Berks County Andrew J. Gallen, certificate no. CA021694L, of Reading, Berks County, was assessed a civil penalty in

the amount of $6,000 for practicing with a lapsed license. (10/24/14)

PA Board of Auctioneer Examiners

Montgomery County Ah Ram Lee, of Norristown, Montgomery County, was provisionally denied licensure based on his

misdemeanor conviction. (10/29/14)

Potter County William H. Morgart, license number AA019137, of Coudersport, Potter County, was revoked and

assessed a $1,000 civil penalty for being convicted of theft by unlawful taking or disposition. (11/12/14)

PA Board of Barber Examiners

Bucks County Boss Barber Shop, license no. BO433210, of Warrington, Bucks County was suspended for failing to pay

a previously imposed civil penalty. (11/19/14)

Butler County Donald R. Ferraro, license no. BM010969L, of Butler, Butler County, was suspended for failing to pay a

James L. Jackson, license no. BL053680, of Harrisburg, Dauphin County, was suspended pursuant to the

Order of the Court of Common Pleas of Dauphin County dated July 17, 2014, which the court issued

Michael A. Payne, license no. BM011819L, of Harrisburg, Dauphin County, was ordered to pay a $750

civil penalty and cease and desist from charging a student tuition in a licensed barbershop because he

Lancaster County Jorge Valentini t/d/b/a Who’s Next Barber Shop, license no. BO432497, of Lancaster, Lancaster County,

was ordered to pay a $1,000 civil penalty and to cease and desist from employing unlicensed individuals

and aiding and abetting unlicensed practice of the barbering profession, because he continues to employ

unlicensed persons and aided and abetted the unlicensed practice of the profession by permitting an

unlicensed person to practice barbering. (12/08/14)

Lehigh County John Antonio Cruz, license no. BL053488, of Allentown, Lehigh County, was suspended for failing to

pay a previously imposed civil penalty. (11/03/14)

Northampton County The Final Touch Barbershop, license no. BO433250, of Bethlehem, Northampton County, was ordered to

pay a civil penalty of $450 because it operated as an establishment without the supervision of designated

manager barber or other designated licensee in charge; and moved said barbershop before filing an

safety to patients by reason of illness, drunkenness, excessive use of controlled substances, chemicals or

‘dental hygienist,’ ‘expanded function dental assistant’ or other letters or titles in connection with his or

her name which in any way represented him or her as being engaged in the practice of dentistry or as a

dental hygienist or as an expanded function dental assistant, or authorized so to do, without being duly

licensed or certified, and authorized to engage in such practice. (12/12/14)

PA Board of Professional Engineers, Land Surveyors and Geologists

Lackawanna County E. Kenneth Acker, license and registration nos. PE024042E and SU000401A, of Moscow, Lackawanna

County, had his certificates of licensure to practice engineering and land surveying suspended, such

suspension immediately stayed in favor of probation, subject to certain terms and conditions, and was

ordered to pay a civil penalty in the amount of $1,000, enroll in and successfully complete a board

approved ethics course for professional engineers/professional land surveyors, and to provide 15 hours of

community service because he failed in his fiduciary duty as a partner in an engineering firm. (11/12/14)

Schuylkill County Merlyn J. Jenkins, license number SU007784E, of Pottsville, Schuylkill County, was assessed

a civil penalty in the amount of $3,000, and indefinitely suspended until he completes 60 hours

of continuing education, because his license was disciplined by the proper licensing authority

Out of State Southeastern Reprographics, Inc., now known as Davey Resource Group, Alpharetta, Georgia,

was ordered to pay a civil penalty of $2,000, for practicing and offering to practice land surveying

while not being properly licensed, and for representing itself without employing a licensed

directing head or responsible charge credentialed as professional land surveyor. (11/14/14)

PA Board of Funeral Directors

Lehigh County John M. Sunday, license and registration nos. FD011616L and FS015298, of Allentown, Lehigh County,

had a public reprimand placed on his permanent disciplinary record with the board and was ordered to pay

a civil penalty of $2,000 and costs of investigation of $767.60 because he failed to fulfill the professional

responsibilities of a funeral director. (12/03/14)

PA Board of Massage Therapy

Allegheny County Weiguang Liu, unlicensed, of Pittsburgh, Allegheny County, was ordered to immediately cease and desist

from utilizing in connection with its business name the word "massage" in advertisements describing the

services provided, immediately remove from the business name as well as any and all advertisements,

signage, etc., the words “massage” or any derivative thereof, and submit proof of the required changes

within 60 days of approval of the order and was ordered to pay a civil penalty of $500 and costs of

investigation of $320.93 because Liu, as the responsible owner/officer of Chinese Back Rub, utilized the

word "massage" in advertisements describing the services provided which implied directly or indirectly

that massage therapy services were being provided even though the services were not being performed by

licensees. (12/01/14)

Centre County Feng Xian He, unlicensed, of State College, Centre County, was ordered to cease and desist hiring or

employing unlicensed individuals to perform or offering to perform activity requiring a license to practice

massage therapy services and pay a civil penalty of $1,000 and costs of investigation of $441.15 because

she, as the responsible officer of Joma Chinese Massage, employed an unlicensed individual to provide

massage therapy/bodywork services to customers even though the individual was not licensed by the

board. (12/01/14)

Chester County Lin Jun Jiang, license no. MSG007511, of Downingtown, Chester County, was ordered to pay a civil

penalty of $500 and costs of investigation of $1,243.37, was placed on probation for one year, ordered to

complete 12 hours of continuing education on the topic of professional ethics, and ordered to cease and

desist from hiring or employing unlicensed individuals because she, as the responsible officer of Green

Tea Spa, knowingly aided, assisted, and hired individuals to perform or offer to perform massage therapy

services when those individuals were not licensed by the board and she practiced massage therapy

between August 5, 2012 and February 14, 2013 without having at the time of so doing, a valid, unexpired,

unrevoked and unsuspended license. (12/01/14)

Dauphin County Jizhen Fan, license no. MSG000325, of Hershey, Dauphin County, was ordered to cease and desist hiring

or employing unlicensed individuals and ordered to pay a civil penalty of $1,000 and costs of

investigation of $494.55 because she knowingly aided, assisted, or hired individuals to perform or offer to

perform massage therapy services at Oriental Massage without being licensed by the board, and she, as

the responsible officer of Oriental Massage, employed unlicensed individuals to perform massage therapy

services. (12/01/14)

Delaware County Xueli Zhang, license no. MSG007866, of Wayne, Delaware County, was ordered to cease and desist from

hiring or employing unlicensed individuals to perform massage therapy services requiring a license,

ordered to pay a civil penalty of $1,000 and costs of investigation of $80.58, and complete four hours of

remedial education in professional ethics, because he as the responsible officer of the Chinese Tai Chi

Bodywork Center, employed unlicensed individuals to provide massage therapy/bodywork services even

though none of the aforementioned individuals were licensed by the board or were members of any

national or local bodywork organization. (12/01/14)

Montgomery County Yong Qiang Li, unlicensed, of North Wales, Montgomery County, was ordered to immediately cease and

desist from hiring or employing unlicensed individuals to perform massage therapy and was ordered to

pay a civil penalty of $1,000 and costs of investigation of $527.52 because Li, as the responsible officer

of Health Power, employed individuals to provide massage therapy/bodywork services to customers even

though none of the individuals were licensed by the board. (12/01/14)

Chester County Michelle S. Montague, license no. MA051498, of West Grove, Chester County, was ordered to pay a civil

without the direct supervision of a licensed veterinarian, ordered to pay a civil penalty of $1,000 and

assessed costs of investigation in the amount of $350 because she violated the Act which states

“….Chiropractic…procedures shall only be performed upon animals by chiropractors...in conjunction

with the practice of veterinary medicine and under the direct supervision of a veterinarian...,” and/or

unlicensed person in his employment to use his license to treat sick, injured or afflicted animals and

knowingly aided, assisted, secured, advised or had in his employment an unlicensed person to practice
