Civil Procedure 24(b)(2) permits any party to interuene in an action "when [the]applicant's claim or defense and the main action have a question of law or fact incommon." Ala. R. Civ. P.24(b)(2). ,: , , , G. Intervention by Town of Century and ESWCD as plaintiff intervenors willnot unduly delay or prejudice the adjudication of the rights of the parties.

7. Thus, Town of Century and ESWCD respectfully move, in the alternative,that they be allowed to intervene under Rule 24(b), in the event the Court finds' intervention of right not warranted under Rule 24(a)
