Hopefully, you have not lost relatives or been sick yourself. I for one have not seen my 96-year-old mother since March. Perhaps she will remember me. The impact of this virus on court operations has been stunning. Orders now require masks for all employees and courthouse visitors. Temperatures are taken and hands well washed. Departments are split so if the virus strikes some, others will be able to come to work to cover for them. Now, we are all taking one furlough day per pay period in an effort to reduce the cost of payroll. With malls and shops closed, there were far fewer theft cases. There were many more domestic violence cases. In April, only 42 traffic tickets were filed in comparison to the 1,247 traffic tickets filed in April 2019. For these months, with extraordinary efforts by my law clerks, magistrates and probation officers, every traffic ticket arraignment received a telephone call advising that we would call their cases from the courtroom and on the record. However, they would not come to court. We would phone them. Pretrials have continued telephonically and prisoners have been seen by video.

The impact of this virus on court operations has been stunning Orders now require masks for all employees and courthouse visitors Temperatures are taken and hands well washed Departments are split so if the virus strikes some others will be able to come to work to cover for them Now we are all taking one furlough day per pay period in an effort to reduce the cost of payroll

Supreme Court has been hard at work Just this

month the Court decided a speeding case that will simplify a courts reliance on radar and laser speed measuring devices

In City ofBrookpark v Rodojev 2020shyOhio-3253 the Supreme Court found that speed results obtained through the use of radar or laser technology are admissible in a court trial without the need for expert

testimony on how these devices work Further courts no longer need to take

judicial notice of the accuracy of these

speed-measuring devices Without expert testimony or judicial notice the scientific principles underlying this technology are deemed reliable according to the Supreme

Court This does not mean that a speeding

ticket cannot be challenged The judge or jury is still required to determine from the evidence presented whether the particular radar or laser was accurate when the ticket was issued and whether the officer using the

device was properly trained Overall this means that if you contest your speeding ticket the city prosecutor is not required to bring in an expert to testify about the accuracy of the speed-measuring device The judge or jury need only to determine if the device was properly operating and properly used

As always obey the speed limits and drive carefully to avoid testing this new

law

SCAMMERS CONCOCT SCHEMES DUE TO

COVID-19

Be wary Scammers are trying to capitalize on fears generated by the pandemic in order to access your money or identity Here are a few to avoid

bull Fake Phone Calls Watch out for calls from the Ohio Emergency Management Agency (EMA) asking for your social security number EMA will NEVER call residents asking for social security or other personal information

bull Scam Emails Avoid emails claiming to be from the Center of Disease Control and Prevention which offer special

advice or information If you want information visit coronavirusgov or coronavirusohiogov Additionally ignore ads promoting and selling cures for COVID-19 as there are currently no vaccines prescriptions or over-theshycounter products available to prevent treat or cure the virus NEVER give personal information to an unknown or phish email

bull Price Gouging Dont pay too much for desired items Price gouging has occurred specifically for toilet paper and surgical masks State laws ban unconscionable sales practices which include dramatically increasing the price of products based solely in response to current events

MEET NEW LAW CLERK RYAN KUN

Hailing from South Euclid OH Ryan IS a rising second year law student at Cleveland-Marshall College of Law who replaces a graduating law clerk at the court

Did you know Ohio ranks fourth in the

nation m human trafficking crimes If

you find this statistic alarming you are not alone Across the Cleveland area organizations are working to help victims and reduce the number of those affected Locally organizations like the Cleveland Rape Crisis Center Bellefaire JCB Homeless and Missing Youth Program and the Cuyahoga

County Regional Human Trafficking Task Force help with this problem These groups

work around the clock to make a difference

by bringing traffickers to justice and offering support to victims

As citizens we can also lend a helping hand by knowing the warning signs ofhuman trafficking Look out for these warning signs from victims who

bull Appear submissive afraid or very nervous

bull Tell a well-rehearsed or consistent story

bull Do not control their own identification papers

bull Are unable to come and go as they please

bull Are very young and with a much older boygirlfriend

bull Have sporadic or poor school attendance or

WHATS A DANGEROUS DOG

Ohio law defines 3 categories of bad dogs nuisance dangerous and vicious In

State v Jones Slip Opinion No 2019-0hioshy

5159 Mr Jones dog bit a lady and injured

her dog without provocation Mr Jones was

charged with Failing to Properly Confine his

Dangerous Dog At trial the prosecutor

had to prove that the dog met the state

definition of being dangerous

A dangerous dog is one AR1I11I8 that in the past has u_s _

1 Caused a non-senous EIIISU

injury to a person OR

2 Killed another dog OR

3 The dogs owner has been cited 3 or

more times for failing to keep the pet

under reasonable control

Mr Jones said that his dog had never

previously been labelled a dangerous dog

and therefore he could not be charged with

this offense The Ohio Supreme Court

disagreed It found that a prior finding that a

dog was dangerous was not a prerequisite to

being charged with this offense Rather if

the prosecutor could prove that the dog met

one of the 3 criteria listed above the charge

was justified

What if you had to blow into an alcohol detection device every time you wanted to drive your car This could become a requirement

The United States Congress introduced HB 4354 Honoring Abbas Family Legacy

to Terminate Drunk Driving after a drunk driver drove the wrong way on a highway killing a family of five The bill directs the Department of Transportation to prescribe a motor vehicle safety standard requiring all motor vehicles to be equipped with an

alcohol detection device that would (1)

determine the blood alcohol concentration of

a driver and (2) prevents the vehicle from

operating if the driver IS legally

intoxicated

The logic behind this proposed law is

obvious We want to prevent drivers who are

under the influence of alcohol from operating

a vehicle However the reliability of an inshy

car device to accurately measure amounts of alcohol in the system raises some concerns

THE FACEMASK EFFECT

masks create special challenges for law

enforcement when looking for suspects of

cnme According to an article titled Now

Everybody Wears the Mask written by

attorney Lisa J Steele fmding the culprits of

crimes has become a more difficult task

Prosecutors and police officers rely heavily

on witnesses to identify the wrongdoer in a

criminal act When half the face is covered

witnesses have less facial recognition on

which to rely Ms Steele therefore

recommends some additional methods for

identifying law breakers Police often will gather a pool of

suspects in what weve come to know as a line-up The police may also present a

witness with a photo line-up To improve this

procedure Ms Steele suggests that all

suspects in the line-up wear identical

facemasks This helps the witness by drawing attention to the parts of the person visible

above the mask and by replicating the event

as closely as possible Officers also may apprehend a

suspect quickly and allow the witness to determine at the scene if the detained person is who they saw committing the crime The

author suggests that if the suspect was

wearing a mask the witness questioned very specifically about the size color pattern type and fit of the mask This improves the witnesss ability to identify the proper person

VIOLENT OFFENDER DESIGNATION

Did you know that Ohio has a list of registered violent offenders The designation of violent offender applies to anyone who has been convicted of

aggravated murder murder voluntary manslaughter kidnapping or abduction Ohio law requires the convicted person to file a form as a violent offender with the sheriff of the county in which the person resides Although a person can object to filing the form the court where the person was

convicted and sentenced for the crime can require this registration

The violent offender database was created under Ohio legislation called Sierahs Law The law was named for Sierah Jougin who was a 20-year-old University of Toledo

student She was abducted and murdered by a man who previously had been convicted of the abduction of another

Sierahs Law creates a searchable database for official to quickly find if someone has been convicted of an offense that would classify them as a violent offender Law enforcement can find violent offenders in their area In order to find out who in your neighborhood could be registered as a violent offender you must

Ohio law defines 3 categories of bad dogs nuisance dangerous and vicious In

State v Jones Slip Opinion No 2019-0hioshy

5159 Mr Jones dog bit a lady and injured

her dog without provocation Mr Jones was

charged with Failing to Properly Confine his

Dangerous Dog At trial the prosecutor

had to prove that the dog met the state

definition of being dangerous

A dangerous dog is one AR1I11I8 that in the past has u_s _

1 Caused a non-senous EIIISU

injury to a person OR

2 Killed another dog OR

3 The dogs owner has been cited 3 or

more times for failing to keep the pet

under reasonable control

Mr Jones said that his dog had never

previously been labelled a dangerous dog

disagreed It found that a prior finding that a

dog was dangerous was not a prerequisite to

being charged with this offense Rather if

the prosecutor could prove that the dog met

one of the 3 criteria listed above the charge

The United States Congress introduced HB 4354 Honoring Abbas Family Legacy

to Terminate Drunk Driving after a drunk driver drove the wrong way on a highway killing a family of five The bill directs the Department of Transportation to prescribe a motor vehicle safety standard requiring all motor vehicles to be equipped with an

suspect quickly and allow the witness to determine at the scene if the detained person is who they saw committing the crime The

author suggests that if the suspect was

her dog without provocation Mr Jones was

charged with Failing to Properly Confine his

Dangerous Dog At trial the prosecutor

had to prove that the dog met the state

definition of being dangerous

2 Killed another dog OR

3 The dogs owner has been cited 3 or

more times for failing to keep the pet

under reasonable control

Mr Jones said that his dog had never

previously been labelled a dangerous dog

disagreed It found that a prior finding that a

dog was dangerous was not a prerequisite to

being charged with this offense Rather if

the prosecutor could prove that the dog met

The United States Congress introduced HB 4354 Honoring Abbas Family Legacy

to Terminate Drunk Driving after a drunk driver drove the wrong way on a highway killing a family of five The bill directs the Department of Transportation to prescribe a motor vehicle safety standard requiring all motor vehicles to be equipped with an

alcohol detection device that would (1)

determine the blood alcohol concentration of

a driver and (2) prevents the vehicle from

aggravated murder murder voluntary manslaughter kidnapping or abduction Ohio law requires the convicted person to file a form as a violent offender with the sheriff of the county in which the person resides Although a person can object to filing the form the court where the person was

convicted and sentenced for the crime can require this registration

The violent offender database was created under Ohio legislation called Sierahs Law The law was named for Sierah Jougin who was a 20-year-old University of Toledo

her dog without provocation Mr Jones was

charged with Failing to Properly Confine his

Dangerous Dog At trial the prosecutor

had to prove that the dog met the state

definition of being dangerous

A dangerous dog is one AR1I11I8 that in the past has u_s _

2 Killed another dog OR

3 The dogs owner has been cited 3 or

more times for failing to keep the pet

under reasonable control

Mr Jones said that his dog had never

previously been labelled a dangerous dog

disagreed It found that a prior finding that a

dog was dangerous was not a prerequisite to

being charged with this offense Rather if

the prosecutor could prove that the dog met

The United States Congress introduced HB 4354 Honoring Abbas Family Legacy

The United States Congress introduced HB 4354 Honoring Abbas Family Legacy

to Terminate Drunk Driving after a drunk driver drove the wrong way on a highway killing a family of five The bill directs the Department of Transportation to prescribe a motor vehicle safety standard requiring all motor vehicles to be equipped with an

aggravated murder murder voluntary manslaughter kidnapping or abduction Ohio law requires the convicted person to file a form as a violent offender with the sheriff of the county in which the person resides Although a person can object to filing the form the court where the person was

convicted and sentenced for the crime can require this registration
