Description:

Trial order denying Defendant Citizens Property Insurance Corporation's "Motion to Enforce Florida Statutes" by which Defendant sought a declaration of the Court that, should Plaintiff prevail in her suit against Citizens for breach of contract, any damages awarded would have to be used to repair the damage to her property. Defendant asserted that this was a necessary implication of section 627.707. Florida Statutes and was consistent with public policy. The Court held that the law and public policy did not authorize or require such seizure of a prospective award of money damages.
