Cristaux International Terms & ConditionsACKNOWLEDGEMENTSAcknowledgments are confirmed via email, fax, or phone. It will be sent following the completion of your order, with the purpose of communicating both receipt of order and information regarding interpretation of design, instructions, pricing, and shipping.

ARTWORKAll submitted orders should be accompanied by sharp, black and white camera-ready artwork. No color or grayscale is permitted. Artwork not meeting these specifications may be charged an additional fee of $40.00 per hour. Per our One-to-One Program the first half hour of artwork is complimentary. (Customer will be notified in advance if additional services are necessary). Submitted digital artwork must be submitted in Ado-be Illustrator (CS5 or lower) or Photoshop. Images must be vector based (raster images are not acceptable). Preferred transmission of artwork is via email using PC or MAC format as .AI, .EPS, or .PDF format. Emailing art: Send artwork to [email protected] NOTE: Failure to comply with these conditions may delay estimated production and delivery time.

BACKORDERSShould you wish to have an item place on backorder that we currently have out of stock, we will be happy to provide you with an estimated time of availability. Please contact customer service for further details.

CANCELATIONSAll cancelations must be submitted in writing. Cancelation charges are based on work completed. Charges incurred prior to cancelation of an order after artwork is approved will be invoiced, plus an additional $100.00 cancelation fee. Once an order has been engraved, it cannot be canceled.

CLAIMSAll claims for breakage shipping third party must be made by distributor with the freight carrier. Cristaux Intl is not responsible for any damages incurred during third party transit shipping. Claims with Cristaux Intl must be made within 7 days upon receipt of good. Any claims made after that point will be denied. All packages should be opened immediately upon arrival and inspected for any damage or your claim will be denied. If damaged, you must save all inner and outer packaging for carrier inspection, and accompany customer service with a de-tailed picture(s). Title to the goods passes to buyer at F.O.B. point or upon mailing of invoices, whichever comes first.

COLOR FILLThere is a charge of $10.00 per color, per unit. Color fill outside of gold or silver may incur a charge of $20.00 per color, per unit. PMS matching is only completed at our overseas factory. NOTE: This option does not apply to all items. Please consult with customer service as some projects may require additional charges due to the complexity of the process. Color fill may also delay production by 24 hours, as paint will need additional time to dry.

COPY CHANGESThere are NO charge copy changes (up to four lines). Anything exceeding four lines will incur a charge of $10. Please consult with customer service or art department if you have questions about the complexity of your project.

CUSTOM ORDERSLut Crystalworks has a custom division specifically dedicated toward custom projects. Please fax or email us with your drawings, specifications, and the desired quantities and a consultant from our customs department will contact you to discuss your needs. There is a minimum order size of $1,000, or project will incur a $295 less than minimum charge. We may accept orders below the minimum standard depending on production capabilities or current production lead time. Minimum order size does not include prototype, mold and tooling, or artwork and design. Production prototype lead-time may vary; standard lead time is 2-3 weeks, excluding international shipping from factory. Custom projects will require a minimum of 50% deposit in order to proceed with production, and terms are dependant based on credit approval. Custom projects manufactured to approved specifications are not returnable for any reason other than defect in the item(s) or workmanship within 10 days of delivery.

DROP SHIPPINGThere is a charge of $10 for each destination after the first destination, plus shipping charges. Addresses must be received in electronic Microsoft Excel or Word format. Cristaux Intl will drop ship internationally, unless distributor provides us with specified third-party shipping instruc-tions. Please contact customer service for additional information.

FREIGHT QUOTESDue to high demand, Cristaux Intl no longer provides domestic shipping quotes unless for custom projects or personal requests for established accounts. We cannot be held responsible for freight estimates as shipping carriers are rarely consistent with estimates in comparison to actual charges. We apologize for the inconvenience this may cause, but for additional questions please feel free to speak with customer service.

INTERNATIONAL SHIPPINGInternational shipments are accommodated. We accept third party account numbers or can ship under our own courier numbers. Note: Please refer to CLAIMS section for international claims policies. There is a $35.00 service charge per international destination. It is the clients responsibility to denote a declared value for the airway bill. Any duties and taxes charged to us will be billed to the client; the charges may be bill up to 90 days after shipment.

MINIMUM ORDERSMost items in our catalog do not require any minimum quantity. You may order as much or as little as you need; however, Cristaux Intl charges a $25.00 handling fee for orders that require products to be broken down from their orginal quantity set.

ORDER PROCESSINGCristaux Intl products are available for sale to all customers, domestically and internationall. PACKAGINGDepending on the product, most goods are packaged in attractive gift boxes. Some products are gift-boxed in corrugated master cartons for added handling care. Please contact customer service for additional details or for special packing requests.

PAPER PROOFSThere are no additional charges for paper proofs. Cristaux is committed to excellent customer service, and therefore feel that you should be able to see as many paper proofs necessary in perfecting your order. We do, however, charge $25 for virtual proofs as that typically interferes with the production processes. Charge is exclusive of any ARTWORK charges.

PAYMENT TERMSNew Accounts: Order(s) must be paid in full upon inception of order. Established Accounts: Prepayment of at least 50% deposit prior to production, and Net terms from date of invoice. Overdue balances will bear an interest rate of 2% per month, per annum. NSF will incur a $30 fee.*** Established accounts are considered as those that have placed five or more orders with Cristaux Intl. ****** Net 15 or Net 30 terms is also subject to credit approval. ***We accept VISA, Discover, MasterCard, or Direct Wire Transfer, as well as personal or business checks.

PRICING All listed prices are effective through December 1, 2012.

PRODUCT VARIANCESDue to the various manufacturing and handcrafted processes in producing crystal and glass, please be aware that some products may contain bubbles, flow lines, chill marks, slight bumps, or other variances which are not considered defects or reasons for replacement.

PRODUCTION TIMEPlease allow a typical production time of approximately 3-5 working days from final approval of artwork. Should there be a need for additional product proofs or artwork designs, please allow an added 2-3 business days for preparation. Production will not begin without final approval of all artwork, engraving, and any additional order information. Orders with short lead times may incur rush charges.

PROPOSITION 65Proposition 65 requires us to notify all California residents that consuming foods or beverages that have been kept of served in leaded crystal products or handing products made of leaded crystal will expose you to lead, a chemical known to the State of California to cause birth defects or other reproductive harm.

RETURN POLICYCristaux Intl is not liable for any damages incurred during shipping. Title to the goods passes to buyer at F.O.B. point or upon mailing of invoices, whichever comes first. Please refer to CLAIMS for further details. Cristaux Intl is not responsible for any claims made after 7 days from receipt of good. All returns must be authorized by Cristaux Intl – please contact customer service at [email protected]. No returns will be accepted without prior written approval. Cristaux Intl reserves the right to refuse any merchandise that has not been authorized. Engraved merchandise cannot be returned. Authorized returns which are considered to be in saleable condition are refundable less a 15% restocking fee plus shipping costs.

SHIPPINGShipments are sent F.O.B. Illinois, California, or New York. Custom projects are F.O.B. China Factory. Freight is prepaid and added to the invoice unless otherwise specified. Standard shipping is either FedEx or UPS Ground delivery, unless other means of shipping is specified. Please note that all ordered items are not always shipped together at the same time. Shipping means vary based on current warehouse availability. FedEx & UPS do not ship to PO Boxes. If shipping to residence, distributor must notify Cristaux Intl before placing the order. Insured shipping will incur and additional charge – please contact customer service for further details. C.O.D. orders are not accepted.

TRADEMARKSUpon the submission of any and all artwork and underlying related content, the customer agrees to hold Cristaux Intl harmless and will defend Cristaux Intl from all claims for patents, copyrights, trademarks, and infringement claims. All liability is held with the customer and not that of Cristaux Intl. Most logos shown in our catalog or website are from our customers, and used for display purposes only. Cristaux Intl reserves the right to photograph or show as samples, items produced by us without any liability on our part as to trademark or artwork rights.
