110 Bulk - Industrial and commercial wastes

A Description: Hardened polymer wastes, wastes of foodstuffs, drinks, tobacco or other luxuries, packaging wastes, wood wastes, waste papers or cardboard packaging wastes, water-based paints, waste clothes, waste animal feeds, used filters and adhesive agents, wastes contaminated with at least one of the following hazardous substances: oils, fats, resins, paints, coating compounds, lacquers, glues, adhesives, bitumen, waxes, tars or impregnation agents

B Terms of delivery:

Tipping containers, roller container, truck with walking floor, other cars and truck tippler that can be emptied backwards as well

as ACTS-Containers on railway cars. Maximal car width is 2.6 m, maximal car height is 4.0 m and the maximal car height during

tilting is 7.0 m. The unloading takes place by the customer on instruction and under supervision of Wien Energie.

C Technical/physical requirements for the waste:

Firm up to semi-solid consistency, not containing non-opened packaging (with the exception of water-based paints), not

containing rolled-up and/or bundled bands/foils/tubes, not sticky, not dusty, not containing an open liquid phase, free-flowing

and pourable respectively, without significant odour nuisance, temperature of the material < 50 °C, flash point > 60 °C,

combustion residue up to 35 %, edge length of combustible parts < 0.4 m, edge length of massive metal parts, stones or concrete

< 0.1 m, bulk density > 200 kg/m³

D Chemical requirements for the waste:

Bromine < 0.1 %, chlorine < 2 %, fluorine < 0.1 %, iodine < 0.1 %, sum of PCB and PCT < 100 mg/kg, sulphur < 2 %, antimony <

5,000 mg/kg, arsenic < 100 mg/kg, lead < 5,000 mg/kg, cadmium < 100 mg/kg, chromium < 1,000 mg/kg, copper < 10,000 mg/kg,

molybdenum < 500 mg/kg, nickel < 1,000 mg/kg, mercury < 50 mg/kg, zinc < 10,000 mg/kg, pH-value 5 – 10, non-reactive

E Wastes those are not included in this article group:

• Wastes according to chapter 6.3 of the general terms and conditions (“wastes that are generally not accepted”)

• Wastes that contain a relevant share of elementary carbon (e.g. carbon black, activated carbon, gas purification mass)

• Wastes that cause a reaction with air, water, acids and/or alkalis

• Wastes that have a tendency towards self-heating/spontaneous combustion

• Highly flammable wastes (flashpoint < 60 °C)

• Wastes with significant odor nuisance

• Liquid wastes (this includes liquid wastes in packing - with the exception of oil cans)

• Gaseous wastes in pressure packaging (e.g. spray cans, gas cartridges, gas canisters, lighters, fire extinguishers)

130 Bulk - Inert wastes

A Description:

Demolition wastes, soil, excavated material, conditioned sludge, used filters and adhesive agents, debris and construction wastes

that are contaminated with hazardous substances (e.g. oils, fats, resins, paints, coating compounds, lacquers, glues, adhesives,

bitumen, waxes, tars, impregnation agents, PAH or chemicals). A description about the ingredients and a special permission by

Wien Energie are required prior to the delivery

B Terms of delivery:

Tipping containers, roller container, truck with walking floor, other cars and truck tippler that can be emptied backwards as well

as ACTS-Containers on railway cars. Maximal car width is 2.6 m, maximal car height is 4.0 m and the maximal car height during

tilting is 7.0 m. The unloading takes place by the customer on instruction and under supervision of Wien Energie.

140 Bulk – Solid additional pre-treated fuels

A Description:

Wood wastes, waste papers, hardened polymer wastes, rubber wastes, biogenic wastes as well as mixtures of these wastes and

solid residues of mechanical treatment. These wastes require a special suitability test by Wien Energie.

B Terms of delivery:

Roller container (closed style) with a lateral locking device as well as swinging and double doors respectively, truck tippler with

swinging and double doors respectively (that can be emptied backwards), trucks with walking floor. Maximal car width is 2.6 m,

maximal car height is 4.0 m. The loading edge of the vehicle must be over 400 mm. The vehicle needs to be able to unload into

Wien Energie BRAM plant at the Werk Simmeringer Haide site and the delivery occurs using an exchange system.

C Technical/physical requirements for the waste:

Firm consistency, demetallised, not agglutinating, not capable of dust explosion, not containing an open liquid phase, free-

flowing and pourable respectively, without significant odour nuisance, temperature of the material < 50 °C, flash point > 60 °C,

combustion residue < 30 %, loss on drying < 20 %, edge length of combustible parts 1 - 30 mm, edge length of non-combustible

parts < 2 mm, bulk density from 100 to 300 kg/m³

D Chemical requirements for the waste:

Bromine < 0.1 %, chlorine < 1 %, fluorine < 0.1 %, iodine < 0.1 %, sum of PCB and PCT < 100 mg/kg, sulphur < 1 %, antimony <

5,000 mg/kg, arsenic < 100 mg/kg, lead < 5,000 mg/kg, cadmium < 100 mg/kg, chromium < 1,000 mg/kg, copper < 5,000 mg/kg,

molybdenum < 100 mg/kg, nickel < 1,000 mg/kg, mercury < 50 mg/kg, zinc < 5,000 mg/kg, pH-value 5 – 10, non-reactive

160 Bulk – Solid pre-treated wastes

A Description:

Solid residues from the mechanical treatment of wastes, which may be contaminated with at least one of the following

hazardous substances: oils, fats, resins, paints, coating compounds, lacquers, glues, adhesives, bitumen, waxes, tars, personal

care products, cosmetics, detergents or cleaning agent wastes, impregnation agents.e These wastes require a special permission

by Wien Energie prior to the delivery.

sulphur < 1 %, arsenic < 100 mg/kg, cadmium < 100 mg/kg, mercury < 50 mg/kg, sum of heavy metals (antimony, lead, chromium,

copper, nickel, zinc) < 5.000 mg/kg, molybdenum < 100 mg/kg, pH-value 5 – 10, non-reactive

E Wastes those are not included in this article group:

170 Bulk – Pumpable sludge

A Description:

Oil sludge, sludge from chemical/physical treatment, decanter sludge, wastes out of tank cleaning and sludge from waste water

treatment as well as processed silted up solid wastes. These wastes require a special permission by Wien Energie prior to the

delivery.

B Terms of delivery:

Tipping containers, roller container with a swinging door, truck tippler with a swinging door (that can be emptied backwards,

with the side lock-off) and suction tank vehicles. Maximal car width is 2.6 m, maximal car height is 4.0 m. The loading edge of

the vehicle must be over 350 mm. The unloading takes place by the customer on instruction and under supervision of Wien

Energie.

C Technical/physical requirements for the waste:

Muddy consistency, demetallised, not containing solid agglomerates or impurities (e.g. rags, wood, foils or other raw impurities),

pumpable with thick-matter pump at the unloading location, pourable, not block-shaped, without significant odour nuisance,

temperature of the material < 35 °C, flash point > 60 °C, dry substance between 20 % and 30 %, edge length of combustible parts

< 50 mm, edge length of non-combustible parts < 5 mm

D Chemical requirements for the waste:

Bromine < 0.1 %, chlorine < 1 %, fluorine < 0.1 %, iodine < 0.1 %, sum of PCB and PCT < 50 mg/kg, sulphur < 1 %, arsenic <

100 mg/kg, cadmium < 100 mg/kg, molybdenum < 100 mg/kg mercury < 1 mg/kg, Sum of heavy metals (antimony, lead,

180 Bulk – Solid pre-treated wastes for recovery (R1)

Solid residues from the mechanical treatment of wastes, which may be contaminated with at least one of the following

hazardous substances: oils, fats, resins, paints, coating compounds, lacquers, glues, adhesives, bitumen, waxes, tars, personal

care products, cosmetics, detergents or cleaning agent wastes, impregnation agents. These wastes require a special

310 Packed – Wastes without high hazardous potential in end-consumer packaging

A Description:

Wastes of foodstuffs, drinks, tobacco or other luxuries, personal care products, cosmetics, medicines (assorted, no heavy metals,

cytostatic drugs, addictive substances), detergents or cleaning agent wastes.

B Terms of delivery:

Delivery in street and railway vehicles that are capable of transporting general cargo and that can be unloaded by a forklift. The

unloading by a forklift is carried out by Wien Energie from the loading sill of the transport unit. The customer carries out any

other unloading after he is instructed to do so and while employees of Wien Energie supervise him.

Valid packing is stable, not deformed, storable, resistant to its content, secured against an unintentional content leakage and it

is not dirty on the outer surface. The packaging units need to be secured against slippery, on pallets. Lid and the packaging must

not be permanently connected.

Each packing has an explicit label containing information about waste code, waste description, waste origin and ADR .

Standard packing:

Single-use plastic and/or cardboard packing with a base (incl. side grips) of max. 350 mm x 400 mm, a height of max. 700 mm

having a maximum gross mass of 25 kg per packaging unit, on pallets.

Wastes delivered in packing deviating from standard require a special permission by Wien Energie.

A Description:

Activated carbon, paints, bitumen, fats, wastes of foodstuffs, drinks, tobacco, hardened resins, wood wastes, impregnation

agents, ion exchange resins, glue wastes, personal care products, cosmetics, plastics, lacquers, adhesives, solvent-containing

wastes, genuine grains, oils, oil-containing wastes, organic solvents, waste paper and cardboards, detergents or cleaning agent

wastes, tars, packaging wastes, waxes.

B Terms of delivery:

Delivery in street and railway vehicles that are capable of transporting general cargo and that can be unloaded by a forklift.

Wien Energie carries out the unloading by a forklift from the loading sill of the transport unit. The customer carries out any

other unloading after he is instructed to do so and while employees of Wien Energie supervise him.

Valid packing is stable, not deformed, storable, resistant to its content, secured against an unintentional content leakage and it

is not dirty on the outer surface. Lid and the packaging must not be permanently connected.

Each packing has an explicit label containing information about waste code, waste description, waste origin and ADR (if

A Description:

• Blood bottles, body parts and parts of organs that contain material of risk group 1 according to EU directive 2000/54/ EG

published on 18.09.2000

• Clinical or veterinary wastes (except cultures) that contain substances of risk group 2 and 3 according to EU directive

2000/54/EG published on 18.09.2000 (e.g. swabs, dressing materials, blood or urine samples, blood bottles, plasma bags,

expired ELISA-test-kits, excrements, body parts or parts of organs, textiles, used protective clothing, electrophoresis gels

and similar wastes).

• Cultures that have contained substances of risk group 2 and 3 according to EU directive 2000/54/EG published on

18.09.2000 (e.g. microbiological wastes, hotbeds, nutrient solutions, cell cultures, agar-agar, and so on).

B Terms of delivery and packing requirements:

Delivery in street and railway vehicles that are capable of transporting general cargo and that can be unloaded manually on the

conveyor bands of Wien Energie. The customer carries out the unloading after he is instructed to do so and while employees of

Wien Energie supervise him.

The packing must meet the applicable ADR packing requirements. It needs to be hermetically sealed, puncture-proof, resistant

to its content, not damaged or deformed, stable and storable. It should be secured against any unintended opening. The outer

surface of the packing is not dirty and must be disinfected. The center of gravity needs to be in the lower third of the packing.

A non-destructive opening of the packing can´t be possible.

Each packing needs to have an explicit label containing information about waste code, risk group, UN-number, waste description

and waste origin as well as the original biological hazardous material in case of disinfected wastes.

Standard packing:

Stable cylindrical single-use plastic packing with a maximal footprint / lid diagonal (incl. lateral handles) of 530 mm, a height of

350 to 700 mm and a gross mass of 8 - 18 kg apiece. (In case the certification of the packing permits a lower gross mass then

this mass will be the maximum mass permitted for delivery).

Wastes delivered in packing deviating from standard require a special permission by Wien Energie.

C Technical/physical requirements for the waste:

Maximum length of body parts or parts of organs 100 mm

D Chemical requirements for the waste:

It is required that the classification of these wastes is performed by a competent person that is fully liable for it. The name and

phone number of this person need to be legibly added to the transport documents. In case of wastes that have been disinfected

the transport documents also need to contain the name of the person responsible for the disinfection.

E Wastes those are not included in this article group:

• Wastes according to chapter 6.3 of the general terms and conditions (“wastes that are generally not accepted”)

• Not disinfected cultures that contained substances of risk group 2 and 3 according to EU directive 2000/54/EG published

on 18.09.2000 (e.g. microbilological wastes, hotbeds, nutrient solutions, cell cultures, agar-agar, and so on)

362 Packed - Wastes with cytostatic drugs

A Description:

• Wastes from chemotherapy that contain cytostatic drugs (e.g. infusions, syringes, swabs, glass/plastics packing, sharps

and similar wastes).

• Cytostatic drugs in packing ready to use for medical treatment

• Production wastes that contain cytostatic drugs

• Other wastes that contain or are afflicted with cytostatic drugs (e.g. exhaust air filters, packing material and similar wastes)

B Terms of delivery and packing requirements:

Delivery in street and railway vehicles that are capable of transporting general cargo and that can be unloaded manually on

370 Packed - Electrical and electronical equipment and components

A Description:

Electrical and electronical equipment, devices, parts of devices and displays

B Terms of delivery and packing requirements:

Delivery in street and railway vehicles that are capable of transporting general cargo and that can be unloaded by a forklift. The

unloading by a forklift is carried out by Wien Energie from the loading sill of the transport unit. Any other unloading is carried

out by the customer after he is instructed to do so and while he is supervised by employees of Wien Energie.

Valid packing is stable, not deformed, storable, resistant to its content, secured against an unintentional content leakage and it

is not dirty on the outer surface. Lid and the packaging must not be permanently connected.

Each packing has an explicit label containing information about waste code, waste description, waste origin and ADR (if

necessary) and the transporter has to put an identification label (available at Wien Energie) on each packing at the time of

delivery.

Standard packing:

For this appropriate single-use drums with a diameter from 470 to 640 mm, a bottom diameter of at least 470 mm and a height

from 650 to 950 mm having a gross mass of 60 - 80 kg per drum. They have to stand stably and the center of gravity of drums

needs to be in the lower third of the packing. The drums need to be conveyable through the direct drum conveyer into the

rotary kiln without further handling by Wien Energie.

Wastes delivered in packing deviating from standard require a special permission by Wien Energie.

C Technical/physical requirements for the waste:

Temperature of the material < 35 °C, solid consistency, without significant odor nuisance

D Chemical requirements for the waste:

Sum of PCB and PCT < 100 mg/kg, not containing asbestos or mercury

E Wastes those are not included in this article group:

• Wastes according to chapter 6.3 of the general terms and conditions (“wastes that are generally not accepted”)

7-8 Manipulation, administrative efforts

A Description:

The following article groups of treatment efforts are applied:

Manipulation efforts are introduced if there is a deviation to the terms of delivery, the packing as well as the chemical or

technical/physical requirements of the article groups as long as the wastes can be categorized to the specific article group.

• Group 711 Personnel provision services

Contains the provision of personnel and equipment.

• Group 720 Administrative efforts

Administrative efforts are introduced because of legal obligations for data management systems in connection with

waste deliveries as well as because of special customer requests.

• Group 730 Provision of packaging materials

This group offers direct the sale of non-reusable packing materials for waste.

• Group 8xx Transportation and additional at cost services

Contains the provision of personnel and equipment for transportation efforts as well as for additional at cost services

General Terms and Conditions waste management

1. General

1.1. Applicability

The general terms and conditions – waste management of Wien Energie GmbH (hereafter referred to as “GTC”) are exclusively applied for the takeover of wastes into the “Werk Simmeringer Haide“ of Wien Energie GmbH, 11. Haidequerstraße 6, 1110 Wien / Austria (hereafter referred to as “Wien Energie”) as well as services that are connected to this. General terms and conditions of the customer are not accepted by Wien Energie unless the validity of the customer GTS is explicitly accepted by Wien Energie in written form.

1.2. Customer

The customer is a natural or legal entity that orders services of Wien Energie at the expense of the customer. In case that the customer is a „consumer” according to §1 of the Austrian consumer-protection law (“Konsumentenschutzgesetz”) there are modifications and additions to the GTC that are separately published in a side letter (“Besondere Bestimmungen für die Abfallwirtschaft für Verbraucher” – only a German version is available).

1.3. Waste classification

The customer has to classify each waste in terms of waste code according to Austrian national law (“AWG” and corresponding regulations) as well as the article number according to “pricelist waste management” (see chapter 2.1) .

1.4. Prior sample classification by Wien Energie

Samples sent by the customer prior to delivery may be analysed and classified by Wien Energie. In any case this classification is not obligatory. The relevant classification for pricing by Wien Energie takes place after the receiving control (see chapter 5.1). The samples will be taken over by Wien Energie only in leak-proof and stable packings appropriate for this. They must be prepared and labelled in such way that no exchange (eg. with the foodstuff) is possible. In addition, there must be attached a filled waste identification paper (available at Wien Energie) for each sample.

1.5. Right to amendment

Wien Energie reserves the right to make changes of these general terms and conditions – waste management of Wien Energie in written form and in agreement with the customer.

2. Article groups

2.1. Pricelist

The corresponding „pricelist waste management” to this „Definition of services and General Terms and Conditions waste management” (hereafter referred to as “definition of waste services”) is published on www.wienenergie.at or will be directly provided to the customer by Wien Energie.

2.2. Allocation of article groups

Basically wastes and services are allocated to article groups using the definition of waste services. Requirements of sections A, B, C and D of the particular article groups are crucial for the allocation of a certain waste to an article group.

2.3. Deviations of requirements

In case of deviations of requirements of chapter 2.2 of the GTC additional efforts for treatment, manipulation or provision of packing are charged. These efforts can be found in the “definition of waste services” as well. Wastes that fulfil criteria of section E of the particular article group will be allocated to a different article group by Wien Energie or can generally not be taken over by Wien Energie.

2.4. Right to amendment

Wien Energie has the right to offer the customer different conditions to the particular requirements of the “definition of waste services” as long as it is done in written form.

3. Announcement of waste deliveries

3.1. Announcement of the customer

In general each waste delivery has to be announced to Wien Energie (contact data – see chapter 3.3) by the customer in written form or electronically. The announcement needs to include at least the following information:

• Announcer (Name, phone number and fax number or email address) • Invoice recipient (incl. address) • Customer is a company or a consumer • Waste transferor (incl. address) • “Personen GLN” (if available) according to the latest regulations of the AWG • Branch code (6 or 13 digit) of the waste transferor • Loading location: addess or “Site GLN” according to the latest regulations of the AWG • Transporter (incl. address and possible “Person GLN” according to the latest regulations of the AWG) • Desired delivery date • Article number of Wien Energie according to the “Pricelist wastes services” (see chapter 2.1) • Type and amount of packing • Weight of wastes in tons • Waste code (according to the latest regulations of the AWG) • Hazards that may occur during treatment • All other information prescribed by law

Please note that in case of waste deliveries of article group 340 the customer has to send a complete packing list for each packing to Wien Energie prior to the delivery. Wien Energie investigates the list and has the right to confirm or reject packing or certain contents of it. Wien Energie will inform the customer about the outcome of the investigation.

3.2. Reporting requirement

The customer has to inform Wien Energie about all further issues that are prescribed by state, national and/ or European law as well as other technical guidelines concerning the waste transfer of the delivered wastes to the best of his knowledge. In connection to this we particularly refer to the valid regulations of Austrian national laws: “Abfallnachweisverordnung”, “Abfallverzeichnisverordnung”, “Abfallverbrennungsverordnung” and the “Abfallbilanzverordnung“.

The customer may use the „waste identification paper“ (provided by Wien Energie disposition or on www.wienenergie.at) as a guideline to know which basic information about the wastes is relevant. Also he can use own papers that contain similar information. Nevertheless Wien Energie always has the right to demand additional information concerning the wastes from the customer.

3.3. Contact at Wien Energie

The customer announces waste deliveries at the Wien Energie “Disposition” (of the site Werk Simmeringer Haide). Contact information is:

3.4. Examination by Wien Energie

Each waste announcement of the customer is checked by Wien Energie. In particular the provided information is examined on behalf of:

• legitimacy • technical possibility • commercial conditions • possible free capacity

3.5. Date coordination with the customer

If all 4 checks of chapter 3.4 are positive then Wien Energie will confirm the delivery date by providing the customer one “Dispo” number per Article. Otherwise Wien Energie contacts the customer to clarify problems and/or to find an alternative delivery date. This coordination may also take place using the “waste services customer portal”.

3.6. Withdrawal

If the provided documents are incorrect, contradictory or incomplete Wien Energie has the right to request amendments or additional information. In this case Wien Energie may as well deny the take over of the wastes. Also Wien Energie has the right to completely refuse to take over waste deliveries for operational reasons even if deliveries have already been confirmed according to chapter 3.5 at any time.

This communication may also take place using the “waste services customer portal” on www.wienenergie.at.

4. Deliveries of wastes

4.1. Order Form

The customer needs to completely fill out and sign an order form of Wien Energie per article for the delivery. Order forms can be acquired from Wien Energie (“Disposition”) as well as from www.wienenergie.at (“waste services customer portal”). The customer has to hand out the order form to Wien Energie upon arriving.

In case of waste deliveries of article group 340 the customer has to add a packing list for the contents of each packing to the delivery documents. This packing list needs to be accepted by Wien Energie prior to delivery (see chapter 3.1).

4.2. Labelling of Packing

Packing with a volume of more than 60 litres has to be labelled by the driver of the delivery vehicle using etiquettes provided by Wien Energie during the takeover process.

4.3. Takeover times of “Werk Simmeringer Haide”

In general entering times for waste deliveries are on working days. The following times are valid for the corresponding article groups:

• Article group 110, 120, 130, 140, 160, 170: Monday to Thursday 7.00 am to 3.00 pm, Friday 7.00 am to 12.00 am

• Article group 210, 220, 230, 240, 250, 260, 270, 310, 311, 313, 314, 320, 331, 360, 361, 362, 370 as well as wastes from article groups 110 and 120 for pre-treatment by shredder : Monday to Thursday 7.00 am to 2.00 pm, Friday 7.00 am to 11.00 am

• Article group 330, 340, 350: Monday to Thursday 7.00 am to 11.00 am, Friday 7.00 am to 10.00 am

Wien Energie has the right to change take over times at any time due to operational reasons or may agree on special take over times with the customer.

4.4. Delivery address

4.5. Delivery conditions

The customer is liable to transport the waste to the address listed in chapter 4.4 (DDP, according to INCO-Terms) and has to unload himself (after the driver is instructed to do so and while he is supervised by Wien Energie) unless other conditions are explicitly stated in this “definition of waste services”. The customer must bear all costs (including legal duties and import fees) for transportation, the responsibility for risks and dangers for the whole transportation route (including the loading) until the arrival (including unloading at the site “Werk Simmeringer Haide”).

5. Receiving control

5.1. Receiving control by Wien Energie

Each waste delivery will be checked by employees of Wien Energie during the takeover process. The result of the control is obligatory for the further treatment of the wastes and their price calculation. Therefore the waste declaration of Wien Energie according to the pricelist (see chapter 2.1) and determent of the Austrian waste code during the waste take over process is a binding basis for further treatment and pricing.

5.2. Detection of a deviation

In case this check results in a deviation to the waste delivery announcement or the specifications of the corresponding article group Wien Energie informs the customer. This information includes the kind and the extent of the deviation as well as the possible further proceedings and will be sent in a written form (“Abweichungsmeldung”). The unloading will be postponed until the conclusion of the customer is available. The customer has to bear the costs for wait- and downtime of the vehicle.

5.3. Decision of the customer

In case of an “Abweichungsmeldung” according to chapter 5.2 the customer may confirm the suggested further procedure of Wien Energie or he may take back the wastes (whether the whole delivery or only parts of it) at his own risk and costs. The customer is obliged to announce his written conclusion within one working day after receiving the “Abweichungsmeldung” of Wien Energie. If the customer doesn’t react within this time period then Wien Energie is authorized to carry out the proposed procedures at the cost of the customer.

This communication can also be performed using the “waste services customer portal” on www.wienenergie.at with the same obligations.

Regardless of this waste deliveries that fulfil one or more criteria of chapter 6.1 have to be taken back by the customer according to chapter 6.2.

5.4. Procedure in case of a delivery containing radioactive materials

All wastes that are delivered to Wien Energie will be checked for radioactivity. In case of a positive detection of radioactivity the vehicle will be parked on a special keepout-area. The “Seibersdorf Labor GmbH” (hereafter called “SEL”) will be called and is ordered by Wien Energie to examine the potential radioactive wastes. The customer is charged with the accruing costs of this procedure as well as an additional processing fee by Wien Energie.

In case that the examination of “SEL“ concludes that the material may be thermally treated by Wien Energie without additional precautions or pre-treatments the customer will be informed by Wien Energie and the waste take over process will be continued.

In case that the examination of “SEL” concludes that the material may not be thermally treated by Wien Energie but must be treated by an officially authorised company (e.g. “Nuclear Engineering Seibersdorf” – hereafter called “NES”) then the following procedure will be started:

a) The customer will be informed of the outcome of the examination by Wien Energie by fax or email.

b) The customer must react swiftly – until 12:00 am of the following working day at the latest. Within this time period the customer has to order an officially authorised company (e.g. “NES”) to pick up and dispose the radioactive wastes and sends Wien Energie a copy of this order as well as the permission of the company by fax or email (contact data: see chapter 3.3). The radioactive waste must be picked up as fast as possible – until 2 working days after the information by Wien Energie according to a) at the latest. The customer will be charged with the costs for parking the original vehicle on the site of Wien Energie by Wien Energie.

c) If the customer doesn’t react according to b) on time then Wien Energie is authorized to order an officially authorised company (e.g. “NES”) to dispose the radioactive wastes. In this case the customer will be charged with the accruing costs of this disposal as well as an additional processing fee by Wien Energie.

In case that “SEL“ concludes in the examination that there is an imminent danger originating from the radioactive wastes, and the wastes must be transported to “NES” immediately, Wien Energie is entitled to order the disposal of the wastes without consulting the customer. The customer will be charged with the accruing costs of this disposal and the transportation as well as an additional processing fee by Wien Energie.

5.5. Unloading location

Wien Energie exclusively defines the unloading location within the “Werk Simmeringer Haide”. The customer unloads at his own costs and risks (see chapter 4.5 of the GTC).

5.6. Takeover of wastes

Basically each waste takeover is based on a “Dispo” number of Wien Energie prior to delivery as well as a positive conformity (verified by Wien Energie) between the announcement and the received wastes after the receiving control. Before the positive conformity is confirmed by Wien Energie there is no transfer of ownership. As a result the customer is responsible for the wastes until the positive conformity confirmation by Wien Energie.

5.7. Hidden defects

In case there are any doubts that the waste classification of the customer is correct Wien Energie is authorized to examine the wastes even after the takeover of wastes according to chapter 5.6. The customer is obliged to take back wastes that are not properly classified by request of Wien Energie within a working day. The customer will be charged with additional efforts due to temporary storage of wrongly classified wastes. In case of serious operational reasons the customer is obliged to take back the wastes even after the takeover of wastes according to chapter 5.6 of the GTC at the request of Wien Energie and at the expense of the customer within three working days.

6. Rejection of wastes

6.1. Reasons for rejection of wastes

Wien Energie is authorized to deny the takeover of wastes (according to chapter 5.6) and to send the delivery back if a) a „Dispo“ number according to chapter 3.5 is missing b) demanded contractual or legal documents are missing c) the maximum amount or size of packing predefined by Wien Energie is not met by the customer d) the waste classification by the customer is missing, wrong or incomplete e) packing is damaged, not properly labelled or cannot be stored f) wastes do not comply with the requirements of the “definition of waste services” g) in case of a delivery of article group 340 a packing list is missing or incorrect h) wastes comply with or contain wastes of chapter 6.3 (“wastes that are generally not accepted”) i) the customer violates contractual commitments of these GTC (e.g. wrong classification, payment delays) j) other serious operational reasons that prevent a takeover of wastes for Wien Energie or are unacceptable for Wien

Energie (e.g. safety dangers for employees or plants of Wien Energie, break downs)

6.2. Obligation of the customer to take back wastes

If there is a reason of rejection according to 6.1 then the customer is obligated to take back the wastes delivered by him or by a 3rd party that he has commissioned as soon as possible. If the customer doesn’t react to his obligation to take back the wastes within one working day Wien Energie is authorized to send the wastes back at the expense of the customer.

6.3. Wastes that are generally not accepted

The following wastes are generally not accepted by Wien Energie: • Wastes for that Wien Energie lacks a takeover permission • Wastes Wien Energie cannot take over due to technical or safety reasons • Wastes containing any biological hazardous substances of risk group 4 as well as non-sterilized cell-cultures of risk

group 2 and 3 according to EU directive 2000/54/EG (published on 18.09.2000) • Wastes that are regulated by the “Wiener Leichen- und Bestattungsgesetz“ law

7. Billing

7.1. Basis for billing of wastes

The weight determination of the delivered wastes is performed by the (proper) weight measurement of Wien Energie. This measurement is the only valid value for the weight. The billing basis of wastes is the measured weight multiplied with the price of the article number (determined according to chapter 5.1).

7.2. Delivery Note

After the takeover of Wien Energie the customer receives a delivery note enclosed to the bill.

7.3. Billing

Accounting will be performed by Wien Energie on a weekly basis for wastes that are delivered the week before. If the wastes need an extensive receiving control the bill is generated after the conformity check according to chapter 5.6 has been finalized. Basis for billing is always the weight measured by Wien Energie or the amount per article. Both values are available in the delivery note that is enclosed to the bill. Treatment, manipulation and administrative efforts as well as legal duties will be separately shown on the bill.

7.4. Payment

Bills of Wien Energie must be paid without discount within 14 days after receiving of the bill. In case of late payment the

legal interests for delays notwithstanding other rights are considered as agreed. The customer is obliged to refund Wien Energie all costs to collect an outstanding account from the customer (e.g. collection fees, information gathering costs, attorney’s fees).

Wien Energie is authorized to ask for cash payment or for a bail out for waste deliveries. In general Wien Energie is not obliged to accept partial payments. Payments or partial payments will generally be charged in the following order: firstly against additional costs in connection with the delayed payment (additional efforts, debt collection); secondly against debts and additional costs for a probable damage infliction; thirdly against accrued interests and lastly against the oldest claims to payment.

7.5. Currency

The decisive currency for billing of services based on this “definition of waste services” is EURO.

8. Other provisions

Price mistakes, printing errors and other mistakes of this definition of waste services are subject to change without notice. Wien Energie is authorized to correct or change these at all times.

The customer is fully responsible for the behaviour of a 3rd party that he contracted for transportation, declaration, unloading, etc.

The customer is liable for all damage for Wien Energie that is caused due to breach against his contractual responsibilities or the regulations of the GTC in particular due to lacking, wrong or not comprehensible labelling or classification as well as if the customer withholds information about hazards of wastes during transportation, hand over or treatment of wastes (e.g. usage of not proper packing). In addition the customer is liable for this damage if it has been caused by a 3rd party (attributable to the customer; e.g. an appraiser).

Wien Energie is not liable for disadvantages for the customer due to idle times, rejected delivery dates and/or deliveries. Also Wien Energie is not liable for damage for the customer or 3rd parties contracted by the customer if safety protocols are not met or instructions of Wien Energie employees are not or only partly followed. Liability of Wien Energie for property damage or financial losses caused with slight negligence as well as for lost profit is excluded.

The customer is not entitled to set off counterclaims against Wien Energie unless they are explicitly recognized by Wien Energie (in written form), have been established by court or are asserting a right of retention.

The customer must return rental container and/or packing in the same shape as found upon take over. Possible damages have to be compensated by the customer. Normal wear is excluded from this.

Wien Energie is authorized but not obliged to check the authority to sign of the customer.

If parts or whole regulations of these general conditions for waste management of Wien Energie are turning invalid or impracticable, the effectiveness or feasibility of the rest of the general conditions remains obligatory. An invalid or impracticable regulation will be replaced by a valid and practical regulation which is close to the original regulation.

It is agreed that the exclusive authorized court shall be the commercial jurisdiction and the exclusive place of jurisdiction shall be the court of the company headquarters of Wien Energie. Applicable law is the law of the Republic of Austria to the exclusion of all collision standards.

The original German version of the definition of waste services waste management may have been translated into other languages. In the event of inconsistency or discrepancy between the German version and any other language version, the German language version “Leistungsdefinition Abfallwirtschaft und Allgemeine Geschäftsbedingungen – Abfallwirtschaft” shall prevail.

Deviations, changes or additions of the general conditions for waste management of Wien Energie (with consideration of chapter 1.5 and chapter 2.4 of the GTC), to the pricelist (see chapter 2.1) or to the “definition of waste services” need to be provided in writing. Any derogation from the written form can only be made in writing.
