The session’s court inMumbai on Friday sentRana Kapoor, former

managing director (MD) andchief executive officer (CEO) ofYES Bank, to judicial custodytill April 2. This came after theEnforcement Directorate (ED)submitted before the court thatit does not need Kapoor’s cus-tody any further.

The Central Bureau ofInvestigation (CBI) has alsomoved a production warrant totake Kapoor into custody.

The CBI had filed a caseagainst Kapoor for allegedlyobtaining illegal gratification byacquiring a property in Delhifrom Gautam Thapar’s Avanthagroup. In exchange, YES Bankwaived the industrial house’sdues and advanced new loans.

Earlier, Kapoor’s ED custodywas extended by four days toMarch 20 while the ED hadasked for a six-day custody. Theformer banker was arrested onMarch 8 by the ED under theprovisions of Prevention ofMoney Laundering Act and wassince in the ED’s custody.Kapoor told the court on Fridaythat he was suffering from asth-ma, and because of his age, he isvulnerable to coronavirus. Thecourt has asked the jail author-ities to take appropriate precau-tions on this count.

Meanwhile, a number ofhigh-profile corporate promot-ers were summoned by theprobe agency, including AnilAmbani, Naresh Goyal, Kapiland Dheeraj Wadhawan,

Subash Chandra and SameerGehlaut in connection with theYES Bank case. Anil Ambaniwas questioned by the ED onThursday and asked to furnishsome important details whichare crucial for the case, said an ED official. Ambani’s Reliancegroup is among the largest borrowers of the bank, with an exposure of around ~13,000 crore.

Ambani sought more timefrom the agency to provide fur-ther clarifications on some spe-cific queries. The probe agencyhas asked him to appear againon March 30. Other big default-ers of YES Bank, who had beensummoned by the ED to appearthis week, did not show up.

During investigations, theprobe agency found that a loanof ~202 crore was sanctioned toMack Star Marketing, which is ajoint venture among HDIL pro-moters Sarang Wadhawan &Rakesh Wadhawan, formerPMC Bank chairman Waryam

Singh and the De Shaw group. The first three hold only

16.64 per cent shares in the entity while the De Shaw groupholds majority stake. The EDfound that the loan of ~202crore, sanctioned to Mack StarMarketing, was used by HDILto pay off loans. The loan wassanctioned to the entity with thespecific purpose of renovatingits office building.

Further investigations haverevealed that about 78 compa-nies owned by Kapoor’s familymembers were being controlledand managed by Kapoor him-self. The ED has also found thatYES Bank had bought deben-tures of Dewan HousingFinance (DHFL) worth ~3,700crore while the latter gave a loanto a firm owned by Kapoor’sdaughters for ~600 crore.

Both the transactions weresuspicious as the companyowned by Kapoor’s daughtersdid not have sufficient businesses or assets.

State Bank of India (SBI) willprovide emergency loans at 7.25 per cent (per annum) fixedrate of interest to existing borrowers whose operationsare impacted by COVID-19. Thescheme will be in force up toJune 30.

The ad hoc loan facility,named COVID 19 EmergencyCredit Line (CECL), is aimed atmeeting the temporary liquidity mismatch arising outof the virus outbreak, SBI informed branches.

All standard accounts as ofMarch 16 and till the date of

sanction are eligible. However,standard accounts classified as SMA 1 (overdue between 30 and 60 days) and SMA2(overdue between 61 and 90days) are not eligible for avail-ing of this credit facility.

The maximum loan thatcould be availed of under thespecial scheme is capped at~200 crore.

This loan facility shall bemade available as fund-basedlimits only, SBI said. The max-imum brunt of COVID-19 fall-out is being faced by businessestablishments. ABHIJIT LELE

Lenders are set to demanda host of relaxations onrepayment of loans in a bidto tide over the COVID-19crisis. These include a 90-day relief in classifyingaccounts as non-perform-ing assets (NPAs) anddeferring installment ofterm loans.

The manage-ment committeeof the IndianBanks’Association (IBA)met on Fridayand froze a set ofdemands that itwill put up beforethe Reserve Bank (RBI) andthe government. It willmake a bid to help the sec-tor and retail and corporateborrowers alike, IBA chiefexecutive officer SunilMehta said over phone.

“We are asking for a 90-day extension of the time-line for slippage of a run-ning account – both cashcredit and overdraft – intoNPA,” Mehta said. If bor-rowers are unable to repayloans within 90 days of thedue date, their loanaccount is classified as NPAby the banks right now. Ifthe IBA’s recommenda-tions are accepted, the NPAtag will take six months.

During the interveningperiod, the accounts willnot be classified as a‘stressed asset’, technicallyknown as Special Mention

Accounts (SMA)-1 or SMA-2 accounts. SMA-1s arethose in which loan repay-ments have been overduefor a period between 31 and60 days, while SMA 2accounts are the ones witha delay of 61-90 days.

Bankers foresee that theCOVID-19 impact on thesector will last for sixmonths. This is becausebusinesses across all sectors

will run dry on cashand even takeextreme measuressuch as retrench-ment to tide over.Banks want easierloan repaymentterms, a CEO of abank, who was pres-

ent in the meeting, said.“We have decided to

demand deferment of upto six months in term-loaninstallments with a conse-quential shift in the repay-ment period by six months.This will be left to the dis-cretion of bankers. Iflenders feel that half of theinstallment amount can bedeferred, as the paymentcapacity of the borrowerhas weakened, additionalsix months can be given.Even full installment sumscan be postponed on acase-to-case basis,” saidMehta, who was earlier theMD and CEO of PNB.

The COVID-19 has hitseveral industries in Indiaand the impact is visibleacross all segments as citieshead for a lockdown to contain the spread.

The Reserve Bank of India (RBI)on Friday appointed R Gandhiand Ananth NarayanGopalakrishnan additionaldirectors to the board of crisis-hit YES Bank for a period of twoyears.

This will be R Gandhi’ssecond stint as an additionaldirector on the private sectorlender’s board. The formerdeputy RBI governor’s first termwas to expire in May 2021 butthe central bank supersededthe previous board of YES Bankearlier this month.Gopalakrishnan, an associateprofessor at SP Jain Institute ofManagement and Research, isan international banking andfinancial markets expert. Hewas previously StandardChartered Bank's regional headof financial markets for ASEANand South Asia.

According to the YES Bankreconstruction scheme, the government had constit-uted a four-member board.Prashant Kumar, the currentadministrator of the bank, wasappointed the managingdirector and chief executiveofficer. Sunil Mehta, formernon-executive chairman ofPNB, was named the non-executive chairman of thebank.
