Declaration by the Presidency on behalf of the European Unionon the situation in BurundiBrussels, 12 November 2001

The European Union welcomes the setting up of the transitional government of national union in Burundi on1 November and encourages the ongoing efforts to put the other transitional institutions in place quickly. Itinvites the new government to implement without delay the reforms provided for in the Arusha agreementand to find solutions to the most urgent questions - a ceasefire in the armed conflict, justice for all, and thepoverty of the Burundian people.

At the same time, the European Union is extremely concerned by the upsurge in violence in the armedconflict in recent weeks. The civilian population is its chief victim. In particular, it condemns unreservedlythe acts of violence committed in recent days by armed FDD and FNL groups against educationalestablishments, schoolchildren and health centres. It also roundly condemns the reprisals carried out by thewarring factions against the civilian population.

It urges all those involved to abandon the logic of war and to enter into negotiations without delay, inparticular those due to begin in November under the auspices of the Gabonese President Omar Bongo andthe South African Vice-President Jacob Zuma. Pending a final end to hostilities, it urges the warring factionsto cease indiscriminate warfare which harms the innocent civilian population without distinction, and callsfor an immediate suspension of the fighting.

It urges the countries in the region to cease their support for this armed conflict and, instead, to encourage allarmed groups to return to the negotiating table as soon as possible. The conflict in Burundi can be solvedonly through negotiations.

It appeals to the responsibility of the new transitional government as a whole to exert its influence on all thewarring factions to persuade them to return to the negotiating table immediately and make every effort tospare the civilian population.

The EU is willing to give political backing to the negotiations which have already begun for a ceasefire. It isalso ready to give financial and logistical support to a programme of disarmament, demobilisation andreintegration of the present combatants when arms have been laid down.

Declaration by the Presidency on behalf of the European Unionconcerning Madagascar's presidential elections

Brussels, 22 November 2001

The European Union is an important partner in Madagascar's economic, social and institutional developmentprocess. As such, it is keeping an interested and careful watch on the preparation and organisation of thepresidential elections on 16 December 2001.

With reference to the Common Position of 25 May 1998 concerning human rights, democratic principles, therule of law and good governance in Africa and to the importance attached to those principles in the ACP-EUPartnership Agreement signed in Cotonou on 23 June 2000, the European Union welcomes the Malagasyauthorities' commitment to ensuring that the elections are held in accordance with democratic procedures.

The European Union hopes that all operations involved in the elections � compiling of electoral registers,organisation of polling stations, polling itself and counting of votes � will pass off calmly, fairly and with theutmost transparency.

Joint Statement on the occasion of the signature of theEU-Pakistan co-operation agreement

Islamabad, 24 November 2001

The European Union and Pakistan warmly welcome the signature of a Co-operation agreement that willsubstantially contribute to strengthening further their relationship.

The EU mission that visited Islamabad on September 25, 2001 underlined the European Union�s appreciationfor the decision taken by Pakistan to join the international community in its fight against terrorism. The EUmission conveyed the desire of the Union to deepen and broaden its relationship with Pakistan. This co-operation agreement is an element of that enhanced relationship.

The European Union and Pakistan reconfirm their commitment to the respect, protection and promotion ofhuman rights and democratic principles as laid down in the Universal Declaration of Human Rights and ascontained in Article 1 of the co-operation agreement. Pakistan reiterates its firm commitment to return todemocratic government in accordance with the roadmap announced by President Musharraf on August 14,2001. The EU welcomes this commitment.

The European Union and Pakistan, in the light of current events, wish to point out the importance ofinternational efforts to tackle terrorism worldwide. Both parties reiterate their shared commitment to

implement fully anti-terrorism measures in pursuit of UNSC resolution 1373 and other relevant resolutionsand conventions, which they believe to be an important element in their relations. Both parties believe that acomprehensive strategy to address the root-causes of terrorism is vital for the success of the efforts by theinternational community to eradicate terrorism. The European Union acknowledges the valuable contributionPakistan makes in the international campaign against terrorism.

The European Union and Pakistan urge the international community not to waver from its consensus on thefuture political dispensation in Afghanistan, which should be broad-based, multi-ethnic and acceptable to allAfghans. The recent events lend urgency to the need for the international community to take steps forensuring peace, stability and reconstruction in Afghanistan. The European Union and Pakistan will maketheir due contribution to the achievement of these objectives.

Declaration by the Presidency, on behalf of the European Union,on the peace process in Colombia

Brussels, 7 December 2001

1. The European Union stands by its active support for the peace process in Colombia and for thecourageous efforts made by President Pastrana. It feels that there is no suitable alternative to anegotiated solution to the internal conflict and that it would be wrong to put that process on the backburner, pending the forthcoming elections. The negotiation mechanism should, moreover, bestrengthened, with all parties contributing.

2. The European Union calls upon the FARC-EP to return to the negotiating table, inter alia in order todiscuss the issues agreed on at San Francisco de la Sombra in October 2001. It commends theresumption of dialogue between the Government and the ELN. It hopes that both movements willshow firm resolve in seeking concrete results leading towards a peaceful and lasting settlement of theconflict.

3. The European Union wholeheartedly supports all efforts to bring respect for human rights andinternational humanitarian law by all parties involved.

4. The European Union reiterates its vigorous and steadfast condemnation of the practices of abduction,extortion and other crimes, which are a violation of human rights and of international humanitarianlaw. Such crimes, which jeopardise the peace process, mustbe condemned by all parties to the conflict. It calls upon the armed groups to free allhostages � whether foreign or Colombian � and to forswear such practices immediately. For the timebeing, the EU Member States will not issue any new visas or residence permits to representatives ofthose armed groups, without prejudice to the continuation of efforts by EU Member Statesparticipating in talks between the Colombian parties.

5. At the request of the Colombian Government and of the parties to the conflict, some Member States ofthe Union are participating in the talks which the Government of President Andrés Pastrana hasestablished with the ELN and the FARC. The EU supports these efforts to achieve a negotiatedsolution to the conflict. However, it emphasises that the EU position vis-à-vis the armed groups inColombia will have to be examined and revisedin the light of respect for human rights, international humanitarian law and diplomatic immunity.

6. The European Union is particularly concerned at the violent actions of the paramilitary, who arecommitting more and more crimes with total impunity. It urges the Colombian Government tocontinue and to step up its efforts to disarm the paramilitary and bring the full force of the law to bearon those responsible for crimes committed � whoever the perpetrators.

7. Taking into account the principle of shared responsibility, the European Union considers it of vitalimportance that the efforts already made to combat illicit drug crops and drug production andtrafficking continue at both local and regional level, while protecting biodiversity and theenvironment.

8. In order to reduce socio-economic inequalities in Colombia, the European Union considers it essentialthat a programme of decisive socio-economic reforms be elaborated and implemented as a matter orurgency, regardless of the uncertainties of the peace process.

9. The European Union will endeavour to fulfil the autonomous commitments entered into under theEuropean programme of support for the Colombian peace process, insofar as security problems do nothamper it.

10. The European Union acknowledges the very valuable work of the United Nations Secretary-General'sSpecial Representative in the context of the peace process. It feels that the role of the United Nationshas never been more important and that its representative should be more closely involved in thatprocess. At the same time, the Union calls upon the Colombian Government to facilitateimplementation of the mandate of the Office of the UN High Commissioner for Human Rights.

11. The European Union attaches great importance to holding an intensive dialogue with all candidates inthe presidential elections. It would like them to make it State policy to seek a negotiated peace.

The European Union considers that the Russian audiovisual landscape would be seriously impoverished ifthis important independent television station were to disappear.

The European Union considers that the independence and pluralism of the media, if needs be guaranteedthrough intervention by the authorities, are one of the democratic values upon which the EU-Russiapartnership is founded.

Declaration by the European Union on the Middle EastBrussels, 10 December 2001

At a time when the situation in the Middle East is extremely serious, we cannot be inactive.

We are convinced that only determined and concerted action by the European Union, the United Nations, theUnited States and the Russian Federation can help the parties to break the cycle of violence and committhemselves once again to the search for peace. This requires:

the reaffirmation and full recognition of Israel's irrevocable right to live in peace and security withininternationally recognised borders;

the establishment of a viable and democratic Palestinian State and an end to the occupation of Palestinianterritories.

As a first step, the following pledges must be given:

by the Palestinian Authority: the dismantling of Hamas' and Islamic Jihad's terrorist networks, including thearrest and prosecution of all suspects; a public appeal in Arabic for an end to the armed intifada;

by the Israeli Government: the withdrawal of its military forces and a stop to extrajudicial executions; thelifting of closures and of all restrictions imposed on the Palestinian people; a freeze on settlements.

Declaration by the Presidency on behalf of the European Unionon the opening of the bridge between Uzbekistan and Afghanistan

Brussels, 12 December 2001

The European Union welcomes the announcement of the re-opening of the Friendship Bridge betweenUzbekistan and Afghanistan. This action by the Uzbek government should allow the volume ofhumanitarian aid entering Afghanistan from the north to be greatly increased.

The Union expresses its hope and expectation that humanitarian aid provided by the Union and others willnow have full access to Afghanistan from Uzbekistan. The Union stresses the important role played byNGOs in alleviating the plight of the Afghan people. International cooperation will be essential to addressthe humanitarian crisis in Afghanistan as winter approaches.

The European Union notes the important initiatives taken by the President of the Republic of Latvia toamend the electoral law by abolishing language requirements as a condition of the right to stand as acandidate at general and local elections.

Since such a reform would indeed be a step in the direction of democracy and respect for human rights, theEU has no doubt that the Latvian authorities will be anxious to endorse it as soon as possible.

The European Union vehemently condemns the violent terrorist attack that was carried out in New Delhi onThursday 13 December 2001 against the Parliament of the Republic of India, causing the loss of several livesand injury to many innocent people.

The European Union deplores this loss of human lives, and whishes to express its indignation that this attackwas directed against the very institution that represents democracy and the rule of law.

Further to their joint declarations at the recently held India-EU Summit in New Delhi, the European Unionwishes to express solidarity and support to the Republic of India in its fight against terrorism, whichconstitutes a threat to mutually shared values of democracy and respect for human rights.

Declaration by the European Council on the situation in the Middle EastBrussels, 15 December 2001

The extreme gravity of the situation in the Middle East requires each side to face up to its responsibilities: itis imperative to put an end to the violence.

The only basis for peace is UN Resolutions 242 and 338 and:

● reaffirmation and full recognition of Israel's inalienable right to live in peace and security withininternationally recognised borders.

● the establishment of a viable, independent and democratic Palestinian state and an end to theoccupation of Palestinian territories.

Israel needs the Palestinian Authority and its elected President, Yasser Arafat, as a partner to negotiate with,both in order to eradicate terrorism and to work towards peace. Its capacity to fight terrorism must not beweakened. The European Union renews its appeal to the Palestinian Authority to do everything to preventacts of terrorism.

The European Union would remind the parties of the pledges demanded of them:

● The Palestinian Authority: the dismantling of Hamas' and Islamic Jihad's terrorist networks, includingthe arrest and prosecution of all suspects; a public appeal in Arabic for an end to the armed intifada.

Resolute and concerted action by the European Union, the United Nations, the United States, the RussianFederation and the Arab countries most concerned is essential and urgent. The European Council hasmandated High Representative Javier Solana to continue appropriate contacts to this end.

The Union attaches great importance to an economic recovery programme focused on Palestine as a way ofencouraging peace.

The European Union will continue its efforts to ensure that both States, Israel and Palestine, can live side byside in peace and security.

Peace in the Middle East can be comprehensive only if it includes Syria and Lebanon.

The last Plenary Assembly of 2001 was notable for the attendance of Mr Romano Prodi,President of the European Commission, and of Ms Annemie Neyts, Belgian Deputy Minister for ForeignAffairs responsible for agriculture, who attended on behalf of the Council Presidency. Both guest speakersfocused on the future of Europe and the role of the Economic and Social Committee in their statements.

Thirty opinions were adopted. The highlights of the session were the discussions about theBureau reports on the ESC and organised civil society (Rapporteur: Mr Westerlund � GR II - S) and theESC development strategy (Rapporteur: Mr Little GR I - UK ).

The Committee supports the Commission's relaunching of the internal market in services by deciding

to intensify work on current questions, update the analysis of barriers and introduce an overall,innovatory approach in 2002.

It therefore emphasises, like the Commission, the need to revive and speed up Community work on anew basis, which will need to be overall, co-ordinated and flexible.

On the analysis of barriers, the Committee draws the Commission's attention to the need to define amethodology and make a more precise distinction between the different types of barrier -distinguishing more clearly between the real barriers to be removed and the reality of Europeancultural diversity, to which operators will still have to adapt.

In order to give the new strategy the necessary impact, the Committee supports the Commission's

intention to propose that the Parliament and the Council adopt a new horizontal legal instrument, andtrusts that this instrument will be politically effective, legally binding, comprehensive in its approach,focused on essential needs, likely to activate and coordinate other, complementary, instruments, andflexible in its implementation. The Committee recommends that the transposition of the essentialrequirements of the framework instrument and the various flanking directives be entrusted to jointregulatory committees, based on experience with the "SLIM" committees, made up of representativesof administrations, service providers and users.

The Committee expects that this new approach will make possible significant, irreversible results in

speeding up completion of the internal market in services by the end of the current terms of office ofthe Commission and the Parliament and before the next new accessions.

forum and a security and privacy body.

The Joint Undertaking should be funded solely through public funding, so as to avoid any conflict ofinterest. It should also pave the way for a European Agency/European Company which will beresponsible for the operational management of the system.

The Committee notes with interest that the Commission proposal seeks to eliminate restrictions onaccess to the port services market and to open up existing monopolies more to competition. However,it has misgivings about the means proposed. It also thinks that the proposal involves some pointlessbureaucratic aspects, which could make management more cumbersome.

The Committee suggests establishing a committee of port partners and players, so that port users'

interests can be taken into account, and has reservations about the way in which the issue of self-handling is dealt with given the risks of personal injury and of serious pollution or accidents, whichcould result from careless handling of certain types of cargo.

In the Committee's view, therefore, the proposal on port services ought to be placed by the

Commission in the context of the debate on the Transport White Paper and made part of an overallapproach, with due regard to the role of ports in providing sustainable transport, in protecting theenvironment, and in the field of employment, economic and social cohesion and regionaldevelopment.

The Committee backs the proposal, including the decision to issue a regulation rather than a directive,which would take a long time to implement.

However, since this proposal deals only with security measures for boarding an aircraft, it considers

that legislation dealing with on-board security should be proposed and adopted as quickly aspossible. The same comment applies to three other pieces of proposed legislation dealing with civilaviation security which are currently under consideration.

The ESC considers that, with regard to infrastructure, the suggested timeframe for implementing the

proposal is unrealistic. Finally, the significant additional expenditure involved in implementing the proposals should be

The ESC welcomes the proposal and is pleased to note that all the parties involved in this field haverecently made strenuous efforts to resolve this issue. With the aim of maintaining the competitiveness of European financial markets in view, the need isimperative to have prior assurance that the same measures will be applied in the dependent andassociated territories and that equivalent measures will be taken in a number of nearby and/or keyfinancial centres. The Committee calls upon all parties concerned to suggest improvements to the proposal whilstendeavouring to contain implementation costs as far as possible. Consideration should be given to including in the definition of "interest payment" other investments,which may give rise to interest indirectly, such as certain insurance products. It is essential for paying agents to be involved as closely as possible in the further development ofthis system as they have a key role to play in its actual implementation. With this aim in view, theCommission is asked to consider making improvements to the impact assessment.

− "Labour costs excluding bonuses": The ESC expressly asks that this partial index be waived on

grounds of cost, or at least only requested annually.

− The ESC suggests that the 70-day time limit be extended to 90 days for a transitional period offive years, so that the Member States can change their statistical systems over to the newrequirements.

3. SOCIAL

The ESC calls for vigorous action from governments to give children protection on the Internet. • Child protection/Internet Rapporteur: Ms Davison (Various interests - UK)

− Reference: Additional opinion - CES 1473/2001 − Key points: The Committee would emphasise the benefits of the Internet for children, but is nonetheless

concerned that police remain unable to trace the majority of children abused for child pornographyon-line. It underlines the need to strengthen cooperation in this area. Europol and Interpol especiallyneed to be targeted.

The Committee endorses the Internet Action Plan and would strengthen it with more resources

particularly with regard to the need to define harmful material, to avoid downloads charged topremium lines, unless there is confirmation by adult signature, and to provide mechanisms whichwould allow suspicious behaviour towards children to be noted, reported and dealt with.

Finally, the plan needs to be backed up by legislation and by vigorous action on the part of

− References: COM(2001) 362 def - CES 1491/2001 − Key points: The opinion focuses on certain aspects of consistency between the policies involved, and of the

methods for developing cooperation in this area. The overriding objective of the method used is to achieve a real synergy and consistency between

social, employment and economic policy. Without prejudice to the remit and responsibility ofnational lawmakers and authorities in this area, the goal of consistency can be best achieved bysystematically involving the social partners all levels. They are key players in all societal change. Toneglect this would be to condemn all pension strategies to failure. The Committee notes that theCommission has not paid sufficient attention to this, and observes that the conclusions of theStockholm European Council highlighted the role of the social partners in managing change.

Social partner involvement must also be promoted and/or stepped up in employment policy and, in

particular, in economic policy. Achieving social consensus is not just a matter of providing people with accurate, exhaustive

information; it also means ensuring all stakeholder civil society and social partner organisations canplay an enlightened, active role.

The Committee would particularly stress the need to develop sufficiently detailed indicators, which

The Committee welcomes the draft directive's objectives and broadly endorses it. It does howeverhave a few comments to make regarding its provisions, with the premise that minimum standardsmust be based on best practice, and notes that the subjects addressed must be considered in thecontext of fundamental human rights, and that they slot into an international legal framework. In thisrespect, its is regrettable that the Commission avoids using the word �rights�, replacing it with otherterms. This paints a picture of an asylum seeker as someone basically deprived of rights.

The Committee endorses the setting of a six-month period after which access to the labour market

cannot be denied. However it feels that such a provision is inappropriate in the case of vocationaltraining, as such training should be offered as widely as possible.

Material reception conditions must provide an adequate standard of living so as to protect the health

and well-being of the asylum seeker and dependent family members. The sum and type of allowances granted to asylum seekers should not differ too much from one

Member State to another and should be determined with reference to the minimum social securityentitlement. The directive should not include provision for the use of vouchers.

Reception procedures should be less protracted, as it is not desirable that people fleeing from

repression and persecution - in the absence of evidence to the contrary - should find their rightssuspended for a lengthy period from the moment they set foot in the host country.

In a "Call to the Laeken Council" the opinion states that sustainable development is a new vision forthe future of Europe and sees the Laeken Declaration as a special occasion to sharpen the vision ofsustainable development as a major task for the EU. This it says is a radical approach with formidablechallenges to society but one aimed at shaping policy and action to meet the long-term priorities ofcitizens. As such it impinges on all activities of the Union and its Member States, opening the wayfor its citizens to be closer to the union and its policies.

This means that EU policies must be built from bottom-up and command wide public support,needing active involvement of citizens backed by well-working information and consultationprocedures.

− Key points:

The ESC draws attention to the correlation between demographic change and pension schemes.

The Committee is pleased to note that Member States are now actively involved in planning toimprove the sustainability of their pension payments. It is inappropriate to propose commonsolutions for Member States since their basic positions differ so much.

In this context the Committee believes that Member States should examine the potential use ofsupplementary schemes (the second and third pillars) as supportive measures, but recognises thatsupplementary pensions are not a panacea.

The Committee agrees with the Commission that there is also a need to modify pensionarrangements to reflect changes in society itself.

The use of the open method of coordination and the setting of common objectives with appropriateindicators will provide an opportunity to transfer experience from one Member State to another.

The Committee recommends that the applicant countries be encouraged to undertake similarassessments of their pension systems to assess long-term sustainability.
