The Owners of Transport Class of vehicles will be given an option to pay the Road Tax either annually or
life time. If the owner of Transport Class of vehicle wishes to pay the Road Tax as one time tax for the remaining period after making annual tax initially, then the owner shall be allowed to pay the remaining tax
@ 6% of the depreciated value.
Explanatory Note: The Andaman & Nicobar Road Tax Regulation was promulgated in the year 1940. It was further amended in the year 1973 with the rate of Road Tax ranging from Rs. 25 to Rs.150.
The Transport Development Council, the apex body to advise the Govt. of India on all matters relating to
roads and road transport, in its 35th meeting has taken the decision to rationalize the motor vehicle taxation to
have a uniform motor vehicle tax regime across the states. It was recommended by the TDC to levy life time tax @ 6% or more on the sale price the motor vehicle. Based on these recommendations, different UTs like
NCR New Delhi and other states have amended the Taxes levied on motor vehicles ranging from 6 % to 10 %.
The UT of Andaman and Nicobar Islands is located in remote area from Mainland and keeping in view of the transportation/maintenance cost in the motor vehicles, it has been proposed to levy the Road Tax at
minimum rate i.e. 6 % recommended by the Transport Development Council.

with other states under the Union of India. The general public is requested to offer comments/feedback on the draft
regulation within 30 days of the publication of this notice, to the Directorate of Transport, Port Blair. The draft regulation
of the proposed Andaman and Nicobar Motor Vehicles Tax Regulation, 2021 is enclosed herewith.

DRAFT ANDAMAN AND NICOBAR ISLANDS MOTOR VEHICLES TAX REGULATION, 2021
(Promulgated by the President of India in the seventy second year of the Republic of India)
A Regulation to provide for the imposition and levy of a tax on Motor Vehicles in the Andaman & Nicobar Islands.
In exercise of the powers conferred by Article 240 of the Constitution of India, the President is pleased to promulgate
the following Regulation made by him:-
1. Short Title and Commencement:
1. This Regulation may be called as the Andaman and Nicobar Islands Motor Vehicles Tax Regulation, 2021.
2. It extends to the whole of Union Territory of the Andaman & Nicobar Islands.
3. It shall come into force on such date from the date of publication in the Official Gazette of India.
2. Definitions - In this regulation, unless there is anything repugnant in the subject or context -
i. 'Lieutenant Governor' means the Lieutenant Governor of Andaman and Nicobar Islands appointed by the President under
Article 239 of the Constitution of India.
ii. 'Certificate of Registration' and 'Motor Vehicles' have the meanings assigned to these expressions in the Motor Vehicle
Act, 1988.
iii. 'Prescribed' means prescribed by rules made under Section 9 :
iv. 'the tax' means the tax imposed by Sub-section (1) of Section 4; and
v. 'Taxing Officer' means an officer appointed under - section 3.
vi. "Hybrid Vehicle" means a vehicle using two different forms of power i.e. an electric motor and an internal combustion
engine.
vii. "Transport Vehicle" means a public service vehicle, a good carriage, an educational institution bus or a private service
vehicle.
viii. "Non Transport Vehicle" means all other vehicles excluding those mentioned at Clause 2 (vii) above.
ix. "Invoice price" means the price of a vehicle before GST in respect of new vehicles which shall be furnished by the dealer
of the vehicle.
x. "Depreciated Value of the vehicle" means the cost of a vehicle upon depreciation through straight line method at the time
of payment of Road Tax assuming the life of a vehicle as 15 years.
3. Appointment of Taxing Officers : The Lt. Governor may, by notification in the Official Gazette, appoint such persons
or agency as he thinks fit to be Taxing Officers and may in such notification specify the areas within which such officers
shall exercise the powers conferred and perform the duties imposed on them by or under this Regulation.
4. Imposition of Tax: On and from the date which the A&N Islands Motor Vehicles Tax Regulation, 2021 comes into
force,-
1. A tax shall be imposed on all motor vehicles kept for use, at such rate as may be notified in the Official Gazette, not
exceeding the rate fixed by-
a. Schedule 'A' for Non Transport Class of vehicles; and
b. Schedule 'B' for Transport Class of vehicles.
2. (a). A person who keeps a motor vehicle of which the Certificate of Registration is current shall for the purpose of this
Regulation be deemed to keep such vehicle for use.
(b). The tax imposed under Clause 4.1 shall be payable for a new vehicle once for fifteen years, in advance, by a person who
keeps the motor vehicle for use.
(c). The tax imposed under Clause 4.1 shall be payable for a already registered vehicle for the remaining years from the date
of registration not exceeding 15 years in advance as given in Schedule A & B.
5. Declaration by person keeping or using a motor vehicle:
(i) Every person who keeps a motor vehicle for use shall fill up and sign a declaration in the prescribed form stating truly
the prescribed particulars and shall deliver the declaration as so filled up and signed to the Taxing Officer and shall pay to
the Taxing Officer the tax which he appears by such declaration to be liable to pay in respect of such vehicle.
(ii) Where a motor vehicle is altered so as to render the person who keeps such vehicle for use liable to the payment of an
additional tax under Section 6, such person shall fill up and sign an additional declaration in the prescribed form showing the
nature of the alterations made and containing the prescribed particulars and shall deliver such additional declaration as so
filled up and signed to the Taxing Officer and shall pay to the Taxing Officer the additional tax payable under Section 6
which he appears by such additional declaration to be liable to pay in respect of such vehicle.
(iii) Every person who owns any motor vehicle which is left for hire otherwise then on a hire purchase agreement shall for
the purpose of this Regulation, be deemed to be the person who keeps such vehicle for use.
6. Payment of additional tax L: Where any motor vehicle in respect of which the tax has been paid is altered in such a
manner as to cause the vehicle to become a vehicle in respect of which a higher rate of tax is payable, the person who keeps
such vehicle for use shall be liable to pay an additional tax of a sum which is equal to the difference between the tax already
paid in respect of such vehicle and the tax which is payable in respect of such vehicle after it being so altered.
7. Receipt for tax : The Taxing Officer shall grant and deliver to every person who pays to him the tax or additional tax in
respect of any motor vehicle, a receipt in the prescribed form in which shall be specified the particulars of the tax paid.
8. Token to be exhibited on motor vehicles :
(i). The Taxing Officer shall at the time of granting a receipt for the tax deliver to the person paying the tax a token of such
form and containing such particulars as may be prescribed.
(ii). Every person to whom such token is delivered shall cause it to be exhibited in the prescribed manner on the vehicle in
respect of which the tax is paid.
9. Power to make rules :
(i). The Lt. Governor, A & N Islands may make rules for carrying out the purpose of this Regulation.
(ii). The Lt. Governor, A & N islands may amend the schedule of rates mentioned in Schedule A & B of this regulation as and
when required.
(iii). In particular and without prejudice to the generality of the foregoing power, the Lt. Governor, A & N Islands may make
rules for all or any of the following purposes, namely -
(a). To prescribe the form of any declaration, receipt or token, the particulars to be stated therein, the manner of exhibiting
a token on a motor vehicle or trailer, and the condition in which such token shall be maintained.
(b). To prescribe the power and duties of the Taxing Officer.
(c). To regulate the manner in which refunds or deductions or exemptions may be claimed, and
(d). To regulate the method of assessing and recovering the tax.
(iv). All rules made under this section shall be published in the Official Gazette.
10. Penalties for certain offences - Whoever -
(a). Keeps for use a motor vehicle without having paid the tax or additional tax in respect of such vehicle or
(b). Delivers a declaration or additional declaration where-in the particulars required by or under this Regulation to be
therein set forth are not fully and truly stated,
Shall be punishable with fine which may extend to one and a half times, and, in the event of such person having been
previously convicted of an offence under this Regulation, with fine which may extend to twice the amount of the tax payable
for the year for the motor vehicle in respect of which the offence is committed and the amount of any tax due shall also be
recovered as if it were a fine.
11. Other penalties : Whoever contravenes any of the provisions of this regulation, or of any rule made there under
relating to the exhibition or maintenance of tokens, shall, if no other penalty is elsewhere provided in this Regulation for
such contravention, be punishable with fine which may extend to five hundred rupees.
12. Trial of offences : No Court inferior to that of a Magistrate of the Second Class shall try any offence punishable under
this Regulation.
13. Power of Lt. Governor to exempt certain motor vehicles from the tax : The Lt. Governor, A & N Islands may, by
notification in the Official Gazette, exempt either totally or partially any motor vehicle or class of motor vehicles from the tax.
14. Refund of tax: (1) When any person who has paid the tax in respect of a motor vehicle produces before the taxation
authority, a certificate signed by the Registering Authority stating that the tax token and the Certificate of Registration
issued in respect of such vehicle have been surrendered on the date specified by the Registering Authority in his certificate,
such person shall, on an application made in that behalf to the taxation authority and subject to such conditions as may be
prescribed, be entitled to a refund,-
In a case where payment of tax has been made in accordance with Sub-section (1) of Section 4, for each complete month
of the period for which such tax has been paid and which is unexpired on the date on which the tax token and the certificate
of registration were surrendered, of an amount equal to one-twelfth of the annual tax payable in respect of such vehicle; and
(2) When any person has paid the tax in respect of a motor vehicle and the vehicle is removed outside the UT of A & N
Islands before the expiry of the period for which the tax has been paid and taxed in another State or the registration of such
vehicle is cancelled before the expiry of the period for which the tax has been paid, such person shall, on an application made
in that behalf to the taxation authority and subject to such conditions as may be prescribed, be entitled to a refund,-
(a) In a case where payment of tax has been made annually in accordance with Sub-Section (1) of section 4, for each complete
month of the period for which such tax has been paid, and during which the vehicle was removed from the UT of A & N
Islands or such vehicles registration is cancelled, of an amount equal to one-twelfth of the annual tax payable in respect of
such vehicle.
(b).In a case where payment of tax has been made on one time basis in accordance with Sub-section (1) of Section 4, for the
period for which such tax has been paid, and during which the vehicle was removed from the UT of A & N Islands or such
vehicles registration is cancelled, of an amount equal to the balance amount derived by deducting the amount applicable for
the remaining period from the total amount paid for life time tax for the corresponding criteria/category in respect of such
vehicle.
15. Penalty payable when tax not paid : When any registered owner or any person who has possession or control of any
motor vehicle used or kept for use in the UT of Andaman & Nicobar Islands is in default in making a payment of the tax, the
taxation authority may direct that, in addition to the amount of arrears, a sum not exceeding one and half times the annual
tax payable in respect of such vehicle shall be recovered from him by way of penalty.
16. (1). The Andaman and Nicobar Islands Motor Vehicles Tax Regulation, 1940 is hereby repealed.
