CERTIFICATION OF APPLICANT
)
STATE OF Oklahoma ) 1 SS
COUNTY OF Garfield
)
I, Continental Resources, Inc. , the applicant in the above matter after being duly sworn upon oath hereby certify the following information in regard to this application:
South Dakota Codified Laws Section 1-40-27 provides:
"The secretary may reject an application for any permit filed pursuant to Titles 34A or 45, including any application by any concentrated swine feeding operation for authorization to operate under a general permit, upon making a specific finding that:
(1) The applicant is unsuited or unqualified to perform the obligations of a permit holder based upon a finding that the applicant, any officer, director, partner, or resident general manager of the facility for which application has been made:
(a) Has intentionally misrepresented a material fact in applying for a permit;
(b) Has been convicted of a felony or other crime of moral turpitude;
(c) Has habitually and intentionally violated environmental laws of any state or the United States which have caused significant and material environmental damage;
(d) Has had any permit revoked under the environmental laws of any state or the United States;
(e) Has otherwise demonstrated through clear and convincing evidence of previous actions that the applicant lacks the necessary good character and competency to reliably carry out the obligations imposed by law upon the permit holder; or
CERTIFICATE OF APPLICATE - FORM 13 PAGE 2
(2) The application substantially duplicates an application by the same applicant denied within the past five years which denial has not been reversed by a court of competent jurisdiction. Nothing in this subdivision may be construed to prohibit an applicant from submitting a new application for a permit previously denied, if the new application represents a good faith attempt by the applicant to correct the deficiencies that served as the basis for the denial in the original application.
All applications filed pursuant to Titles 34A and 45 shall include a certification, sworn to under oath and signed by the applicant, that he is not disqualified by reason of this section from obtaining a permit. In the absence of evidence to the contrary, that certification shall constitute a prima facie showing of the suitability and qualification of the applicant. If at any point in the application review recommendation, or hearing process, the secretary finds the applicant has intentionally made any material misrepresentation of fact in regard to this certification, consideration of the application may be suspended and the application may be rejected as provided for under this section.
Applications rejected pursuant to this section constitute final agency action upon that application and may be appealed to circuit court as provided for under chapter 1-26."
Pursuant to SDCL 1-40-27, I certify that I have read the forgoing provision of state law, and that I am not disqualified by reason of that provision from obtaining the permit for which application has been made.

Geologic Summary
Continental Resources, Inc.; SBRRU # 14-12 well laterals will be drilled out of existing 4 Y2" casing by cutting a northwest facing window at least 10' below the Gunton porosity located at 8,204'-8,244', landing in the Red River "B" porosity at 8,354'-8,370'. Out of this window one lateral will turn to the southwest and one to the northeast to described bottom hole locations.
The SBRRU #14-12 well laterals are proposed to be drilled between a current injection plume and a previous injection plume from nearby wells. There is the possibility that we may encounter an injection plume from the current air injection well during the drilling of either of the proposed laterals.
The well is located in SW/SW Section 12 T2ON R4E of Harding County, near Buffalo, South Dakota.
This well spud on April 5, 2007 and well-site geological services began on that day. The plan for this well is to drill out both curves first before drilling out the laterals. Ten, twenty, thirty and fifty foot lagged samples were caught and saved for archive by Continental Resources, Inc.
Pason Total Gas Detection equipment was used for monitoring gas.
Curve — NE Lateral
Began re-entry of the SBRRU # 14-12, northeast well lateral on April 6, 2007. Curve for the lateral began from a tie in survey at 8,220' MD; 0.89° INC; 151.5° AZ; 8,219.28' TVD; -59.87' VS. Kick-off point was 8,265' MD, 2.5° INC, 8.1° AZ, 8,264.27' TVD at —59.18' VS. Control drilling began at 8,265 ft. measured depth. Lithology from samples consisted of limestone, medium to light gray to off white, white, light gray brown, micro to very fine crystalline, firm to lightly brittle, brittle in part, soft, pasty, argillaceous, pyritic, lightly dolomitic, scattered dull yellow fluorescence, poor to no cut. Recorded gamma through the curve would range between 54-80 counts per second to the Red River top.
Drilled gyro section to 8,312 ft. measured depth. End of curve was achieved at 8,415 ft. measured depth.
Red Riven 8321' MD 8317' TVD -5304' SS
The Red River came in at 8,321' MD; -42.58' VS. A significant decrease in gamma is used to identify the Red River. Gamma would decrease from 73 counts to 10 counts at Red River entry. Initial samples consisted of limestone, light to medium gray brown, light brown, gray, off white, white in part, micro to very fine crystalline, firm to brittle, argillaceous, edges frosty, scattered dull fluorescence, no cut. ROP values through
2
the Red River ranged between 2.9-15.4 min/ft_ Gas values were recorded at 23-45 units. Hourly fluid losses were 0 bbl. It should be noted that gamma and samples begin to clean up towards bottom of Red River.
Red River "B": 8382' MD 8355' TVD -5342' SS
The Red River "B" was encountered at 8,382' MD; 8,355' TVD; 3.7' VS. An increase in gas was noted upon entry into the Red River "B". Gas analyzer was down for several hours, and no gas information would be available for entry into the Red River "B". ROP values increased from 11.1 min/ft to 3.1 min/ft. while sliding, and gamma would decrease from 10 counts to 2-5 counts at "B" entry.
Initial samples from the Red River "B" consisted of dolomite, dark brown, dark gray brown, brown, very fine to fine crystalline, sucrosic to tight sucrosic, brittle, spotty brown oil in pores, abundant anhydrite, white, soft, dense, opaque, trace shale, gray, poorly indurated, strong oil odor, even dull yellow to trace yellow fluorescence, instant diffuse, slow streaming cloudy yellow cut Recorded gamma would indicate the likelihood of an anhydrite bed overlying the "B" porosity. Hourly fluid losses to this point were 4-14 bbls.
We would get approximately 5 feet below the Red River "B" top. A hot gamma signature of 7-9 counts per second was noted at approximately 5 feet below the Red River "B" top. A hard, tight dolomite stringer was also noted beneath the anhydrite bed during the drilling of both laterals, more pronounced toward middle to end of the southwest lateral.
Drilling of the lateral continued until a top strike was encountered at 9,217' MD; 8,377.0' TVD; 8,371.1' VS. Dip thus far in the lateral was calculated at 88.5 degrees. Lithology from this area of the lateral would consist of dolomite, brown, gray brown, very fine to fine crystalline, sucrosic, firm to friable, lightly vuggy to intergranular, good intercrystalline porosity, strong oil odor, heavy oil on wash sample, even dull fluorescence, moderate streaming cloudy to milky yellow cut We began picking up gas again at 9063 ft. measured depth. Gas values through this section of the lateral would range between 335-530 units. Oil shows at the possum belly were 40-80%, while fluid losses were 32-56 bbl/hr.
Drilling of the lateral continued 1-2 ft. below the top of the Red River "B" target porosity at 88.12 degrees until a top strike was encountered at 10,530' MD; 8,425.5' TVD; 2,148.9' VS. A top strike is initiated for the end of lateral for mapping purposes. Lithology of the "B" throughout this segment of the lateral consisted of dolomite, light gray brown to gray brown, brown, occasional dark brown, fine to very fine crystalline, sucrosic, firm to lightly brittle, friable, good intercrystalline porosity, heavy oil on sample, strong oil odor, even dull fluorescence, fast streaming cloudy yellow cut Gas values were recorded at 527-857 units, with peaks of 1,000-1,400 units. Oil shows at possum belly were 60-90% throughout most of the northeast lateral.
3
The SBRRU #14-12, NE well lateral achieved TD status of 10,538' MD at 7:00 A.M. CDT on April 11, 2007.
Curve — SW Lateral.
Began re-entry of the SBRRU #14-12, Southwest well lateral on April 11, 2007. Curve for the lateral began from a tie in survey at 8,220' MD; 0.89° INC; 151.5° AZ; 8,219.28' TVD; 59.87' VS. Kick-off point was 8,265' MD, 2.4° INC, 268.5° AZ, 8,264.27' TVD at 60.65' VS. Time drilling began from 8,265'-8,275 ft. measured depth. Lithology from samples consisted of limestone, medium to light gray to off white, white, light gray brown, micro to very fine crystalline, firm to lightly brittle, brittle in part, soft, pasty, argillaceous to shaley, pyritic, lightly dolomitic, scattered dull yellow fluorescence, poor to no cut. Gas values through the curve would range between 14-50 units. Recorded gamma through the curve would range between 54-79 counts per second to the Red River top.
Drilled gyro section to 8,312'measured depth. End of curve was achieved at 8,411' measured depth.
Red Riven 8320' Ml) 8316' TVD -5303' SS
The Red River came in at 8,320' MD; 77.4' VS. A significant decrease in gamma is used to identify the Red River. Gamma would decrease from 78 counts to 10 counts at Red River entry. Initial samples consisted of limestone, medium to light gray brown, brown, light brown, gray, off white, frosty, micro to very fine crystalline, firm to brittle, argillaceous, pyritic, dolomite, brown, sucrosic, scattered dull yellow fluorescence, no cut. ROP values through the Red River ranged between 3.3-14 7 min/ft. Gas values were recorded at 23-59 units. Hourly fluid losses were 5-12 bbl.
Red River "B": 8382' MD 8354' TVD -5341' SS
The Red River "B" was encountered at 8,382' MD; 124.8' VS. An increase in gas was noted upon entry into the Red River "B". Gas values increased to 259 units over a background of 16-54 units. ROP values increased from 6.1 min/ft to 2 1 min/ft., and gamma would decrease from 12 counts to 2-6 counts at "B" entry.
Initial samples from the Red River "B" consisted of dolomite, light gray brown, light brown, off white, brown, microcrystalline, mostly brittle, firm in part, argillaceous, anhydrite, trace oil on sample wash, moderate petroleum odor, scattered dull yellow fluorescence, slow streaming cloudy cut. Recorded gamma would indicate the possibility of a thin anhydrite bed overlying the "B" porosity. ROP information was inconclusive due to the low bit weight and sliding needed for higher build rates.
We would get approximately 7 feet below the top of the Red River "B. Gas values from entry would range between 230-269 units. We would continue to come up in section until 8,692' MD, 8,352.4' TVD, 433' VS, approximately 1 ft. from the top of the Red River "B". Lithology from entry to this point in the lateral would consist of dolomite, dark gray brown, gray brown, brown, very fine to fine crystalline, sucrosic, firm to brittle,
4
friable, good intercrystalline porosity, fair to good layer oil on wash water, strong oil odor, even dull fluorescence, fast streaming cloudy to milky cut. Gas values from entry would range between 269-713 units, with peaks of 1,000-1,300 units at the top of the "B" target porosity. Fluid losses were already at 88-112 bbl/hr. Oil shows at the possum belly were 50-70%.
Drilling of the lateral continued until a top strike was encountered at 9,024' MD; 8,351' TVD; 764.9' VS. Calculated dip thus far in the lateral was 89.8 degrees. Gas values were recorded between 633-1011 units. Fluid losses would remain quite high at 102-112 bbl/hr. Oil shows at the possum belly were 50-60%.
Drilling of the lateral would continue approximately 4 ft. below the top of the Red River "B" until a second top strike was encountered at 9,988' MD, 8,352' TVD, 1,728.0' VS. Calculated dip to this point in the lateral was 89.95 degrees. Lithology between top strikes consisted of dolomite, gray brown, brown, dark brown, light brown, very fine to fine crystalline, sucrosic, lightly vuggy, firm, friable, good intercrystalline porosity, good layer oil on wash water, strong oil odor, even dull fluorescence, instant diffuse streaming cloudy cut. Gas values would range between 650-950 units, with peaks of 1200 units. Fluid losses would range between 52-72 bbl/hr. It will be noted that a bi-polymer sweep was sent for fluid losses at 9,435' MD. A wiper trip was also made to clean hole. Oil shows would average 50-80%.
It would be somewhat difficult getting away from the top due to a tight, hard dolomite member beneath the overlying anhydrite. As a result we would get 7 ft. below the Red River "B" top before getting turned around and trending upward.
A top strike was initiated for the end of the lateral at 10,372' MD; 8,353' TVD; 2,111.2' VS. A top strike is initiated for the end of each lateral for mapping purposes. Overall dip was calculated at 89.95 degrees. Lithology throughout the lateral was dolomite, mostly brown to light gray brown, gray brown, very fine to fine crystalline, sucrosic, lightly vuggy, firm to lightly brittle, friable, good intercrystalline porosity, fair to good layer oil on wash water, strong oil odor, even dull fluorescence, instant diffuse cloudy to milky yellow cut. Gas values while drilling of the upper Red River "B" target porosity ranged between 600-1380 units. ROP values ranged between 0.5 min/ft to 1.3 min/ft. Gamma was recorded between 3-7 counts while drilling of the lateral. Oil shows at the possum belly ranged between 50-70%.
The SBRRU #14-12, SW well lateral achieved TD status of 10,372' MD at 2:00 P.M. CDT on April 13, 2007.
This well is currently awaiting completion.
