Mr Beling is restricted to practising only under supervision for a period of two years as (a) an employee of a law practice; or (b) in another category of legal practice, other than as a principal of a law practice, in circumstances where he is subject to supervision arrangements which are to the satisfaction of the Commissioner. This period of two years is concurrent with the period specified in order 2 above. 3. Mr Beling is to pay a fine of $5,000 to the Commissioner. 4. In the event that the respondent fails to comply with order 5 during the suspended order period, the Victorian Legal Services Commissioner may make application to the Tribunal to revoke the suspended order period. On such application, if the Tribunal is satisfied that a material breach of this order has occurred during the suspended order period, and is satisfied that it is appropriate in all the circumstances, Order 3 will be vacated, and the practitioner's practising certificate will be cancelled and a local practising certificate not granted to the practitioner before the expiry of six months from the date of cancellation or six months and any further period that the Tribunal may determine, having regard to the circumstances of the breach of the Order. 8.
