HOW TO USE THIS MANUAL

The first step to debt freedom is organization and self‐discipline.Organization is key to the success of this program.

To facilitate the use of this program, we have organized the DebtElimination System into topical manuals. These manuals are intended tobe printed, 3‐hole punched, and placed in a 2” binder for convenience and ease of reading.

Many of the manuals include worksheets that will assist you in stopping

your creditors, eliminating your debt, and increasing your credit score. It is crucial that you print all copies of the worksheets, place them in yourbinders, and use them!

Having these manuals and their corresponding worksheets in binders

will allow you to take them with you, or place them near the phone, or work on them in bed or at the dinner table. Having this information accessible when a creditor calls or when you have spare time to work onthe program will be crucial to your success.

We have provided color inserts to place in the clear pockets on the frontand side of the binders.

The Ten Rules for Handling Phone Calls

1. Be Consistent Don’t‐ change your positions every time they call.

2. Be Concise A‐ phone call with a debt collector should be no

more than 3 minutes long.

3. Be Polite ‐ There is no reason to get angry, frustrated or

frightened; it is just a phone call.

4. Hang Up You do‐ not have to talk to anyone who is rude or

mean.

5. Call Back When You Should ‐ If you do not, they will be calling

you.

6. Get the Name ‐ Be sure you take notes, including the name of

the collector.

7. Get the Date and Time ‐ Be sure your notes include the date and

time of every call.

8. Record the Call ‐ If permissible in your state, record the

conversation. You will thank me for this one.

9. Keep Your Answering Machine Messages These are always‐

good evidence.

10. USE THIS BOOK Your most‐ valuable tool.

If possible, always record the phone calls. If you are calling from a 1‐

party state, you can record the call without the other party’s

permission. If you are calling from a 2‐party state, you must inform

the other party by saying, “I am recording this phone call.” Just quickly

make that statement and without pause continue the conversation.

Do not wait for their consent, just move on. If they object, turn the

recorder off and keep good notes. I recommend the phone recording

respond to phone calls, but it

will not make a difference in

calls.

better the evidence, the more debt you will eliminate. If you use this

1. We want a payment! *

Respond – “I can’t make a payment now. I will pay you as soon as I

can.” If you can give them a date, do it. If you are not going to pay

them, send a refusal to pay letter, and tell them not to call you

anymore. They will call you again. Be sure to be consistent and make

a record of the calls in this book.

2. We are going to sue you! *

Respond – “Then I guess you will have to sue me. But you are

probably lying to me. You should just be professional and stop lying.”

Make a record of the conversation in this book.

3. We are going to call your work & family! *

Respond – “There is no reason to call them. If you do, I will sue you.

You should not be calling them and I will not tolerate that kind of

abuse. Why can’t you just be professional and quit lying to me?”

4. We are going to garnish your wages! *

Respond – “You do not have a judgment against me, so you cannot

garnish me. Why don’t you act like a professional and quit lying to

me?” Make a record of the conversation in this book. It is probably a

violation of the FDCPA.

5. We are going to put a lien on your house! *

Respond – “I know that you cannot put a lien on my house until you

sue me. You and I both know that you are not going to do that. Why

don’t you deal with this in a professional manner and quit lying to

me?” Make a record of this threat because it is a lie.

6. We are going to have a Sheriff serve you papers!*

Respond – “I don’t believe you. You are a liar. I am writing down what

you said, and I am going to use it against you. I do not have to take

your abuse and lies. Why don’t you act like a professional, instead of a

thug?” Make a record of the conversation in this book.

7. You are going to jail! *

Respond – “We do not have debtors’ prisons, you idiot. I am writing

down what you said, and I am going to use it against you when I sue

you. I do not have to take your abuse and lies. Why don’t you act like

a professional, instead of a thug?” Make a record of the conversation.

8. You committed fraud! *

Respond ‐ “I have not committed fraud. I am writing down what you

said, and I am going to use it against you when I sue you. I do not

have to take your abuse and lies.” Make a record of the conversation

in this book.

9. You’re a bad person! *

Respond – “You are a bully and a bad debt collector. I am writing

down what you said and it will help me when I sue you. I don’t have

to take your abuse because I have Legal Credit Cures.” Make a record

of the conversation.

10. What do you mean you will hire an attorney? You can’t even

afford to pay your bills? *

Respond – “I can get a free attorney through Legal Credit Cures. I

don’t have to put up with your nonsense anymore. Your violations of

Federal Law will help me get the relief I need.” Make a record of the

conversation.

* If you have sent the Refuse to Pay letter to a Collection Agency then

say: “You can’t call me!” and hang up. Make a note of the

conversation. This is a violation.

The following pages are designed to help you

keep records of the phone calls and other

contacts you have with creditors. Any notes

you take during a conversation with a debt

collector are admissible in court to verify your side of the story. Many

times this will make the difference between winning and losing.

As I stated earlier, it is always good to record conversations on audio

tape or digitally, but you need to do it legally. If you break laws while

recording conversations, the

evidence will not be

admissible and you will likely

not have the leverage you

need.
