The Hamsey Green entry simply called 'Hamsey' proved very popular with ourvisitors, and received an extremely high number of votes. Hamsey is on displayoutside the Dene Coffee Shop at ourWoldingham Centre.

Mr Knight was delighted with so many entries for the competition which willrun annually.

All the schools and organisations will compete for three trophies and medals andalso garden centre vouchers. Mr Knight said "It's super that so many youngpeople have taken part in our competition, all the entries were great, it’s superto see these bright young people involved in such a simple country pastime."

Is a Directoran Employee?When a company becomes insolvent,whether or not a director is anemployee, within the meaning ofthe Employment Rights Act 1996(ERA), for the purposes of a claimfor a statutory redundancy paymentfrom theGovernment, can be difficultto ascertain. The EmploymentAppeal Tribunal (EAT) consideredthis issue in the case of Nesbitt andNesbitt v Secretary of State forTrade and Industry.

Mr and Mrs Nesbitt were directorsof APAC Computer Training Ltd.They managed the company on aday-to-day basis and between themowned 99.99 per cent of the shares.From the start, they had writtencontracts of employment with thecompany in the same form as thoseof other company employees. Theywere paid salaries commensuratewith their roles as the seniormanagers of the business.

In the course of 2006, the company became insolvent and the remaining employees, including Mrand Mrs Nesbitt, were made redundant by the liquidator. The couple applied to the InsolvencyService for redundancy payments under the provisions of the ERA. Their claims were rejected onthe grounds that they were not employees within the meaning of the Act.

The Employment Tribunal agreed with the Insolvency Service on the basis that the Nesbitts werein joint control of the company.

The EAT overturned this decision on appeal. In its view, the fact of the Nesbitts’ control over thecompany was not sufficient of itself to deprive them of employment status if they otherwisesatisfied all the criteria for employment.

In this case, apart from the level of control they had over the company, all the indications werethat Mr and Mrs Nesbitt were employees. They had proper employment contracts (equivalent tothose issued to other employees), they received all their remuneration by way of salary and they‘behaved like employees’.

Says Richard Stephens, “One of the relevant factors to be taken into consideration in cases suchas this is the contract of employment.We can assist you to ensure that your employment termsmake sure you have the appropriate contractual relationship with your company.

Nasty pest

Q. My gooseberry plants have most of theirleaves eaten each year by a pest, is thereanything I can do about it?

A. This is the gooseberry sawfly which can bevery common and destructive on the plants.They can strip the plants very quickly of allfoliage. Unfortunately any chemical control hasnow been withdrawn and the only course ofaction is to pick off and destroy the larvae asthey are seen from about April onwards.

January tips• Chit seed potatoes this month.

• Check tree stakes and ties to make surethey are not too tight or have rotted.

• Now is a good time to buy lily bulbs anddahlia tubers.

• Sow sweet pea seeds now in containers.

• Take root cuttings of suitable perennials.

• Brush any heavy snow off plantsespecially conifers to preventbranches breaking or bending.

• Prune late flowering clematis.

• Pot up plug plants of bedding.

• Start dahlia tubers into growth.

• Rake any leaves off thelawn but keep off if it’sfrosty.

• Plant fruit trees and bushesif the soil is not frozen ortoo wet.

• Prevent ponds fromfreezing over completely byinstalling a pond heater orfloat a ball on the surface.

• Prune grape vines beforeChristmas.

Q. My fuchsia leaves are distorted, haveholes in and the flowers have failed to developproperly, what could have caused this?

A. This is most likely capsid bug damage;the insects attack the foliage earlier in theseason and produce toxic saliva which kills theplant cells as they feed. As the foliage expandsit tears into holes where they have beenfeeding. Vigilance early in the spring aroundmid-may onwards is the key. Use an insecticidecontaining bifenthrin, such as Bayer GreenflyKiller Plus if damage is seen, as it is importantto catch damage in the early stages.

Q. My brassicas are completely strippedof foliage most years by wood pigeons, isthere an effective method of stopping this?

A. The only reliable protection is to net theplants. Some home made devices such ashanging cd’s to reflect the light or windmillsthat make a noise to scare the birds off willwork for a while, but they often become usedto these.
