SUBJECT: AUTHORIZE THE PUBLIC WORKS AGENCY TO ADVERTISE AND

RECEIVE BIDS FOR A JOB ORDER CONTRACT

RECOMMENDATION:

Authorize the Public Works Agency to advertise and receive bids for a Job Order Contract, and

return to your Board with a recommendation to award a one-year contract with a minimum

APPROVE PROJECT AND ADVERTISE FOR BIDS

WHEREAS, in the judgment of the Board of Supervisors of the County of Alameda, it is necessary to secure all labor, material, equipment, mechanical workmanship, transportation, arid services required for:

ALAMEDA COUNTY PUBLIC WORKS JOB ORDER CONTRACT FOR REPAIR, REMODEL, AND RENOVATION WORK

NOW, THEREFORE, BE IT RESOLVED that Project Plans for the above mentioned work as prepared by the Director of Public Works, as authorized by the Board of Supervisors be and they are hereby accepted and approved; and

BE TT FURTHER RESOLVED that the bid bond to be submitted with the proposals for the above work shall be in the amount of$25,000; and

BE IT FURTHER RESOLVED that the contractor awarded the bid and any subcontractor shall pay not less than the specified general prevailing rates of wages to all workers employed in the execution of the contract, said general prevailing rate for holiday and overtime work shall be as determined by the Director of the Department of Industrial Relations, State of California, for each craft, classification, or type of workman needed to execute the contract as set forth in Sections 1770 and 1773 of the Labor Code of the State of Cahfomia, copies of which are on file with the Contract Compliance Officer at the office of the Director of Public Works, 951 Turner Court, Room 100, Hayward, CA 94545; and

BE IT FURTHER RESOLVED that the Clerk of this Board be and is hereby authorized and directed to advertise for proposals for the above-mentioned work, in accordance with law by publishing the same in the Inter-City Express, a newspaper of general circulation published in the County of Alameda, State of California; and

NOTICE TO BIDDERS

J. Notice is hereby given that The County of Alameda Public Works Agency ("PW A," "County" or "Owner") will receive sealed bids for:

ALAlvIEDA COUNTY PUBLIC WORKS AGENCY JOB ORDER CONTRACT FOR REPArR, REMODEL, AND RENOVATION WORK

2. Sealed Bids will be received until 2:00p.m., November 29. 20 It, at 951 Turner COllrt, Room 300, Hayward, California 94545, at or after which time the bids will be opened and publicly read aloud. All bids, whether delivered by an employee of Bidder, U.S. Postal Service, courier or package delivery service, must be received and time stamped at the staled address. The PWA's timestamp shall be considered the official timepiece for the purpose of establishing the actual receipt of bids. Any claim by a bidder of error in its bid mllst be made in compliance with section 5100 et seq. of the Public Contract Code. Any bid that is unsealed or submitted after this time shall be non-responsive and returned to the bidder.

3. Scope of Work:

Each Job Order Contract (JOC) is an indefinite quantity contract pursuant to which the Contractor will perform a variety of projects, consi sting 0 f spec ific constmction tasks, at different locations. The scope of the JOe Contract is for general construction, repair, remodel and other repetitive related work to be performed for the County of Alameda. The County has published a Construction Task Catalog® (CTC) containing a series of construction tasks with preset Unit Prices. The CTC was developed using experienced labor and high quality materials. All Unit Prices are based on local labor, material and equipmenl prices incIud ing the cUITent prevai Iing wages. The Contractor wi II bid Adj ustment Factors to be applied to the Unit Prices. The price of an individual project will be detelmined by multiplying the preset Unit Prices and the appropriate quantities by the appropriate Adjustment Factor.

The scope of Work for each Contract will be determined by the Detailed Scope of Work issued in connection with individual Job Orders. The scope of work, for each project will be explained to the Contractor at a Joint Scope Meeting. The County will provide a Request for Job Order Proposal and Detailed Scope of Work for each project to the Contractor. The Contractor will be required to review the Detailed Scope of Work and develop a Price Proposal using appropriate tasks, quantities and the applicable Adjustment Factor. The County will review the Contractor's Proposal in detail and, if found to be reasonable and acceptable, a lob Order may be issued. The agreed upon price will be a fixed price for the perfomnllce of the Detai led Scope of Work.

Contract Time: The teon of each Job Order Contract commences on the effective date of the Notice to Proceed issued by the County for the respective Job Order Contract

The tenn of each Job Order Contract will be either for one year or when issued Job Orders totaling the Maximum Contract Value have been completed, whichever occurs first. All Job Orders must be issued, but not necessarily completed, within one calendar year of the commencement date of the Contracl.

Contract Value: The Minimum Contract Value for each Contract is £50,000. Each Contractor will receive aggregate Job Orders totaling at least $50,000 during the Contract term.

The Maximum Contract Value of each General Construction Contract is $1,000,000. No Contractor will be issued Job Orders that in total exceed the Maximum Contract Value. The County does not guarantee the Contractor will receive any volume of work in excess of the Minimum Contract Value. The County may award other construction contracts for the same or similar Work during the term of any or all of these Job Order Contracts.

4. All bids shall be on the Bid Form Document provided by the County. Each bid must confoon to and be responsive to all pertinent Contract Documents, including, but not limited to, the Instructions to Bidders, the Alameda County Standard General Conditions and the Supplementary Instructions to Bidders ­Construction Outreach Program located in project speci fications.

5. Bidders are strongly encouraged to review the Supplementary Instructions to Bidders - Enhanced Construction Outreach Program Document (ECOP) and to begin their outreach efforts prior to the mandatory Pre-bid Conference. The list of bidders solicited for this project include but are not limited to all those construction contractors listed in the GSA Small, Local & Emerging Program Vendor Query database located at http://www.<lCgov.org/sleb querv arp/gsalsleb/q uery/s lebmenu. isp .

6. To bid on this Project, the Bidder is required to possess one or more of Ole following State of California Contractor Licenses:

A - General Engineering Contractor License

The Bidder's license(s) must remain active and in good standing throughout the tenn of the Contract.

7. A bid bond by an admitted surety insurer on the form provided by the County, or a cashier's check or a certi tied check, drawn to the order of the County of Alameda, in the amount of $25,000 shall accompany the Bid Form, as a guarantee that the Bidder will, within seven (7) business days after the date of the Notice of Award, enter into a contract with the County for the performance of the services as stipulated in the bid.

8. Each successful Bidder shall be required to fumish a 100 % Performance Bond and a 100% Payment Bond in an amount equal to the Maximum Contract Value if it is awarded the contract for the Work.

9. Each successful Bidder may substitute securities for any monies withheld by the County to ensure performance under the Contract, in accordance with the provisions of section 22300 of the Public Contract Code.

10. Every Contractor and all Subcontractors under the Contractor shall pay all workers on all work perfonned pursuant to their respective Contract not less than the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work as detennined by the Director of the Department of Industrial Relations, State of California, for the type of work performed and the locality in which the work is to be performed within the boundaries of the County, pursuant to sections 1770 et seq. of the Califomia Labor Code. Prevailing wage rates are also available from the County on file at 951 Tumer Court, Hayward, CA, 94545, or on the Internet at: <http://w\vw.dir.ca.gov>.

11. Bidders must attend a mandatory pre-bid conference. The pre-bid conference will be held on Tuesday, November 15,2011, at 10 a.m. at 951 Turner Court, Room 230B, Hayward, CA 94545. All participants are required to sign in. Failure to attend the mandatory conference or tardiness will render the bidder ineligible.

It is County policy to minimize the expenditure of County funds on goods and services produced by any entity which buys, sell, leases or distributes commodities andJor professional services to (1) the government of Burma; or (2) any entity organized under the laws ofBunna; or (3) any entity which does business with any private or public entity located in Bunna, or conducts operations in Burma. Contractors are urged to comply with the policy in making purchases and subcontracts. (ref. Alameda County, Cal., Adm. Code tit.4, §4.32.050(B),(F) )

15. Contractors must comply with County's Administrative Code CONSTRUCTION DEBRIS MANAGEMENT AND GREEN BUILDING PRACTICES.

16. The County reserves the right to reject any and all bids andJor waive any irregularity in any bid received. If the County awards a Contract, the security of unsuccessful bidder(s) for that Contract shall be returned within sixty (60) days from the time the award is made. Unless otherwise required by law, no bidder may withdraw its bid for ninety (90) days after the date of the bid opening.

17. The County shall award all Contracts, if it awards any at all, to the lowest responsive responsible bidder for each Contract based on the Award Criteria Factor only.
