyoutowithdrawortransferfundsbetweenallnominatedaccounts,obtainarecordofrecenttransactions(notavailableforacreditcardaccount),orderarepeatstatement(notavailableforacreditcardaccount)andcheckyouraccountbalances.SomeNABATMsmayalsoallowyoutodepositfundsintoanominatedaccountandtochangeyourPIN.
ItisyourresponsibilitytofamiliariseyourselfwiththecorrectuseofATMs.IfyouareunsureorrequireassistanceintheoperationoftheATM,pleaseseekassistancefromNAB’sbranchstafforcontactNABusingthe‘CustomerService’detailsin‘Summaryofimportantinformation’atthefrontofthisdocument.
3.2 ATMs provided by other institutions
ATMsprovidedbyotherinstitutionsacceptingcardsmayallowyoutowithdrawfundsandcheckyourdesignatedmainnominatedaccountbalances.InstitutionsprovidingotherATMsacceptingcards

mayimposetheirownfeesandrestrictionsontheoperationofthecardswiththeirATMsincludinglimitstotheamountswhichmaybewithdrawnandtheaccountswhichmaybeaccessed.NABacceptsnoresponsibilityforsuchfeesandrestrictions.
3.3 EFTPOS terminals provided by merchants
EFTPOSterminalsallowyoutopayforpurchasesandmayallowtheoptionofwithdrawingextracashfromyourdesignatedmainnominatedaccountatcertainlocations(butnotfromacreditcardaccount).MerchantsprovidingEFTPOSterminalsacceptingcardsmayimposetheirownfeesandrestrictionsontheoperationofthecardswiththeirEFTPOSterminalsincludinglimitstotheamountswhichmaybewithdrawn.NABacceptsnoresponsibilityforsuchfeesandrestrictions.
3.4 Other transactions through electronic equipment
(Suchasusingamerchantinternetsiteonacomputerorbycommunicatingthroughtelephoneorelectronicmailwithamerchant).ThemerchantorotherpersonmayimposetheirownrestrictionsontheseEFTtransactions(suchasapurchaseatamerchantusingacontactlessreader).ContactlessreadersgiveyoutheoptionofmakingpurchasesuptothelimitnotifiedtoyoubyNAB.NABhasnocontroloverwhetheramerchantwillacceptthisformofcontactlesspurchase.ThemerchantorotherpersonmayimposetheirownrestrictionsontheseEFTtransactions.
NABacceptsnoresponsibilityforanysuchrestrictionsinconnectionwithanysuchtransactionsthroughelectronicequipment.
Note: Using digital wallets on mobile phone devices and wearable devices.
Irrespectiveofthevalueofthepurchase,youmaynotberequiredtoenteraPINinthecontactlessreaderwhenmakingacontactlesspurchasewheretheelectronicequipmentisaneligiblewearabledeviceormobilephone.Youwillbenotifiedaboutthisatthetimeyouenrolforthedigitalwallet.

3.5 Functionality
TheprocessingofanEFTtransactiontoaparticularaccountwilldependonthefunctionalityoftheelectronicequipment(forexampleanoverseasATMmayprocessatransactiontoamainnominatedaccountwhichisacreditcardaccounteventhoughyousoughttoinitiateadebittransactiononadifferentnominatedaccount).
NABacceptsnoresponsibilityforthisdifferingfunctionality.
3.6 Fees
FeesmayapplytoanyEFTtransactionyouundertakewithNAB’scardbasedelectronicbankingfacilities,theamountandnatureofwhicharedetailedin‘AGuidetoFeesandCharges-Personalbankingfees’,or‘BusinessBankingFees-aguidetofeesandcharges’,asapplicable.
4. Operation of card based electronic banking services
4.1 Receipts
(a)Itisdesirableforyoutoretainorrecordreceiptstoverifyyouraccountstatements;
(b)TheissuingofareceiptbyanEFTPOSterminalorATMmaybeacceptedasevidencethatthetransactionhasbeenperformedbyNABintermsofthereceipt.ThisconditiondoesnotapplytodepositslodgedinATMs(seeclauses5.1and5.2).
(c)Whenmakingacontactlesspurchaseyoumustcheckthecorrectamountofthepurchaseisdisplayedonthecontactlessreaderoronthemerchantregister.
4.2 Statements
(a)Creditcardaccountstatementsmaybeprovidedunderthetermsofthecreditcard’sspecifictermsandconditions.Forallothernominatedaccounts,astatementisissuedinaccordancewiththetermsandconditionsforthenominatedaccount(s).Thestatementsmaybeprovidedtotheaccountholder.
(b)Forthepurposesofpreparingstatements,NABreservestherighttoshowanEFTtransaction

ashavingbeencarriedoutonthenextorsubsequentbusinessdayaftertheday(s)thetransactionwasmade.
4.3 Reviewing statements of account
YoushouldalwaysreviewyourstatementsofaccountandbringtoNAB’sattentionanydiscrepancies,errorsorunauthorisedtransactionsassoonaspossible.IfyouwishtodisputeanEFTtransaction,youmustreportthistoNAB.Pleaserefertothe‘CustomerService’detailsin‘Summaryofimportantinformation’atthefrontofthisdocument.YoushouldreportanyunauthorisedtransactionstoNABasquicklyaspossible(andcertainlynolaterthan120daysaftertransactiondateonyourreceiptorstatement).Yourabilitytoobtainarefundmaybeaffectedbyanydelayinraisingyourconcerns.
4.4 Discrepancies in cash delivered by an ATM
WhenwithdrawingcashfromanATM,youshouldimmediatelycheckthatthecorrectsumhasbeendelivered.IfthereisadiscrepancybetweentheamountofcashdeliveredbyanATM,andtheamountshownonthereceipt,reportthefactsassoonaspossibletoNAB.Pleaserefertothe‘ATMemergency’detailsinthe‘Summaryofimportantinformation’atthefrontofthisdocument.
4.5 Cards
Remembertotakepropercareofyourcardandcardaccountdetails.Donotkeepyourcardincontactwithothercardsthathaveamagneticstrip.MagneticstripscanreactwitheachotherandifthisoccursyourcardmaynolongeroperateinaATMorEFTPOSterminal.
(a)Yourcardisissuedwithvaliditydatesdenotingmonthandyeare.g.03/20isMarch2020.Thecommencingdateisthefirstdayofthemonth,theexpirydatethelastdayofthemonth.Cardsarenotvalidbeforeorafterthesedates.
Expiredcardsmustbedestroyed.
(b)YourcardremainsthepropertyofNAB.YoufurtheragreetoreturnthecardtoNABordestroythecardbycuttingitverticallyinhalfthroughitsmagneticstripupon:

(i) noticefromNABcancellingyourcard;
(ii) closureofallyournominatedaccounts;or
(iii) revocationofauthoritytooperateyournominatedaccountsbymeansofyourcard.
(c)YourcardmaybeconfiscatedbyanATMifyourepeatinvalidPINentries.ThenumberofadditionalentriesallowedafterthefirstinvalidentrymaybevariedatNAB’sdiscretionandisnotsubjecttoanypriornotice.
4.6 EFTPOS malfunction
IntheeventofanEFTPOSterminalmalfunctionorfailure,themerchantmayprovidealternativemanualprocedurestoenableatransactiontobemade.Youwillberequiredtopresentyourcardforimprintingofatransactionvoucher,indicateoneofthemainnominatedaccounts,andsignthetransactionvoucher.(Theprocedureissimilartothatusedforpapervouchercreditcardtransactions.)NABreservestherighttovarythemanualprocedureatanytime.
Ifyouhaveindicatedonthepapervoucherthatamainnominatedaccountistobedebited,andthataccountisclosedorhasinsufficientfundsavailable,NABmayredirectthedebitentrytotheothermainnominatedaccount(excludingacreditcardaccount)withoutnoticetoyou.
4.7 Merchants
NABwillnotbeliablefortherefusalofanymerchanttoacceptcarddetailsand/orcard,orcardaccountdetails.
Anycomplaintsconcerninggoodsandservicespurchasedmustgenerallyberesolvedwiththemerchant.InsomecircumstancesNABmaybeabletolodgeaclaimtorequestarefundforyouunderthecardscheme’srulesfordisputedtransactions.Detailsaboutchargebackrightsandtheproceduresfordisputingtransactionsaredescribedinthe‘Summaryofimportantinformation’atthefrontofthisdocumentandmaybefurtherdescribedinthetermsandconditionsapplyingtotheaccount.Youshouldreportanydisputedtransactionsasquicklyaspossible(andcertainlynolaterthan

120daysafterthetransactiondateonyourreceiptorstatement)asyourabilitytoobtainarefundmaybeaffectedbyanydelayinraisingyourconcerns.
4.8 Promotional material
PromotionalmaterialreferringtoNAB’scardbasedelectronicbankingfacilitiesthatisdisplayedonorinanypremises,isnottobetakenasawarrantybyNAB,orbythemerchantcarryingonabusinessinthosepremises,thatallgoodsandservicesmaybepurchasedbymeansofanEFTtransaction.Youalsoacceptthattheuseofyourcardandcardaccountdetailsmaybesubjecttootherlimitationsimposedbythemerchant.
5. Deposits
5.1 Cash deposits at ATMs
WhenmakingacashdepositatanATMyoushouldbeawarethatsuchdepositmaynotbecreditedtoyouraccountimmediately.
AcashdepositlodgedinanATMissubjecttoverificationandatNAB’sdiscretionmaynotbecreditedtoyouraccountuntilthefollowingbusinessday.DepositsmadeatanATMafter6.00pmwillbecreditedtoyouraccountwithintwobusinessdays.
IntheeventofadiscrepancybetweenthedepositvaluedeterminedbyNABandtheamountrecordedbytheATM,theaccountholderwillbepromptlyadvisedoftheactualamountwhichhasbeencreditedtothenominatedaccount.CardholdersshouldremembertoincludetheATMdepositadvicecardintheenvelopewiththedeposit,asfailuretodosomaydelayfundsbeingcreditedtoyouraccount.NABreservestherighttocorrectorreverseanysuchdeposittransaction.
NABwillacceptresponsibilityforthesecurityofyourdepositcorrectlylodgedatanATMwhichoffersdepositingservices,subjecttoverificationoftheamountdeposited.
YoushouldkeepallrecordsassociatedwithadepositthatyoumakeviaanATMuntilthedepositisverifiedandrecordedonyouraccountstatement.Wheretheclaimeddepositisnotavailablefor

verificationfollowingforcefulremovaloftheATMorothercriminalact,NABrequiresyoutoreasonablysubstantiatethevalueofyourclaim.
5.2 Deposits in the form of cheques
Ifyoumakeadepositintheformof,orincludingacheque,thefundsofthechequearenotavailableforwithdrawaluntilthechequereachesthepayingbankandNABisguaranteedpayment.(ThisconditionappliestodepositsmadethroughanATMoratabranchofNAB.)IntheeventofadiscrepancybetweenthevalueofchequesdepositedasdeterminedbyNABandyourdepositclaim,NABwillinformyou.NABreservestherighttocorrectorreverseanysuchdeposittransaction.
BecauseoftherequirementsofNAB’ssystems,NABreservestherighttoplacea‘hold’onthefullamountofadepositwhichincludesacheque.
Forexample,whereadepositincludescashandoneormorecheques,theholdappliestothecashcomponentaswellastothevalueofcheques.
Holdsarenormallyappliedforthreebusinessdays,andtransactionsrequiringuseofthesefundsmayberefusedwithinthisperiod.
Therefore,ifyouwishtodepositcashandexpecttowithdrawagainstthesumofthatcashwithinthethreebusinessdayperiod,youareadvisedtodepositthecashseparatelyfromthecheques.(Thatis,maketwodeposittransactions.)
NABwillnotberesponsibleforanyclaimorrefusalofatransactionifthisconditionisdisregarded.YouareentitledtoenquirefromanybranchofNABifholdsaretobeappliedtoanydeposit.
Subjecttoclause6,theaccountholderagreestoindemnifyNABagainstallclaimsorliabilitiesitmayincurasaconsequenceofitcollectingachequeofwhichtheaccountholderisnotthetrueowner.

6. Responsibilities and liabilities
6.1 Your responsibilities with respect to the card and card details
IfNABissuesacardtoyouthenyoumust:
(a)signthecardimmediatelyonreceipt;
(b)keepyourcardinasafeplace,andprovidereasonableprotectionforthecardandcardaccountdetailsfromtheft;
(c)notifyNABifyoubelieveyourcard,cardaccountdetailsoranydevicethroughwhichcardaccountdetailsmaybeusedislostorstolen(seeclause6.7forfurtherdetails);
(d)adviseanychangeofaddress(refertothe‘CustomerService’detailsin‘Summaryofimportantinformation’atthefrontofthisdocument);
(e)usethecardinaccordancewiththeseNABElectronicBankingtermsandconditions;
(f)destroyanexpiredcard;and
(g)ifatemporarycardhasbeenissuedtoyou,youagreetodestroyituponreceiptofapersonalisedcard.
6.2 General responsibility
TheaccountholderisgenerallyresponsibleforallEFTtransactionsauthorisedbytheuseofthecardand/orPINand/orthecardaccountdetails(includingthroughtheuseofamobilephoneorwearabledevice)orundertakenbyanotherpersonwithyourknowledgeand/orconsent.Theaccountholder’sliabilityforanyusenotauthorisedbyyoumayhoweverbelimitedasprovidedbelow.
6.3 No accountholder liability in some circumstances
Theaccountholderisnotliableforlosses:
(a)thatarecausedbythefraudulentornegligentconductofNAB’semployeesoragentsorcompaniesinvolvedinnetworkingarrangementsorofmerchantsoroftheiragentsoremployees;
(b)arisingbecausethePIN,cardaccountdetailsorcardisforged,faulty,expired,orcancelled;

(c)thatarisefromEFTtransactionswhichrequiredtheuseofyourcardorcardaccountdetailsoryourPINandthatoccurredbeforeyoureceivedthecardorcardaccountdetailsorbeforeyoureceivedorselectedyourPIN;
(d)thatarecausedbythesameEFTtransactionbeingincorrectlydebitedmorethanoncetothesameaccount;
(e)resultingfromunauthorisedtransactionsoccurringafternotificationtoNABthatthecardorcardaccountdetailshavebeenmisused,lostorstolenorthesecurityofthePINhasbeenbreached;or
(f) resultingfromunauthorisedtransactionswhereitisclearthatyouhavenotcontributedtosuchlosses.
6.4 Accountholder liability for unauthorised transactions
Theaccountholderisliableforlossesresultingfromunauthorisedtransactionsasprovidedbelow:
(a)whereNABcanproveonthebalanceofprobabilitythatyoucontributedtothelossesthroughyourfraudoryourcontraventionofthesecurityrequirementsinclause6.5theaccountholderisliablefortheactuallosseswhichoccurbeforeNABisnotifiedthatthecardhasbeenmisused,lostorstolenorthatthesecurityofthePINhasbeenbreached;and
(b)theaccountholderisalsoliablewhereNABcanproveonthebalanceofprobabilitythatyoucontributedtolossesresultingfromunauthorisedtransactionsbecauseyouunreasonablydelayednotifyingNABafterbecomingawareofthemisuse,lossortheftofthecardorcarddetails,orthatthesecurityofthePINhasbeenbreached.Theaccountholderwillthenbeliablefortheactuallosseswhichoccurbetweenthetimeyoubecameaware(orshouldreasonablyhavebecomeawareinthecaseofalostorstolencardorcardaccountdetails)andwhenNABwasactuallynotified.

However,inrelationto(a)and(b)above,theaccountholderisnotliableforanyofthefollowingamounts:
(i) thatportionofthelossesincurredonanyonedaywhichexceedtheapplicabledailytransactionlimit(s);
(ii) thatportionofthelossesincurredinaperiodwhichexceedsanyotherperiodictransactionlimit(s)applicabletothatperiod;
(iii) thatportionofthetotallossesincurredonanyaccountwhichexceedsthebalanceofthataccount(includinganyprearrangedcredit);or
(iv) alllossesincurredonanyaccountswhichtheaccountholderandNABhadnotagreedcouldbeaccessedusingthecardorPIN.
(c)whereaPINwasrequiredtoperformtheunauthorisedtransactionsandneitherparagraph(a)nor(b)applies,theaccountholderisliablefor
theleastof:
(i) $150;or
(ii) thebalanceofthoseaccount(s)(includinganyprearrangedcredit)fromwhichvaluewastransferredintheunauthorisedtransactionsandwhichNABandtheaccountholderhaveagreedmaybeaccessedusingthePIN;or
(iii) theactuallossatthetimeNABisnotified(whererelevant)thatthecardhasbeenmisused,lostorstolenorthatthesecurityofthePINhasbeenbreached(excludingthatportionofthelossesincurredonanyonedaywhichexceedsanyapplicabledailytransactionorotherperiodictransactionlimit(s)).
(d)theaccountholderisliableforlossesarisingfromunauthorisedtransactionsthatoccurbecauseyoucontributedtothelossesbyleavingacardinanATM.

6.5 Your responsibilities
(a)WhereNABprovidesyouwithaPINyoumustnot:
(i) voluntarilydisclosethePINtoanyoneincludingafamilymemberorfriend(unlessyourcardisa‘DepositOnlyCard’);
(ii) recordthePINonyourcardoronanyarticlecarriedwiththecardorliabletolossortheftsimultaneouslywiththecard;and
(iii) actwithextremecarelessnessinfailingtoprotectthesecurityofthePIN(forexamplebyfailingtocomplywithguidelinesinclause6.6).
(b)WhereNABallowsyoutoselectaPINorchangeyourPINyoumustnotselect:
(i) anumericcodewhichrepresentsyourbirthdate;or
(ii) analphabeticalcodewhichisarecognisablepartofyourname.
EitheroftheseselectionsmaymeanyouareliableforlossescausedbyunauthorisedtransactionscausedbyabreachofyourPIN.
6.6 Guidelines
Youshouldalsocomplywiththeseguidelinestoprotectthesecurityofyourcard,cardaccountdetailsandPINandthusreducethepossibilityofanyinconveniencetoyou:
(a)donotpermitanyotherpersontousethecardand/orcardaccountdetails(includingthroughamobilephoneorwearabledevice);
(b)destroythePINenvelope(ifany)aftermemorisingthePIN;
(c)takereasonablecarewhenusingyourATM,orEFTPOSterminaltoensureyourPINisnotdisclosedtoanyotherperson;and
(d)shouldyourequireamemoryaidtorecallyourPINyoumaymakesucharecordprovidingtherecordisreasonablydisguised.However,NABdoesnotconsiderthefollowingexamplesto

provideareasonabledisguiseandyouagreenotto:
(i) recordthedisguisedPINonyourcard;
(ii) disguiseaPINbyreversingthenumbersequence;
(iii) describethedisguisedrecordasa‘PINrecord’or‘Passwordrecord’;
(iv) disguisethePINasatelephonenumber,partofatelephonenumber,postcodeordateofbirth;or
(v) disguisethePINusingalphabeticalcharacters,eg.A=1,B=2,C=3etc
(e)followanyotherreasonableinstructionsNABgivesyouinrelationtoselectingaPIN.
TheremaybeotherformsofdisguisewhichmaybesimilarlyunsuitablebecauseoftheeaseofanotherpersondiscerningyourPIN.
Pleasenotealltheguidelinessetoutinclause6.6areforyourassistancebutyourliabilityinthecaseofanactuallosswillbegovernedbytheePaymentsCodeifitappliesandclause6.5inthisdocument.However,youshouldtakecaretomeettheguidelinessetoutinclause6.6asafailuretomeettheseguidelinesmayinsomecircumstancesconstituteanactofextremecarelessnessunderclause6.5(a)(iii).
6.7 Advising NAB
Ifyoubelieveyourcardorcardaccountdetails(oranydevicesthroughwhichcardaccountdetailsmaybeused)havebeenlostorstolen,yourPINdivulgedorthattherehasbeenmisuseofyourcardorcardaccountdetails,youmustnotifyNABassoonaspossible.PleaserefertoNAB’s‘Lost/stolencards/compromisedPersonalIdentificationNumbers(PINs)’detailsin‘Summaryofimportantinformation’atthefrontofthisdocument,oranyothermeansNABmakesavailabletoyou.
OnceNABhasbeennotifiedofthesematterstheaccountholder’sliabilityforfurtherEFTtransactionswillbelimited.

Wheretelephonefacilitiesorothermeansarenotavailableduringparticularperiods,anylossesoccurringduringtheseperiodsthatwereduetonon-notificationaredeemedtobetheliabilityofNAB,providingnotificationismadetoNABwithinareasonabletimeofthefacilityagainbecomingavailable.
NABwillacknowledgeyourreportandyoushouldrecordorretainthisacknowledgement.
6.8 Liability under credit card scheme
NotwithstandingtheabovewhereyounotifyNABofanunauthorisedtransactiononacreditcard,NABwillnotholdtheaccountholderliableforanamountgreaterthantheliabilitytheaccountholderwouldhavehadifNABhad,atthetimethecomplaintwasmade,exerciseditsrights(totheextentrelevant)undertherulesofthecreditcardscheme.
6.9 Failure of NAB electronic equipment
(a)IftheePaymentsCodeappliestoyouforanEFTtransactiononanominatedaccount,NABwillbeliabletoyouforlossesyousuffercausedbythefailureofNAB’selectronicequipmentorsystemtocompleteanEFTtransactionacceptedbyNAB’ssystemorNAB’selectronicequipmentinaccordancewithyourinstructions.(Seeclause9.1forwhentheePaymentsCodeapplies).
However,NABwillnotbeliableforconsequentiallosseswhereyoushouldhavebeenawarethatNAB’selectronicequipmentorsystemwasunavailableforuseormalfunctioning.NAB’sresponsibilitiesinthiscasewillbelimitedtothecorrectionoferrorsinyouraccountandtherefundofanychargesorfeesimposedonyouasaresult.NABwillalsonotbeliableforanylossescausedbythefailureofNAB’selectronicequipmentwhereNAB’ssystemorelectronicequipmenthasnotacceptedtheEFTtransaction.
(b)IftheePaymentsCodedoesnotapplytoanEFTtransaction(forexamplebecauseitisabusinessEFTtransaction)NABwillnotbeliabletoyouforanyloss,claim,liabilityoroutgoing,includingwithoutlimitationanyconsequentiallossorliability,whichyousufferbecauseofanyfailure

ofNAB’ssystemsorNAB’selectronicequipmenttocompletethatEFTtransaction.

8.1 Changes NAB may make
NABmayneedtomakechangestothesePurchasingandCorporateCardsElectronicBankingConditionsfromtimetotime.NABmaymakechangeswithoutyourconsent.NABpromisestoactreasonablywhenitmakesanychanges.

8.2 Types of changes NAB may make
Forexample,NABmaymakethefollowingtypesofchangeswithoutyourconsent:
(a)introduceanewfeeorcharge(includingtheintroductionorincreaseofchargesrelatingsolelytotheuseofyourcardorPINorcardaccountdetailsortheissueofanadditionalcardorPINorcardaccountdetails);
(b)changethedailylimitthatcanbewithdrawnortransferredfromyourcard;
(c)changethetimeduringwhichthedailylimitappliestopurchasesandwithdrawalsofcashundertakenusingacardorPIN;and
(d)increaseyourliabilityforlossesrelatingtoEFTtransactions.
NABmayalsomakeotherchangestothesePurchasingandCorporateCardsElectronicBankingConditionswithoutyourconsentfromtimetotime(forexampletoreflectchangesinthewayanelectronicbankingfacilityoperates).
8.3 When NAB will notify you of change
NABwillgiveyouatleast30days’noticeofanychange,exceptasfollows:
(a)Ifyouareasmallbusiness(asdefinedintheNABPurchasingandCorporateCardsFacilityTermsandConditions)andNABreasonablyconsidersachange(otherthanachangetointerestrates)willbeunfavourabletoyouandthesamechangeisnotbeingmadetosimilarfacilitiesofNAB’sothersmallbusinesscustomers,wewillgiveyouatleast90days’priorwrittennoticeofthechange;
(b)NABmaygiveyouashorternoticeperiod,ifitisreasonableforustomanageamaterialandimmediaterisk;
(c)Ifthereisachangeto,orintroductionofagovernmentchargethatyoupay,inwhichcaseNABwilltellyouaboutitreasonablypromptlyafterthegovernmentnotifiesusofit(howeverNABdoesnothavetonotifyyouifitispublicisedbythegovernment);and

(d)Ifthereisachangethatreducesyourobligations(forexample,areductioninafeeorcharge),NABmaygiveyouashorternoticeperiod,ornonoticeperiod(inwhichcaseNABwillgiveparticularsofanysuchchangeassoonasreasonablypossibleafterthechangetakeseffect),howeverNABwillonlygiveyoushorternoticeornonoticewherethisisnotinconsistentwithNAB’sobligationsundertheBankingCode(orwhereitappliestheePaymentsCode).
8.4 Methods of communication
(a)Subjecttothisclause8.4,NABmaygiveyounoticeselectronicallyorinwriting(includingbywayofstatementsincludedonyourstatementofaccountortotheextentconsistentwiththeePaymentsCodeandBankingCodebyadvertisinginnationalorlocalmedia).
(b)Totheextentpermittedbylawandsubjecttoclause8.5,notices,statements,certificates,consents,approvalsandothercommunicationsinconnectionwiththetermsandconditionsinthisbookletfromNAB,maybegivenelectronically:
(i) byelectronicmeans,includingbySMS,electronicmailtoyournominatedelectronicaddressorpushnotificationtoanyNABappNABmaymakeavailabletoyou;
(ii) bymakingitavailableatNAB’swebsite;
(iii) ifyouuseanonlinebankingserviceprovidedbyNAB(eg.NABInternetBankingorNABConnect),bybeingmadeavailablethroughthatservice;or
(iv) byanyothermeansNABagreeswithyou.
(c)WherecommunicationsaremadeavailablethroughNAB’swebsiteorthroughaNABonlinebankingservice,NABwillletyouknowtheinformationistherebysendingyouanSMSoremailtothecontactdetailsNABhasonfile,orbypushnotificationfromanyNABapporanyotheragreedmethod.

(d)YoucanchoosetoreceivenoticesorstatementsinpaperbygivingNABnotice.Whereyourproductorserviceisdesignedexclusivelyforelectronicuse,papernoticesandstatementsareonlyavailableinlimitedcircumstances.
8.5 For the purposes of clause 8.2(d):
(a)Youmayrequestapapercopyofacommunicationgivenelectronicallywithinsixmonthsoftheelectroniccopybeingreceivedormadeavailable(oriftheePaymentsCodeapplieswithin7yearsoftheelectroniccopybeingreceivedormadeavailable).
(b)Acommunicationisdeemedtobereceivedwhenthecommunicationenterstherecipient’sdesignatedinformationsystemoriscapableofbeingviewedfromarecipient’scomputer,andiseffectivewhenreceivedevenifnopersonisawareofitsreceipt.
(c)Forthepurposesofcommunicationssentbyelectronicmailandthe‘Electronic Transactions Act 1999(Cth)’,theserveronwhichthemailboxforthedesignatedaddressresidesistobetakentobetherecipient’sdesignatedinformationsystem.
(d)Acommunicationisdeemedtobesentfromwherethesenderhastheirplaceofbusinessandisdeemedtobereceivedwheretherecipienthastheirplaceofbusiness.
Forthepurposesofthisclause:
(i) ifthesenderorrecipienthasmorethanoneplaceofbusiness,theplaceofbusinessisthesender’sorrecipient’sprincipalplaceofbusiness;and
(ii) ifthesenderorrecipientdoesnothaveaplaceofbusiness,theplaceofbusinessisthesender’sorrecipient’susualplace.

ThetermsandconditionsinthisbookletandthetransactionscontemplatedbythesetermsandconditionsaregovernedbythelawinforceinVictoriaandeachpartyirrevocablyandunconditionallysubmitstothenon-exclusivejurisdictionofthosecourts.

‘business account’meansanaccountthatisdesignedprimarilyforusebyabusinessandestablishedprimarilyforbusinesspurposes.
‘business customer’meanstheaccountholderinrespectofanominatedaccountwhichisabusinessaccount.
‘business day’meansadayotherthanaSaturdayorSundayoradaygazettedasapublicholidaythroughoutAustralia.

(b)yourcreditcardexpirydate,assetoutonyourcreditcardoranyrepresentationofthosedetailswhichallowatransactiontobeperformed.
‘cardholder’meansapersonwhohasbeenissuedacardoranyotherpersonwhohasbeennominatedbyanaccountholdertooperateonanominatedaccountandwhohasbeenissuedacard,orotherwiseauthorisedbyanaccountholdertouseanaccountholder’scardorcardaccountdetails.
‘contactless authorisation method’meansthemethodofconfirmingyourauthoritytomakeacontactlesspurchase,ifany.

‘contactless purchase’isamethodofauthorisingpurchases:
(a)bywavingortappingacard(whichiscapableofmakingacontactlesspurchase)infrontofacontactlessreaderwithouthavingtoinsertorswipethecard;or
(b)whenavailable,wavingortappinganeligibledevice(e.g.mobilephoneorwearabledevice)infrontofacontactlessreadertotransmitcardaccountdetailsusingNearFieldCommunicationandcomplyingwithanyrequiredcontactlessauthenticationmethod.
