PENSIONERS MARCH TO PARLIAMENT
A surging crowed of Pensioners & serving Central Govt. / State Govt. employees as also University &
school teachers filled the Jantar Mantar Chowk on the Parliament Street, N Delhi at 10.00 A.M. on 25.11.2011.
Tens of thousands Superannuated persons & in-service employees gathered there to protest against
anti pensioners policies of the Central & State Govt. all of them demanding withdrawal of Pension FundRegulatory & Development Agency (PF & RDA ) Bill from the Parliament and scrapping of New Pension
Scheme ( NPS ) introduced by NDA Govt. w.e.f 01.01.2004 & continued by both the UPA Govts which
deprives the new employees of their hard-won right to PENSION.
Leaders of BHARAT CENTRAL PENSIONERS CONFEDERATION, including S.S. Ramachandran,
Chairman, Shyam Sunder, Secy. Genl. and of the major Trade Unions of Central Government / State
Govt. / University teachers / School Teachers were on the dais the huge gathering was chaired by com.
Shiv Gopal Mishra, Genl. Secy. All India Railwaymen’s Federation ( AIRF )
The entire ground echoed with Slogan shouting not only of Pensioners, but especially also of the
young workers whose right to Pension has been snatched by the cruel NPS which is now sought to be
legalized by the UPA Govt. thru the Parliament.
Over 1000 Pensioners from all over India had joined them. The grand Rally continued upto 3 PM. A
delegation of leaders, alongwith Com. Basudeo Acharya, M.P. met the Prime Minister Dr. Manmohan
Singh, explained the demands & handed over a Memorandum for withdrawal of PFRDA Bill from Parliament,
scrapping off of NPS & also considering Pensioner, memorandum like full parity between pre & post 2006
retirees and adequate Medicare. The Prime Minister gave patient hearing but no promise.
Shyam Sunder, Secy. Genl, BCPC ( S.G. BPS ) addressed the grand rally He gave a clarion call for
the unity & joint struggle of Pensioners & in-service employees to achieve their demands.He emphasized:

Visakhapatnam in Rly Pensioners’ Fedn Office,
behind, DRM’s Office, E C Rly, Visakhapatnam.

presided. T. Krishna Murthy, Wkg Prez of the
Fedn while welcoming the gathering requested
the B.P.S. leaders to apprise the gathering of
the latest position on various pending demands.
Addressing the gathering, Shyam Sunder,
Secy Genl, BPS hoped that the ‘March to
Parliament’ being organised by Central Govt.
Employees and Pensioners together on
25.11.2011 at Delhi would compel the Govt. of
India to concede our just demands such as same
fitment benefit to pensioners, Parity, 50% DA/
DR merger, etc. He also hoped that the govt.
would implement CAT/New Delhi Principal
Bench order dt. 1-11-2011 on ‘Modified Parity’
without prolonging it by litigation.
S.C. Maheshwari, Secy, BPS explained the
various steps being taken by the Samaj to bring
all pensioners organisations on one platform to
further the cause of pensioners and retirees in
all sectors in the country. He also explained the
progress in respect of re-opening of RELHS-97,
enhancement of fixed Medical allowance to Rs.
1000/- P.M., 50% DR merger for pensioners’
w.e.f. 1-1-2011 etc. He appealed to all
pensioners to strengthen the senior citizens
movement in the country by extending support
to All India Senior Citizens Confederation
(AISCCON). M Somasekhara Rao, Vice-Prez,
BPS explained about ‘modified parity’ covered
by CAT/Principal Bench’s common order Krishna
Devarayalu, Secy of All Central Govt. Pensioners’
Assn, VSK also spoke, D A N Sarma, Secy, P&T
Pensioners Welfare Assn, VSK proposed a vote
of thanks. SK Krishna Rao, AGS of Railway
Pensioners’ Fedn thanked one and all for
gathering in large numbers in their office to hear
BPS National leaders.
On 22.11.2011, as a special invitee, Secy
Genl BPS led a 50 strong delegation to the 11th
Annual Conference of AISCCON at Vizag in
Kalavani Auditorium wherein he chaired ‘National
Seminar On Pensioners’.
Following resolutions related to the retirees
were unanimously passed by this largely
attended 11th Conference of AISCCON.
11 - 11A) With respect to pension toretirees, this Conference unanimously resolves
and requests the Government of India, the
following:
• “One Rank – One Pension” to be adopted
for Defence Personnel without delay.
• To bring parity among Central government
pensioners and pensioners from Central PSUs.
• Healthcare schemes like CGHS, ECHS,
RELHS & ESI may be integrated into one uniform
standardized scheme so that it is applicable to
all government retirees from State / Central /
PSUs/ Local bodies etc bringing parity among
pensioners.
• To apply the principle of minimum Pension
of ` 3500 plus DA to all ex–gratia & EPS 1995
beneficiaries.
• Not to divide Pensioners into categories on
the basis of their dates of retirement.

Secy (Rly Pensioners) BPSWe are receiving innumerable complaints
from the affiliated units that they are not getting
prompt reply from the railway offices when they
take up the grievances related to pensionary
benefits with the administration. According to the
Right to Information Act, we have got every right
to call for the details required after submitting an
application to the concerned Public Information
Officer of the Railways, duly remitting a sum of
` 10/- in the booking office. Pensioners belonging
to Deptts, other than Rlys, may enclose an IPO
for ̀ 10 with the RTI application.The problem can
be more conveniently settled this way as the Right
to Information Act stipulates a time limit for
replying the letter. (The list of Public Information
Officer in each Railway has been furnished in
the Time Table circulated by each Railway). You
are requested to fully utilize the services
extended by the Govt.

Principal Bench of the Central Administrative Tri-
bunal dt 01.11.2011. While the Govt’s reaction is

CHARTER OF PENSIONERS’ DEMANDS

Sir,
BHARAT CENTRAL PENSIONERSCONFEDERATION (BCPC)
is the Apex Organisation of the Central Govt
Civilian Pensioners’ Federations (including
Railways). Thus, this Confederation represents
all the Central Govt Pensioners.
The IIIrd National Convention of the Central
Pensioners Associations finalized a Charter of
Demands on 4 July, 2010 which have been
reiterated once again by the Governing Council
meeting held on 28th September 2011, as noted
below:-
1. RECOGNIZE BHARAT CENTRALPENSIONERS CONFEDERATION ASFOR 3 EX - SERVICEMEN FEDERATIONS
Extend all facilities including an effectiveGrievance Procedure on lines of JointConsultative Machinery & CompulsoryArbitration (JCM) available to serving CentralGovernment employees
1. The V Central Pay Commission in para
141.24 of its Report has observed that the
number of associations representing pensioners
needs to be reduced drastically and a
mechanism needs to be evolved to grant some
sort of recognition to Pensioners Associations
who are capable of espousing their cause and
that such of the associations which are granted
recognition may be provided facilities to the
extent possible, including provision of
accommodation for housing their offices. The V
CPC in para 141.29 have further observed that
SCOVA should meet more frequently and at least
once in three months and that it should be
multi-tier institution and it should have the same
mandate for implementation of the decisions
taken as in the case of JCM including that of
reference to the Board of Arbitration wherever a
disagreement is recorded.
2. In year 2006, the major Federations of
Pensioners Associations - Bharat Pensioners
Samaj (BPS), All India Central Confederation of
Pensioners Associations (AICCPA), National
Coordination Committee of Pensioners
Associations (NCCPA), All India Central Govt
Pensioners Association (AICGPA), All India Retd
Railwaymens Federation Secunderabad
(AIRRF) and many others including several State
Coordination Committees of Pensioners
Associations met and formed a Streering
Committee for preparing a One Memorandum
on pensioners’ problems and issues to be
submitted to the VI Central Pay Commission.
Such a memorandum was in fact submitted to
VI Central Pay Commission by the said Steering
Committee and a large number of Pensioners
Associations.
3. These Federations and State Coordination
Committees of Pensioners Associations have
since constituted Bharat Central Pensioners
Confederation (BCPC) as their Apex National
Level Organization.
4. The Government should therefore consider
the above mentioned suggestions given by the
V Central Pay Commission and evolve a
mechanism to facilitate settlement and resolution
of Central Govt Pensioners’ problems &
grievances and accord recognition to this
Confederation as the Apex National Organization
of Pensioners Associations viz BCPC and its
constituents like BPS, AICCPA, NCCPA, AIRRF,
NFRP, etc and State level Committees of
Pensioners Associations and also strengthen the
SCOVA to function as an effective Grievance
Procedure for them.
2. WITHDRAW NEW PENSION SCHEME ASALSO THE PFRDA BILL FROM THEPARLIAMENT

1. Pension @ 50% of last pay drawn (LPD)
has been recognized as a statutory and a
Fundamental Right to Property by the Supreme
Court of India. The steps taken by introducing a
New Pension Scheme requiring employees to
contribute to a Fund and to earn a pension
through investment in equities with no guarantee
for statutory pension @ 50% of LPD is an illegal
move which is ultravires to the Fundamental
Right to Property as enshrined in the Constitution.
It has rendered this social security in old age
contingent upon market forces which may be
ending in negation of a secured statutory
pension.
2. The pensioners are totally opposed to these
measures. There is hardly any justification for
introduction of New Pension Scheme. Its
compulsory implementation in respect of a
section of Government employees who entered
service on or after 1.1.2004 was not only not
warranted, it was illegal too.
3. It is therefore demanded that the New
Pension Scheme and the PFRDA Bill may be
withdrawn.
3. FULL PARITY TO ALL PRE 2006PENSIONERS
1. The concept of parity i.e. equalization of
pension means that past pensioners should get
the same amount of pension which their
counterparts retiring on or after revision of pay
scales from the same post will get irrespective
of the date of their retirement. The V CPC in para
137.13 of their Report observed that while it is
desirable to grant complete parity in pension to
all past pensioners irrespective of the date of their
retirement, this may not be feasible straightaway
as the financial implications would be
considerable. The process of bridging the gap
in pension of past pensioners had already been
set in motion by the IV CPC when past
pensioners were granted additional relief in
addition to consolidation of their pension. This
process of attainment of reasonable parity needs
to be continued so as to achieve complete parity
over a period of time.
2. In para 137.14 of their Report, as a follow-
up of the basic objective of parity, the V CPC
recommended that the pension of all the pre
1986 retirees may be updated by notional fixation
of their pay and pension as on 1.1.86 by adopting
the same formulae as for serving employees
from time to time and their determining the actual
pension as on 1.1.96 to be consolidated by
allowing the same fitment weightage as given to
serving employees.
3. The Sixth Central Pay Commission,
however, did not recommend that pension of pre-
1996 may be updated by notional fixation of their
pay as on 1.1.96 (One CPC below) by adopting
the same formula as for serving employees.
Though it was stated by them in para 5.1.47 of
their Report that it will be necessary to allow the
same fitment benefit as is being recommended
for existing Government employees; in fact, it
recommended fitment benefit equal to 40% of
the pension which has less than 50% of Grade
Pay (@ 40% of maximum of pre-revised pay
scale). The modified parity between present and
future retirees recommended by VI CPC was
denied by the Government when instead of
minimum of pay in the Pay Band corresponding
to the pre-revised pay scale from which the
pensioner had retired, the minimum pay of the
Pay Band corresponding to the minimum of the
lowest pay scale of that Pay Band was taken
into account to determine the amount of modified
Pariy.
4. The Hon’ble Supreme Court in their
judgment dated 9.9.2008 (Union of India Vs SPS
Vains (Retd) CA No.5566/2008) have held that
it would be arbitrary to allow officers who retired
prior to 1.1.96 to get less pension than the other
set of officers belonging to same rank / cadre
who retired after 1.1.96 and get higher amount
of pension since they would be entitled to the
benefit of revision of pay scale on / after 1.1.96
since it offends the provisions of Article 14 of the

Constitution. The Apex Court had directed that
the pay of all pensioners in the rank of Major
General and its equivalent in two other wings of
Defence Services be notionally fixed at the rate
given to similar officers of the same rank after
introduction of new pay scales w.e.f. 1.1.96 &
thereafter to compute their pension on such
basis.
5. Since this judgment is in, we demand that
the pay of all past pensioners (pre-1.1.2006
retirees) may first be fixed notionally as on 1.1.96
and 1.1.2006 as in the case of serving
employees, on the basis of the notional pay thus
fixed as on 1.1.2006. Thus, their pension may
be so determined as to ensure that they get same
pension as is granted to an employee retiring
from the same post on or after 1.1.2006.
4. MEDICAL FACILITIES FOR PENSIONERS
1. The V CPC in para 114.12 of their Report
had recommended that the CGHS facility should
not only continue but be expanded. It had also
suggested that all Authorized Medical Attendents
(AMAs)under CS (MA) Rules, may be pooled
together at stations where there is no CGHS
dispensary to provide CGHS like facilities for
limited hours of the day.
2. The VI Central Pay Commission, in para
4.11.3 of their report, have also recommended
for retaining the existing scheme of CGHS while
simultaneously providing optional facilities (IPD)
through Medical Insurance. The VI CPC did not
favour extending CS (MA) Rules to the
Pensioners on cost and administrative grounds.
The Commission recommended that insurance
scheme to be devised by the Government should
include OPD treatment as well and in the
interregnum Government should consider
enhancing the amount of Medical Allowance for
pensioners living in Non-CGHS areas.
3. The Government, it is understood, is
processing the scheme of medical insurance
which will be optional for existing employees and
pensioners but compulsory for future employees
and pensioners. We are of the view that, if at all
introduced, the medical insurance scheme
should be optional as an alternative to CGHS
for all employees and pensioners existing as well
as future. The CGHS should be expanded to
cover all state Capitals and wherever CGHS is
not there, the AMAs may be pooled to act as
Central Health Agency to provide CGHS facilities
to pensioners as well till such time that CGHS
Dispensaries are opened.
4. In our considered view, the extention of CS
(MA) Rules to the pensioners would be more
economical option than the medical Insurance
even for purpose of IPD treatment. The
Government should examine this before deciding
to introduce Medical Insurance Scheme.
5. Since only consultation for OPD treatment
has been provided for in the proposed Medical
Insurance Scheme, the Fixed Medical Allowance
of Rs. 300/- pm sanctioned by the Government
is totally insufficient.
6. Taking into account the huge hike in
medicine prices, and a trend of further rise in
their price, it is demanded that Rs.1200/- pm may
be granted as Fixed Medical Allowance at par
with EPFO pensioners with a provision for
Dearness Relief thereon on the lines it has been
provided for in respect of Transport Allowance
to the serving employees.
7. We also demand that P&T Dispensaries
may be merged with CGHS Dispensaries or may
be allowed to function as CGHS Agency and
provide all CGHS facilities. All P&T pensioners
may be made eligible for CGHS facilities by
enrolling them as CGHS beneficiaries at the
nearest dispensary chosen by them.
5. IMPLEMENT ALL 6TH CPCRECOMMENDATIONS W.E.F 1.1.2006
1. The revision of Pay and Dearness
Allowance on the basis of recommendations of
VI CPC has been implemented with effect from.
1.1.2006. The revision of all allowances,
introduction of MACP etc. has been done only

with effect from 1.9.2008 i.e. after a long lapse
of 32 months. There is hardly any justification
for such delayed implementation of
recommendations of 6lh CPC i.e. regarding
allowances and MACP etc.
2. Several anomalies have crept in on account
of continuance of old rates of allowances based
upon the pre-revised pay etc. Many employees
who did not get any benefit under ACP but had
retired during the period between 1.1.2006 and
31.8.2008 did not get the 3rd MACP as it was
introduced only with effect from 1.9.2008.
3. It is therefore demanded that all
recommendations of VI CPC may be
implemented with effect from 1.1.2006.
6. FULL REVISED EXGRATIA PAYMENTTO SRPF / CPF RETIREES
1. Widows of employees who had opted for
SRPF / CPF benefit were granted exgratia
payment @ Rs. l 50/- pm with DR thereon as
recopmmended by IV CPC. This was updated
to Rs. 605/- pm, by the Govt, applying the same
formula as applicable to pensioners after
1.1.1996.
2. Exgratia payment @ Rs.600/- pm was
granted to SRPF / CPF retirees with effect from
1.1.96 by the Government of India as
recommended by V CPC. The Railways had
revised the exgratia payment at the rate of
Rs.650/- for Gr. D and Rs,750/- for Gr. C with
effect from 1.11.2006 in respect of SRPF
retirees.
3. Unfortunately, perhaps due to paucity of time
at their disposal, the VI CPC has not
recommended any revision in exgratia payment
to SRPF / CPF retirees.
4. These retirees are therefore getting the
above rates of exgratia payment with DR thereon
at rates applicable to the pre-revised set-up.
5. It is therefore demanded that CPF retirees
may also be granted the enhanced rates of
Rs.650/- pm and Rs.750/- pm + DR thereon.
6. It is also demanded that the above rates of
exgratia payment may be updated by multiplying
it by 1.86 and then adding 40% of pre-revised
exgratia thereon. In other words, the existing pre-
revised rates of exgratia payment may be revised
by multiplying it with a factor of 2.26 and DR as
admissible thereon as per pre-revised rates may
be granted.
7. INTRODUCTION OF HEALTHINSURANCE FOR CG EMPLOYEES ANDEX-EMPLOYEES PROPOSAL UNDERCONSIDERATION IN THE GOVTREGARDING
1. It is not disputed that in any healthcare
delivery system the OPD is the initial point of
contact, it is only here the doctor examines the
patient and decides the course of treatment. In
emergent cases it is the OPD reception centre
of the emergency section of any health delivery
system that the patient is examined.
2. It is here the Doctor decides to prescribe
the needed medicines, administers some of them
to give immediate relief to the patient. In some
cases the Doctor feels the need for more
observations or have particular tests performed
to decide the course of treatment. Hence in such
cases he may suggest admission as an inpatient
for further treatment.
3. These cannot be disputed. These are facts
and procedures outlined by the Health Delivery
System agencies all over the World. It is also
the same in our country.
4. The CGHS was designed on similar lines
and has stood the test of time. The bulk of the
CG employees and ex-employees have seen and
experienced the user-friendly OPD attention
since 1954-55. Earlier this OPD function was
performed by Authorised Medical Attendants
under CS(MA) 1944 Rules all over the country.
Here the AMA is paid as per the consultation fee
fixed and the medicines in the prescription were
obtained from the open market chemists and
druggists. Where inpatient attention was

necessary, the CG patient attends the approved
hospital for further attention. The AMA
consultation fees and medicines purchased are
reimbursed by the Deptt where the CG employee
patient serves. So also the hospital stoppages
are reimbursed to the employee. In respect of
hospital stoppages if the hospital provides an
estimate in advance the Dept. provides some
advance payment to the Hospital. In the CGHS
the CGHS card guarantees the cashless indoor
attention and ultimate payment. The Hospital
stoppages are directly obtained from the Dept./
CGHS Additional Director for pensioner
beneficiaries.
5. The CPC V gave a suggestion which the
Govt. have had no time to examine and come to
conclusions, even on an experimental basis, in
a selected state areas. In places where a CGHS
Wellness Centre cannot be opened due to low
number of beneficiaries being far below the
norms, the CPC V suggested redesignation of
the AMA in that locality as the CGHS doctor, with
medicines being obtained from an authorised
chemist(s). The approved panel hospitals/
diagnostic centres for CG (MA) and CGHS
beneficiaries can be utilised for treatment on the
recommendations of the designated AMA
doctor(s). As and when the beneficiaries increase
a CGHS Wellness Centre can be budgeted and
opened after approval by competent authority.
6. This involves no additional infrastructure
expenses and is affordable.
7. The Govt. seems to favour a market-driven
Health Insurance provider to take over the
healthcare needs of the CG employees and ex
employees in non CGHS areas. For one thing
current private agencies providing health
insurance mode are averse to taking OPD
treatment and expenses as as part of health
insurance scheme. Of late a few have, to grab
the contract, inclined to agree for OPD with or
without a cap. But world over the OPD is outside
the preview of the Health Insurance Providers
scheme. Further the experience world over is
that the insurance mode is a costlier mode and
net affordable to the bulk of the low paid CG
employees. The bulk of the CG employees in
this bracket is about 98% including the
supervising cadres. In terms of percentage to
total of Group A and promotees from below form
hardly 2%. Hence, for the bulk beneficiaries, the
insurance mode as it is available in the Indian
market is not affordable. Let us not forget
CS(MA) Rules 44 is a reimbursable scheme, that
is, free treatment for the employees and their
dependants. CGHS is a replacement with a token
payment on the lines of ESIC provisions. Hence
this cannot be compared to a scheme where the
contribution is based on estimated expenditure
for treatment.
8. The scenario in the USA is also far from
satisfactory. We are extracting the ILO published
clip for your honour’s ready reference. We quote.
“USA - Health Coverage status: With the
exception of Medicare, Medical aid, the
Children’s Health Insurance Programme and the
Veterans Health Administration, . health
insurance in the USA is provided on a for profit
basis by private insurance companies and is
generally linked to a person’s employment (60%
of total number insured). Necessarily, many
people are excluded. A recent USA Census
Bureau report stated that 45.7 million Americans
are uninsured. While an even greater number
lack sufficient insurance cover the medical costs
they might incur according the American Journal
of Medicine. Medical debt is the principal cause
of personal bankruptcy in the USA. Meanwhile
the Institute of Medicine of the National Academy
of Sciences have stated that the USA is the only
wealthy industrialised nation that does not ensure
that all citizens have health care coverage, and
estimates that 18,000 deaths per year can be
attributed to the lack of insurance. A study
published in the American Journal of public
Health put the number of deaths per year at
44800. The ongoing congressional debate on
health care reform has produced on health care

as a basic right issue of access, fairness - especially
with regard to existing insurance practices and
affordability”. unquote. - [Extracted from ILO World

9. Thus we find the richest industrialised
country, a trend setter for other nations, is still to
cover all citizens with an affordable health
delivery system. In fact this ‘high cost’ by the
private insurance health providers is beyond the
capacity of the common US citizen and the
country has been witnessing avoidable deaths.
10. We presume the experience in less Wealthy
industrialised European Union countries is no
different. We have had no access to their
statistics.
11. Health Insurance mode is not the only
universal healthcare format and hence has
necessarily to be adopted. Each country has to
examine analyse the existing format even though
pluralistic or fragmented and adopt a format
affordable and user friendly to the user groups.
In our country our courts have interpreted Art 21
Right to Life of our Constitution as inclusive of
healthcare provision.
12. It is a fact that the CGHS, as sectoral health
delivery scheme for the CG fraternity, has stood
the test of time. It is affordable. It is user-friendly.
The per card expenditure is in the range of Rs.
5,000/- and hence affordable. It has become a
role model for the other sectors like Railways
(RELHS 97) and Defence Forces retirees (ECHS
2000), Port Trusts (autonomous bodies under
the Deptt of Shipping), RBI and Banking Industry
etc. Even in the Health delivery systems
managed by private agencies, they have
advertised in the media their readiness to treat
on CGHS tariffs even without reference from
CGHS. Many health delivery agencies proudly
proclaim that their hospitals are on the approved
panel of CGHS. The judiciary have ordered
payment on CGHS tariff while adjudicating
disputes in medical reimbursement issues.
13. In case the Govt. is not inclined to continue
the CGHS as a department under the DGHS,
they can corporatise the system on the lines of
the Institute of Health & Family Welfare or the
ESIC or like ECHS (Def) or with an lAS officer
as CMD reporting of HM or Secy, Ministry of
Health & FW or Secy. Dept. of Health.
14. In the circumstances kindly review the
proposal to introduce health insurance utilising
the existing private health insurance providers
keeping in view that their main aim is profit and
re-examine indepth the feasibility of utilising the
AMAs of CSMA Rules 44 as CGHS OPD
consultants to begin with for pensioners - now
without any health care - after collecting CGHS
subscriptions. After gaining experience, non-
CGHS areas can be covered in the same way in
the 2nd phase. Thus, in course of time, the
CGHS will be the main healthcare provider for
CG employees and ex-employees all over the
country. The States will follow suit as usual.
15. The next alternative will be to corporatise the
CGHS with internal automony like EPFO, CSIR,
ESIC, ECHS, BSNL, MTNL, Port Trust etc.

Minister in his chamber at Parliament House on
25,11.2011 at 12 noon and submitted the
memorandum demanding Scrap PFRDA Bill.
Another memorandum on pensioners’
demands was also submitted to the Prime Minister.
The representatives raised the following issues
i) When such New Pension (Contributory)
Scheme have failed in countries like USA, Chile,
Britain etc where the pension wealth generated
through contributions from workers have
vanished with no pension for them or has given
a meager return why PFRDA Bill envisaging New
Pension Schemes is being pushed for enactment
ii) Why have Government not accepted
and incorporated even the unanimous
recommendation of the Standing Committee for
Finance Ministry for a defined benefit scheme
but have introduced defined contribution scheme
through PFRDA Bill.
iii) Why FDI to the extent of 26% is being
introduced through an executive order.
iv) When the New Pension Scheme is a
voluntary Scheme and is meant for these who
do not have any social Security (Pension)
scheme, why have Government imposed it on
Government employees compulsorily who were
already having statutory Pension which has been
recognized as a constitutional right to Property
by the Supreme Court.
The Prime Minister justified this scheme as
he felt that long time investment of the
contributions in equity market would yield more
pension than what is now admissible under the
Rules. The representatives there asked that, if it
were so, why have Government not provided for
a defined (assured) pension and have provided
defined contribution scheme.
In the end the Prime Minister told that his
Government is not against employees and their
interests and their memorandum and concerns
expressed would be addressed. He also assured
that Pensioners demands would also be looked into.
The Rally was addressed by the
representatives and Members of Parliament on
return after meeting the Prime Minister informed
the gathering about the discussions held. All
exhorted the employees to continue to resist this
bill through a sustained struggle till it is scrapped.
Steering Committee declared that on the day
following the day the PFRDA Bill is taken up for
enactment, employees all over the country
should walkout from their offices and
demonstrate for 2 hours to register their protest.
The Steering Committee will meet again on
20.12.2011 to review the situation and decide
follow-up programmes of actions.

Fiercely independent, fearless and

NEW DELHI: Dev Anand was the ultimate style
icon. India’s first superstar who cast a spell on
multiple generations. The first angry young man of
Indian cinema.
Fiercely independent, fearless and
individualistic, it was no surprise that he was the
first one from the industry to come out against the
Emergency. He also stood by his friend Kishore
Kumar when his songs were banned on All India
Radio. I met him at least a dozen times and
interviewed him on four occasions. He rarely lived
in the past, but always looked to the future. The
lesson he has left is that we should learn to
celebrate life.
A great fan of his, I can’t recall any other star’s
films commanding near the same black market
price for a first-day-first-show ticket. While in school,
some of us bunked class to see ‘Johnny Mera
Naam’ and each one of us later got a blue blazer
just like his.
Till the late 1980s, Dev saab had a huge fan
following. I had invited him to the Press Club of
India for a meet-the-press just before ‘Sache Ka
Bol Bala’ was to be released. I doubt any other
actor had received the kind of coverage he got on
the front pages of every newspaper that came out
from Delhi.
At Dainik Hindustan, the story goes that the
report, was slated for page three, but the night
foreman ran it on the front page telling his
colleagues he was prepared to face the
consequences as “Dev Anand has to be on page
one”.
Dev Anand would rarely get nostalgic, but the
trick was to get him to talk about the Government
College, Lahore. I had to mention the institution
and he would start unwinding.
He rarely talked about his leading ladies, but
would turn philosophical when the conversation
shifted to ‘Suraiya and Madhubala. He was also
aware that many of his critics would accuse him of
imitating Gregory Peck and Gary Grant, something
he never agreed to.
Dev Anand had enormous affection for SD
Burman and Sahir Ludhianvi was his favourite poet.
The ultimate love song according to him was Abhi
naa jao chhod ke, ke dill abhi bhara nahin from
‘Hum Dono’. He rated Mohammad Rafi as the best
singer though he thought that Kishore Kumar
captured his flamboyance better in certain
situations.
He once disclosed that Jaidev, then assistant
to Burman, composed ‘Jayen to Jayen Kahan’ from
Taxi Driver’ for which Burman got his first Filmfare
award. Jaidev later gave the score for ‘Hum Dono’.
I once asked him how he remained so energetic,
Dev saab smiled and said his mother had always
encouraged him to have Chavanprash.
Suffering from migraines, Dev saab would say,
“Once I sense it coming, I catch the first flight to
London to see my doctor.”
Dev Anand was perhaps destined to pass on
in London. He has gone without any controversy,
keeping his integrity and image intact. We should

Through the decades
Bharat Pensioners Samaj (BPS)established in 1955, headquartered at New
Delhi, is an all India Federation of Pensioners’
Associations. It was founded, along with some
others, by Justice (Retd.) Shankar Saran of
Allahabad High Court in 1955. It functions as a
nodal point for pensioners supported by central
and state governments and quasi-governmental
organizations. It highlights the difficulties faced
by Pensioners and other Senior Citizens at
various forums and strives to resolve the
grievances of its members by negotiating with
appropriate authorities..
As part of its mandate and role, BPS
publishes a monthly Journal (BHARAT
PENSIONER), “Pensioners Hand book”whenever Pension & related rules are amended
or changed, organizes National level
Conventions, periodic seminars and conferences
to focus on the problems of Pensioners and other
elderly citizens, participates in social events.
Organizes Annual General Meetings of its
affiliates and provides support to members. It
also rewards affiliated Associations for their work.
The BPS helps the really needy pensioners
through a Benevolent Fund created with
contributions from its well-to-do pensioner
members
All pensioners and their Associations are
eligible to become members of this organization.
At present 500 associations are affiliated to it.
BPS has been the Member of SCOVA right from
its inception in July, 1986. It has also been
nominated as a member of Advisory Committee
for Govt. of India Web based ‘PensionersPortal’.
BPS has been continuously struggling for the
expansion and upgradation of SCOVA to a
multitier institution having the same machinery
for implementation of the decisions taken as in
the case of JCM. BPS has also been arguing for
the provision of time frame, punitive clause &
multitier monitoring of online grievance redress
mechanism.
Bharat Pensioners Samaj is the only Indian
pensioners organization, which finds mention in
a UNFPA publication “SITUATION ANDVOICES / THE OLDER POOR ANDEXCLUDED IN SOUTH AFRICA AND INDIA”Issue No. 2 of 2002. P. 108.
Not only its functioning has been a matter of
interest to Sociologists, Social scientists &
Anthropologists and finds a reasonable space
in their books & papers but also finds references
in Lok Sabha & Rajya Sabha debates records a
number of times. As per GOI records, on 16th
August 1968 BPS had an audience with the
Prime Minister to represent the problems of
Pensioners and requested for constitution of a
statutory body for resolving pensioners’
grievances in consultation with pensioners’
representatives.

BPS has been a pioneer in forging the unity
of Pensioners and has been tirelessly working
to bring the entire community under one
umbrella.
The idea of forming a National Council of
Pensioners was conceived to involve the entire

pensioners community in great task of welding it
into one integrated whole under one umbrella
fully representing by all classes and grades of
pensioners in the country. This was in response
to demand voiced at an earlier All India Pensioners
Convention held under the aegis of Bharat
Pensioners Samaj at Delhi in the year 1973.
In the last week of May 1979 BPS organized
‘National Convention of Pensioners’ including
Elderly at Delhi to constitute “National council of
pensioners”. 100 delegates from all over the country
participated in the convention the members
intended to draw up a plan of action that will make
govt. pay heed to their problems. “Compulsionsof present day life in a highly competitiveSociety, forced pensioners & the Elderly tomeet at one place and think of their futurewelfare as aged persons” reported, “HindustanTimes” Delhi edition on 28th May 1979.
The National Council of Pensioners, in no
way intended to replace the Bharat Pensioners
Samaj, instead National Council of Pensioners
was known as supreme body of the Bharat
Pensioner Samaj. It laid down the broad policies
of Bharat Pensioner Samaj. It also elected the
executives of Samaj for implementation of the
policies & programmes of National council of
Pensioners. The National Council of Pensioners
comprised about 500 members representing all
Districts (358). Two representatives from each
departmental organizations like Railways,
Defence, P&T, Class-l officers Association etc.
Representatives of specialized skills like Doctors,
Engineers, Judges, Lawyers, Account officer,
Auditors etc were also included in National
Council of Pensioners.
In October, 1995, when 5th CPC was already
in session, BPS and AICCPA convened the
National Pensioners Convention to present a
unified Charter of demands to the 5th CPC.
Again, after the implementation of 5th CPC,
another National Convention of Pensioners was
held in Constitution Club, New Delhi. Com. I.J.
Gupta, former Home Minister who was mainly
instrumental in getting 20% fitment formula
revised to 40%, was the Chief Guest.
In 2005, BPS took the initiative to organize
the Pensioners on All India basis to oppose the
move for disbanding Central Government Health
Scheme (CGHS) An idea ! mooted by the Deputy
Chairman, Planning Commission Dr. Montek
Singh Ahluwalia, on the ground that CGHS is
both inefficient & corrupt. Whereas doubtlessly,
‘CGHS’ is the most beneficial and necessary for
the Pensioners. BPS, undertook tours to almost
all the major cities/locations in the country,
consequently the above move was thwarted. The
Government agreed to make the CGHS efficient
by introducing Computerization and providing
Grievance Committees at Dispensary (Wellness
Centre) and additional Director levels.
In the year 2006, BPS in co-ordination with
AICCPA & others could constitute, “PensionersOne Memorandum Steering Committee” for
submission of a common memorandum to 6th
CPC. This was subsequently; with the consensus
of AICCPA, NCCPA, AIRRF & others
constituents of ‘One Memorandum SteeringCommittee’ converted in to BCPC on 28th April
2008. BCPC (Bharat Central Pensioners
Confederation), is in no way a replacement of
BPS. Instead, the BCPC was constituted to be
an All India Supreme Body (confederation) from
a single platform for the welfare and redressal
of the grievances of Pensioners
On 4th April 2008, in the National Summit of
All India and State level Sr. Citizen Federations
at Hyderabad. ‘BHARAT PENSIONERSSAMAJ’ gave the clarion call to consolidate
“Elderly Vote Bank” as a viable tool to make
Government heed, to the problems of the Elderly
in the country. The thread has been, well picked
up and several Sr. Citizen organizations including
AISCCON are working on this project.
In recent times, Bharat Pensioners Samaj in
its capacity as a member of Advisory Committee
for web based ‘Pensioners Portal’, has been

no. 1445 dt. 20.02.2011, which was
acknowledged by your letter no. nil dt.
10.03.2011, intimating that you are examining
the matter and will get back to me shortly.
Thereafter I again wrote letter no. 3203 on
21.08.2011 a photocopy of which is enclosed for
a ready reference. These letters were regarding
merger of 19 Postal Dispensaries located in 12
cities, in which Jaipur is one of them, with CGHS.
The matter in brief is this that at present in
these 12 cities, the employees and retirees of
Postal Department are getting only outdoor
medical facilities through postal dispensaries,
managed by Postal Department, as there is no
provision of indoor/specialist medical aid, since
5 decades. To overcome this difficulty, the VI
Central Pay Commission recommended in Sept.
2008, to merge these 19 postal dispensaries with
CGHS, where outdoor / indoor / specialist
medical facilities are available. Accordingly on
the initiative of DoH&FW, the D/o posts
forwarded a proposal to DoH&FW in March,
2009. Since then the proposal is under
examination in the MoH&FW, but no final orders
have been issued for merger although a period
of 32 months has passed.
The Pensioner’s Association of Rajasthan
is calling upon me again and again for immediate
merger of these Postal Dispensaries with CGHS,
so that working / retired employees of D/o posts
in 12 Cities including Jaipur, may get all types of
medical aid through CGHS and the 5 decades
old discrimination is brought to an end.
You are, therefore, again requested to very
kindly look into this already abnormally delayed
case, to see that orders of merger, lying pending
in your Ministry, for last 32 months, are issued at
the most by the end of 2011, in the interests of
pensioners, who require indoor medical aid, in
last phase of their life. With regards,

As stated earlier, BPS over the years had
been repeatedly suggesting to the Govt. of India
to provide ‘Time Frame’ with punitive clause as
well as to introduce multilevel monitoring system
for the success of CPENGRAM i.e. online
grievance redress system, under e. governance.
This suggestion of BPS has been fully accepted
& duly taken care of in Citizens Right to
Grievance Redress Bill 2011 expected to be
introduced in the Parliament in winter session. It
is a very big achievement & will go a long way to
ensure timely redressal of Pensioners’
grievances.

A meeting was held under the Chairmanship

modalities of the proposed merger of 19 P & T
Dispensaries with CGHS in 12 CGHS cities

Bhuhaneshwar, Jaipur, Lucknow and Dehradun).
2. The following attended the meeting-

3. During the discussion, it emerged that
serving employees of Department of Posts are
getting OPD as well as In-patient treatment
facility while pensioners are being provided only
OPD facility. Serving employees of Department
of Posts do not pay any contribution while
pensioners are contributing @ Rs, 60/- per
month. Pensioners’ cards are issued on an
annual basis.
4. After discussion, the following course of
action was decided:-
(i) Requirements of additional funds by
Department of Posts have to be worked
out by CGHS and conveyed to Department
of Posts.
(ii) Department of Posts will send a note
(through this Ministry) to Department of
Expenditure for enhancing their budget
provision.
(iii) As the technical posts and the existing
technical incumbents of P & T
dispensaries would be transferred to
CGHS and would be redistributed, their
seniority / promotional avenues have to
be looked into carefully from the point
of view of both CGHS & P&T staff.
(iv) The serving employees & pensioners
(P&T) will have to pay the prescribed
monthly contribution / lump sum
contribution under CGHS.
(v) MoHFW’s order dt 1.8.1996 restricting
the CGHS coverage to those P & T
pensioners who had no CGHS cards at
the time of retirement has to be reviewed.
(vi) Addl. Secretary & DG, CGHS desired
that initially the proposed merger of P&T
dispensary may be implemented in
Jammu on an experimental / pilot basis.
Under this, the existing CGHS card
holders will start getting medical facility
from the P&T dispensary in Jammu. The
decision was agreed to by the
representatives of Department of Posts.
The decision has to be implemented by
1st November, 2011. An order to this
effect has to be issued by MoHFW.
Department of Posts will intimate the
cost to be paid by this Ministry on
account of this service.
5. After 3 weeks the next meeting will be called.

Reply- As per the comments mentioned by
D/o Posts, further action in the matter is to be
taken by MoH&FW.
Para 10.11(iii) To increase no. of CGHS
dispensaries.
Reply- The representatives of MoH&FW in-
formed that the proposd merger of 19 Postal
dispensaries (with CGHS) would to some extent
resolve the issue.
(2) In this connection it is stated that as per
recommedation of 6CPC (7.6.16) dispensaries
run by D/o Posts in CGHS cities be merged with
CGHS in order to provide indoor / specialist
medical aid. As a result, on the initiative of
DoH&FW, the D/o Posts sent such a proposal
to merge 19 postal dispensaries in 12 cities - viz
Ahmedabad, Bhopal, Bhubneshwar, Dehradun,
Guwahati, Jabalpur, Jammu, Jaipur, Lucknow,
Pune, Ranchi and Shillong, to DoH&FW on
25.3.09. It remained under examination in DoH&PW
upto May 2011 (25 months), when on 04.05.2011 a
meeting was held in the chairmanship of
Shri L.C. Goyal, A.S and Director General CGHS,
which was attended to by DDG (Estt) of D/o Post.
The minutes of the metting are enclosed as
Annexure A. The D/o Posts supplied information
to DoH&FW last week of Sept. 11, as per these
minutes. (Taking nearly 4-5 months) Another
meeting between both the departments was held
on 28.10.2011.

As you are aware, that on line grievances of
pensioners are being fed through our application
CPENGRAMS available in the Pensioners’ Portal
maintained by Department of Pension &
Pensioners’ Welfare. To facilitate lodging of
grievances by pensioners’ spread all over India,
27 Pensioners’ Associations have been identified
across the country. The list of 27 Pensioners’
Association is enclosed. However, these
associations are finding it very difficult in getting
these grievances redressed and are requiring
constant follow up with the Departmental offices
at regional level. Some of the Pensioners
Associations have pointed out that timely action
is not being taken by various Ministries/
Departments/ Organisations for redressal of
grievances and same remain pending for unduly
long periods. You are, therefore, requested to
sensitize your Department towards the
grievances of pensioners so that unnecessary
delays could be avoided leading to a prompt
redressal of grievances. The regional offices and
field officers, wherever they exist, also be
requested to provide all cooperation to the
Pensioners’ Associations who are helping us in
the redressal of grievances.

Secretary (Pension, AR&PG) welcomed the
participants and initiated the discussion by apprising
them of the purpose of convening this meeting. He
apprised the participants of the action taken on the
decisions of Advisory Committee Meeting held on
19.07.10.
During the meeting the following issues were
discussed by the members of Advisory Committee.
1. The members of Advisory Committee
suggested that the components like rent for hiring
of accommodation and remuneration for Data Entry
Operator should be included in the Plan proposal
for the 12th Plan.
2. Concerned Departments/ authorities as well
as banks/ post office may be advised to provide all
co-operation to the representatives of identified
Pensioners’ Associations for redressal of pensioner
grievances.
3. List of invalid characters need to be displayed
at suitable location in Grievance Registration
Format and the limit of the character for recording
various details needs to be increased. It has also
suggested to make available the final status of the
grievance on the portal. The Department clarified
that final status is already available in the
application.
4. The grants were given to the 27 pensioners
associations during 2007-08 and 2008-09.
Secretary (Pension, AR&PG) expressed his
concern about the 10 associations who have still
not utilized the amount and have not given the
utilization certificate and other required documents.
The Audit has also adversely commented upon
these Associations. It was decided that they should
be warned in strict terms to either utilise & send us
UCs or return back the grant with interest.
After the detailed discussions the following
decisions were taken:—
1. The scheme of Pensioners Portal needs to
be continued during the 12th Plan period (2012-
17). As regards components of activities for which
Grant in Aid is given to Pensioners Associations,
provisions /or subsidy towards charges on rent of
office premises and remuneration of Data Entry
Operator should be considered. A few awareness
cum training programmes for the members /
pensioners of Pensioners Association also need
to be conducted.
2. There is need to allow the flexibility of
expenditure on individual components within the
overall sanctioned grant-in-aid.
3. Further grants should be given to only those
pensioners associations who are functional.
4. For Pensioners’ Portal, Department of
Defence and Ministry of Railways need to provide
link for viewing the status of PPO from their website.
5. To write letters to the Nodal Officers of the
Ministries/ Departments to extend necessary
cooperation to the office bearers of identified
pensioners associations in the matter of redressal
of pensioners grievances.
6. At present the redressal of grievances of
pensioners is taking unduly long time. Ministries/
Departments should fix a time line for redressal of
grievances. In this regard guidelines issued by
DARPG may be followed and may also be
displayed in the portal.
7. FAQs to be constantly monitored.
8. For Bank related grievances, DOP&PW may
examine the feasibility of directly forwarding the same
to the banks to avoid delays in grievance redressal.
9. For the Ministry of Railways, the
representative from the Ministry was asked to
provide a separate helpline for pensioners as was
available earlier.
10. It was also decided that the criteria for
selection of Pensioners Association may be made
available in the website so that more Pensioners
Associations may be encouraged to apply.

The undersigned is directed to refer to this
Department’s earlier office memoranda No.1/17/
86-P&PW(E), dt 29.08.1986, 25.01.1991 and
18.02.1993 and No. 1/28/04-P&PW(E) dt
31.03.2009 and 2.07.2010 regarding grant of family
pension to the eligible members of the family of an
employee/ pensioner reported missing and whose
whereabouts are not known.
2. As per this Department’s O.M. dt. 29.8.1986,
subject to fulfilment of certain conditions, the family
pension can be granted to the family of an employee
reported missing and whose whereabouts are not
known after a period of one year reckoned from
the date of filing the FIR with the police authorities.
Subsequently, it was clarified vide this Department’s
O.M. dt 25.1.1991, that the Department of Pension
& Pensioners’ Welfare’s O.M. dt 29.8.1986, would
be applicable in the case of missing pensioners
mutatis mutandis. It was further clarified vide this
Department’s O.M. No. 1/17/86-P&PW(E), dt
28.02.1993 that family pension to the eligible family
member of an employee reported missing, would
accrue from the date of lodging the FIR or expiry of
leave in the case of an employee who had
disappeared, whichever is later.
3. While providing that the family pension to
the family of the missing employee/ pensioner may
be sanctioned after a period of six months from
the date of registration of an FIR with the police
vide this Department’s O.M. dt 2.7.2010, it was also
made clear that the earlier instructions did not make
any distinction between the government servant
and the pensioner and cover both of them for the
purpose of grant of family pension. However,
doubts have been raised by some quarters to the
effect as to whether family pension will accrue from
the date of lodging the FIR in the case of missing
pensioners as well.
4. The matter has been considered in this
Department in consultation with Department of
Expenditure, Ministry of Finance. It is hereby
clarified that as the previous instructions did not
make any distinction between the Government
servant and the pensioner, the family pension to
the family of a missing pensioner would accrue
with effect from the date of lodging the FIR or
from the date immediately succeeding the day
till pension had been last paid to the pensioner,
whichever is later. Accordingly, arrears in past
cases would also be admissible.
5. This issues with the concurrence of
Ministry of Finance, Department of Expenditure
vide their U.O. No.263/E.V/2011, dt 12.9.2011.

Sub : Payment of Family Pension atenhanced rates to the widowed/divorced/unmarried daughters beyond 25 years of age -Clarification regarding
In terms of sub-rule (4) of Rule 75 of the Railway
Services (Pension) Rules, 1993, enhanced family
pension is payable to the eligible member of the family
as indicated in sub-rule (6) of Rule 75 of Rules ibid.
Instructions were issued vide Board’s letter No. F(E)lll/
98/PN1/4 (RBE No.44/2005) dt 16.03.2005 and letter
No. F(E)lll/2007/PN1/5 dt 18.9.2007 extending the
scope of family pension to divorced/widowed
daughters and unmarried daughters respectively
beyond 25 years of age. Para 8.2 of Board’s letter
No. F(E)lll/2008/PN1/13 dt 15.9.2008 provides for
payment of enhanced family pension under Rule
75(4)(i)(a) to the family of a Railway servant, who
dies in service, from the date following the date of
death of the Railway servant for a period of ten years,
without any upper age limit.There will be no change
in the period for payment of enhanced family pension
in case of death of a pensioner.
2. The matter regarding admissibility of
enhanced family pension to the eligible widowed/
divorced/unmarried daughters of deceased
Railway servants and pensioners beyond 25 years
of age has been under consideration in this Ministry
in consultation with the Department of Pension and
Pensioners’ Welfare (DOP&PW) and it is clarified
that such daughters beyond 25 years of age will
continue to be eligible for family pension at
enhanced rates as per the Railway Services
(Pension) Rules, 1993. In other words, the
enhanced family pension payable will be for ten
years in case of death of a railway servant while in
service and in case of death of a railway servant
after retirement, family pension at enhanced rate
will be payable for a period of seven years, or for a
period upto the date on which the retired deceased
railway servant would have attained the age of sixty
seven years had he/she survived, whichever is less.

Sub. : Fresh empanelment of private hospitaland revision of package rates applicableunder CGHS, Delhi
The undersigned is directed to state that CGHS
has initiated action for fresh empanelment of private
hospitals under CGHS, Delhi (Which covers area in
Delhi, Faridabad, Gurgaon, Ghaziabad and Noida)
and also for the revision of package rates (which
were fixed in 2006), to be paid to hospitals, by floating
tender for the same. On the basis of the responses
received rates for various procedures / treatment
have been arrived at and have been uploaded in
the website of CGHS. www.mohfw.nic.in/cghsnew/
index.asp and can be downloaded.
2. In order that CGHS beneficiaries get
treatment from well maintained and run hospitals,
it has been decided to have differential rates of
reimbursements, as per details given in the
enclosed rates list. The principle followed for the
differential package rates begin.
(i) where L-1 rates were arrived at on the basis
of rates quoted by non-NABH accredited hospitals /
super-speciality hospitals, NABH accredited
hospitals will be entitled to reimbursement of certain
percentage of additional amount over and above
the L-1 rates.
(ii) where L-1 rates were arrived at on the
basis of rates quoted by NABH accredited hospitals,
then non-NABH accredited hospitals would be
entitled to an amount lower by certain percentage
than the reimbursement made to NABH accredited
hospitals at L-1 rates; and
(iii) Rates for super-speciality hospitals have
been identified separately and notified in the rate list
put on the website of the CGHS. Super-speciality
hospitals covered under this category are;
a. Cardiology and Cardio-thoracic surgery
b. Joint Replacement surgery made under
orthopaedics
c. Nephrology and Urology including renal
transplantation,
d. Endocrinology;
e. Neurosurgery;
f. Gastro-enterology and Gl surgery; and
g. Oncology
8.3 The hospitals shall extend credit facility
to the above categories of CGHS beneficiaries
under emergency / with prior permission
irrespective of the CGHS city where they are
registered and send the bill to additional Director,
CGHS (Hqrs) Delhi.
8.5 In case of emergencies empaneled
hospitals shall not refuse admission nor demand
payment from CGHGS beneficiaries on
production of valid CGHS card, issued by
competent authority of any CGHS city.
9. During in-patient treatment of the CGHS
beneficiary, the hospital will not ask the
beneficiary of his / her attendant to purchase
separately the medicines / sundries / equipment
or accessories from outside and will provide the
treatment within the package rate, fixed by the
CGHS which includes the cost of all the items.
13. The office Memorandum supercedes all
earlier instructions relating to empanelment of
hospitals for specialised and general purpose
treatment and investigations for Delhi, Faridabad,
Ghaziabad, Gurgaon and NOIDA areas.
14. This issue with the concurrence of

15. The revised rates will come into effect
from 1st September 2010.

BSNL Pensioners / Arrears of PensionAnd Income - Tax for the Financial Year2011-12 (i.e. Assessment Year 2012-13)
The employees, who retired from BSNL, during
the period 1-10-2000 to 31-12-2006, have been
extended the benefit of “II Pay Revision” and the
same is made applicable with retrospective effect
from 1-1-2007. As a result of this the basic pension
an on 1-1-2007 is revised as under :
(1) Basic Pension x 2.1944 =
Revised Consolidated Pension.
(2) (+) Dearness Relief @ zero% on 1-1-2007.
(3) The Dearness Relief rates have been
increased quarterly thereafter and the rate applicable
w.e.f. 1-10-2011 is 52% on revised pension.
As a result of this revision the Basic Pension of
BSNL pensioner and family pensioner has been
increased and the amount of arrears exceeding
Rs. One Lakh has been paid to them. This isdefinitely good news, but on account of this, these
pensioners in some cases will be liable to pay
Income-Tax for the financial year 2011-12.
The arrears on account of increased pension are
spread over in 6 years, namely, 2006-07, 2007-08,
2008-09, 2009-2010, 2010-11 and 2011-12 whereas
the total amount has been paid in the year 2011-12.
Broadly, the income of a pensioner is from two
sources i.e. (1) Pension received during the year
and (2) The amount of interest received from all
sources. This year there is addition of (3) Arrears
of pension received. If all these 3 sources are put
together, the total income may exceed the ‘NO TAX’
limit applicable to Senior Citizen Pensioners. From1-4-2011 all the pensioners retiring at the ageof 60 years become ‘Senior Citizen’ and areeligible to NO TAX limit of Rs. 2,50,000/-.
Let us assume, the income of a pensioner from
all the sources, for the financial year 2011-12 reach
Rs. 3,70,000/-, then the position will be as under :
Income Rs. 3,70,000/-
NoTax Limit Rs. 2,50,000/-
Taxable Income Rs. 1,20,000/-The income tax payable will be @ 10% on
Rs. 1,20,000/- i.e. Rs. 12,000/-.
This income - tax can be saved if the pensioner invests-
(1) upto Rs. 1,00,000/- in various schemes such
as PPF, NSC, SSS, 5 years Fixed Deposit in Bank
etc, as admissible under section 80-C of the
Income Tax Act and
(2) additional Rs. 20,000/- in some infrastructure Bonds
If the income is less than Rs. 3,70,000/- but
more than Rs. 2,50,000/-, the investment to the
extent of amount in excess of Rs. 2,50,000/- will
meet the requirement of saving tax.
Since the arrears received are for 5 to 6years, section 89 of the Income Tax Actprovides for appropriating the amount ofarrears of a particular year, to the relevant year.This facility can be availed by doing thefollowing exercise.
1) To allocate the total amount of arrears (arose
on account of increase is pension) in 6 years.
2) To specify the correct income and investment
of the relevant year.
3) If the Income Tax returns for the relevant
year have been filed, revised returns cannot be
compiled and submitted.
4) If, perchance, in one or more of these years
income tax was due and not paid, the same will
have to be paid now, with penalty.
5) The detailed calculations need full
information about the Income-Tax slabs, the
Income Tax rates and the provisions of rules,
applicable to the relevant year. The pensioner may
require the help of qualified Chartered Accountant,
to know and claim refund if any.
However the calculations of income-tax fora persons depends on his income, investmentetc. Hence one specific formula cannot begiven. This article is presented as a guideline.
The Income-Tax Slabs and the rates applicable, for
the income for the financial year 2011-12 are as under.
For Sr. Citizen PensionersTaxable Income Income Taxup to Rs. 2,50,000/- NIL
Rs. 2,50,000 to Rs. 5,00,000 10%
Rs. 5,00,000 to Rs. 8,00,000 20%
More than Rs. 8,00,000 30%
For those who have attained 80 years of
age the income Tax upto Rs. 5,00,000/- is NIL
and Rs. 5,00,000/- to Rs, 8,00,000/- it is 20%.

AHMEDABAD: BSNL & DOT Pensioners’Assn – Silver Jubilee Get-to-Gather was held
on 08.11.11. More than 300 pensioners attended
the function. Smt Darshana Momaya Dabral,
CCA, Gujarat was the Chief Guest. Shri A N Patel
made an announcement that BDPA had been
awarded a Trophy and Cash Award/Certificate
by the BPS, New Delhi in recognition of
outstanding contribution as the Best Affiliate of
BPS. Shri D D Mistry was honoured by the BDPA
and his services were appreciated by the
speakers. He thanked the BPS, New Delhi for
conferring the honour on BDPA at national level.
A seminar on Knee/Joint pains and related
surgery with a slide show was organized by
Aditya Orthopedic Hospital, Ahmedabad.
DANAPUR: E R P Brotherhood – In the meeting
held on 13.11.11, minutes of the previous
meeting and Accts were read out and confirmed.
Members were briefed about the preparations
for the AGM to be held on 23.12.11.
GUWAHATI: N F R P A (Rest Camp, Pandu) –With profound grief, we record the sad demise
on 23.10.11 of our respected Duttada, an Ex-
N F R employee and Treasurer of NFRPA at the
age of 90. Born in a remote village of the then
East Pakistan (now Bangladesh) on 01.11.21,
he joined Railways in Coochbehar in 1942 and
retired as Chief Coaching Clerk on 31.10.79. He
was closely associated with NFRPA from 1983
till his death as a Treasurer. The NFRPA
condoled his death and the Associations’ Flag
was flown half mast for 3 days in his honour. He
was also associated with the religious, socio –
cultural organisations and also known for his
contribution in theatre.
NELLORE: AP Govt R E A – A meeting was
held on 15.10.11. The President informed the
gathering that D R @ 5.992% has fallen due on
01.07.11. He requested the State Govt to release
this DR. He reminded all pensioners about the
submission of life certificate to the Pension
Disbursing Authority in November itself without
fail. He informed the members that pending HLP
case would be coming up for final hearing afterDeepavali holidays. The Secy read out names
of Sr Members to be felicitated on 17.12.11.

elected for a period of 3 years for Allur Mandal
Unit. President: D Sriramulu, Treasuer: P
Venkateswarlu. Besides this, 1 Associate
President and 3 each VP’s and Jt Secretaries
were also elected. President conveyed Birthday
Greetings to members born in October.
SHILLONG: CGPA, Meghalaya – AGM was
held on 18.06.11. Following new office bearers
were elected. President: A B Paul, VP: T K
Bhattacharjee, Secy: G C Bhattacharjee,
Treasurer: S K Biswas. Besides this, 5 Advisors,
2 Jt Secretaries, 1 Auditor and 9 EC Members
were also elected. The Secy highlighted the
activities of the Assn during the year. It was
resolved to take up with the CGHS expeditious
issue of plastic cards to all beneficiaries. The
President in his speech stressed for immediate
settlement of all long-pending demands of
pensioners.

SRI GANGANAGAR: C G P A – Meeting was
held on 06.11.11. The President apprised
members about Scova Meeting minutes. They
were informed that full parity / modified parity for
pre-2006 pensioners would be taken up for
discussion in the next meeting of the NAC.
Members were advised to apply for formal revision
of pension through their departments from where
they had retired.
VIJAYAWADA: Welfare Assn of the Telecomand BSNL Pensioners – The Open Session
was held on 13.11.11. More than 600 comrades
attended the meeting. Com. Ramankutty, Gl
Secy of AI BSNL PWA spoke about the BSNL
pensioners problems. Com. B Kondiah, Incharge
of Reception Committee made ellobarate
arrangements at Vijayawada for the stay of
comrades. The meeting ended with a vote of
thanks by Com. N S Sarma, the Local Secy.
TENALI: Rly Pensioners Welfare Assn -A meeting was held on 23.10.11. It was
attended by a large gathering of pensioners.
M Somasekhara Rao, VP, Southern Zone
of DPS also attended this meeting on a
special invitation. He was given a rousing
reception on this occasion. Rao told the
gathering that BPS has been making
persistent efforts in improving the condition
of CG Pensioners in general and Rly
Pensioners in particular. Shri Parameswara
Rao, Secy explained the services rendered
by his unit to Rly Pensioners. S Ameeruddin
and Dhananjay Rao also spoke. In the

Resolutions adopted by the 56th AnnualConference of Bharat Pensioners’ Samaj held
at New Delhi on 4th November, 2011
This Annual Conference of Bharat
Pensioners’ Samaj expresses its grave anguish
and disappointment over the continued indifferent
attitude of the Government of India towards pre
1-1-2006 pensioners & over the raw deal meted
out to them by the VI central pay commission
and thereafter in its implementation. It hardly
behooves an enlightened employer to allow the
discontent among its older pensioners to persist
and deepen further and further in the evenings
of their lives. This meeting therefore urges on
the authorities to take immediate steps to resolve
the following issues to the satisfaction of their
older pensioners.
1) Extension of following benefits to pre1-1-2006 retirees:
a) Same fitment benefit to pre 1-1-2006
pensioners as implemented for serving
employees w.e.f. 1-1-2006 i.e. basic pension
+86% DR +50% of grade pay. Since Principal
CAT Delhi in its judgement dated 01.11.2011 in
OA 655/2010 has struck down DOP & PW OMs
dated 1.9.2008, 03.09.2008 & 14.10 2008. G.O.I
should implement its commitment of being a
good litigant. And without entering into further
legal battle with helpless pensioners should
accept the above demand.
b) Full pension for 20 years of service / 10
years in superannuation cases.
c) Last pay drawn or average of last 10
months pay whichever is beneficial to the retiring
employee towards emoluments for computation
of pension.
2) Full parity upto 1-1-96: Full parity may be
brought upto 1-1-96 as recommended by the V
CPC : considering that V CPC enunciated this
principle for a laudable purpose and abandoning
it has done grave injustice to past pensioners. It
needs to be appreciated that parity is not linked
to cent per cent neutralization of price-rise as
erroneously assumed by the VI CPC and both
are different and for different purposes Correct
implementation of modified parity as on 1-1-
2006.
Correct implementation of modified parity as
on 1-1-2006 to do equal justice to all those who
retired in various pre-revised pay scales. The
manner in which modified parity has been
implemented has violated the accepted
principles and the established law. Introduction
of Pay Bands in place of pre-retired pay scales
should not act to the detriment of pre 1-1-2006
pensioners in the matter of modified parity. It is
the bounden duty of the government to fully
protect the past pensioners under the new
dispensation. This conference therefore urges
the government to take early remedial measures
Modified parity to those who retired in IV CPC
scale of Rs.1400-2300 on Indian Railways w.e.f.
1-1-96 and 1-1-2006.
“Certain categories of staff in scale Rs. 1400-
2300 mentioned in Annexure B of RBE 138/97
dated 16/10/1997 were placed in higher scale of
Rs. 1600-2660 by V PC, with corresponding
scale Rs. 5000-8000 w.e.f. 1.1.1996. This scale
Rs. 5000-8000 was in vogue till 31.12.2005 as
mentioned in V PC PPOs..
Finance Directorate of RB unilaterally
reduced this scale to Rs. 4500-7000 with PB
1+GP Rs. 2800 denying min. pension Rs. 6750
w.e.f. 1.1.2006, citing DOP & PW instructions.
DOP &PW is nodal agency for pension matters
and not for pay scales.
MOF(DOE) is the authority in the matter of
pay scales. RB reducing the pay scale, without
consulting and without concurrence of
MOF(DOE) is unjustified and untenable.
The arbitrary instructions of RB to the
disadvantage of pre 1996 pensioners need to
be withdrawn forthwith. “

(NFSG Rs 14300—18000 ‘Vth CPC scale’)is provided in the JUNIOR ADMINISTRATIVEGRADE (JAG)to prevent stagnation. Itconstitutes 30% of the total Functional JuniorAdministrative Grade. (5th CPC Scales S.21to 23) The designation, duties, Schedule ofPowers, (Disciplinary and Financial) andresponsibilities are the same for JAG as wellas NFSG. NFSG is not a promotional Railway.
Board’s letter RBE 135/2000 of 14-07-2000which clearly spells out that “NFSG is segmentof JAG” and that “it will not be treated as aPromotion”. But while implementing 6th CPCrecommendations the said existing Scale 24has been placed in PAY BAND 4 leaving behindJAG in PAY BAND 3. This has resulted higherpay packet to the erstwhile S 24 than JAG (S21-23) though the duties & responsibilities remainidentically the same. This is an anomaly whichneed to be suitably addressed
4) Revision of ex-gratia rates of pre 1986 CPF
& SRPF (C) beneficiaries’ w.e.f. 1-1-2006 raising
minimum exgratia to Rs.3500/- p.m. This benefit
of minimum ex-gratia /pension of Rs 3500 plus
DR be extended to EPS 95 beneficiaries also.
Granting of same percentage of relief to families
getting ex-gratia. Extension of exgratia to voluntary
retirement cases also.
5) Merger of 50% DR with basic pension w.e.f.
1-1-2011 or an alternative benefit in lieu thereof
to protect pensioners against ravaging inflation.
6) Early steps for revision of pension’s w.e.f.
1-1-2011 to ensure quinquenial revision as
revisions at long intervals have been doing grave
injustice to pensioners in the context of fast growth
rate of the economy and continuous high inflation.
7) Restoration of commuted portion of pension
after 12 years.
8) Reopening of RELHS-97 and making it
open-ended and removal of lock in period for
referral to private recognized hospitals.
9) Merger of postal dispensaries with CGHS
and opening of more CGHS dispensaries to cater
to the growing needs of pensioner at various
places. CGHS Benefit be extended to all those
retirees who were getting it while in service e.g
KVS pensioners.
10) Enhancement of FMA to Rs.1200/- p.m.
Extension of this benefit to CPF & SRPF
beneficiaries and their families.
11) Raising of income tax exemption limit to
Rs.5,00,000/- p.a. and graded relief for higher age
groups.
12) Monitoring mechanism at various levels
for disposal of pensioners Grievances.
13) CDS canteen facilities to DefenceCivilian Pensioners (issue of Smart Cards fordrawing grocery items from CS Depots)
14) Withdrawal of new pension scheme.

passed, would be the most revolutionary
reform in public interest, this conference appeals,
that the definition of ‘complaint’ in Chapter I under
the heading Definitions 2 . (f) of the proposed
Bill may be amended to specifically include the
grievances of superannuated persons/
Pensioners as they are not Public servants.
The revised definition of “Complaint may be
amended to read:
(f) “Complaint” means a complaint filed by
a citizen including a superannuated Person/Pensioner regarding any grievance relating to
or arising out of any failure in the delivery of goods
or rendering of service pursuant to the Citizens
Charter, or in the functioning of a public authority,
or any violation of any law, policy, programme,
order or scheme but does not include grievance
relating to the service matters of a public servant.
11C) With special reference to retirees inprivate and public sector industries,
Employees Family Pension Scheme was
introduced in 1995. Under this scheme, retired
industrial workers are still getting a maximum of
Rs 1000 per month as pension. This amount has
not been revised despite several representations
since starting the scheme. Considering the plight
of senior citizens in this segment, this conference
unanimously resolves and requests the Ministry
of Finance and Ministry of Labour to look into
this specific issue and suitably revise the amount,
commensurate with present cost of living and
inflation.
12.Widows in India are victims of financial
abuse by their own relatives and are left without
any heath care, even if they belong to APL
category. Therefore, this Conference
unanimously resolves and requests the
Government of India that ALL widow seniorcitizens, irrespective of the fact whether they
belong to BPL or APL Category, must be
provided with monthly pension and subsidizedhealth care.

Initially this service will be introduced in 100 post
offices of the country. Delhi,Punjab and Tamil
nadu will be the first states to have this facility in
their post offices by the year 2014, this service
will be introduced in the 5000 post offices of the
country. This was disclosed by the telecom
Minister Kapil Sibal on 29.09.2011. This service
will be a big help to the people residing in rural
areas and who do not have any account in a Bank
or any financial Institution.

4871. Shri Kapil Muni Karwariya
will the Minister of Finance - be pleased to state:-
(a) whether the Government proposes to provide
neutralization of Dearness Allowance hundred
per cent to the pensioners of the Public Sector
Banks retired prior to November, 2002;
(b) if so, the details thereof along with the time
by which such neutralization of D.A. is likely
to be provided to such retired employees of
the said banks; and
(c) if not, the reasons therefor ?
ANSWER
The Minister of State in the Ministry of
Finance (Shri Namo Narain Meena)
(a) There is no proposal for neutralization of DearnessRelief to 100% to the pensioners of Public
Sector Banks retired prior to November, 2002.
(b) Do not arise.
(c) Pension to Bank employees are paid in terms
of the Provision of Bank Employees Pension
Regulations framed / amended based on
settlement / joint note, which do not provide
100% nuteralization of Dearness relief to
those retired prior to November, 2002.
