7CWater QualityWater Quality within the DSA is regulated bythe RWQCB The RWCQB has establishederosion control guidelines for the TruclzeeRiver hydrologic unit in which the DSA is located The Lahontan RWQCB currently re

quires that any discretionary project must

comply with their erosion control guidelinesas a condition of approval These guidelinesinclude prohibitions on grading between October 15 and May 1 excluding single familyresidences and installation of Best Management Practices BMPs on the project site Because of the Lahontan Review process new

discretionary development meeting Lahontans standards will not result in adverse water

quality impacts Water quality problems resultprimarily from existing untreated discharges

The following General Plan policies are par

ticularly relevant to protection of water qualitv within the DSA

Conservation and Onen Space PolicvProtect surface and groundwater from con

tamination through runoff by implementingthe Regional Water Qualify Control BoardLahontan Regions Best Management Practices

Conservation and Oneu Snaee PoliceCooperate with state and local agencies in efforts to identify and eliminate all sources ofexisting and potential point and nonpointsources of pollution to ground and surface wa

ters including lealzing fuel tanlzs dischargesfrom storm drains auto dismantling anddump sites sanitary waste systems parizinglots roadways and logging and mining operations

Water Cluality Protection Policies

1 New private and public development in

cluding new parizing areas shall comply with

the Lahontan Erosion Control Guidelinesand BMPs

2 The Town shall woriz with responsible property owners and Lahontan to identify andremedy existing untreated discharges withinthe DSA to implement General Plan Conservation and Open Space Policy 63

7D Noise

The DSA is one of the most noise impactedareas in Truelzee due to its location nearI80and the railroad Given the amount of additional infili development proposed in noise im

acted areas mitigation of noise impacts is a

primary concern The following policies provide additional direction on acceptable noise

levels in mixeduse projects due to the mix ofland uses in the DSA Noise standards and re

view criteria are established by the TruclzeeGeneral Plan Noise Element Table 61 ofthe Truelzee General Plan sets forth standardsfor land use compatibility with noise

duction policies applicable to the DSA

7F Soil Contamination

Soil contamination on properties within theDSA is alongstanding problem currently cre

ating abarrier to new infill development and

property revitalization The majority oflzuown contaminated sites within the DSAare a result of underground and abovegroundstorage tame leaies or accidental spillage associ

ated with a variety of industrial uses The primacy pollutants are petroleumbased productssuch as diesel and heating oil

In the existing regulatory and legal environ

ment the current property owner is responsible for the cleanup of contaminated propertyeven if the contamination was there when the

property was purchased Instances have oc

curred in the DSA where contamination was

not identified until project construction was

underway resulting in project delays and in

some cases project abandonment It is not

uncommon for the costs of remediation to

outweigh the economic benefits of the projectfor the developer

The primary regulatory agencies dealing withsoil contamination are the Nevada CountyDepartment of Environmental Health and Lahontan The State of California recently cre

ated afund to encourage cleanup ofcomingled plumes of contaminated water Lahontan is encouraging Downtown propertyowners withcomingled plumes to submit ap

plications for these funds

Of particular importance to implementationof the Downtown Specific Plan is the status

of the Mill Site area currently owned by Union Pacific A substantial amount of additional growth is projected for the Mill Sitehowever the extent of soil contamination on

this site is currently unlznown Until steps are

talzen to identify the extent of the problemprivate developers may not be interested iii

pursuing development of the Mill Site MasterPlan and the Town will be unable to fully im

plement the Downtown Specific Plan TheMill site is most lilzely not in acomingledplume and therefore may not be eligible forcleanup funds under thecomingled plumepxograrn

The Downtown Study Area embraces the historic heart and character of Truckee TheDowntown area is composed of several historic neighborhoods with a concentration ofhistoric buildings There are more than 125structures older than 60 years found in theDowntown area The Nevada County Boardof Supervisors conducted aIistoric Resources Inventory of eligible historic buildingsand structures in 1981 and subsequentlyadopted historic preservation developmentstandards and design guidelines regulating theappearance of new structures anti alterationsto esistind stntetures within an establishedFlistoric District

vitality Properties with wellmaintained historic structures are least susceptible to

This chapter acts as the frameworiz fora historic preservation plan for the Truclzee Downtown area with the goal of preserving andenhancing the historic quality In addition to

enhancing the aesthetic and scenic qualitiesof Truclzee the historic resources element is

designed to preserve the amenity and uniquecharacter of Downtown Truckee promote thetourism economy of the Town conserve andenhance property values in the Downtownarea and foster and encourage the preserva

tion restoration and rehabilitation of struc

tures areas and neighborhoods therebypreventing future urban blight

8D Determination of HistoricResources

The cornerstone of any historic preservationplan is the identification of cultural and historic resources which will be safeguarded bythe plan To accomplish this the historic or

architectural significance of a structure must

be determined by the Town Council Howeverhistoric and architectural significance is a subjective judgment varying from area to area

based on the unique history and characteristics of the area Criteria for determiningwhether a structure is historically or architec

The age of a structure by itself is not a reliable way to determine whether a structure is

structure which is not old compared to otherstructures in the area may be considered his

toxically significant i an important historicalevent or person is associated with the struc

ture or maybe considered architecturally significant if it is a distinctive architectural typeperiod or method of construction unique to

the Town region or State Many other factors must be talzen into consideration to determine whether a structure is historically or

architecturally significant

One of the most crucial components of historic preservation efforts is the protection ofhistoric buildings from unnecessary removalor demolition Retaining historic buildings is

essential in maintaining the historic characterof Downtown Truclzee Development standards and evaluation criteria are needed to en

courage preservation of historic buildings andidentify appropriate situations when historicbuildings may be removed or demolished Pro

cedural standards are also necessary to providethe Town interested organizations and prop

erty owners sufficient time to consider the eco

nomic feasibility of renovating andrehabilitating the structure and explore otheralternatives which may result in the preserva

tion of the structure

Building Demolition Policies

bance sucli development may uncover important resources which bane remainedundisturbed since their burial Because suchresources may be deeply buried or covered bybuildings and paved roads typical archae

ologieal resource evaluations may be not besufficient to identify these resources Closeevaluation of potential distnrbance must oe

cur during excavation phases of projects Ifhistoric or archaeological resources are discovered construction activities must be halted to

allow adequate time for a qualified archaeologisthistorian to evaluate the significance ofthe discovered resource and also to mitigate

impacts to the resource if warranted Mitigation should be in conformance with AppendixK of the California Environmental QualityAct Guidelines based on the significance ofthe resource and the impact

subsurface Historic ArchaeologicalPolicies

1 The Town will acquire information on ar

chaeological records and inventories on filewith the Archaeological Inventory NorthCentral Information Center for properties in

the Downtown Study Area These recordsand inventories will be used to assist the Com

munity Development Director in determiningthe sensitivity of a site and whether a projectmay be exempt from further investigation

2 Prior to approval of any discretionary development resulting in disturbance of theground an archaeological resource investigation will be required for the project site Thearchaeologist will determine as part of theevaluation if there is a potential for archaeological or historic resources on the site Ifso the archaeologist will conduct appropriatemeasures to identify and evaluate any re

sources including identifying the significanceand extent of the resources Such measures

may include archaeological test excavations

removal of historic resources and major alterations to structures These types of activi

ties create eriforeement problems and requirestronj enforcement provisions to deter andprevent unauthorized activities Strong codeenforcement provisions are necessary to prop

erty or business owner must alter their plansto conform with these guidelines Some technicai assistance is provided by the Commu

nity Development Department staff andHPAC

In the past some Community DevelopmentBlocle Grant funds have been available to

qualifying persons and were used for rehabilitation and repair of historic resources But

for the most part the property or businessowner is responsible for costs associated with

complying with the guidelines This regulatory environment with no supporting financial and assistance programs creates

disincentives for the rehabilitation restora

tion repair and maintenance of historic re

sources and subsequently results in thedeterioration of these resources Also this en

vironment does not promote cooperative and

Truclzee has the unique and exciting opportunity to create a recreational area with bilze andhilzing trails on a State owned parcel alongthe south side of the Truclzee River downtown The intent behind this pariz is to maizethe Townsmost valuable natural asset theTruclzee River a focal point of the Downtown area Because the river was historicallyused as a waste dump development acedaway rom the river rather than towards it In

dustrial development which was consideredundesirable in other parts of Town was located primarily along the river Strict water

quality controls and laelz of channelization or

other Mood control development have allowedthe Truclzee river to flow in a relatively pristine condition today The Visual Preference

Survey results for the Downtown area show a

clear public mandate to increase the visibilityof and the public access to the Truclzee Rivercorridor The following pariz proposal is in

tended to achieve these above listed goals

Two portions of the proposed pariz area are

the country In 1905 the Truclzee townspeo

ple acquired an old steam engine which was

transported by ox team rom an abandonedlumbermill to Truclzee and ashioned into a

pullbaelz lift located at the Hilltop slzi hillSome slei historians claim that this was thefirst mechanical lit of its hind in the UnitedStates The Hilltop area was a center owin

ter recreational activity such as slzi jumpingsledding and cross country sluing Today theHilltop area continues its tradition as a ocal

point of nordic sluing serving as the finisharea for the annual Great Slzi Race a 30 lzilometer cross country slzi race from Tahoe Cityto Truclzee The intent of the Hilltop Pariz is

to recognize the historic value o this area and

protect it for future generations

From the northeast Highway 267SouthFrom the south Highway 267 NorthFrom the west West River StreetFrom the northwest Donner Pass Pcoad

There is currently no sense of arrival to Downtown created by these existing gateway areas

In fact at three of the gateways there are billboards that advertise attractions in other areas
