Today’s session will provide an overview of…

• state discipline data reporting requirements

• procedures for accurate data entry in PowerSchool

• using reports for checking data, managing schools, and verifying the data pulled by DPI for state and federal reporting

Reporting Requirements

• The PowerSchool Incidents module can collect data on any disciplinary incident.

• The minimum input is one offender, one of the listed behaviors, and one of the listed actions.

• Recommend entering all incidents involving office-administered disciplinary actions

• The following slides detail the (minimum) reporting requirements.

State and Federal Reporting Requirements

• Any of the 16 reportable crimes committed on a school campus or in connection with a school function.

• Any act resulting in corporal punishment, an in-school suspension, an out-of-school suspension or an expulsion.

• Any disciplinary assignment of a student to an alternative school or alternative learning program.

• Other designated acts, regardless of consequences assigned.

• Victims of dangerous crimes and victims of harassment based on sex, race, disability, religious affiliation, or sexual orientation.

• Whether or not a transfer was offered to a victim of nine dangerous acts.

• Any use of seclusion or restraint by school staff, including “victim.”

Violent Offenses that can lead to a school

designation of Persistently Dangerous

• Homicide• Assault Resulting in Serious Bodily Injury• Assault Involving Use of a Weapon• Rape• Sexual Offense• Sexual Assault• Kidnapping• Robbery with a Dangerous Weapon• Taking Indecent Liberties with a Minor

(Must include victim and transfer offer information.)

Persistently Dangerous Designation

…may be given to a school where at least two (2) violent criminal offenses and five (5) per 1000 students were committed in two (2) consecutive years.

• The SBE makes a final determination of “whether the school is a persistently dangerous school, whether the school should be placed on probation, or whether no additional interventions are necessary to protect students from violent crimes.”

• Make Incident Type = Discipline (dropdown box with only 1 choice)

• Enter Incident Date, Time (defaults to current date, time)• Select Time Frame from dropdown box• Give Incident a Title• Provide Incident Description • Select Location from dropdown box

Entering Transfers Offered to Victims of Violent Crimes

• Transfer offer is required for victims of nine violent crimes if the student’s grade level is available at another school in the LEA.

• Enter the answers to one or two questions and attach to victim in PowerSchool.

Entering Transfers Offered to Victims of Violent Crimes

• In the Add Action screen, select Victim Actions and make the following one or two selections to attach to the victim.

• Select Victim Offered Transfer, Victim Not Offered Transfer, or No Transfer Available, depending on circumstances.

• If a transfer is offered, also select Victim Accepted Transfer Offer or Victim Declined Transfer Offer.

• Attach the selection(s) to the victim.

• In the Add Action screen, select Victim Actions and make one or two selections to attach to the victim.

Entering the number of days for a 365-day suspension

When assigning a 365-day suspension, - select OSS-365 Days as the Action Type - Enter the Begin Date. - In order to capture only the suspension days the state needs

to report for the current-year suspension data collection, enter the number of school days remaining in the school year. The system will generate the last day of school as the End Date.

- To document when the student is eligible to return to school, overwrite this date with the correct date from the next school year that the suspension will end.

Reporting Uses of Seclusion and Restraint

The following behaviors only apply to actions of school staff:

097 SR: Aversive Procedure (staff only)098 SR: Illegal Physical Restraint (staff only)099 SR: Illegal Mechanical Restraint (staff only)100 SR: Illegal Seclusion (staff only)111 Mechanical restraint (staff only—OCR report)112 Physical restraint (staff only—OCR report)113 Seclusion (staff only—OCR report)

The first four are per GS 115C-391.1. The last three are for the federal OCR data collection. OCR collects demographic data on the “victims” of restraint and seclusion.

Do not use these behavior types for offenses committed by students.

Reporting Uses of Seclusion and Restraint (OCR)

Federal Seclusion Mechanical Restraint Physical Restraint

Definition

Involuntary confinement of a student alone in a room or area from which the student is physically prevented from leaving.

Any device that restricts a student's freedom of movement EXCEPT devices implemented by trained school personnel or prescribed by an appropriate medical or related services professional.

A personal restriction that immobilizes or reduces the ability of a student to move his or her torso, arms, legs, or head freely.

What Must be Reported

Use of Seclusion Use of Mechanical Restraint Use of Physical Restraint

Stated Exceptions to Reporting

1. The confinement is a "timeout," which is defined as a behavior management technique that is part of an approved program, involves the monitored separation of a student in a non-locked setting, and is implemented for the purpose of calming.

1. adaptive devices or mechanical supports used to achieve proper body position, balance, or alignment to allow greater freedom of mobility than would be possible without the use of such devices.

1. A physical escort, which is defined as a temporary touching or holding of the hand, wrist, arm, shoulder, or back for the purpose of inducing a student who is acting out to walk to a safe location.

Reporting Impermissible Use of Mechanical Restraint (per state statute)

Notify parents and report to DPI all prohibited uses. The use of mechanical restraint is permissible if it meets federal exceptions or is

• reasonably needed to obtain possession of a weapon or other dangerous objects on a person or within the control of a person.

• reasonably needed for self-defense.

• reasonably needed to ensure the safety of any student, school employee, volunteer, or other person present.

• the use of seat belts or other safety restraints to secure students during transportation.

Reporting Impermissible Use of Seclusion (per state statute)

Notify parents and report to DPI all prohibited uses and seclusion exceeding 10 minutes or the amount specified in the student’s IEP. A short use of seclusion is permissible if the student is in a safe, well-ventilated space and • the seclusion meets federal exceptions

• it is reasonably needed to respond to a person in possession of a weapon or other dangerous object.

• it is reasonable needed to maintain order or prevent or break up a fight.

• it is reasonably needed for self-defense.

• it is reasonably needed when a student's behavior poses a threat of imminent physical harm to self or others or imminent substantial destruction of school or another person's property.

Reporting Impermissible Uses of Physical Restraints (per state statute)

Notify parents and report to DPI any use of physical restraint resulting in observable physical injury to a student.

Although GS 391.1(c)(1) describes a number of cases (obtaining possession of a weapon, preventing or breaking up a fight, etc.) in which the use of physical restraint by school staff is a reasonable use of force, all incidents with an observable physical injury from such an interaction must be reported.

• Reports are useful to check for input errors, manage school and LEA discipline processes, and verify annual data totals.

• Two types of reports in PowerSchool:

- State Reports (Discipline Report views)

- SQL Reports (Incidents)

On Start Page click State Reports and locate Discipline Report. To pull most recent data, run (and refresh) Discipline Report and select report from the drop-down menu “Data Views.” May need to click “Clear Cache” at bottom right of report.
