The panel reviewed and discussed the written submissions of the parties provided to the panel before the hearing. Also attending the conference call were Carla Gelbloom, who recorded the minutes and the panel’s decision and independent legal counsel, Andrew Roman. Mr. Morrison was available during the call to answer any questions the panel had.

NoticeofReferral

ThePanelreceivedacopyoftheNoticeofReferral.Thepartiesacknowledgeandagreethattheallegationsassetoutbelowaresubstantiallycorrect.

1. TheMemberbreachedhisobligationswithrespecttomaintainingqualityservice.

(a) ApplicableArticle(s)oftheCodeofProfessionalEthics:

(i) Article6.1–MaintenanceofQualityService;

(ii) 6.1.1–Meetallapplicabledeadlines;

(iii) 6.1.2–ConductClientaffairsinanefficient,cost-effectivemanner;

(iv) 6.1.3–CommunicatewiththeClientatallstagesofamatterinatimelyandeffectiveway;

(v) 6.1.5–AnswerreasonableClientrequestsinatimelyandeffectivemanner;

(vi) 6.1.9–ComplyinletterandinspiritwiththisCode.

(b) ParticularsoftheAllegation(s):

(i) TheComplainantretainedJamesWebb(the“Member”)tomakeApplicationforPermanentResidenceinCanada.

(ii) TheComplainantsignedaContractofEngagementwiththeMemberinApril,2009andpaidtotheMembertherequiredupfrontfeeof$3,000CDN.onoraboutApril21,2009.

(iii) TheMemberpromisedtoarrangeajobofferfortheComplainant,approvedbyHumanResourcesSkillsDevelopmentCanada(“HRSDC”).TheMemberwouldthenfiletheComplainant’sApplicationforPermanentResidenceinCanadaonthepointsystem.

(iv) InoraboutJanuary,2010theMemberinformedtheComplainantthattheMemberhadsuccessfullyarrangedajobofferfortheComplainant.Theoffer,however,wasforthedesignationelectrician.

(v) TheComplainantinformedtheMemberthathewasnotqualifiedforthisjob.

(vi) Immediatelythereafter,onthesamedaytheMembersenttheComplainantanotherjobofferfromanothercompany.Allthematerialinthisjobofferwasthesameasthematerialinthepreviousjobofferexceptforthecompany’snameandthedesignation.

(vii) UponreceiptofthesecondjoboffertheComplainantsuspectedthatthiswasnotarealjobofferandhadnotbeenHRSDCapproved.TheComplainantrepeatedlyaskedtheMembertoprovideproofthatthesecondjobofferhadbeenapprovedbyHRSDC.TheMemberfailedtodosoandtoprovidetheComplainantwithasatisfactoryanswer.

(viii) ThereaftertheComplainantrepeatedlyaskedtheMemberabouttheprogressofhiscase.However,theMemberavoidedtheComplainant’semailsandfailedtorespondtotheComplainant’srequestsforinformation.

(ix) TheComplainantaskedtheMembertorefundhismoneybuttheMemberfailedorrefusedtodoso.

(x) TheCompliantfiledacomplaintagainsttheMemberwithICCRCinoraboutNovember,2014.

MinutesofSettlement

IntheMinutesofSettlementthepartiesjointlyagreeandsubmitthatthepenaltytobeimposedbythepaneloftheDisciplineCommittee:

(a) Areprimand,thetextofwhichissetoutinSchedule“A”attachedhereto;

(b) TheMemberwillbesuspendedfrompracticeforaperiodoftwomonths,commencingMay1, 2016;

(c) OnemonthofthesuspensionwillbewaivedonconditionthattheMembertakestheICCRC PracticeManagementEducation(“PME”)courseonEthicalPractice,suchcoursetobe completedbyJune1,2016;

(d) NolaterthanJune15,2016theMemberwillfilewiththeICCRCRegistrarasworndeclaration thathehascompletedthePMEcourseassetoutinsubparagraph(c)above;

(e) IftheMemberdoesnotcomplywiththerequirementssetoutinsubparagraphs(c)and(d) above,thenhewillbesuspendedforafurtherperiodofonemonth,suchsuspensiontotake effectuponnon-compliance.

THEDISCIPLINECOMMITTEEORDERSthatthisOrdershallbepublishedontheICCRCWebsite.

Decision

Aftercarefullyreviewingthewrittensubmissionsoftheparties,thepanelunanimouslyapprovedtheJointSubmissiononPenalty.Inaddition,thepanelrecognizesthattheMemberhasarrangedtorefundtotheComplainanttheupfrontfeeof$3,000CDNbytwochequesdatedFebruary27,2016andMarch22,2016.Thepanelfoundthattheproposedpenaltyadequatelyaddressedtheneedforageneraldeterrencetotheentiremembership,aswellasaspecificdeterrencetotheMember.Thepaneldecidedthattheproposedpenaltyisreasonableandinthepublicinterest.

Thepanelcommendedthepartiesforreachinganagreementonboththefactsandtheproposedpenalty.
