Question: I am thinking of selling my home and my agent said I have to fill out a Seller’s Property Condition Form. What is this and why should I fill it out? Can I just answer “Do Not Know” to all the questions?
Answer: The Seller’s Property Disclosure is required by Idaho statute to be given to any purchaser of 1 to 4 dwelling units within 10 days of acceptance of the purchaser’s offer.
While a limited number of sellers under specifically defined circumstances are exempt, most sellers must complete and deliver a property disclosure.
Why answer ALL those questions? Particularly when the form used by the Idaho Association of Realtors goes into considerably more detail than required by Idaho sta-tute? There is one very good reason: putting a buyer on notice of the existence, or potential existence, of an issue with the home transfers the responsibility of investiga-ting that issue from the seller to the buyer. The buyer now has knowledge of the issue and, if it is a concern, the buyer has the responsibility to investigate.
For example, let’s say you had a sprinkler that popped off and water ran into the base-ment 3 years ago. You fixed the sprinkler and never had any further problems. Should you disclose this? After all, you got it fixed, right?
Warning: If you don’t disclose it to the buyer and the buyer subsequently discovers mold that resulted from water damage, the buyer may have grounds to look to you for damages because you knew, but did not disclose, there had ever been water in the basement. On the other hand, if you explain on the property disclosure that a sprinkler popped off, water entered the basement, and you got it fixed, you have protected your-self by fully disclosing the incident. Now the buyers are responsible for determining whether there is an issue and whether they are comfortable moving forward.
The proper use of the Seller’s Property Condition Disclosure Form can reduce a seller’s liability and transfer responsibility to the buyer to investigate the condition of the pro-perty to their satisfaction. It would be pretty hard for the buyer in the above example to come back to the seller and claim the seller was responsible for any unknown damage when the buyer had been fully informed of the issue.
Be sure to talk to your Group One agent about how a Seller’s Property Condition Disclosure Form can protect you, the seller, from liability.
