We live in interesting times. With the growth of global trade in the post-war era, we saw the growth of efforts to harmonize approaches to dispute resolution – and, in particular, arbitration – around the world. The New York Convention provided the foundation for success on that front – a foundation upon which UNCITRAL Model Laws and Rules for commercial arbitration and conciliation have built, thus paving the way for growing uniformity in institutional approaches to dispute resolution around the world. Yet, this very success has produced a backlash. Treaty-based arbitration is being challenged as a violation of state sovereignty, ethical concerns are being raised in both investor-state and broader commercial arbitration contexts. As the use of mediation grows, calls for national and international standards raise concerns about preserving the flexibility that is widely viewed as a hallmark of conciliation/mediation processes.

Join Us in New Orleans, Louisiana CPR’s 2016 Annual Meeting promises to be the latest in a series of exceptionally engaging events. Once again, meeting panelists and participants will include an outstanding group of General Counsel, leading practitioners, noted academics and jurists, and expert international arbitrators and mediators.

The opening keynote address will be by Gov. Howard Dean, former governor of Vermont, presidential candidate, Chair of the Democratic National Committee and noted political commentator. The panels program on Day One will begin with “Are We Killing Mediation?” a panel continuing the robust debate at AM15 on changes in mediation practice and their impact on mediation effectiveness. The next panel, “Why I ‘Hate’ Arbitration”, will be a lively discussion of reasons counsel avoid and/or delay dispute resolution. Following our morning dissecting issues and challenges in dispute resolution, the afternoon of Day One will begin with “Creative Approaches to Aligning Interests in Dispute Resolution”, a panel focused on the innovative approaches our neighbors in Brazil and Canada are using to enhance dispute resolution processes and outcomes. The panels on Day One will conclude with “Redefining Winning – CPR Hot Topics”, addressing emerging issues and solutions in dispute resolution around the world.

On the evening of Day One, CPR is pleased to announce that it will honor Monsanto Company and Scott Partridge, the company’s Vice President of Global Strategy, with the inaugural Inspiring Innovation Award in recognition of Monsanto’s development

and implementation of a unique, business-led dispute management process creating a powerful, proactive industry-wide dispute identification and resolution program.

The program on Day Two will begin with a keynote address by Kenneth Feinberg, noted mediator, Special Master for victim compensation funds, including the September 11th Victim Compensation Fund and One Fund Boston, and author of What is Life Worth? and Who gets What? Day Two will continue with breakout sessions including an IP panel addressing Patent ADR around the world, a Healthcare panel addressing dispute resolution in the context of the industry consolidation and realignment that have followed in the wake of the Affordable Care Act, and an In-house panel addressing practical and strategic issues involved in arbitrator selection. The morning with continue with “The Rising Global Debate Regarding Arbitration Ethics”, a spirited discussion of the nature and source of concerns and a range of proposals that have been made to “solve” the problems. Day Two will conclude with two CPR perennial favorites. First, CPR’s Business Roundtable, during which leading General Counsel from around the world will address strategic issues they face as they implement a thoughtful approach to dispute resolution. Second, we will once again convene a dynamic and interactive ethics panel addressing key issues faced day-to-day in dispute resolution.

Governor Howard Dean

Governor Howard Dean, former DNC Chairman, presidential candidate, six term Governor and a physician, currently works as a part time independent consultant focusing on the areas of health care, early childhood development, alternative

energy and the expansion of grassroots politics around the world.

Dean serves as a MSNBC contributor and is the founder of Democracy for America, a progressive online organization with one million members nation wide. DFA works to elect more progressive candidates to local, state and national office by providing the tools to create change.

Dean Currently serves on the Board of the National Democratic Institute, a democracy building organization chaired by former Secretary of State Madeline Albright. He has extensive experience in Southeastern Europe including in Ukraine, Moldova, and the Balkans. He has also has an extensive knowledge of Iraqi and Iranian affairs, and has spent time in China and Myanmar as a result of his NDI activities. He has been active in anti human trafficking efforts in Asia and in the United States. He lectures frequently in Europe, and is currently teaching a course on the Politics of American Foreign Policy at the Jackson Institute at Yale. He also teaches at Hofstra University’s Peter S. Kalikow School of Government: Public Policy & International Affairs and the University of Vermont.

Respected on both sides of the political aisle, Dean was chairman of the National Governors’ Association and the Democratic Governors’ Association. Dean left office in Vermont to run for President in 2003 where he implemented innovative fundraising strategies such as use of the Internet.

As chairman of the Democratic National Committee, Dean created and implemented the “50 State Strategy” and the development of 21st century campaign tools. Dean is credited with helping Democrats make historic gains in 2006 and 2008.

In the U.S. alone, approaches to mediation vary sufficiently so that it is not uncommon to hear references to “East Coast” style, “West Coast” style, and “the California experience.” Global practices introduce even more variation. Practices such as mandatory mediation, avoidance of joint sessions, and limiting mediator interaction with parties have given rise to enormous debate about whether certain practices reduce the efficacy and/or professionalism of mediation. This panel will address these issues in the classic CPR interactive style, drawing from the experiences of the panelists and the audience.

Kenneth R. Feinberg Esq. The Law Offices of Kenneth R. Feinberg, PC

Kenneth R. Feinberg has been key to resolving many of our nation’s most challenging and widely known disputes. He is best known for serving as the Special Master of the Federal September 11th Victim

Compensation Fund of 2001, in which he reached out to all who qualified to file a claim, evaluated applications, determined appropriate compensation, and disseminated awards. Mr. Feinberg shared his extraordinary experience in his 2005 book What Is Life Worth? and in his follow-up book Who Gets What, published in 2012. Mr. Feinberg became Fund Administrator for the Hokie Spirit Memorial Fund following the tragic shootings at Virginia Tech and has also served as the fund administrator for the Aurora Colorado victim relief fund and the One Fund Boston established to provide relief to the victims of the Boston Marathon shooting.

Mr. Feinberg has been involved in resolving thousands of disputes involving a wide range of interests and clients. In the commercial sector, Mr. Feinberg designed, implemented and administered an ADR settlement Program involving Liberty Mutual Insurance Company, Zurich N.A. Insurance Company and Hurricane Katrina and other Gulf hurricane claimants. He also has served as Distribution Agent for AIG Fair Fund claimants, and has been the Fund Administrator for a variety of claimant funds totaling more than $1 billion. In 2009, Feinberg was appointed by the U.S. Treasury Department to oversee the compensation of top executives at companies which have received federal bailout assistance.

Mr. Feinberg has been appointed to two presidential-level commissions because of his experience and expertise, and has had a distinguished teaching career as an Adjunct Professor of Law at Georgetown University, the University of Pennsylvania, Columbia University, New York University, and the University of Virginia.

In 2004, he was named “Lawyer of the Year” by the National Law Journal (2004), and has been named repeatedly as one of “The 100 Most Influential Lawyers in America” by the National Law Journal.

Track A: IP Panel: Patent ADR around the Globe: U.S. intellectual property law has been influenced most profoundly in recent years by the implementation of the 2011 America Invents Act (“AIA”) and by recent Supreme Court decisions. Primarily as a result of AIA inter parties review (“IPR”) proceedings, the U.S. Patent and Trademark Office is now the number 2 jurisdiction in the country for volume of contested patent filings. The panel will discuss how IPRs and the Supreme Court cases have influenced litigation. implications for dispute resolution, together with a consideration of comparable proceedings in other countries and current prospects for ADR abroad.

Track C: Dispute Resolution in the Wake of Realignment in the Business of Healthcare: The Affordable Care Act of 2010 (the “ACA”) anticipates and mandates many theoretical and structural changes in the multi-billion dollar healthcare industry.
