COMMON FOREIGN AND SECURITY POLICY 14/2005

Declaration by the European Union on the reconvening of the National Convention in

Burma/Myanmar Brussels, 16 February 2005

The European Union notes that the National Convention will reconvene on 17 February 2005 and strongly hopes to see concrete results. In this connection the European Union calls on the State Peace and Development Committee to renounce past hostilities and enter into a constructive dialogue with the National League for Democracy (NLD), other legitimate representative bodies and the ethnic groups. Only such a dialogue can lead to the drawing up of a constitution that can win the true support of the people and bring peace and development to the country. Only if it adopts this approach will the Government be able to arrive at real and lasting national reconciliation and to honour its commitments vis-à-vis the international community contained in its road map announcing the "building of a modern, prosperous and democratic nation". The European Union regrets that the State Peace and Development Committee has not yet created the necessary conditions for participation by the National League for Democracy (NLD) and other legitimate representative bodies in the National Convention, which will reconvene on 17 February and which could provide an opportunity for genuine and transparent dialogue. These conditions include lifting the house arrest of Aung San Suu Kyi, reopening all the offices of the National League for Democracy and releasing all political prisoners, including the elected representatives of the opposition parties. In this connection, the European Union is very concerned at the arrest on 9 February of Khun Htun Oo, president of the Shan National League Democracy Party, together with other leaders of the Shan community, and at the increased harassment of the leaders of other ethnic national groups. The EU calls for a stop to all such restrictive treatment. The European Union calls on the Burmese authorities to establish permanent and sincere cooperation with the UN Secretary-General's Special Envoy and with all the UN agencies involved. The European Union takes this opportunity to emphasise that, as envisaged in Council Common Position 2004/730/CFSP of 25 October 2004, it could respond positively to concrete signs of progress and that it is already committed to the reduction of poverty and the promotion of democratisation in Burma/Myanmar. The Acceding Countries Bulgaria and Romania, the Candidate Countries Turkey and Croatia*, the Countries of the Stabilisation and Association Process and potential candidates Albania, Bosnia and Herzegovina, the Former Yugoslav Republic of Macedonia, Serbia and Montenegro, and the EFTA countries Iceland, Liechtenstein and Norway, members of the European Economic Area, align themselves with this declaration. * Croatia continues to be part of the Stabilisation and Association Process

Declaration by the Presidency on behalf of the European Union on the political situation in Togo

Brussels, 23 February 2005 The European Union repeats the concern it expressed in its declaration of 9 February 2005, and it is still greatly alarmed at developments in Togo. While the European Union welcomes the positive signals given by the announcement of presidential elections within sixty days and restoration of the freedom to demonstrate, it condemns the violation of constitutional and legal provisions in the form of the maintenance of Mr Faure Gnassingbé as interim President of the Republic. The European Union demands an immediate return to constitutional and legal order, to open the way for free and transparent presidential elections, to which the EU is ready to offer its support in due course. The EU calls for full respect for civil liberties and the holding of free and transparent elections, to which the establishment of a genuine national dialogue, or even of a national transitional government, can contribute. In this context the European Union fully supports the actions of the African Union and of ECOWAS and the efforts being made by their Presidents, Mr Obasanjo and Mr Tandja, to restore constitutional order and the democratic process. In the absence of progress, the EU reserves the right to take measures to support the actions of ECOWAS and in particular to review its actions regarding Togo in the light of the 22 undertakings given by the government in the context of the consultations held in 2004. The Acceding Countries Bulgaria and Romania, the Candidate Countries Turkey and Croatia*, the Countries of the Stabilisation and Association Process and potential candidates Albania, Bosnia and Herzegovina, the Former Yugoslav Republic of Macedonia, Serbia and Montenegro, and the EFTA countries Iceland, Liechtenstein and Norway, members of the European Economic Area, align themselves with this declaration. * Croatia continues to be part of the Stabilisation and Association Process.

Declaration by the European Union on the situation in Nepal

Brussels, 28 February 2005 The EU Presidency issued a statement on 2 February expressing deep concern about the dissolution of the multi-party government in Nepal and the assumption by the King of executive powers, and calling for the speedy restoration of multi-party democracy. Later all EU Member States with ambassadors in Nepal separately recalled their ambassadors for consultations in view of the seriousness of developments there. The ambassadors of France, Germany, United Kingdom and the charge d’affaires e.p. of Denmark have now returned to Kathmandu.

The EU continues to believe that the action taken by the King is a serious setback to the prospects for a negotiated and democratically based solution to the conflict in Nepal. The EU calls upon the King to take early measures to restore democratic freedoms and civil liberties, and to lift the emergency powers he introduced following the takeover of power on 1 February. In particular, the EU calls for the restoration of representative democracy; the fast release of all political and other prisoners detained under emergency ordinances; for unrestricted access without the need for prior notice to all detainees to be given to the NHRC and its representatives; for political parties and civil society organisations to be granted the freedom to organise and operate; for the lifting of reporting restrictions on the media; assurances of CIAA continued independence and for the restoration of the right to assembly and other fundamental rights. The EU further calls on the King to undertake the necessary steps to make sure that the representatives of the NHRC will be able to carry out their mandate independently, effectively and without fear for their personal safety. The EU views with particular concern the current human rights crisis in Nepal, and the serious and systematic human rights violations by both sides in the conflict. The EU believes that there is a clear and real danger that intensified conflict and the restrictions on democratic freedoms will lead to levels of human rights abuse rising. The EU calls for respect for human rights of the Nepalese people and compliance with international human rights norms and obligations. The EU is mindful of the impact the new political situation might have on security conditions in the country and on donors’ ability to provide development assistance to poor people in Nepal. The EU is concerned that intensified conflict could make it more difficult to deliver effective assistance and sustain development programmes. EU donors are therefore reviewing the development effectiveness of existing and planned activities in the new context. The EU calls in particular for all involved in the conflict to respect and publicly express commitment to donors' Basic Operating Guidelines, to ensure the safety of all those working for and with development agencies, and to allow them to continue to carry out their assistance activities without interference.
