Monthly Progress Report January 1991

Step I - Initial Evaluation and Preparation of Detailed Planning Documents

Baxter Springs and Treece Subsites RI/FS Cherokee County Superfund Site

1.0 ACTIONS COMPLETED THIS MONTH

Action completed on this project during the month of January 1991 included:

• A conference call was held on January 2, 1991 to discuss Sampling and Analysis Plan (SAP) modifications incorporating x-ray fluorescence (XRF) field monitoring into the waste pile sampling program.

• The Monthly Progress Report for December 1990 was prepared and submitted to EPA on January 15, 1991

• A modified SAP, Laboratory Analytical Protocol (LAP), and responses to the November 21, 1990 EPA comments were submitted on January 21, 1991.

• Dames & Moore notified EPA of planned dates for upcoming Step II field work in a January 21, 1991 letter.

• With a January 22, 1991 cover letter, Dames & Moore transmitted information (a table of sampling program impacts, a listing of owner data, and maps) to EPA on nine properties in the subsites for which access agreements have not been obtained.

• Site reconnaissance and preliminary sampling activities were conducted the week of January 28, 1991, with the following specific actions:

- Set up field office.

- Contact 3 land owners regarding access.

- Conduct reconnaissance for mine shaft and waste pile runoff/leachate sampling sites.

- Collect priority samples of chat and unpaved road materials for grain size determinations.

2.0 DATA AND RESULTS RECEIVED THIS MONTH

No new data or results were received during January 1991. The index of background data and reports compiled by Dames & Moore during Step I is attached. Further updates will be made in Step II, as appropriate. Files of data collected by Dames & Moore in Step II will be maintained.

3.0 SCHEDULED ACTIONS NOT COMPLETED THIS MONTH

None.

4.0 PLANNED ACTIONS NEXT MONTH

During the month of February 1991, approval of the modified SAP and LAP are expected. Task 3 field work will be started in accordance with the attached Round 1 schedule. As an official initiation date for Step II work is already known (February 11, 1991) , a listing of the deliverables for Step II is also attached showing due dates based on the schedule in Section 6.0 of the approved Work Plan. The deliverables and meetings list shows early planned completion dates for some deliverables and the two meetings, because completion of these items on the Work Plan dates would constrain the subsequent activities to unreasonably short durations. Use of the planned early delivery dates (especially on sampling data validation memos) will allow adequate time for all activities so that the Final Draft RI and Risk Assessment Reports (the last deliverables) can be delivered on April 6, 1992, per the Work Plan schedule.

5.0 CHANGES IN KEY PERSONNEL

In preparation for Step II, key personnel on the staff of Risk Assessment Technical Coordinator, Dr. Gary Krieger, were supplemented in preparation for Step II. Mr. Robert E. Quinlan will serve as Assistant Coordinator, and Mr. Daniel S. Efseaff will serve as Task Leader for the Ecological Risk Assessment. Resumes of these new project personnel are attached.

6.0 ISSUES OF PROBLEMS ARISING THIS MONTH

Dames & Moore's efforts to obtain access to private properties in the subsites resulted in nine parcels for which access had not been obtained as of January 22, 1991. Dames & Moore provided information to EPA (see Section 1.0) concerning the impact of non-access on the intended Step II field activities and requested assistance from EPA in obtaining access.

Five of the nine parcels were identified as being high priority in terms of the Step II sampling program and are identified as follows:

7.0 RESOLUTION OF ISSUES OR PROBLEMS

Mr. Steve Sanders of EPA called a relative of the owners of high priority properties Nos. 31 and 32 in Treece (Mr. and Mrs. Mervil Meeds). Additional information was supplied to the Meeds family in late January 1991.

Currently, five high priority properties including the Meeds property are still legally inaccessible for field work. Details on each high priority property are being provided to the Group and EPA by separate correspondence, including discussion of impacts and possible alternatives if access can never be obtained. A force majeure condition may be asserted because the waste piles and other features (open shafts, subsidence features, etc.) are of vital importance to the project.
