During the month of December, counsel for Houston deposed Jack Gambrell of the Cajun Electric Power Coopera- tive, J. H. Butts of the Deep East Texas Electric Coopera- tive, Inc., and John Wilson, the economic expert witness of the Public Utilities Board of Brownsville, Texas (" PUB") . Mr. Wilson's deposition was not completed, and counsel for Houston and PUB have agreed to continue the deposition at a mutually convenient time. This is the December 1979 discovery report c f HoustonLighting & Power Company.

Depositions have been noticed for the thirteen witnessesrecently designated by the Department. Three additionalsubpoenas duces tecum addressed to the City of CollegeStation, the City of Vernon and the Tri-County ElectricCooperative, Inc., respectively, were also issued at Houston'srequest.

Houston served its Third Set of Interrogatories andRequests for Production of Documents on the Department andthe Etaff on December 18, 1979.

During December, Houston produced certain documentsrequested by the Department and the Staff respectively.Houston also received documents produced by the Central andSouth West Corporation and the PUB.

The Board ordered o1. October 23, 1979, that the Depart-ment must produce to Houston certain drafts of testimonyprepared by the Department's expert engineering witness,William E. Sco: Houston still has not received copies of..

those drafts.

Finally, on July 19, 1979, during the deposition of theStaff's economic expert witness, Norman Lerner, Staff counselagreed to provide Houston with copies of four cr fivememoranda vhich were called for in Houston's discoveryrequests but not included in the materials produced by theStaff. */ Although Houston recently renewed its request forproduction, the Staff has still not furnished copies ofthose memoranda.
