GUIDELINES AND PROCEDURES FOR EMPLOYEE SERVICE

CENTERS, DEPARTMENTAL HR LIAISONS, AND TIMEKEEPERS

The Expanded Paid Family & Medical Leave Act (EFMLA)—one of the new paid leaves under the federal Families First Corona Virus Response Act (FFCRA)—adds a new qualifying reason for related FMLA leave: the need to care for a child under age 18 because of school

and daycare closures due to COVID-19. Eligible employees may access 12 weeks of paid

leave, which includes (i.e., runs concurrently with) the Emergency Paid Sick Leave, or use of

other accrued balances, for the first two weeks. For the remaining 10 weeks of eligibility, per

the provisions of amended EFMLA, the employee will receive two-thirds of their rate of pay

for their regular schedule.

The FFCRA regulations allow an employer to cap EFMLA compensation at a maximum of

$200 per day and $10,000 total. The County has made a policy decision not to apply these

caps to employee compensation received under EFMLA. This means that, if an employee’s

daily compensation under EFMLA exceeds the $200 cap, they will receive the full calculated

value of two-thirds of their rate of pay and their daily compensation will not be capped at

$200.

In addition, the County will implement this two-thirds paid leave and will allow integration of

leave to achieve full pay. The benefits under the amended EFMLA expire on December 31,

2020.

Who is not eligible for benefits under the EFMLA?

weeks of FMLA, regardless of the qualifying reason for leave. The EFMLA does not provide

for an additional 12 weeks of leave.

Who is a Healthcare Provider?

For the purposes of employees who are exempt from expanded family and medical leave, a

healthcare provider is anyone employed at any doctor’s office, hospital, healthcare center,

clinic, post-secondary educational institution offering healthcare instruction, medical school,

local health department or agency, nursing facility, retirement facility, nursing home, home

healthcare provider, any facility that performs laboratory or medical testing, pharmacy, or any

similar institution, employer, or entity. This includes not only medical professionals, but other

workers who are needed to keep hospitals and similar health facilities well supplied and

operational. This also includes any permanent or temporary institution, facility, location, or

site where medical services are provided that are similar to those provided at hospitals and

other such health facilities. This definition includes any individual employed by an entity that

contracts with any of the above institutions, employers, or entities to provide services or to

maintain the operation of the facility. This also includes anyone employed by any entity that

provides medical services, produces medical products, or is otherwise involved in the making

of COVID-19-related medical equipment, tests, drugs, vaccines, diagnostic vehicles, or

treatments. This also includes any individual that the highest official of a state or territory,

including the District of Columbia, determines is a health care provider necessary for that

state’s or territory’s or the District of Columbia’s response to COVID-19.

Who is an Emergency Responder?

For the purposes of employees who are exempt from expanded family and medical leave, an

emergency responder is an employee who is necessary for the provision of transport, care,

health care, comfort, and nutrition of such patients, or whose services are otherwise needed to

limit the spread of COVID-19. This includes, but is not limited to, military or national guard,

law enforcement officers, correctional institution personnel, fire fighters, emergency medical

services personnel, physicians, nurses, public health personnel, emergency medical

technicians, paramedics, emergency management personnel, 911 operators, public works

personnel, and persons with skills or training in operating specialized equipment or other

skills needed to provide aid in a declared emergency, as well as individuals who work for such

facilities employing these individuals and whose work is necessary to maintain the operation

of the facility. This also includes any individual that the highest official of a state or territory,

including the District of Columbia, determines is an emergency responder necessary for that

state’s or territory’s or the District of Columbia’s response to COVID-19.

How does the County determine who is a health care provider or emergency responder?

Please see the attached list of classifications that are exempt from the expanded family and

medical leave provisions, updated as of April 24, 2020. This list is not comprehensive.

Classifications/positions not included on this list will be reviewed on a case-by-case basis.

If you are contacted by a supervisor/manager who believes an employee meets the

definition for exemption from EFMLA, or you identify a class or position you believe

should be exempt, but is not on the exemption list, please contact Gina Donnelly at

[email protected] or 408.209.7322 to discuss exempting a class or position(s)

within a class.

If an otherwise eligible employee already used 12 weeks of FMLA in the last 12

months, are they eligible for benefits under expanded FMLA?

No, employees who have exhausted 12 weeks of FMLA leave in the last 12 months are

not eligible for EFMLA.

If an otherwise eligible employee used a portion of the 12 weeks of FMLA in the last 12

months, are they eligible for benefits under EFMLA?

Yes, otherwise eligible employees who have exhausted only a portion of the 12 weeks of

FMLA leave in the last 12 months are eligible, but only for the remaining hours/the balance

of the 12 weeks remaining for this benefit. Similarly, going forward, use of EFMLA or

FMLA leave now (for any qualifying reason) limits future eligibility for EFMLA or FMLA

leave depending on how many hours the employee has used of the 12-week benefit.

Can the EFMLA be used intermittently?

The County has approved intermittent use of EFMLA benefits but only for a regularly

occurring weekly schedule mutually agreed upon between the employee and the

manager/supervisor that meets the needs of the employee and the operational needs of the

Department. Intermittent schedules may not be approved in increments less than one full

workday. For example, an employee who normally works Monday through Friday, eight

hours per day, may request to use EFMLA leave on Mondays, Wednesdays, and Fridays, and

continue working eight hours on Tuesdays and Thursdays. However, they may not elect to

work four hours per day and take four hours of EFMLA leave.

The Department has discretion to approve use of intermittent leave, but must do so fairly and

equitably, and must not treat similarly situated employees differently. For example, if a

Department has two workers in the same job classification working remotely, the Department

should not grant one person use of part-time intermittent leave and deny another person’s

request for the same intermittent leave, absent a legitimate, non-discriminatory reason for

doing so. A Department should agree with the employee on a schedule of intermittent leave

(i.e., particular days) for use it approves.

How do employees apply for the new benefits under the EFMLA?

EFMLA leave is subject to approval by the Service Center Manager in their assigned

Employee Service Center. Employees requesting approval should complete the EFMLA

application and should consult with their manager/supervisor for schedule approval and

their department’s Employee Service Center for questions regarding EFMLA benefits and

eligibility. However, employees who attest to the notice requirements for leave, even

orally, must be conditionally approved and their leave initiated.

Verification of school closure or daycare closure/unavailability is required.

What options are available for employees who are not eligible for EFMLA leave—like health care providers or emergency responders—but cannot work due to closure of schools or daycare facilities?

Paid childcare is being offered by the County for employees who are continuing to provide essential services on site to the community.

EFMLA Procedures:

Notify your supervisor/manager that you are requesting EFMLA

leave and believe you are eligible. You will need to provide

sufficient information to allow the County to conditionally approve

the leave. As soon as practicable, complete the EFMLA form and

submit it to your supervisor/manager (if requesting intermittent use, it

is recommended that you consult with your supervisor to discuss your

request prior to submission for approval of your requested schedule.)

Intermittent use is subject to supervisorial approval and may only be

taken in full day increments.

Review and approve/deny any intermittent schedule request.

If schedule is approved, forward form to Service Center for

determination of eligibility and final approval of EFMLA leave.

If denied, return the County’s EFMLA form to the employee and

inform the employee of the reason for denial. Employee may

supplement their information, but if they are not eligible, discuss

other options, if any, for intermittent use.

FAMILY AND MEDICAL LEAVE REQUEST FORM

Applications for leave under the Emergency Family and Medical Leave Expansion Act (EFMLEA) should be made in advance whenever possible. To request leave under the EFMLEA, complete this form and return it to your Department Employee Service Center. You may request EFMLEA for up to twelve work weeks if you need to care for a child under age 18 because of school/daycare closures or childcare provider is unavailable related to COVID-19. The Department of Labor’s notice about EFMLEA is attached with this Request Form. EFMLEA is not available to healthcare providers and emergency responders as noted in the “Updated COVID-19 Guidance for Leaves and Timekeeping” memo provided along with this form.
