Dear Ms. Eraut:

This letter requests Federal Highway Administration (FHWA) approval of the following Section 4(t) de minimis finding for a recreation area associated with the US 20 @ Barclay (Sisters) Project: Sisters Multi-Use Path. Oregon Department of Transportation (ODOT) is preparing a Categorical Exclusion for this project. The construction on the $3.5 million dollar project is expected to occur during the Spring/Summer of 201 7.

The City of Sisters, in partnership with ODOT, with the US 20 @ Barclay (Sisters) project, intends to improve the intersection of US 20 and McKinney Butte Road/W Barclay Drive, located northwest of downtown Sisters. According to the 2010 City of Sisters Transportation System Plan (TSP), this intersection does not currently meet jurisdictional operating standards for both volume-to-capacity and safety conditions. As a result, there have been serious crashes at the intersection recently, and there is great concern for school related pedestrian safety. Based on the TSP analysis, US 20 and McKinney Butte Road/W Barclay Drive intersection failure occurs due to high delays experienced by the minor street (W Barclay Drive) traffic. Delays are caused by high through traffic volumes and the resulting lack of available gaps for minor street traffic to enter or cross the major street traffic stream. A high level of truck traffic likely affects highway performance at this intersection.

The proposed remediation for the US 20 and McKinney Butte Road/W Barclay Drive intersection will be to construct a roundabout (the "US 20 @ Barclay roundabout") that will reduce conflicts among vehicles, bicyclists, and pedestrians while improving traffic flow for all users, including freight. The roundabout will also improve access to and from the W Barclay Drive/N Locust Street and provide an aesthetically pleasing gateway into Central Oregon. The

US 20 @ Barclay roundabout will provide freight safe controlled access back onto US 20 from W Barclay Drive/N Locust Street.

The US 20 @ Barclay roundabout abuts the Sisters Multi-Use Path, which is owned and maintained by the City of Sisters. The multi-use path is located west of US 20 and serves as a major connector between downtown Sisters and commercial retailers. The path also serves as a corridor giving access to the Sisters Middle School and the Sisters High School. The path extends 0.5 miles before connecting back within the City of Sisters sidewalk system. The path is an important piece within the larger connecting corridor for making the City of Sisters accessible without automotive transportation. It also is an important recreational trail that residents of the City of Sisters use to easily escape the urban atmosphere while trail running, jogging, biking, etc. The Sisters Multi-Use Path is open to the public and integral to the overall vision of the City of Sisters and, therefore, is considered significant at the local level. As a result, the Sisters Multi­Use Path is considered a Section 4(f) resource.

The project will acquire approximately 6,278 sq. ft., 0.1441 acres, or 0.1840 percent of the 26,400 sq. ft. Sisters Multi-Use Path in permanent easements. The project will also acquire approximately 402 sq. ft., 0.0092 acres, or 0.0152 percent of the Sisters Multi-Use Path in fee acquisition to tie the path to the existing sidewalk along McKinney Butte Road. The fee acquisition and permanent easements will not affect the public's ability to use any of the activities, features, or attributes of the path. Per the specifications of the project, the path will be open during the construction of the roundabout. Even after the construction is finished, the path will continue its use and the fee acquisition and permanent easements will only be utilized when maintenance of the sidewalk, slopes, illumination facilities, and drainage facilities is required.

Avoidance of the entire path was not feasible; however, the US 20 @ Barclay (Sisters) project, throughout its design, took into consideration the recreational activities, attributes, and features of this Section 4(f) property. The project recognized the importance of the site's existing recreational use. As the design for the US 20e@ Barclay (Sisters) project advanced, the project actively attempted to take into consideration the Sisters Multi-Use Path and preserve its recreational options. When the project was first proposed, the APE was substantially larger than the current footprint. Striving to not alter or hinder the recreational opportunities provided by Sisters Multi-Use Path, the proposed acquisition from the path became limited to the small area needed for the continued and future sidewaik maintenance, management of slopes. illumination facilities, and drainage facilities following the construction of the roundabout. The permanent easement will not hinder the use of the path as the parcel will only be accessed as necessary. The design team carefully limited the permanent easement to the location immediately surrounding the proposed roundabout.

Therefore, with the careful consideration to the land to be procured and the lack of impacts to the recreational features present, as well as its intended limited use for future maintenance which ultimately enhances the overall purpose of the path, the Section 4(f) use is considered minor in

scale to the entire site (Attachment I a and Attachment 1 b ). As a result, the Section 4(f) use is considered a de minimis impact and the permanent easement acquisition will be consistent with the Uniform Act.

There are no other Section 4(f) resources within the project APE; however, a Section 4(f) Temporary Occupancy finding is also anticipated for the Sisters Multi-Use Path.

ODOT Region 4 has been very active with engaging and notifying the public about the US 20 @ Barclay (Sisters) Project including a public meeting on April 14th

, 2015, where approximately 52people attended from the community. ODOT Region 4 has also held meetings with the City of Sisters Chamber of Commerce. The project has also been ardently followed and documented in the local newspaper, NuggetNews. The NuggetNews, with comments from ODOT, published articles on March 31, 2015; April 7th

, 2015; August 4th, 2015; August 25th

, 2015; April 19th,

2016; and July 19th, 2016 describing the project and its subsequent updates. Overall, the majority

of the comments received about this project in general have been very favorable.

ODOT Region 4 published a notification in the NuggetNews detailing the project and its proposed impacts on August 315

\ 2016 and September 7th, 2016 (Attachment 2a). The notice was

also posted at the Sisters Multi-Use Path beginning on August 25th. The notifications provide public comment opportunity for the proposed Federal Highway Administration Section 4(f) de

minimis impact to the Sisters Multi-Use Path. There were no comments received for the proposed de minimis use of the Sisters Multi-Use Path.

Attachment 2a: A copy of the public notice printed in the NuggetNews describing the de minimis use of the Sisters Multi-Use Trail. Since the permanent easement size ODOT was going to be acquiring for the project kept fluctuating, the number published was set for a larger amount. In this case, the number ODOT is actually acquiring (6,680 sq. ft. - the permanent easement plus the fee acquisition) is smaller than what was published and posted at the trail site. Zero comments were received during the public notice period with the larger number published. The new temporary easement number is reflected in the temporary occupancy document as concurred with by the Official With Jurisdiction - the City of Sisters.
