NEW DELHI: The SupremeCourt on Tuesday said therewould be zero tolerance ofillegal constructions — fromstatues of public figures toreligious structures — on en-croached government land.
With this, the court gavefresh force to its 2013 ban oninstallations on public land.
Addressing the hazard ofencroachments on roads,street pavements and publicland, which hampered thelives of the ordinary citizen,the court ban had empo-wered the civic agencies andmunicipal authorities,which were hitherto help-less before local political in-terests and religioussentiments.
“We have made it clear. Il-legal constructions are ille-gal constructions. There is alarge number of statues,temples, gurdwaras,mosques, churches con-structed illegally on govern-ment land,” Justice S.J.Mukhopadhaya observed onTuesday.
While passing the ban or-der, the Supreme Court hadlast year said “public road isnot anyone’s property”.
“Each citizen had a rightto use the road and that rightcannot be interfered with orimpeded by constructing atemple, mosque, church orgurdwara or by installing thestatue of a public figure,” thecourt had said.

NEW DELHI: Observing that“guns are sold like toys in themarket,” the Supreme Courton Tuesday sought a full-fledged investigation cover-ing all nine Army Commandsinto the illegal sale of armsand ammunition by Armyofficials.
A Bench of Justices H.L.Dattu and S.A. Bobde washearing a public interest liti-gation petition filed by Su-preme Court lawyer ArvindKumar Sharma on the nexusbetween Army officials andarms dealers.
The petition focusses on
the illegal sale of non-stan-dard-pattern weapons andimported ammunition byhigh-ranking officers of theSouthwestern Command inGanganagar district of Rajas-than near the India-Pakistanborder.
A Court of Inquiry report ofSeptember 25, 2008, found 72Army officials guilty of sellingammunition and importedarms in violation of the ArmyOrders and Arms Act, 1959.
But the Bench on Tuesdaycalled the 2008 Army pro-ceedings an “eyewash,” not-ing how most of the Armyofficials, even after pleadingguilty, were punished withjust reprimands, recordingsof “severe displeasure” andfines of Rs. 500.
Mr. Justice Dattu said it“shocks the conscience of thecourt” to find that the Armyproceedings ended with theguilty men “getting away bypaying a pittance.”
“Army officials, trainedwith the taxpayers’ moneyand given weapons to save thecountry, sell them.”

NEW DELHI: The Delhi Bharati-ya Janata Party chief SatishUpadhyay has in a letter to theLieutenant-Governor de-manded that “80 per cent offlats being allotted by the Del-hi Development Authority in
the next scheme be reservedfor the people of Delhi”.
In the letter, Mr. Upadhyaysaid the city’s residentsshould get the benefit of theDDA housing schemes, espe-cially those who are livinghere for several years and donot have houses of their own.

ly found in a semi-unconsciousstate in his hostel room in theresidential school on August20. He was taken to a privatehospital in Gwalior and thenshifted to Indraprastha ApolloHospital in New Delhi wherehe is undergoing treatment.

Thereaf-ter, the In-come Taxdepartmentconsideredthe matterand accept-ed Ms. May-awati’s explanation and theorder passed by the Income TaxAppellate Tribunal was upheldby the Delhi High Court. “Thereis no other material availablewith the CBI to warrant regis-tration of a fresh FIR,” the
counter said. The CBI alsopointed out that the petitioner-had filed a review petitionagainst the quashing of the FIRand the apex court had rejectedit. The petitioner had not pro-duced any material apart fromthe one which was already ex-amined by the apex court.
After the Supreme Courtquashed the earlier FIR as ille-gal, “the material collectedthereof does not exist in theform of evidence anymore forfiling fresh FIR.” The CBIsought dismissal of the petition.
