HOUSE AND WALK-IN-TUNNELS FOR ONE YEAR
TERMS AND CONDITIONS OF EMPANELEMENT INCLUDING INSTRUCTIONS TO BIDDERS
The tender shall be submitted in accordance with these instructions and any
tender not confirming to the instructions as under is liable to be rejected. These
instructions shall form the part of the tender.
1. General
i) The bidders are required to submit the bid online on Punjab Govt.
Procurement Portal https://eproc.punjab.gov.in using valid Class 3/2 Digital
Signature Certificates.
ii) More information useful for submitting the online bids is available on the
above mentioned website.
iii) Bidders are required to enroll on the e-Procurement portal
(https://eproc.punjab.gov.in). Enrolment on this portal is free of charge.
iv) All the bidders shall have to pay the required tender fee and processing fee
as applicable before the submission of tender.
v) The tenderers are advised in their own interest, to carefully read the
instructions and understand their purport and unless the tender specifically
states to the contrary in respect of any particular clause, it shall be
presumed that all tender conditions have been accepted as laid
down in this document.
vi) This tender is not transferrable.
vii) Conditional and incomplete tenders shall not be accepted.
viii) Firm (individual or partnership), company (Public or Private Ltd.) shall be
called as firm.

ix) The bids are invited for empanelment of reputed firms for construction of
protected structures viz. Hi-tech polyhouse, Naturally Ventilated Poly
Houses (Tubular), Shade Net Houses, Walk-in-Tunnels on rates as per
norms of Mission for Integrated Development Horticulture (MIDH) for the
financial year 2019-20 (rates subject to change as per MIDH norms as and
when).
2. Bidders/Firms applying for the empanelment should have an experience of
installation of Protected Cultivation structures in India for a minimum period of
2 years.
3. The bidder/firm shall have to submit compliance for both specifications and
terms & conditions of the tender as per given format (Annexure 1), failing
which the bid will be treated as incomplete and is liable to be rejected.
4. Categorization of Firms and Work Allotment
i) The Firms have been categorized in two Categories i.e Category-A and B
based on their turnover and area of installed protected structures. The firm
having turnover of Rs. 2.50 Crore consecutive for the FY 2017-18 & 2018-
19 and installed minimum 50000 sqm shall be categorized as Category A.
Firms having turnover of Rs. 0.50 Crore consecutive for the FY 2017-18 &
2018-19 and installed minimum 25000 sqm shall be categorized as
Category B. A proof is required to attach in the technical bid.
ii) Based on Category, the firms shall have to meet the following parameters
while applying for empanelment:-

iii) Category B Firms shall be allowed to work in its own “size category” (upto
2080 sqm) of work allotment but Category A can work in the both size
categories of work.
5. Protected cultivation structures for a minimum area of 50,000 sqm and 25,000
sqm should have been installed by Category A and Category B, respectively.
Bidders shall have to attach list of such protected structures installed as per
Annexure 2.
6. Bidders must enclose last 2 years income tax return (Assessment year 2017-
18 and 2018-19) and must have GSTIN number. A proof to this effect should
be attached with the technical bid.
7. Bidder should not be black listed anywhere in any case. Undertaking is
required with the technical bid (Annexure 3).
8. Manufacturer and/or bidder (if bidder is authorized dealer/agent/supplier)
should be ISO certified Company. Proof required with technical bid.
9. The bidder must give the undertaking about the trueness of all the documents
(Annexure 4).
10. The last date for receiving the bids would be 16-09-2019 at 5:00 P.M and shall
be opened on 18-09-2019 at 11.00 a.m in the presence of the representatives
of the participating firms, who wish to be present. Firms are suggested to
submit the tender well in time. No request to extend the last date of
submission and opening shall be entertained at any circumstances.
11. Earnest Money Deposit (EMD) and Bank Guarantee.
i) EMD amounting to Rs. 3,00,000/- shall have to be deposited online for this
tender. Bidder should ensure that the online transaction carries the name of
firm/bidder and address of bank to access the details. Bidders shall have to
enclose the EMD receipt in technical bid. No tender will be entertained
without earnest money deposit.
ii) EMD shall be refunded to the firms without interest after the empanelment
tenure only.
12. All the tender documents must be clear and readable and must be uploaded in
a Single/double PDF file format with numbering on each page.

13. Firm must have their own workshop in a minimum area of 1000 sq. meter
with the following minimum installed infrastructure
i) Hydraulic pipe bending machine ii) Tower type drill machine iii) Power press iv) Welding machine/grinders and drills etc.
These requirements will be verified at the time of empanelment. if any discrepancy detected the firm will not be given work order and empanelment will be cancelled.
14. Firm having serious complaint shall not be empanelled. Undertaking in this
regard is required to attach with technical bid.
15. Bank Guarantee
i) The successful tenderer shall be required to furnish Bank Guarantee
amounting to Rs. 10.00 lakh for Category A and Rs. 5.00 lakh for
Category B as security within fifteen days after opening the bid. This bank
guarantee shall have validity of one year.
ii) This Bank Guarantee shall be refundable after the expiry of empanelment
i.e one year subject to the submission of completion certificate of all work
duly signed by concerned District Head.
iii) If any firm violates any specification and terms & conditions of the
empanelment, the Bank Guarantee amount shall be forfeited and firm shall
be black listed by Director Horticulture-cum-Mission Director, SHM, Punjab.
16. The beneficiaries shall be free to choose the empanelled firm of their own
choice (Form No. 2) but execution of work should only be allowed after the
approval of Director Horticulture-cum-Mission Director, SHM, Punjab.
17. The application of beneficiaries shall be prioritized through HortNet only.
18. Approval for execution of work for protected structures shall be accorded by
Director Horticulture-cum-Mission Director, SHM, Punjab. District head will
endorse/recommend the Application Form within seven days of receipt to
Director Horticulture-cum-Mission Director, SHM, Punjab along with Form no.
1 & 2 duly completed.
19. If the firm does not start the work within one month from issuing of work
order then on the basis of written complaint of the farmer endorsed by district

head, work order shall be cancelled by Director Horticulture-cum-Mission
Director, SHM, Punjab.
20. The financial assistance on protected structure shall be released by the
department to the beneficiary or to the lending bank in when the farmer has
taken loan for the project from that bank.
21. If the firm fails to complete the protected structure within stipulated time i.e.
within 60 days from the date of work order (90 days in case of bank loan)
then on the written complaint of the farmer and verified by the district head,
penalty of 2% of total project amount will be imposed. This amount will be
deducted from the EMD of the firm and the concerned firm cannot take up
any further work till it completes the project in hand. Decision of Director
Horticulture-cum-Mission Director, SHM, Punjab in this regard shall be final.
22. The beneficiaries will provide the suitable levelled site and arrangement of
water. The arrangement of electricity would be the responsibility of the firm at
its own expenses. The firm will be responsible for watch & ward of structure
material.
23. The firm shall collect the payment of work directly from beneficiaries through
RTGS/DD only. The payment receipt shall be attached while submitting the file
for the release of subsidy.
24. Payment terms
The mode of payment by farmer shall be as under;
i) 1st instalment: The farmer will have to pay 10% of total estimate at the
execution of Tri Partite Agreement.
ii) 2nd instalment: Farmer has to pay 40% to concerned firm on completion
of foundation work and supply of complete steel material (excluding
cladding material). Farmer has to pay this amount within 3 working days
from unloading the material and inspection by duly constituted committee.
iii) 3rd instalment: 30% will be paid by the farmer to concerned firm after
supply of cladding material. Farmer has to pay this amount within 3 days
from unloading the material.

iv) 4th instalment: Final instalment of 20% after completion of protected
structure in all respects. Farmer has to pay this amount within 10 days from
the final inspection/removal of short comings, if any.
Note: In case the structure is financed by the bank then bank is responsible
for the payment as per their terms and conditions.
25. The firm will get the structure insured from reputed insurance company for
consecutive two years at the cost of the firm. The cover note will be in the
name of beneficiaries by covering all risks thereof as per policy terms and
conditions.
26. All the firms should submit design, drawing specifications as per prescribed
specifications before execution of the work to the department along with time
submission of Tri Partite Agreement.
27. Inspections
The inspection of protected structure will be as under;
i) 1st inspection will be conducted by the concerned HDO in the presence of
concerned firm’s representative and concerned farmer and representative
from Director Horticulture Office (Form No. 1).
ii) 2nd inspection will be conducted by the concerned HDO, District Nodal
Officer for Protected structures in the presence of concerned firm’s
representative and concerned farmer. This inspection will be carried out at
the time of completion of foundation work and supply of complete steel
material (excluding cladding material) (Form No. 7).
iii) 3rd final inspection will be conducted after completion of protected
structure in all respects subject to submission of No Due Certificate, and
“Completion certificate” from concerned firm. Afterwards the district head
will arrange the final inspection. Committee for final inspection shall be
comprising District Head, District Nodal Officer for protected cultivation,
concerned block HDO, Assistant Agriculture Engineer or SCO or
representative from PAU and representative from Director Horticulture
Office. This inspection shall be done in the presence of concerned firm’s
representative, concerned farmer and financing institution if, applicable.
This inspection shall be arranged within 15 days after completion of the

protected structure subject to availability of committee members (Form
No. 9).
28. Guarantee/Warranty
The firm will provide guarantee/warranty certificate to the farmer for the material
used for construction of protected structure as follows:-Guarantee:
i) Three years for structure ii) One year for cladding material iii) Three years for properties of poly sheet. iv) Three years for MI systems.
Warranty:
Two years for cladding material after the completion of one year of Guarantee period.
29. Director Horticulture-cum-Mission Director, SHM, Punjab shall have right to get
the cladding material/structure material tested from laboratory or agency at
any time, if required and the cost of testing shall be borne by the concerned
firm.
30. Service Centre:-
i) Firm should have to establish at least one "service centre" in the state of
Punjab after the empanelment but before the execution of work.
ii) The service centre should have one graduate engineer and one agricultural
graduate. The firm shall give salary slip/bank statement as proof of hiring of
expert.
iii) The technical person other than Agriculture Engineer should have completed
the training on polyhouse/net house from State Department of Horticulture,
Punjab State/State Agricultural Universities (SAU's)/ Horticultural Training
Centre (HTC) In due course of time and as per additional requirements,
number of trained technical persons should be increased.
iv) The service centre must provide free after sales service to the farmers at least
for three years. This may exclude the material cost, transportation of material
and installation cost. And must execute the protected cultivation after
sales service card as per Annexure 5.

v) Service centre shall have the information board as per the format provided by
Department of Horticulture, Punjab.
vi) Service centre shall maintain the list of farmers covered under the scheme.
vii) Service centre shall maintain the registers as per the format provided.
viii) It will be the responsibility of the firm to see that the service centre is kept
functional all the year and grievances/complaints of beneficiaries are attended
within a week after receiving written complaints/phone calls.
ix) The service centre must be equipped with the communication facilities such as
phone, internet/email etc and must display these at service centre.
31. The Firm shall furnish the technical bid in the prescribed Performa with
supporting documents.
32. The firm shall display an iron board at site having size 5’ x 3’ where particulars
viz name of the beneficiaries, size of structure, date of completion, total
estimate, amount of subsidy, name of manufacturing firms, established under
MIDH for the year 2019-20 etc. should be mentioned.
33. The officers of department of horticulture Punjab can check the structure at
any time.
34. Successful firm has to open at least one registered/branch office in Punjab or
Chandigarh after empanelment but before the execution of the work.
35. Inventory of material, complete operational and maintenance manual shall be
provided by the firm to farmers.
36. Director Horticulture-cum -Mission Director, SHM, Punjab reserves the right to
accept/reject the tender without assigning any reason thereof.
37. Director Horticulture-cum-Mission Director, SHM, Punjab shall have all rights to
amend/delete/add any clause.
38. All disputes and differences arising out of or in any way touching upon or
concerning the fabrication, construction what so ever shall be referred to the
District Head. The decision of district head shall be final and binding of the
concerned parties.
39. Director Horticulture-cum-Mission Director, SHM, Punjab will be appellant
authority in case the dispute is not settled at district level.

40. Firm/farmers have to submit required forms timely to the concerned district
head.
41. Applicant (Beneficiary) will have to complete performa's before / during/ or at
completion of protected structure.
42. Firm will have to complete Protected cultivation after sales service card and
hand it over to concerned beneficiary at completion of construction
43. This empanelment is solely for the purpose of protected house construction
from reputed firms so that only best quality units are constructed for the
farmers of Punjab. The department of Horticulture, Punjab reserves the right
to demand at any time from firm/ applicant farmer, any certification/affidavit
as per the requirement which is found supporting/necessary as legal
documentary proof for the constructed protected structure, its stability,
working, etc.

Protected Cultivation After Sales Service Card
Security Deposit: An amount has been retained as "Security deposit"(as per category
of firm) from the earnest money deposit against the after sale service for 3 years. The
Security deposit is interest free & refundable after submission of duly filled card from
the farmers by respective firm.
Payments terms: The firm is required to make at least six visits to farmer’s field at an
interval of six month or at start of cropping season. Firm will submit duly signed
"Protected cultivation after Sales Service Card" after 32 months but before 36 months
from date of installation & handing over of polyhouse to farmers. The Department Of
Horticulture, Punjab will release payment to the firm within 15 days of submission of
protected cultivation after Sales Service Card.

Introduction
The horticulture offers the diversification of the Punjab agriculture from the monoculture of paddy wheat
rotation. This will also create the ample employment opportunities for the youth of Punjab. To make
horticulture viable there is need to make horticulture more resource efficient. The hi-tech horticulture which
includes development and cultivation of high yielding varieties, protected cultivation, micro irrigation,
fertigation etc. will certainly improve the quality and quantity of the horticultural produce.
The quality and uncertainty of the vegetable as well as flower production under open cultivation in
the state results in the produce which is not suitable for export markets as well as the high end consumers of
the state. And as such most of this is procured from other states. The need of the hour is to increase the
productivity and quality of the produce to meet the requirements of quality conscious consumer. A paradigm
shift is required which fuels the vertical growth in the productivity.
Protected cultivation is one such technology which can provide the solution. Protected cultivation
means some level of control over plant microclimate to alleviate one or more of a biotic stresses for optimum
plant growth. The protected cultivation includes different levels of technologies from hi-tech vegetable
production to low tunnels to save the crop from frost. From the previous experiences it has been observed
that yields are several times higher than those under open field conditions, quality of produce is superior,
higher input use efficiencies are achieved and vegetable export can be enhanced. Under such circumstances,
protected cultivation is best option. To increase productivity there are mainly two approaches. First by
improvement in genetic base and second by maintenance of favorable environment. In a given genetic
material, they field potentials fully exploited only when an optimum growing environment is provided.
Environment refers to light, temperature, air composition and nature of root medium. Traditionally it is
possible to control only nature of root medium by way of till age, nutrition, irrigation, etc. Protected
cultivation is one which has control over growing environmental conditions.
Protected cultivation is being practiced in the various parts of the world for the last 150 years or so. In
India due to m o r e e m p h a s i s o n food grain production this technology lagged behind. Moreover the
Punjab the harbinger of green revolution there was very less area under horticulture as compared to area under
food grains.
The declining farm sizes in the states is furthering the decreasing farm incomes, thus making agriculture
financially unviable. The protected cultivation technologies will certainly increase the income levels of the
farmers and making small farms financially viable. Of late this technology is catching the fancy of the farmers
and more and farmers are coming forward for the adoption of this technology. The need was felt for the
development of specifications, so that the farmer gets best of the technology.

General Conditions of Erection
1. No pipes should be found welded. The bottom horizontal of 8 m length should be
prepared by placing one feet section of lesser size. (inside & clamping it properly).
2. The apron plastic must be buried in the ground at least 50 cm from ground level.
3. The curtain pipe should be cut near the door in case door is placed at the centre of the
side wall. The wall of poly house having more length, at centre of the wall a complete
plastic without side curtain, insect net etc. should be fixed with separate profile and
springs so that it can be removed as and when tractor operation is required in the poly
house.
4. Supplier should ensure checking of poly house construction materials for
specifications by department representatives after supply of material at site.
5. In case of top poly film fitted to the arches, if the length of top is more than 30 m,
then the top plastic to be fitted to arch at every 24 m length by using profile and zig
zag spring to avoid flapping of top plastic during winds.
6. Fixing of top poly – sheet should be fixed with profile and spring in the center of
gutter length.
7. Self-drilling screw in profile should not be more than 30 cm apart
8. While installing the multi layer film, first in sure that respective layers are facing the
right direction as shown on film (e.g. inside out)
9. Provide a sample of one sqm size of poly film, thermal net etc. having manufacturer’
identification mark along with batch no.
10. Film should be tensioned tightly enough so that there should not be flapping during
windy days.
11. The structural design should be sound enough to with stand minimum wind velocity of
150 km/hr.
12. Regarding material used under MI component the firm will use BIS mark material.
The system should run smoothly and there shall be no leakage.
13. Farmer will arrange the water source, electricity and booster pump at his own level to
operate the MI system.
14. The overall structure should perform satisfactorily in all respects.

General conditions of Erection
1. No pipes should be found welded. The bottom horizontal of 8m length should be
prepared by placing one feet section of lesser size. (inside & clamp in git
properly).
2. The apron plastic must be buried in the ground at least 50 cm from ground level.
3. If fixtures found rusted the structure will be considered incomplete.
4. Regarding material used under MI component the firm will use BIS mark
material. The system should run smoothly and there shall be no leakage.
5. The overall structure should perform satisfactorily in all respects.
6. Trellising system–Trellising wires of 2 mm gear wire or 3 mm dia high carbon
steel to be used at suitable height from ground level parallel to bed sand number
of wires will be 8 for 8 m span.

TRI PARTITE AGREEMENT (TPA) FOR PROTECTED CULTIVATION

administrator and assigns on the first part.

deemed to include its successors and assigns on the second part, (Represented by authorized
signatory of the firm).

Horticulture Development Officer of concerned block (herein after called the "HDO") having
its office at, which expression shall be deemed to include its successors and assigns on the
third part, Farmer, therefore, approached HDO vide application dated _________ which is
received by Block Office vide receipt No. ________ and farmer requested for installation of
Protected Cultivation structure (tick mark on applicable) on _____________sqm.(........... in
words) Of and situated in village _____________, Tehsil____________________,
District___________________________, Punjab State. HDO has organized installation of
poly house on farmer's field through empanelled and selected Firm by farmer on the
following terms and conditions, obligations and responsibilities of each party as under:
1. APPLICATION REGISTRATION
1.1. HDO has received above referred application of farmer in MIDH Performa along
with design, cost estimates, original copy of and record and attested copy of ration
card / residence proof.
1.2. Farmer undertakes that he / she has not availed assistance on account of Protected
Cultivation in his / her name from any Government agency at anytime, anywhere in
Punjab State.
1.3. HDO issued application receipt no. ____________________ dated _____________
2. SANCTION LETTER
2.1. District Head of concerned district received followings estimates from farmer
alongwith estimate of the Firm duly accepted by farmer and after verification from
HDO of concerned block to accord approval in the format as under:

2.2. Director Horticulture-cum-Mission Director SHM, Punjab shall issue sanction to
farmer in Form-5 with copy to Firm & Bank (if financed) after receipt of following
documents.
1. Tri partite Agreement
2. Site Survey Report (Form-1)
3. Choice/Selection of firm by the farmer (Form-2).
4. Design and cost estimate of structure and Design and technical
specifications of MIS System (Form-3).
5. Site Clearance Certificate (Form-4)
6. Undertaking of farmer (if financed).
Farmer agreed to undertake and work at his own cost as per advice of firm and hand
over the site to the firm for installation of structure on the date of signing of TPA..
3. SIGNING OF TPA (TRI PARTITE AGREEMENT) & ISSUE OF WORK ORDER
3.1 This tri-partite agreement is signed by the farmer, authorized representative of Firm
and HDO.
3.2 The Tri-partite Agreement shall be effective from the date of signing of Agreement.
4. INSTALLATION AND INSPECTION :
4.1. Farmer shall provide facilities like levelled site and water required during installation
of structure free of cost.
4.2. Farmer shall provide safe storage place to Firm for storing various components /
instrument subject to watch and ward of firm.
4.3. Firm shall undertake installation activity after received work order from Director
Horticulture-cum-Mission Director SHM, Punjab and complete installation work in a
maximum period of 60 calendar days( 90 days in bank loan case). The start of period
shall be counted from the date of issue of work order. The firm shall be responsible
and liable for installation of structure as per standards applicable.
4.4. Firm agreed to construct suitable pucca platform of size 8'x 8' or as per guidance
given by the MIS Supplier for creation of platforms for filter, fertigation tank, head
control unit and also take up other involved civil works. The cost of civil work as
above is to be borne by the firm.
4.5. Firm should ensure that trenches are kept open at defined locations for physical
verifications cum trial run.
4.6. Firm will hand over after trial run of the MIS system, a complete and updated "As
Made Design Map" to the farmer. The map should include a clear presentation of the
head control unit, water carrier and distribution system including pipelines, location
of valves, air release valves, junctions and other components etc.
4.7. Inspection
4.7.1 1st inspection will be conducted by the concerned HDO in the presence of concerned
Firm representative and concerned Farmer (site selection).
4.7.2 2nd
inspection will be conducted by the concerned HDO, District Nodal Officer for
Protected structures in the presence of concerned Firm representative and concerned
Farmer. This inspection will be carried out at the time of completion of foundation
work and supply of complete steel material excluding cladding material (Form No.
7).
5.7.3 3rd
final inspection will be conducted after completion of protected structure in all
respect subject to submission of No Dues Certificate, and “Completion certificate”
from concerned firm. Afterwards the district head will arrange the final inspection.
Committee for final inspection shall be comprising District Head, District Nodal
Officer for protected structures, concerned HDO, Assistant Agriculture Engineer or
SCO or nominee from PAU as representative. This inspection shall be done in the
presence of concerned firm representative, concerned farmer and financing
institution if, applicable. This inspection shall be arranged within 15 days after
completion of the protected structure subject to availability of committee members.
4.8. Additional inspection: Due to the shortcoming in structure during first / final
inspection, the additional inspection if required, the firm shall be responsible for
arranging inspection.
4.9. Delay in start of work: In case delay in start of work by firm is more than 30
calendar days, then, farmer is free to choose another empanelled firm. In this case
first firm shall pay actual amount along with interest @18% per annum to the
farmer on the deposited amount.
4.10. Delay in completion of work : If firm fail to complete the protected structure with
in stipulated time i.e. within 60 days from the date of confirmed order then there
will be a penalty of 2 % of total project cost .Decision of the sanctioning authority
will be final. This amount will be deducted from the EMD of the firm and the
concerned firm cannot take up any further work till it completes the project in
hand.
4.11. Termination of Contract : In case of delay of more than 90 days(including penalty
days) the contract may be terminated and work may be got completed by the farmer
from any other empanelled firm at the risk and cost of the first firm after approval
from Director Horticulture-cum-Mission Director SHM, Punjab and action may be
initiated against first firm.
4.12. Completion of structure: The completion of structure means submission of
completion certificate and satisfactory final inspection report along with removal of
short coming if any (Submission of Form-9 and 10) .
5. GOVERNMENT CONTRIBUTION
5.1. HDO will calculate Government contribution (Subsidy), farmers share as per the
provision under the scheme.
5.2. As per requirement of Government contribution, farmer is required to maintain
structure for five years from the date of handing over by firm. In case the farmer
dismantle the structure within five years from the date of handing over by Firm,
farmer is bound to refund the subsidy amount.
5.3. This agreement will be considered as part of undertaking for the purpose of subsidy.
6. OTHER OBLIGATIONS OF THE FARMER
6.1. Farmer agreed to settle (pay or receive) the account, after the installation of structure
on the field and firm agreed to collect/pay difference amount, if any.
6.2. The farmer agreed not to change / modify / remove / dispose / resell the structure
during the five years period. The farmer shall note that HDO and / or Firm will not
be responsible for any consequence like Government contribution entitlement
variation due to amendments issued by Government, reduction in yield, crop
damages etc. arising out of changes such as modification / removal / disposal / sale /
damage of the structure by the farmer.
6.3. The farmer cannot create any lien / charge or transfer the structure fully or any
portion thereof. In case of bankable projects, the banks are free to make lien as per
RBI norms and guidelines.
6.4. HDO and firm shall not be responsible for cropping plan, yield, crop damage, etc.
arising out of either delay in installation of structure or after handing over of
structure to the farmer.
6.5. The farmer agrees that he has acquired sufficient knowledge to run the Poly house.
Therefore, in this context the firm and Department of Horticulture, Punjab are no
where responsible.
6.5.1. The construction of protected structure is to be executed by farmer through
empanelled firm of his/ her choice, the responsibility of quality standard of material
and erection rests with the farmer. However, Department is facilitating the farmer by
conducting inspection two times during erection. Department is not supervising the
entire erection of protected structure. These inspections are on random sample basis
of each structure. As farmer is executing the erection and supposed to supervise his /
her structure during execution of work, therefore, any deviation of specifications and
standards the farmer shall bring this into the notice of Block HDO and District Head
in writing during execution of work for timely correction and deficiency if any and
even stoppage of work. The Department shall release the financial assistance
after successful final inspection subject to availability of funds.
6.5.2. At the time of first inspection (Form-6) farmer will be present with the inspection
team and will certify that the material being used by the firm is as per specification
and he will give certificate to the firm as well as to the inspection team (Form-6,
Progress Report – I). The farmer will also submit the report of supply of cladding
material in Form-8 as Progress Report – II.
6.5.3. Before final inspection the firm will intimate to the farmers as well as to the
Department that the work has been completed in all respects (Form-9). The farmer
will inspect the work done by the firm before final inspection and point out
deficiencies / short coming to the firm as well as to the Department, if any . The
firm will remove these deficiencies / short coming before final inspection pointed
out by the farmer.
6.6. At the time of final inspection farmer will be present with the inspection team. The
farmer can point out if any short coming is still left in that case the firm will remove
short comings immediately and intimate to the farmer and Department for additional
inspection. The expenditure for the additional inspection will be borne by the
concerned firm.
6.7. At the time of final inspection, if the farmer is satisfied with the work done by the
firm, the farmer will take possession of the structure in the presence of team and will
give possession certificate (Form-10) to the firm as well as to the Department. If the
farmer fails to give possession certificate within one week after final inspection /
additional inspection his / her structure shall stands completed.
7. Release of Assistance :
7.1. Assistance release in case of non-bankable projects: District head will send the
complete case along with final inspection to the mission Director. if documents
founds complete in all respects, mission Director shall release the finical assistance to
the concern the district which further transfer it online to the beneficiary’s account.
to farmer in single instalment, on receipt of invoice along with first and final
inspection report subject to availability of funds.
8. Guarantee / Warranty / After Sale Service :
8.1. Guarantee / Warranty of material : The firm will provide guarantee / Warranty
certificate of the material used for construction of protected structure to farmer. This
guarantee / Warranty shall remain valid for a period of three years after final
inspection. The guarantee / Warranty includes all the structure material including
cladding material. If material has to be replaced in guarantee / Warranty period, the
same shall be done by the construction agency free of cost.
8.2. The guarantee / Warranty of cladding material shall be of properties only.
8.3. The guarantee period of cladding material shall be for one year. After one year
warranty period is for two years. Firm must supply guarantee of cladding material for
three years for its properties.
8.4. After sale service : After sale service is the responsibility of the firm. The after sale
service has to be provide the sale service on following items free of cost.
8.4.1. Any type of technical defect.
8.4.2. Gutter leakage and other type of leakage.
8.4.3. Improper operation of shade net beneath poly sheet.
8.4.4. Leakage in MI system.
8.4.5. Side vent curtain not proper opening and closing.
8.4.6. Curtain clamps left out from curtain folder.
8.4.7. Tighten of nut bolts / fasteners.
8.4.8. Rusted fasteners / nut-bolts / steel parts.
8.4.9. Agronomical services as per provisions of After Sales Service Card.
8.5. Process of repair in case of damage and claim of penalty :
8.5.1. Repairing must be executed by the construction firm. Farmer shall intimate to
firm through email or in written and shall maintain receipt of the same. Firm
has to ensure to repair the structure within seven days. If firm fails to repair the
structure then farmer has to complaint to District Head in written.
8.5.2. The District Head will intervene the problem of farmer and wrote to the firm
to repair the structure of said farmer within five days. If again firm fails to
repair the structure then the concerned firm will not be given any further work
in Punjab and it will be conveyed to Mission Director Horticulture, SHM,
Punjab for debarring the firm for next year’s empanelment.
10. OTHER TERMS
10.1 The farm productivity does not depend on the use of structure alone. It is also
impacted by other factor such as planting materials, application of inputs in terms of
quantity and schedule, incidence of diseases, soil quality and weather conditions etc.
The responsibility of Firm is limited to the quality installation, technical guidance
about maintenance and operation of structure.
10.2 Firm is bound to entertain all type of cases for which it is empanelled irrespective of
size of unit.
10.3 Farmers should strictly follow the guidelines for operation and maintenance given
by firm for successful performance.
10.4 Farmers should not lodge any false complaint / claim or to create any unpleasant
situation and try to settle differences and disputes if any, amicably and as far as
possible at local level through concerned HDO. In no case the department of
Horticulture will be involved in any legal procedures.
10.5 If any time during the continuance of this contract, the performance in whole or in
part by either party of any obligation under this contract shall be prevented or
delayed by reason of any war, hostility, act of the public enemy , civil commotion,
sabotage, fires, floods, explosion, epidemics, quarantine restriction, strikes etc.
(herein referred to as event), then provided written notice of the happening of any
such event is given by either party to the other within 60 days from the date of
occurrence thereof, neither party shall by reason of such event be entitled to
terminate this contract nor shall either part have any claim for damages against the
other in respect of such non-performance or delay in performance, and deliveries /
services under this contract shall be resumed as soon as practicable after such event
has come to end or ceased to exist and the decision of District Head as to whether
the deliveries have been submitted or not shall be final and conclusive.
10.6 In case of damage of structure before completion the firm is responsible. In any
circumstance the Department is not responsible for any type of damage.
10.7 All disputes and difference arising out of or in any way touching upon or concerning
this construction fabricated what so-ever-shall be referred to Director Horticulture-
cum-Mission Director SHM, Punjab. The decision of Director Horticulture-cum-
Mission Director SHM, Punjab shall be final and binding on the concerned parties.
10.8 Mission Director Horticulture, Punjab will be Appellant Authority in case the
dispute is not settled at district level.
10.9 Any suit or proceedings to enforce the right of either party under this, agreement
shall be instituted and tried only in the court of concerned district and by no other
courts, and parties here to expressly agree to submit to the exclusive jurisdiction of
Courts in concerned district.
10.11 The contents of this agreement have explained fully to the farmer and the farmer
signed this agreement after fully understanding the contents of this Agreement.
