When is a crime “reported”?(for purposes of the Annual Report)

H When a victim or witness brings it to theattention of the local police or a campussecurity authority.

Public Property? So…. Where does one draw the line? A

sidewalk or a public parking lot across the

street from campus property would beincluded in this new reporting area, while alimited-access Interstate highway whichdirectly borders the campus but is separated

by a right-of-way fence would not be.è Use of a map to define the area is

optional.

CategoriesH Criminal Homicide, Sex Offenses ( forcible +

nonforcible ), Robbery, Aggravated Assault,Burglary, Motor Vehicle Theft, & Arson….plus arrests or disciplinary referrals for liquor,drug & weapon offenses.

Voluntary confidential reporting & reporting to counselors

H If there is a policy or procedure thatallows victims or witnesses to makevoluntary, confidential crime reports forinclusion in the annual crime stats, itmust be described.

H If pastoral or professional counselorsinform their clients of the opportunity tomake voluntary, confidential crimereports, that must also be addressed.

Timely Notice RequirementH The school shall, in a manner (to be

determined by the school) that is timely andwill aid in the prevention of similar crimes,

report to the campus community on crimesthat are: – listed in the Act, – reported to campus secur it y aut horit ies

as ident if ied by t he school or to localpolice , and – considered to represent a threat to others.

Records Retention Period

H This requirement is outlined in Section 668.24of the Student Assistance General Provisions.

All supporting records, including daily logs,must be kept for 3 years following thepublication of the last annual campussecurity report to which they apply.

å This may result in a Clery Act recordsretention period of nearly 7 years afterthe date of an incident.
