Project officers should note that in case of term contracts, measurement for payment for the Daily Cleaning and Weekly Tidying of the Site shall be based on the area of the Public Cleaning Areas, but, it shall be a condition precedent that the whole Site (work area plus Public Cleaning area) are to be cleaned and tidied up in any ‘Daily Cleaning’ and ‘Weekly Tidying’ work to the satisfaction of the Engineer/Maintenance Surveyor’s Representative before the Contractor is entitled to the payment for such items of work. 3. Technical Circular (Works) No. 6/2002A

Enhanced Specification for Site Cleanliness and Tidiness

WBTC No. 6/2002 was issued to promulgate a set of Special Conditions of Contract, Particular Specification, Method of Measurement and sample BQ and Schedule of Rate Items to enhance the level of cleanliness and tidiness of public works project sites. Appendices A to D of that Circular are hereby amended and superseded by Appendices A to D of this Circular. The purpose of the amendments are, inter alia, to revise the relevant clauses in that WBTC No. 6/2002 to clarify the definition of “Site” to include “Public Cleaning Areas”, and the measurement and payment for term contracts. 2. Cleaning Week Days in any rolling five Cleaning Days or Cleaning Week Days can result in a verbal warning. If performance is not improved, a written warning will be issued and further non-performance may be reflected in the quarterly report on the contractor’s performance. For the purpose of this counting, ‘Cleaning Day’ and ‘Cleaning Week Days’ are counted as one.”

Appendix A

Appendix A(a) - Special Conditions of Contract (Applicable to works contracts other than term contracts) SCC 1 (1) “Public Cleaning Areas” means those public areas

of the Site where no work is to be carried out other than cleaning by the Contractor and which have to be maintained open to the general public throughout the progress of the Works, the extent of which is specified in para. 1(a) of the Particular Specification Clause No. [ ]. [The Sample Particular Specification clause in Appendix B(a).] For the avoidance of doubt, Site includes Public Cleaning Areas.

(2) “Daily Cleaning” means daily cleaning and tidying up of the Site in accordance with Particular Specification Clause No. [ ].

Daily Cleaning

(3) “Weekly Tidying” means weekly overall cleaning and tidying up of the Site in accordance with Particular Specification Clause No. [ ].

Weekly Tidying

(4) “Cleaning Day” means a day on which “Daily Cleaning” is to be carried out.

Cleaning Day

(5) “Cleaning Week Day” means a day on which “Weekly Tidying” is to be carried out.

Cleaning Week Day

(6) From the date for commencement of the Works to the date for completion of the Works, or the relevant Section, as the case may be, the Contractor shall, unless otherwise instructed by the *Architect / Engineer (except on a General Holiday) carry out either Daily Cleaning or Weekly Tidying. The time for commencing Weekly Tidying and the day of every week for the Cleaning Week Day shall be agreed with the *Architect / Engineer’s Representative within seven days after the date for commencement of the Works. If a day on which the Weekly Tidying is scheduled falls on a General Holiday, then it shall be carried out on the day following which is not a General Holiday.

(7) The *Architect/Engineer has absolute discretion to instruct the Contractor to cease or suspend all

or part of the Daily Cleaning and/ or Weekly Tidying of the Site at any time during the Contract. Such instruction shall not constitute a variation under Clause 60 of the General Conditions of Contract and the Contractor shall not be entitled to be reimbursed of any expenses arising out of or in relation thereto the instruction.

(8) The *Architect/Engineer’s Representative has the power to instruct the Contractor to clean and tidy up the areas around the Site if to the judgment of the *Architect/Engineer’s Representative, the rubbish and debris are likely connected with the Works or disposed of by the persons working on the Site, and the Contractor shall not be entitled to claim for any additional cost due to such cleaning and tidying up work performed outside the Site boundary.

(9) The Contractor shall only be entitled to payment for only one day of “Daily Cleaning” or “Weekly Tidying”, but not more of either, for the cleaning and tidying up work carried out by the Contractor on any one Cleaning Day or Cleaning Week Day.

(10) The Contractor shall not be entitled to any payment for Daily Cleaning or Weekly Tidying carried out if in the opinion of the *Architect / Engineer, such work has not been satisfactorily performed on the relevant working day.

For the avoidance of doubt, measurement for the items for “Daily Cleaning” and “Weekly Tidying” for each Works Order shall be made for the Public Cleaning Areas of such Works Order. Daily Cleaning and Weekly Tidying for the areas of the Site other than the Public Cleaning Areas for a Works Order shall be deemed to be included in the rates of other items of work for such Works Order and shall not be measured for payment. It shall be a condition precedent that the Daily Cleaning and Weekly

Tidying of the Site including areas other than the Public Cleaning Areas in a Works Order are performed to the satisfaction of the *Engineer/Maintenance Surveyor’s Representative before the Contractor is entitled to payment for the respective item for “Daily Cleaning” and “Weekly Tidying” under such Works Order.

(10) The Contractor shall not be entitled to any payment for Daily Cleaning or Weekly Tidying carried out if in the opinion of the * Engineer/ Maintenance Surveyor, such work has not been satisfactorily performed on the relevant working day.

Appendix B

Appendix B(a) - Particular Specification for Daily Cleaning and Weekly Tidying (Applicable to works contracts other than term contracts)

[1] Site Cleanliness and Tidiness – Daily Cleaning and Weekly Tidying (a) The Contractor shall perform Daily Cleaning and Weekly Tidying of the

Site including Public Cleaning Areas. The extent of the Public Cleaning Areas required for cleaning are delineated in the Drawing No. _______ / deemed to be within ___ metres [preferably not less than 2.5m] on the periphery outside the barriers or hoardings, or determined by the *Architect/Engineer’s Representative on site for each work location based on the requirements in the Particular Specification, and taking into account the actual site condition before work commences.

(b) The Contractor shall draw up, in the Waste Management Plan where

appropriate, a system on waste management, and maintenance of cleanliness and tidiness of the Site including, but is not limited to, the methods and provisions including the proposed areas for on-site sorting, separation, storage and disposal of waste materials, and the proposal of how to maintain the Site in clean and tidy condition. The Contractor shall provide the necessary facilities, receptacles and transport for the temporary storage, disposal and removal of different types of wastes.

(c) Daily Cleaning

(i) “Daily Cleaning” shall include cleaning and tidying up after work of tools, equipment, unused materials, storage areas and common areas such as passageways, daily removal of waste materials from works areas, removal of any rubbish and debris dumped into the Site by the public and, without derogating from the generality of the foregoing, shall include, but is not limited to, all the items subject to checking as listed in sub-clause (c)(ii).

(ii) The Contractor shall develop inspection checklist for Daily Cleaning for the approval of the *Architect/Engineer’s Representative. The inspection checklist shall be reviewed and updated whenever there is a change in work nature or work location and re-submitted for approval by the *Architect/Engineer’s Representative. The inspection checklist shall include an assessment on the cleanliness and tidiness of all work locations, plus the Public Cleaning Areas. Items to be checked against for each work location shall include, but are not limited to, the following:

− Maintenance of passageways, common accesses and public areas free of obstruction;

− Proper storage and stacking of materials;

− Proper placement and storage of tools and equipment after work;

− Proper sorting, storage and/or disposal of waste materials in accordance with the Waste Management Plan;

− Proper securing of hoarding, barriers, guarding, lighting, and signing of works;

− Prevention and removal of water ponds and flooding;

− Clearing of stockpiling and wastes arising from the Works;

− Conditions of cleanliness and tidiness of the Site including Public Cleaning Areas in the perspective of the general public; and

− Other cleaning requirements as instructed by the *Architect/Engineer’s Representative.

(iii) The Contractor shall assign person(s) to inspect the Site after each Cleaning Day’s work. The assigned person shall check and ensure the cleanliness and tidiness of the Site, complete the inspection checklist, record the areas requiring improvements, and take photographs of areas where cleaning and tidying up works have been done and where improvement actions are required.

(iv) The Contractor shall notify the *Architect/Engineer’s Representative the time schedule for Daily Cleaning on every Cleaning Day and the name of the assigned person as referred to in sub-clause (c)(iii) above responsible for the inspection and checking after each Cleaning Day.

(v) The Contractor shall submit, in the morning of the day (which is not a General Holiday) following a Cleaning Day, the inspection checklist, records and photographs prepared pursuant to sub-clause (c)(iii) above to the *Architect/Engineer’s Representative for checking and recording.

(vi) The *Architect/Engineer’s Representative may carry out inspections and surprise checks to verify the Contractor’s performance on cleanliness and tidiness of the Site before the noonof the day (which is not a General Holiday) following a Cleaning Day. The Contractor shall not be entitled to any payment for the item for “Daily Cleaning” for a Cleaning Day if the performance of the Contractor on cleanliness and tidiness for any part of the Site on that Cleaning Day is not carried out to the satisfaction of the *Architect/Engineer’s Representative. The *Architect/Engineer’s

Representative shall notify the Contractor and record in the Site Diary for any non-payment of the item for “Daily Cleaning” on a Cleaning Day and the areas of dissatisfaction for improvement by the Contractor.

(vii) The Contractor shall in the morning of every Cleaning Day before work commences inspect and remove any rubbish and debris that may be littered by the public over the night within any area which cleanliness and tidiness the Contractor is required to maintain under this Contract before the inspection by the *Architect/Engineer’s Representative.

(d) Weekly Tidying

(i) “Weekly Tidying” shall include the cleansing and tidying up of the common areas and accesses, cleansing and/or re-conditioning of hoardings, barriers, guarding, lighting, signage and/or traffic cones, cleansing of external covers for plant and equipment, removal of waste and debris etc. so as to ensure that the plant and equipment, hoardings, as well as the Site as a whole, to be clean and tidy in the perspective of the general public and, without derogating from the generality of the foregoing, shall include, but is not limited to, all the items subject to checking as listed in sub-clause (d)(ii).

(ii) The Contractor shall develop inspection checklist for Weekly Tidying for the approval of the *Architect/Engineer’s Representative. The inspection checklist shall be reviewed and updated whenever there is a change in work nature or work location and re-submitted for approval by the *Architect/Engineer’s Representative. The inspection checklist shall include an assessment on the cleanliness and tidiness of the Site conditions at various work locations, plus including the Public Cleaning Areas. Items to be checked against for each work location shall include, but are not limited to, the following:

− Thorough cleansing of passageways, common accesses and public areas;

− Re-organizing of storage materials for better utilization of storage spaces and safe stacking if appropriate;

− Maintenance and re-conditioning of tools and equipment;

− Cleansing of external covers for plant and equipment;

− Collection and removal of disposed waste materials off site in accordance with the Waste Management Plan;

− Cleansing, re-conditioning and/or replacement of hoarding, barriers, guarding, lighting, and signage of works to good working condition;

− Clearing of drains and channels to prevent flooding; and

− Other cleansing requirements as instructed by the*Architect/Engineer’s Representative from the perspective of the general public.

(iii) The Contractor shall assign person(s) to inspect the Site after each Cleaning Week Day’s work. The assigned person shall check and ensure the overall cleanliness and tidiness of the Site, complete the inspection checklist, record the areas requiring improvements, and take photographs of areas where overall site cleaning and tidying up actions have been done and where improvement actions are required.

(iv) The Contractor shall notify the *Architect/Engineer’s Representative the time schedule for Weekly Tidying on every Cleaning Week Day, and the name of the assigned person as referred to in sub-clause (d)(iii) above responsible for the inspection and checking after each Cleaning Week Day.

(v) The Contractor shall submit, in the morning of the day (which is not a General Holiday) following the Cleaning Week Day, the inspection checklist, records and photographs prepared pursuant to sub-clause (d)(iii) above to the *Architect/Engineer’s Representative for checking and recording.

(vi) The *Architect/Engineer’s Representative shall, together with the Site Agent, check and inspect the overall cleanliness and tidiness of the Site on the day (which is not a General Holiday) following the Cleaning Week Day. The *Architect/Engineer’s Representative shall advise the Contractor whether his performance is to his/her satisfaction, or if not, where improvement actions are required.

(vii) The Contractor shall promptly rectify the defects identified by the assigned person as referred to in sub-clause (d)(iii) above, and/or the *Architect/Engineer’s Representative. The Contractor shall not be entitled to any payment for the item for “Weekly Tidying”for a Cleaning Week Day if the Contractor fails to rectify the identified defects pursuant to sub-clauses (d)(iii) and (d)(vi) above to the satisfaction of the *Architect/Engineer’s Representative before the end of the day (which is not a General Holiday) following the Cleaning Week Day.

(viii) The Contractor shall in the morning of every Cleaning Week Day

Appendix B

Appendix B(b) – Particular Specification for Daily Cleaning and Weekly Tidying (Applicable to term contracts) [1] Site Cleanliness and Tidiness – Daily Cleaning and Weekly Tidying

(a) The Contractor shall perform Daily Cleaning and Weekly Tidying of the

Site including the Public Cleaning Areas for each Works Order. The extent of the Public Cleaning Areas required for cleaning are delineated in the Drawing No. _______ /deemed to be within ___ metres [preferably not less than 2.5m] on the periphery outside the barriers or hoardings unless otherwise specified by the *Engineer/Maintenance Surveyor’s Representative in the Works Order. Where necessary, the *Engineer/Maintenance Surveyor’s Representative shall determine the Public Cleaning Areas on site for each Works Order and may amend their extent on each day based on the requirements in the Particular Specification, and taking into account the actual site condition before work commences.

(b) The Contractor shall draw up a system and provide the necessary

facilities, receptacles and transport for sorting, temporary storage, disposal and removal of different types of waste materials including, but is not limited to, metals, papers and non-metallic inert construction and demolition (C&D) materials.

(c) Daily Cleaning

(i) “Daily Cleaning” of a Works Order shall include cleaning and tidying up after work of tools, equipment, unused materials, storage areas and common areas such as passageways, daily removal of waste materials from works areas, removal of any rubbish and debris dumped into the Site by the public and, without derogating from the generality of the foregoing, shall include, but is not limited, to all the items subject to checking as listed in sub-clause (c)(ii).

(ii) The Contractor shall develop inspection checklist for Daily Cleaning for each Works Order after each Cleaning Day’s work for the approval of the *Engineer/Maintenance Surveyor’s Representative. The inspection checklist shall be reviewed and updated whenever there is a change in work nature or work location under such Works Order and re-submitted for approval by the *Engineer/Maintenance Surveyor’s Representative. The inspection checklist shall include an assessment on cleanliness and tidiness of all work locations of such Works Order plus the Public Cleaning Areas. − Conditions of cleanliness and tidiness of the Site including Public Cleaning Areas in the perspective of the general public; and

− Other cleaning requirements as instructed by the *Engineer/Maintenance Surveyor’s Representative.

(iii) The Contractor shall assign person(s) to inspect the Site of each Works Order after each Cleaning Day’s work. The assigned person shall check and ensure the cleanliness and tidiness of the Site of such Works Order, complete the inspection checklist, record the areas requiring improvements, and take photographs of areas where cleaning and tidying up works have been done and where improvement actions are required.

(iv) The Contractor shall notify the *Engineer/Maintenance Surveyor’s Representative the time schedule for Daily Cleaning of each Works Order on every Cleaning Day and the name of the assigned person as referred to in sub-clause (c)(iii) above responsible for the inspection and checking after each Cleaning Day.

(v) The Contractor shall submit, in the morning of the day (which is not a General Holiday) following a Cleaning Day, the inspection checklist, records and photographs prepared pursuant to sub-clause (c)(iii) above to the *Engineer/Maintenance Surveyor’s Representative for checking and recording.

(vi) The *Engineer/Maintenance Surveyor’s Representative may carry out inspections and surprise checks to verify the Contractor’s performance on cleanliness and tidiness of any Site before the noonof the day (which is not a General Holiday) following a Cleaning Day. The Contractor shall not be entitled to any payment for the item for “Daily Cleaning” of a Works Order for a Cleaning Day if

the performance of the Contractor on cleanliness and tidiness for any part of the Site under such Works Order for that Cleaning Day is not carried out to the satisfaction of the *Engineer/Maintenance Surveyor’s Representative. The *Engineer/Maintenance Surveyor’s Representative shall notify the Contractor and record in the Site Diary for any non-payment of the item for “Daily Cleaning” on a Cleaning Day and the areas of dissatisfaction for improvement by the Contractor.

(vii) The Contractor shall in the morning of every Cleaning Day before work commences inspect and remove any rubbish and debris that may be littered by the public over the night within any area which cleanliness and tidiness the Contractor is required to maintain under this Contract before the inspection by the *Engineer/Maintenance Surveyor’s Representative.

(d) Weekly Tidying

(i) “Weekly Tidying” of a Works Order shall include the cleansing and tidying up of the common areas and accesses, cleansing and/or re-conditioning of hoardings, barriers, guarding, lighting, signage and/or traffic cones, cleansing of external covers for plant and equipment, removal of waste and debris etc. so as to ensure that the plant and equipment, hoardings, as well as such Site as a whole, to be clean and tidy in the perspective of the general public and, without derogating from the generality of the foregoing, shall include, but is not limited to, all the items subject to checking as listed in sub-clause (d)(ii).

(ii) The Contractor shall develop inspection checklist for Weekly Tidying of each Works Order after each Cleaning Week Day’s work for the approval of the *Engineer/Maintenance Surveyor’s Representative. The inspection checklist shall be reviewed and updated whenever there is a change in work nature or work location under such Works Order and re-submitted for approval by the *Engineer/Maintenance Surveyor’s Representative. The inspection checklist shall include an assessment on the cleanliness and tidiness of the Site conditions of such Works Order including the Public Cleaning Areas. Items to be checked against for each Works Order shall include, but are not limited to, the following:

− Thorough cleansing of passageways, common accesses and public areas;

− Re-organizing of storage materials for better utilization of storage spaces and safe stacking if appropriate;

− Maintenance and re-conditioning of tools and equipment;

− Cleansing of external covers for plant and equipment;

− Collection and removal of disposed waste materials off site;

− Cleansing, re-conditioning and/or replacement of hoarding, barriers, guarding, lighting, and signage of works to good working condition;

− Clearing of drains and channels to prevent flooding; and

− Other cleansing requirements as instructed by the *Engineer/Maintenance Surveyor’s Representative from the perspective of the general public.

(iii) The Contractor shall assign person(s) to inspect the Site of each Works Order after each Cleaning Week Day’s work. The assigned person shall check and ensure the overall cleanliness and tidiness of the Site of such Works Order, complete the inspection checklist, record the areas requiring improvements, and take photographs of areas where overall site cleaning and tidying up actions have been done and where improvement actions are required.

(iv) The Contractor shall notify the *Engineer/Maintenance Surveyor’s Representative the time schedule for Weekly Tidying of each Works Order on every Cleaning Week Day, and the name of the assigned person as referred to in sub-clause (d)(iii) above responsible for the inspection and checking after each Cleaning Week Day.

(v) The Contractor shall submit, in the morning of the day (which is not a General Holiday) following the Cleaning Week Day, the inspection checklist, records and photographs prepared pursuant to sub-clause (d)(iii) above to the *Engineer/Maintenance Surveyor’s Representative for checking and recording.

(vi) The *Engineer/Maintenance Surveyor’s Representative shall, together with the Site Agent, check and inspect the overall cleanliness and tidiness of the Sites on the day (which is not a General Holiday) following the Cleaning Week Day. The *Engineer/Maintenance Surveyor’s Representative shall advise the Contractor whether his performance is to his/her satisfaction, or if not, where improvement actions are required.

(vii) The Contractor shall promptly rectify the defects identified by the assigned person as referred to in sub-clause (d)(iii) above, and/or the *Engineer/Maintenance Surveyor’s Representative. The Contractor shall not be entitled to any payment for the item for

(viii) The Contractor shall in the morning of every Cleaning Week Day

before work commences inspect and remove any rubbish and debris that may be littered by the public over the night within any area which cleanliness and tidiness the Contractor is required to maintain under this Contract before the inspection by the *Engineer/ Maintenance Surveyor’s Representative.

xx.3 The extent of the Public Cleaning Areas required for

cleaning shall be determined by the *Engineer/Maintenance Surveyor’s Representative for each Works Order.

xx.4 The Contractor shall not be entitled to any payment for

the item for “Daily Cleaning” for a Works Order on a Cleaning Day if the performance of the Contractor on cleanliness and tidiness for any part of the Site including areas other than the Public Cleaning Areas of such Works Order for that Cleaning Day is not carried out to the satisfaction of the *Engineer/Maintenance Surveyor’s Representative. For the avoidance of doubt, the measurement for “Daily Cleaning ” for each Works Order on a Cleaning Day shall be either in full or none.

xx.5 The Contractor shall not be entitled to any payment for

the item for “Daily Cleaning” for more than one day for the cleaning and tidying up work carried out by the Contractor in one Cleaning Day.
