PRELIMINARY STATEMENT
This is an action fo pursuant to 11 use 524 and 11 USC 105
of the Banptcy e
In C:ddition, CRUZ seeks actual and punitive damages on her common law pendant state
~laîms for defamation, and a declaration from the court that no p'~rsonal liability exists on. . ., . . . ,the account, and an injunction barrng GM.A.C from continuing to' report the account
without Bankuptcy Notation.
GMAC violated the FCRA by failing to conduct a proper investigation of CRUZ'S
disputes filed with the credit reporting agency defendants. Those disputes claimed that the
CRUZ was not liable for the account as a result of a BanJUptcy Discharge. GMAC
failed to revie\.v all relevant information purportedly provided to it by such credìt
reporting agency defendants and it failed to direct such consumer reporting agencies to
update inaccurate information about CRUZ from the mes maintained by them.
In addition, GMAC willfully and maliciously defame.d CRUZ by repeatedly reporting
false Infonnation about CRUZ to various third parties which it knew, or reasonably
should have known, was false. As a result of such actions and conduct, CRUZ suffered
damage, which recovery is permitted in tbis action and CRUZ is also entitled to an award
of punitive damages.
The credit reporting agency defendant, Experian violated the FCRA by failing to follow
reasonable procedures to assure maximum possible accuracy when preparing credit
reports purportedly concerning CRUZ. Experian also violated the FCRA by repeatedly
issuing credit repoiis to various third-paiiies, purportedly pertaining to CRUZ, which
contained an enoneous tradeline entry which failed to disciosc the balance as $0.00 and
discharged in Banlcruptcy; despite having recei ved actual notice of the same.

disputed items in CRUZ'S creòit ñle maintained by them.
Experian defamed CRUZ and violated CRUZ'S privacy by repeatedly publislung to
thu'd-paries information purportedly about CRUZ which was false and which caused
CR UZ to suffer injury.
Experian provided .CRUZ'S credìt report, containing en-oneous information, to
third-paries, who then used such reports to make creditworthiness determinations about
CRUZ and, as a result, CRUZ'S credit Score was adversely affected and current credit
standing was adversely affected.,
. Expeiian willfully violated various provisions of the FCRA, as s~tiortli herein, andCRUZ is thereby entitled to an award ofpunitíve damages pursuant to the FCRA.
Experan also wilfully and maliciously defamed CRUZ by repeatedly reporting
information about CRUZ to varous tlid paries which they knew, or reasonably should
have known, was false. As a result of such actions and conduct CRUZ suffered damage
and is also entitleò to an award of punitive damages.
The forgoing actions also amount to a Conspiracy wheirein GMAC and Experian have
acted in concert to collect on a discharged debt in violation of the Discharge Injunction of
11 USC 524. Such conspiracy between Expera.'1 to GMAC allows GMAC to collect on
discharged debt and therein allows concessions to take place from GMAC in rerum to
Experian. Such concessions to not exist between GMAC and TransUnion or Equifax,
and thus why proper repOlting exists with those agencies.
CRUZ further alleges that as a direct and proxiniate result of the each of the defendants'
actions, conduct and omissions she suffered actual damage including, but not Iimited to,
damage to existing credit accounts, damage to reputation, emotional distress, annoyance,
aggravation, fi'ustration, and legal fees to secure the defendants' compliance with the
FeRA.

JURISDICTION A..ND 'VENUE
Jurisdiction is conferred On this Court pursuant to the provisions of28 USC 1334 in that
this proceeding arises from anà is related to the above captioned underlying banptcy

The claims herein arise from a common nucleus of operative facts, and are best dealt with
il1 one Court in the interests of judicial economy, faimess, convenience, and efficient
resolution. Accordingly this Coun has supplemental jurisdiction of the state law. claims
asserted herein undeJ 28 U.S.C. § J 367(a) and pendant jurisdiction over the state common
law claims asserted herein.

PlaintiffPAlvlELA JEAN CRUZ ("CRUZ") is a natural person residing in San Diego
County, California and is a Debtor under Title 11, of the United States Code,
CRUZ is a "consumer" within the meaning of the FCRA (15 U.S,c. § 1681 a(c)).
DEFENDA~T, GMAC, is a "creditor" as that ter is defined by 1 i use 101(10), listed

GMAC is a Michigan corporation duly authorized anè qualified to do business in the
State of Califonùa.
GMAC is a "furnisher of information" within the meaning of the FCRA (15 U.S.C. §
1681 s-2 et seq.)
Expeiian is an Ohio corporation, duly authorized and qualified to do business in the State
of Califomia.
Experian is a "consumer reporting agency" within the meaning of the FCRA (15 U.S.c. §
1681 a(r)).
GMAC, Experian, and DOES are all entities or indiv:duals who contributed to or
participated in, or authorized the acts or conspired 'Nith the náine"d GMAC to commit the
acts and do the things complained of which caused the injuries and damages to CRUZ as
set forth below. Each of the parties, named and fictitious, acted as principal and agent,
each of the other, and combined and concurred each 'Nith the other in committing the acts

CRUZ incurred a debt with GlVi/\C sometime prior to filing for bankniptcy protection.
CRUZ never reaffrmed the account with GMtC.

G1viAC was notified of both the commencement and discharge by two separate notices
from the Bankptcy Noticing Center out oÎHemdon, Virginia.
On or about October 15,2007, an FCRA dispute letter with copies of
BankrptcyCommencement and Discharge disputing the account was sent by certified mail to the
three credit reporting agencies of Equifax, TransUnion, and Experian as evidenced by
Exhibit "A" incorporated herein by reference.
Equifax, TransUniou, and Experiaiï acknowledged receipt of the dispute letters as
evidenced by signing for completion of delivery.
The dispute letter requested, inter aìia, that it conduct an investigation of, and update all
inaccuracies regarding the account to properly reflect the following:
1) "Curren! Balance" 0/"$0.00"
2) . "Account Status" 0/"$0.00 balance/closed accowil,"
3) "Amount Past Due" 0/"$0.00,"
4) '~FCR.A CompliancelDeLÙiqucncy Dale" as of daie of díscharge, and
5) "Payment His/.oiy Profile" must 110 longer reflecf paymelt histOiT and default
Eguifax, TransUn.ion, and Experal1 each advised GMAC of CRUZ'S dispute.Glv1.A.C faileò to conàuct a reasonable iiwestigatìon ofthe dispute and it continued tù
report to Ëquifax, TransUnion, and Experian that CRUZ remained legally obligated on
the account ror the balance due.

To date, GMi\C refuses to update the account with the Îorgoing Bankruptcy 1-iorration.
From the date of the banptcy filing on 6/29/07 to present, GWiAC continues to contact
CRUZ with biling statements and phone calls to collect on the discharged debt.
FACTS PERTAINING TO EXPERL~l\
On October 15,2007, CRUZ wrote to ExperiaD with reference to the account improperly
being reported iii the credit report, via certfied mail.
EXPERlAN acknOwledged the certified mail and dispute Jetter by sigrng for .the same on
October 23, 2007...""; ; ..,,'., I
.j.EXPERIAN became aware of the Bank-uptcy Commencement and Discharge v,iith.in" one
week of each event.
In the dispute Jetter, CRUZ identified the account and requested that Experian update the
account as follows:
1) "Current Balance It 01"$0.00"
2) "Accouii Status" oI"$O.OO balance/closed account,"
3) "..mounl Past Due" oI"$O.(JO,"
4) "FG'" Compliance/Delinquency Date" as of date oL díscharge, and
5) "Paymem Histor)1 Profile" must no longer reflect payment history and default.
To further assist Experian's investigation, CRUZ provided with the dispute Jetter, copies
of the bankuptcy discharge and list of all creditors sub.ieci to said discbarge.
On or about November 3,2007, Experian advised CR.UZ that it had investigated the
dispute and that it had verified tiie accuracy of the account, as evidenceò by Exhibit "B"
in corporated herein by reference.
Expenan has failed and refused; and continues its failure and refusal, to conduct a proper
anò reasonable investigation of the dispute and update the account the account with
Bankruptcy infoffiation.
Experìal1 has repeatedly published and disseminated such inaccurate information
regarding the erroneous aceount Í11 creåit repons prepared about CRUZ which it has
provided, and continues 1.0 provide, to third pa¡1.ies.

FIRT CAUSE OF ACTION: GMAe
VIOLATION OF 11 D.S.C. § 524 DISCHARGE INUUNCTION
CRUZ repeats, re-aJ1eges, and incorporates by reference all of the paragraphs above as
though fully stated herein.
Bankptcy Code Section 524(a)2 "operates as an injunction against the commencement
or continuation of an action, employment of a process, or an act, to collect, or recover, or
offset any sud1 debt as a personal liability of the debtor..."
Pursuant to Eskanos & Adler, P.t. v. Leetien, 309 F.3d 1210, (9th CiT. CaL. 2002),
Section 362(a) Imposes an Affinative Duty to Discontinue Collection Actions.
Pursuant to In re Perviz (2003, BC ND Ohio) 302 BR 357, § 11 USC 524(a)(2) simply
makes pennanent what had previously been temporary under § 362(a)(6).
j 1 USC 524 imposes an Affirmative Duty to Discontinue Collection Actions.
While CRUZ' Bankrptcy Case was pending, GMAC allowed her pre-petition reporting
to remain in an attempt to coerce payment of S9ü,803 .00 from CRUZ in violation of the
automatic stay provisions of 1 1 use 362.
After discharge, GJ'viAC has continued to upload false information on CR UZ' credit
report.
GÌ'v'Í.Ä.C purposeiy and intentionally uploads a "monthly trap," an "employment of a

CRUZ on her credit report in a direct and intentional effort to collect, harass, inàu:;e,
pressure, and coerce CRUZ into paying her cischarged debt to clean up her credit repon
in direct violation of 11 USC 524.
GMAC is directly attempting to collect discharged debt in exchange for an increase in
CRUZ' credit score.
GMAC refues to cease the monthly false reporting, despite the plethora ofrequests made
by CRUZ discussed above.
G:iu~..C works in conspiracy with EXPERlAN to make sure the improper credit reporting

calls \vîl result in collection of the discharged debt.
Glv'lAC intentionally, deliberately, and wí1fully violaæd 11 USC 524 and refuses to cease
violations of J 1 USC 524 by its employment of a false credit reporting process, collection
calls, and collection letters, to coerce payment of a discharged debt in the amount of
$90,803.00.
CRUZ is entitled to Ci vil Compensatory Contempt Damages in the f0111 of sanctions
pursuant to J 1 use 524 and i J USC 105 sufficient to compensate her for actual
damages, attomey fees, costs. and other retief this court deems just and proper.

GMAC has reported the failure to pay the account to the three national credit reporting

CRUZ is entitled to a declaration by the Court, pursuant to 28 USC § 2201 that there is
no liability to GMAC on the account.
GMAC'S contÍnued reportng of the aceount to the thee natioDaf credit bureaus has
caused CRUZ to suffer hann. Such har will continue unless and until GMAC is
enjoined frm continuing to report to third-paries that CRUZ is liable for payment on the
account.
CRUZ is entitled to an injunction directing GMAC to correct its records so as to update
the account with Bankptcy lnfoD11ation and to refrain from advising any third parties
that CRUZ is liable for payment on the account.
