Comments and Responses for the Borrow Area Use Plan Sardinia, New York

Dear Mr. Denk; McMahon & Mann Consulting Engineers, P.C. (MMCE), as requested by Waste Management of New York, LLC (WMNY), has performed additional studies for the Chaffee Facility Proposed Borrow Area. This letter describes the additional studies and provides responses to the New York State Department of Environmental Conservation (NYSDEC) June 11, 2009 comment letter. Specifically, we collected additional soils and groundwater information. Since the BAUP was submitted, MMCE has continued collecting groundwater elevation data from the three monitoring wells located within the Proposed Borrow Area. Included in Attachment A is a revised Table 1, which shows monthly groundwater elevations through June 2009. As shown in Table 1, the highest sand and gravel groundwater

level recorded in SB9-08 (West Area monitoring well) and SB4-08 (East Area monitoring well) is elevation (El.) 1439.15 feet and El. 1441.88 feet respectively. We reviewed existing information and collected additional data to estimate the lateral extent and depth of the clay till. We reviewed the information presented in the February 2005 Hydrogeologic Report, Part III of the 6 NYCRR Part 360 Permit Application for the Western Landfill Expansion. The Hydrogeologic Report presents a line showing the estimated southern boundary of the clay till at the Chaffee Facility. On June 17, 2009, WMNY excavated 12 test pits within the West Area to provide additional data regarding the lateral extent and depth of clay till. The test pits were logged by Earth Dimensions, Inc. (EDI) and the logs are included in Attachment B. The test pit locations are plotted on revised Figures 2, 3 and 4, included in Attachment C. Figure 3 shows the test pit locations and the elevation of the bottom of the clay till where present. The elevation of the bottom of the clay till is also included for the original borings. Based on this information, a refined lateral clay till extent line is shown on Figures 2, 3 and 4. We revised the West Area borrow area limit to exclude a portion in the southwest corner, based on the refined lateral extent line. This revision reduces the West Area by approximately 1.5 acres and decreases the borrow volume by approximately 50,000 cubic yards. As shown on Figure 4, the revised reclamation grades result in approximately 2.4 to 13.4 feet of clay till remaining across the borrow area floor. The Sedimentation Basin for the West Area is also revised. As indicated on Figure 4, portions of the basin will be constructed on each side of the lateral clay till extent line and will extend below the observed bottom of clay till. The basin bottom is raised 3 feet from El. 1440 feet to El. 1443 feet, providing approximately 4 feet of separation between the bottom of the basin and the highest recorded groundwater elevation in SB9-08. Additionally, as shown on Figures 5 and 7 in Attachment C, the basin will be constructed with a 9-inch thick low permeability soil liner to limit stormwater infiltration. The design is consistent with that used for the site’s existing sedimentation basins #1, #2 and #3. The Sedimentation Basin will operate as originally proposed to allow for continued surface water discharge to the NYSDEC jurisdictional wetland SD-1. Please consider the information and revisions discussed above and included in the attachments during your continued review of the March 2009 BAUP submittal. Our responses to the NYSDEC comments, considering this additional information are included in Attachment D.

CONSTRUCTION SPECIFICATIONS

GENERAL:1. Contractor to verify all dimensions and conditions prior to construction.

2. Any questions regarding these drawings shall be directed to McMahon & Mann Consulting Engineers, P.C.(MMCE) (716 - 834-8932). Modifications will only be made in writing.

3. The Contractor will be responsible for construction layout.

4. The Contractor will be required to comply with all of the applicable Chaffee Facility Permits.

EXCAVATION AND BACKFILL:1. All excavations shall be performed in accordance with OSHA regulations.

2. Excess excavated material shall be disposed of in locations designated by Waste Management of New York(WMNY).

3. Unsuitable materials shall be legally disposed of, coordinate with WMNY for disposal locations.

4. Existing underground utility locations are unknown and must be confirmed with WMNY and utility companies priorto any excavation.

5. Embankment material shall be obtained from the excavation and shall be recompacted to 90% of the ModifiedProctor (ASTM D1557) maximum dry density. Embankment material shall not contain material greater than 10inches in size, organics or other deleterious materials. Embankment material shall be placed in compacted lifts notexceeding 12 inches in thickness.

6. Low permeability soil liner material shall not contain material greater than 3 inches in size, organics, or otherdeleterious material. When placed and compacted, the material must have a permeability less than or equal to1x10 cm/sec.

7. Pipe bedding shall meet the requirements for subbase Type 4 stated in Section 3.04 of the NYSDOT StandardSpecifications. Material shall be compacted to 90% of the Modified Proctor (ASTM D1557) maximum dry density.

STORMWATER DRAINAGE:1. Outlet pipes and standpipes shall be 12 inch and 36 inch diameter as shown on the drawings. Pipe shall be

corrugated exterior polyethylene pipe with a smooth interior wall. Pipe shall meet the requirements stated inAASHTO M294 for type 5 pipe.

2. Light stone rip-rap shall meet the requirements for light stone filling stated in Section 620-2 of NYSDOT StandardSpecifications. Heavy stone rip-rap shall meet the requirements for heavy stone filling stated in Section 620-2 ofNYSDOT Standards and Specifications. Installation shall be in accordance with Section 620-3 of the NYSDOTStandard Specifications.

3. All disturbed areas shall be seeded and mulched, using the following seed mix:Common White Clover 8 lbs. / acreTall Fescue 20 lbs. / acrePerennial Ryegrass 10 lbs. / acre

4. Separation Geotextile shall be a non-woven geotextile with a minimum mass per unit area of 6 oz. meeting therequirements of Geotex 701 or approved equivalent. Installation shall be in accordance with the Manufacturer'srecommendations.

5. Erosion Protection Mat shall consist of a polypropylene fiber mat specially designed for erosion control applicationson steep slopes and vegetated waterways such as C350 permanent turf reinforcement manufactured by NorthAmerican Green (NAG) or Engineer approved. Installation shall be in accordance with the Manufacturer'srecommendation.

6. Valves shall be flanged 12 inch quarter turn ball valves. The valves shall be either thermoplastic, HDPE orapproved equivalent. The valves shall be equipped with valve stems and curb boxes to allow access at theelevations shown on the Contract Drawings. The curb boxes shall be installed with a removable cover capable ofwithstanding AASHTO HS-20 loads.

AQUATIC PLANTINGS:1. Aquatic bench will be planted with a combination of some or all of the following submerged or floating stemmed aquatics:

Submerged Aquatics: Coontail, Pond Weed, Water Weed, Lond-Leaved Pond Weed and Wild Celery.

Floating Stemmed Aquatics: Spatterdock, Duckweed, Watershield, Water Cress, Rice Cutgrass, Bay Forget Me Not, Swamp Smartweed, Water Smartweed, White Water Lily and Pale Mannagrass.

Other plantings may be allowed if the plants are capable of withstanding constant inundation of water to depths of 1 foot.

No one individual species of submerged or floating aquatics may exceed 10 percent of the total proposed for the project.

Spacing of plantings shall be based on Manufacturer's recommendations. The plantings shall have a two year warranty.

Response to NYSDEC Comments: The NYSDEC comments are presented in italics followed by our response. 1. It is stated on page 2-7 that the west borrow area will be excavated from east to west between elevation 1450 feet to elevation 1440 feet. Location SB8-08 is just east of the boundary of this area, and the base of the till was at 1440.67 feet, so it appears that the excavation could only go down to about 1443 feet in this area. The cross section in Figure 4 does appear to show that the excavation will go only to about 1444 feet in the vicinity of this borehole. However, since the boreholes are offset on the cross sections it would be useful to have a grid map showing the base of till elevations and excavation elevations. Based on the additional clay till information, the reclamation grades shown on Figure 4 in Attachment C are revised resulting in approximately 2.4 to 13.4 feet of clay till remaining across the West Area floor. The borings in the East Area indicate that there will be approximately 4.8 to over 20 feet of clay till remaining. In lieu of a grid map, the remaining clay till thickness, after reaching the reclamation grades, have been plotted on Figure 4. As shown on Figure 4, the West Area Sedimentation Basin will be excavated below the bottom of clay till. Therefore, as shown on the revised figures, the sedimentation basin will be constructed with a 9-inch thick low permeability soil liner, consistent with the design of the site’s existing sedimentation basins. 2. The delineation of the extent of clay till as presented in McMahon and Mann’s Hydrogeologic Report for the Western Expansion Area (February 2005) was reviewed. Figure 14 of Volume I of this report shows the clay till potentially ending in the southernmost portions of the proposed borrow areas, particularly the west borrow area. This information should be incorporated into any excavation plan to make sure the sand and gravel zone is not excavated into in these areas. We refined the lateral clay till extent line considering the additional test pit data, as shown on the Figures in Attachment C. We also revised the West Area reclamation elevations to maintain the borrow operation in the clay till. Additionally, the West Area Sedimentation Basin is raised 3 feet to El. 1443, providing a greater separation to groundwater. Because the sedimentation basin will be excavated into the sand and gravel, the design includes a 9-inch thick low permeability soil liner consistent with the site’s existing sedimentation basins. 3. A plan for properly decommissioning the monitoring wells in the borrow areas should be included with the application materials. Currently Section 2.3.2 indicates that the three monitoring wells will be decommissioned. Monitoring well SB6-08 will be removed during borrow excavation.

The bottom of screen (Elev. 1448.26) is within 4 feet of the reclamation grade, therefore this monitoring well can be completely removed by excavation equipment. Monitoring wells SB4-08 and SB9-08 both extend below the reclamation grades. These wells will be lowered during borrow excavation and will then be decommissioned in accordance with Appendix C of the Environmental Monitoring Plan, Part XI of the February 2005 Western Expansion Landfill 6 NYCRR Part 360 Solid Waste Management Permit Modification Application. 4. See the attached letter regarding the wetland survey map. Please ensure these requirements are met. Earth Dimensions, Inc. submitted revised wetland mapping on June 4, 2009 to the NYSDEC.
