Background

Chapter 383, Statutes of 2012 (SB 1186 – Steinberg and Dutton) created Government Code Section 4467, which requires any applicant for a local business license or equivalent instrument to pay an additional $1 fee to the local government that issued the business license. Local governments must submit 30 percent of the fee revenue to the Division of the State Architect (State Architect) for deposit into the Disability Access and Education Revolving Fund (Fund). Pursuant to Government Code Section 4465, the purpose of the Fund is to provide increased compliance with state and federal accessibility requirements by:

• Increasing the number of certified access specialists (CASp). • Maintaining State Architect oversight of the CASp program. • Expanding education and outreach efforts for compliance with accessibility

requirements. Government Code Section 4470(c) requires the State Architect to submit an annual report for the previous calendar year. The State Architect must report the total fees collected by each local government, the total fees transmitted to the Fund by local governments during the previous calendar year, and their distribution, including Fund resources spent on:

• Administrative services. • Moderating certification and examination fees for the CASp program. • Establishing and maintaining oversight of the CASp program. • Developing and disseminating educational materials to facilitate compliance with state

and federal access requirements. Information provided in this report is based on accounting data that represents amounts collected by the state from local governments until March 6, 2017, and state billing information indicating amounts spent in each specific reporting category. Total Fees Transmitted to the Fund

The State Architect received a total of $606,984 from fees collected by local governments for the 2016 calendar year. In addition, the State Architect received late payments in the amount of $64,618 attributable to the 2015 calendar year, $5,603 attributable to the 2014 calendar year, and $1,123 attributable to the 2013 calendar year. The State Architect received Fund transmittals from the 10 largest cities in California, except the city of Los Angeles. Fund Resources for Administrative Services by the State Architect

The State Architect spent $112,667 of Fund resources for administrative services in 2016. Primary administrative services included: operation of the fee collection system and related instruction, correspondence with local governments, review of information reported by local governments, form development, and technical guidance.

Fund Resources Used to Moderate CASp Certification and Examination Fees

The State Architect spent $1,945 of Fund resources for moderation of CASp certification and examination fees. The work performed was on the development of new regulations to create a $150 delinquency fee that allows CASps to reinstate an expired certification for up to one year, rather than subjecting them to the entire fee and exam process. The new regulations became effective on May 9, 2016.

Fund Resources Used to Increase Oversight of the CASp Program

The State Architect spent $41,601 of Fund resources to increase oversight of the CASp program. Major items included providing technical guidance, investigating occasional complaints filed against CASps, and final development and implementation of new regulations to strengthen audit procedures and to address CASp conduct and discipline. The new CASp program regulations became effective on May 9, 2016. Fund Resources Used for Education and Outreach

The State Architect spent $226,751 for education and outreach. The State Architect conducted outreach to business owners through partnerships with chambers of commerce, local governments, state legislators, the Governor’s Office of Business and Economic Development, the State Treasurer’s Office, and the Department of General Services’ Procurement Division’s Office of Small Business and Disabled Veteran Business Enterprise Services. The State Architect increased awareness of the CASp program to business and commercial property owners through website and form updates, a newsletter, email blasts, and by providing local governments marketing materials about the CASp program for distribution when businesses pay their $1 fee, including newly developed educational handouts. The State Architect also participated in events to educate business communities about the benefits of the CASp program. The State Architect continued its outreach to CASps and CASp candidates through eight sessions of the CASp 101 training class, and distribution of a newsletter. The State Architect also began development of a best practices guide for local governments, designed to share information on how some cities and counties have used resources from the $1 fee to fund increased CASp services in their jurisdictions and to facilitate compliance with construction-related accessibility requirements. Finally, the State Architect implemented provisions of new legislation affecting the CASp program, including communication with CASps and CASp candidates regarding the changes. Total Fees Collected by Each Local Government

Local governments that collected the $1 fee reported collecting a total of $518,841 for the 2016 calendar year. Out of 423 local governments that submitted 2016 fees to the State Architect, 146 submitted an annual report by the time this report was published. The State Architect continues to work with local governments that had not submitted fees and/or annual reports

when this report was published in order to inform them of their requirements under Government Code Section 4467. The Appendix indicates the 2016 Fund payments transmitted to the State Architect by each local government, whether the local government submitted an annual report, and (when reported) the total fees collected by each local government for the 2016 calendar year. Local governments that are not listed in the Appendix neither transmitted 2016 funds nor submitted an annual report.
