FORMS T TRANSFER AGREEMENTS RELATED T WATER TANK MAINTENANCE
RECOMMENDATION:
That Council authorizes the Director of Public Service and Safety to execute Request for Consent to
Assignment forms to transfer water tank maintenance agreements from Caldwell Tanks, Inc to Utility
Service Company, Inc. USCI).
BACKGROUND:
In October of 2010 Troy City Council authorized a ten year water tank maintenance agreement with
Caldwell Tanks, Inc. related to the Herrlinger Water Tower. In 2012 a similar agreement for a twenty
year agreement was authorized for the maintenance of both the Stanfield and Barnhart towers and a
wash out tank located at the Water Treatment Plant. These agreements provide for yearly inspection and
maintenance of these tanks
as
well
as
an exterior painting during the life of the contracts.
Caldwell Tanks, Inc recently notified the City that the focus of the company will be on new tank
construction and the company would not continue their tank maintenance operation. Caldwell Tanks,
Inc. is transferring all of their maintenance contracts nationwide to USCI, which company is the largest
tank maintenance provider in the nation. USCI will honor the terms and conditions o the agreements
between the City o Troy and Caldwell Tanks, Inc Staff has had multiple conversations with USCI staff
and
has
been in contact with adjacent jurisdictions that are currently using USCI for similar services.
Staff is
qu
ite comfortable that USCI will provide excellent service in carrying out the agreements.
REQUESTED ACTION:
It would
be
appreciated if you would assign to a Committee
o
Council authorizing the Director of Public
Service and Safety to execute a Request to Consent to Assignment form related to each of the
agreements with Caldwell Tanks,
Inc
so that Caldwell Tanks,
Inc
may transfer the water tank
maintenance contracts to Utility Service Company, Inc.

RECOMMENDATION:
That Council approves the dedication of two (2) water and one (1) sanitary sewer easement at 1910 West Main
Street to allow for the development of Chick-fil-A and other outlots
in
front of the Meijer location.
BACKGROUND:
Meijer
is
proposing to develop three (3) additional proposed lots
in
the front of the existing Meijer store. The
additional lots will be located at the southwest corner of West Main Street (State Route 41) and South Stanfield
Road.
In
order to provide water and sanitary sewer services
to
these additional lots, it
is
necessary to obtain
easements from Meijer
and
the three (3) proposed lots.
In addition to easements from Meijer and proposed lots, an additional easement is be ing granted by Troy 41,
LLC (i.e . Tolson Enterprises, LLC of Toledo, Ohio) for the water main which exists along the south side of the
building where Panera Bread/Chipolte are located, and which faces West Main Street (State Route 41 ). The
proposed water for the developing lots will tie into the existing water main, which the City currently maintains .
The attached exhibits show the layout of the proposed easements . All water
and
sanitary sewer infrastructure
additions are at the developer s expense and will
be
turned over to the City at the successful completion of
construction.
REQUESTED ACTION:
It
would be appreciated if
you
would assign to a Committee of Council consideration of accepting the dedication
of two (2) water easements and one (1) sanitary sewer easement for Meijer and the development of three (3)
proposed lots at 1910 W Main Street. To accommodate the additional development and the proposed
construction schedule, consideration of emergency legislation is requested.

RECOMMENDATION:
That Council authorizes the Resolution of Necessity regarding the repair and/or replacement of certain sidewalks
in
a 2016 Sidewalk Replacement Program (Phase
9 .
BACKGROUND:
Attached
is
a map of the area identified regarding the next phase, the 2016 Sidewalk Replacement Program
(Phase
9
. That information indicates there are approximately 120 parcels that have been identified where the
sidewalks need to
be
repaired/replaced. This year s program includes the areas along South Plum Street, South
Cherry Street, South Walnut Street, and South Mulberry Street between Main Street and Franklin Street; South
Market Street, South Walnut Street and South Mulberry Street between East Franklin Street and East Canal Street;
and the area encompassed by South Market Street, East West Street, South Clay Street, Ross Street, and South
Mulberry Street, which includes Young Street, Enyeart Street and Dakota Street.
The first step
in
this process
is
the Resolution of Necessity. If Council approves the Resolution
o
Necessity, the
City notifies property owners
by
letter that the repairs/replacements must
be
made and of the time limitations for
such work. The property owners will be given a date
by
which
to
obtain a permit to do the sidewalk work. Those
permits are good for six months, so the property owners who choose to complete their own work will have the
construction season to do so . Properties for which permits are not obtained will then be included
in
a sidewalk
project bid by the City, with the property owners later paying the City for that work or having the cost assessed to
the property tax.
Included with the notice will
be
a packet of information including the list of licensed concrete/sidewalk contractors, a
general brochure about the program, and a sketch of the sidewalk requiring replacement.
