    Pre-Tria l Chamber I I ( the "Chamber") of the Internat ional Criminal Court(the "C ou rt") ren de rs this decision on the "Prosec ution 's urg en t notificat ion oftravel in the case of The Prosecutor v Omar Al Bashif' ( the "Prosecutor ' sNotification", or the "Notification").^

    1. O n 31 M arch 2005, the Security Cou ncil ( the "SC"), act ing un de rChapter VII of the Charter of the United Nations (the "UN"), adopted Resolution1593 (2005) referring the situ ation in Darfur to the Court.^

    2. On 4 March 2009 and 12 July 2010, Pre-Trial Chamber I (the "PTC I"),formerly seized of the present case, issued two warrants of arrest against OmarHassan Ahmad Al-Bashir ("Mr. Al-Bashir")^. These warrants of arrest remain tobe executed.

    3. On 6 March 2009 and 21 July 2010, act ing upon PTC I 's request ,^ theRegist rar prepared and t ransmit ted two requests for the arrest and surrender ofM r. Al Bashir for the pu rpo ses of the execution of the two w arr an ts of arrest .^

    4.     Congo, Darfur, Sudan and Cte d'Ivoire si tuat ions", in which i t re-assigned, interalia, the situation of Darfur, Sudan to this Chamber.^

    5. O n 10 October 2013, the Cha m ber received the Prosec utor 's Notificat ion,in which she avers, on the basis of new s reports,^ that Mr. Al-Bashir migh t t rav elto the Federal Republic of Ethiopia, to at tend the two-day extraordinary summitat the African U nion he adq uar ters in Add is Ababa, on 11 October 2013.^According to the Notification, Mr. Al-Bashir will thereafter travel to theKingdom of Saudi Arabia.^ Consequently, the Prosecutor requests the Chamberto take steps "to ensure that the arrest warrants are executed" and in part icularto (i) seek information from the relevant authorities of the Federal Republic ofEthiopia and the Kingdom of Saudi Arabia regarding said visi t ; ( i i) remind thoseauthorities of the existence of the warrants of arrest against Mr. Al Bashir; (iii)remind those authorities of SC Resolution 1593 (2005); and (iv) considerinform ing the SC of the situ ation .

    6. The Ch am be r no tes articles 86, 87(l)(a) an d (5), 89(1) an d 92 of the Ro meStatute (the "Statute").

    7. The Ch am ber high lights that only States Part ies to the Statute are un de ran obligation to cooperate with the Court . Given that the Statute is aninternational t reaty governed by the rules set out under the Vienna Conventionon the Law of Treaties, it is only with the State's consent that the Statute can

    imp ose obligations o n a non-State Party . ^ Th us, non-States Part ies ma y d ecide tocoo pera te w ith the C ou rt o n a n ad hoc basis , as foreseen in article 87(5) (a) of theStatute. This principle may be al tered by the SC which may, by means of aresolution adopted under Chapter VII of the UN Charter, create an obligation tocoopera te wi th the Court on those UN Member Sta tes which are not par t ies tothe Statute. In such a case, the obligation to cooperate s tems direct ly from the U NCharter .

    8. Acco rdingly, the Federa l Repu blic of Ethiopia as well as the Kin gdo m ofSau di Arabia, as non -States Part ies to the Statute, hav e no o bligations vis--vis theCourt arising from the Statute. In this regard, the Chamber recalls that thesituation in Darfur was referred to the Court by way of SC Resolution 1593(2005), which also recognizes that States not part ies to the Statute (apart fromSudan) have no obligation under the Statute. However, SC Resolution 1593(2005)st i l l "urge[d] al l States and concerned regional and other internationalorganizations to cooperate fully" with the Court (emphasis added).^^

    9. In this context the Ch am ber wish es to poin t ou t that the Co urt has noenforcement mechanism and thus re l ies on the Sta tes ' coopera t ion, wi thoutwhich i t cannot fulfi l i ts mandate and contribute to ending impunity.

    FOR THESE REA SON S, THE CHAM BER HEREBY

    a) or de rs the Registrar to transm it to the Federal Rep ublic of Ethiopia a ndthe Kingdom of Saudi Arabia the requests for arrest and su rrend er i ssuedby the R egistry on 6 March 2009 and 21 July 2010; or in case of urgen cy, torequest , in accordance with art icle 92 of the Statute, the provisional arrestof O m ar Al-Bashir;

    b) orders the Registrar to send Notes Verbales to the Federal Republic ofEthiopia and the Kingdom of Saudi Arabia, enquiring about said visi t ,reminding them of the SC Resolution 1593(2005) and invit ing them tocoopera te wi th the Court in the arrest and surrender of Omar HassanAh m ad A l-Bashir to the Court ;

    c) orders the Registrar to notify the present decision, to the competentauthori t ies of the Federal Republic of Ethiopia and the Kingdom of SaudiArabia ;

    d) orders the Registrar to prepare a report to be fi led with the Chamber indue course conceming said visi t ; and

    e) inv ites the comp etent auth ori t ies of the Fede ral Repu blic of Ethiopia a ndthe Kingdom of Saudi Arabia to arrest Omar Hassan Ahmad Al Bashirand surrender him to the Court , in the event he enters their terri tory.
