AMENDMENT TO THE MONTREAL PROTOCOL ON SUBSTANCESTHAT DEPLETE THE OZONE LAYER

BEIJING, 3 DECEMBER 1999

ADOPTION OF AMENDMENT

The Secretary-General of the United Nations, acting in his capacity as depositary,communicates the following:

At the Eleventh Meeting of the Parties to the above Protocol, held in Beijing from29 November to 3 December 1999, the Parties adopted, in accordance with the procedure laid down inarticle 9, paragraph 4 of the 1985 Vienna Convention for the Protection of the Ozone Layer, theAmendment to the Montreal Protocol as set out in Annex V to the report of the Eleventh Meeting ofthe Parties (Decision XI/5).

The text of the above Amendment, in the six official languages of its conclusion, is attachedas an Annex to this notification.

In accordance with its article 3, paragraph 1, the Amendment shall enter into force on1 January 2001, provided that at least twenty instruments of ratification, acceptance or approval of theAmendment have been deposited by States or regional economic integration organizations that areParties to the Montreal Protocol on Substances that Deplete the Ozone Layer. In the event that thiscondition has not been fulfilled by that date, the Amendment shall enter into force on the ninetieth dayfollowing the date on which it has been fulfilled.

After its entry into force, the Amendment, in accordance with its article 3, paragraph 3, shallenter into force for any other Party to the Protocol on the ninetieth day following the date of deposit ofits instrument of ratification, acceptance or approval.

ADOPTION D'UN AMENDEMENT

Le Secrétaire général de l'Organisation des Nations Unies, agissant en sa qualité dedépositaire, communique :

A la onzième réunion des Parties au Protocole susmentionné, tenue à Beijing du 29 novembreau 3 décembre 1999, lesdites Parties ont adopté (Décision XI/5), conformément à la procédure énoncéeau paragraphe 4 de l'article 9 de la Convention de Vienne pour la protection de la couche d'ozone de195, Г Amendement au Protocole de Montréal qui figure à l'annexe V de rapport de la OnzièmeRéunion des Parties.

On trouvera en annexe à la présente notification, le texte de l'Amendement susmentionné,dans les six langues de sa conclusion.

Conformément au premier paragraphe de son article 3, l'Amendement entre en vigueur le1er janvier 2001, sous réserve du dépôt à cette date d'au moins 20 instruments de ratification,d'acceptation ou d'approbation à l'Amendement par des États ou des organisations régionalesd'intégration économique qui sont Parties au Protocole de Montréal relatif à des substances quiappauvrissent la couche d'ozone. Si à cette date ces conditions n'ont pas été remplies, le présentAmendement entre en vigueur le quatre-vingt-dixième jour suivant la date à laquelle ces conditionsont été remplies.

Après son entrée en vigueur, l'Amendement entrera en vigueur le quatre-vingt-dixième jour àcompter de la date du dépôt, pour toute autre Partie au Protocole, de son instrument de ratification,d'acceptation ou d'approbation, conformément au paragraphe 3 de l'article 3 de l'Amendement.

To adopt, in accordance with the procedure laid down in paragraph 4 of Article 9 of the ViennaConvention for the Protection of the Ozone Layer, the Amendment to the Montreal Protocol asset out in annex V to the report of the Eleventh Meeting of the Parties;

Article 1: Amendment

A. Article 2, paragraph 5

In paragraph 5 of Article 2 of the Protocol, for the words:

The following paragraph shall be added after paragraph 7 of Article 2F of the Protocol:

8. Each Party producing one or more of these substances shall ensure that for the twelve-month periodcommencing on 1 January 2004, and in each twelve-month period thereafter, its calculated level ofproduction of the controlled substances in Group I of Annex С does not exceed, annually, the averageof:

(a) The sum of its calculated level of consumption in 1989 of the controlled substances in GroupI of Annex С and two point eight per cent of its calculated level of consumption in 1989 ofthe controlled substances in Group I of Annex A; and

(b) The sum of its calculated level of production in 1989 of the controlled substances in Group Iof Annex С and two point eight per cent of its calculated level of production in 1989 of thecontrolled substances in Group I of Annex A.

However, in order to satisfy the basic domestic needs of the Parties operating under paragraph 1 ofArticle 5, its calculated level of production may exceed that limit by up to fifteen per cent of itscalculated level of production of the controlled substances in Group I of Annex С as defined above.

D. Article 2 I

The following Article shall be inserted after Article 2H of the Protocol:

Article 21: Bromochloromethane

Each Party shall ensure that for the twelve-month period commencing on 1 January 2002, and in each twelve-

month period thereafter, its calculated level of consumption and production of the controlled substance in

Group III of Annex С does not exceed zero. This paragraph will apply save to the extent that the Parties

decide to permit the level of production or consumption that is necessary to satisfy uses agreed by them to be

essential.

E. Article 3

In Article 3 of the Protocol, for the words:

The following paragraphs shall be added to Article 4 of the Protocol after paragraph 1 qua:

1 quin. As of 1 January 2004, each Party shall ban the import of the controlled substances in Group I ofAnnex С from any State not party to this Protocol.

1 sex. Within one year of the date of entry into force of this paragraph, each Party shall ban the import ofthe controlled substance in Group III of Annex С from any State not party to this Protocol.

G. Article 4, paragraphs 2 quin. and 2 sex.

The following paragraphs shall be added to Article 4 of the Protocol after paragraph 2 qua:

2 quin. As of 1 January 2004, each Party shall ban the export of the controlled substances in Group I ofAnnex С to any State not party to this Protocol.

2 sex. Within one year of the date of entry into force of this paragraph, each Party shall ban the export ofthe controlled substance in Group III of Annex С to any State not party to this Protocol.

No State or regional economic integration organization may deposit an instrument of ratification, acceptanceor approval of or accession to this Amendment unless it has previously, or simultaneously, deposited such aninstrument to the Amendment adopted at the Ninth Meeting of the Parties in Montreal, 17 September 1997.

Article 3: Entry into force

1. This Amendment shall enter into force on 1 January 2001, provided that at least twenty instrumentsof ratification, acceptance or approval of the Amendment have been deposited by States or regional economicintegration organizations that are Parties to the Montreal Protocol on Substances that Deplete the OzoneLayer. In the event that this condition has not been fulfilled by that date, the Amendment shall enter intoforce on the ninetieth day following the date on which it has been fulfilled.

2. For the purposes of paragraph 1, any such instrument deposited by a regional economic integrationorganization shall not be counted as additional to those deposited by member States of such organization.

3. After the entry intoforce of this Amendment, as provided under paragraph I, it shall enter into forcefor any other Party to the Protocol on the ninetieth day following the date of deposit of its instrument ofratification, acceptance or approval.

du Groupe I de l'Annexe C; 2,8 % de son niveau calculé de consommation en 1989 dessubstances réglementées du Groupe I de l'Annexe A;

b) La somme de son niveau calculé de production en 1989 des substances réglementées du

Groupe I de l'Annexe C; 2,8 % de son niveau calculé de production en 1989 dessubstances réglementées du Groupe I de l'Annexe A.

Toutefois, pour répondre aux besoins intérieurs fondamentaux des Parties visées au paragraphe

1 de l'article 5, son niveau calculé de production peut excéder cette limite d'un maximum de15 % de son niveau calculé de production des substances réglementées du Groupe I del'Annexe С tel que défini ci-dessus.

D. Article 21

Insérer l'article ci-après à la suite de l'article 2H du Protocole.

Article 21 : Bromochlorométhane

Pendant la période de douze mois commençant le premier janvier 2002 puis pendant chaque périodede douze mois qui suivra, chaque Partie veille à ce que ses niveaux calculés de consommation et de

production de substances réglementées du Groupe III de l'annexe С soient égaux à zéro. Ce

paragraphe s'appliquera, sauf si les Parties décident d'autoriser le niveau de production ou deconsommation qui est nécessaire pour répondre aux besoins en utilisations dont elles conviennent

qu'elles sont essentielles.

E. Article 3

A l'article 3 du Protocole, remplacer les mots :

Après le paragraphe 1 quater, ajouter les paragraphes suivants :

Article 2 : Relations avec l'Amendement de 1997

Aucun Etat ni organisation régionale d'intégration économique ne peut déposer un instrument de

ratification, d'acceptation ou d'approbation du présent Amendement ou d'adhésion au présentAmendement, s'il n'a pas précédemment, ou simultanément, déposé un tel instrument à

l'Amendement adopté par les Parties à leur neuvième Réunion à Montréal le 17 septembre 1997.

Article 3 : Entrée en vigueur

1. Le présent Amendement entre en vigueur le 1er janvier 2001, sous réserve du dépôt, à cettedate, d'au moins 20 instruments de ratification, d'acceptation ou d'approbation de l'Amendement par

des Etats ou des organisations régionales d'intégration économique qui sont Parties au Protocole deMontréal relatif à des substances qui appauvrissent la couche d'ozone. Si, à cette date, cette

condition n'a pas été respectée, le présent Amendement entrera en vigueur le quatre-vingt-dix-neuvième jour suivant la date à laquelle cette condition aura été remplie.

2. Aux fins du paragraphe 1, aucun des instruments déposés par une organisation régionaled'intégration économique ne doit être considéré comme un instrument venant s'ajouter auxinstruments déjà déposés par les Etats membres de ladite organisation.

3. Postérieurement à son entrée en vigueur, tel que prévu au paragraphe 1, le présent instrument

entre en vigueur pour toute autre Partie au Protocole le quatre-vingt-dix-neuvième jour suivant la datedu dépôt de son instrument de ratification, d'acceptation ou d'approbation.

Статья 1: Поправка

В пункте 5 статьи 2 Протокола слова

В статью 2F Протокола после пункта 7 следует добавить нижеприведенный пункт:

"8. Каждая Сторона, сокращающая одно или более из этихвеществ, обеспечивает, чтобы за период двенадцати месяцев,начинающийся 1 января 2004 года, и за каждый последующий периоддвенадцати месяцев ежегодный расчетный уровень производстварегулируемых веществ, включенных в группу I приложения С,ежегодно не превышал в среднем:

a) суммы ее расчетного уровня потребления в 1989 годурегулируемых веществ, включенных в группу I приложения С, идве целых восемь десятых процента от расчетного уровня потребленияею в 1989 году регулируемых веществ, включенных в группу Iприложения А; и

b) суммы ее расчетного уровня производства в 1989 годурегулируемых веществ, включенных в группу I приложения С, идве целых восемь десятых процента от расчетного уровняпроизводства ею в 1989 году регулируемых веществ, включенных вгруппу I приложения А.

Однако для удовлетворения основных внутренних потребностейСторон, действующих в рамках пункта 1 статьи 5, расчетный уровеньпроизводства ею может превышать этот предел на пятнадцатьпроцентов от расчетного уровня производства ею регулируемыхвеществ, включенных в группу I приложения С, как определеновыше".

D. Статья 21

После статьи 2Н Протокола следует добавить нижеприведенную статью:

"Статья 21: Бромхлорметан

Каждая Сторона обеспечивает, чтобы за период двенадцати месяцев,начинающийся I января 2002 года, и за каждый последующий периоддвенадцати месяцев расчетный уровень производства и потребленияею регулируемого вещества, включенного в группу III приложения С,не превышал нулевого уровня. Этот пункт применяется заисключением тех случаев, когда Стороны принимают решениеразрешить уровень производства или потребления, которыйнеобходим для удовлетворения видов применения, которыеопределены ими как основные".

2 секс В течение одного года последаты вступления в силунастоящего пункта каждаяСторона запрещает экспортрегулируемого вещества,включенного в группу IIIстатьи С, в любое государство,которое не является Сторонойнастоящего Протокола".

Статья 2: Связь с Поправкой 1997 года

Ни одно государство или региональная организация экономической интеграции немогут сдать на хранение документ о ратификации, принятии или одобрении илиприсоединении к настоящей Поправке, если они заранее или одновременно несдали на хранение такого рода документ, касающийся Поправки, принятой надевятом Совещании Сторон в Монреале 17 сентября 1997 года.

Статья 3: Вступление в силу

1. Настоящая Поправка вступает в силу 1 января 2001 года при условии сдачина хранение не менее двадцати документов о ратификации, принятии илиодобрении Поправки государствами или региональными организациямиэкономической интеграции, являющимися Сторонами Монреальского протоколапо веществам, разрушающим озоновый слой. Если к этой дате указанные условияне соблюдены, Поправка вступает в силу на девяностый день после датысоблюдения этих условий.

2. Для целей пункта 1 любой такой документ, сданный на хранение какой-либорегиональной организацией экономической интеграции, не считаетсядополнительным по отношению к документам, сданным на хранениегосударствами - членами такой организации.

3. После вступления в силу настоящей Поправки в соответствии с пунктом 1Поправка вступает в силу в отношении любой другой Стороны Протокола надевяностый день после сдачи на хранение документа о ратификации, принятии илиодобрении.

- Adoptar, de conformidad con el procedimiento establecido en el párrafo 4del artículo 9 del Convenio de Viena para la Protección de la Capa deOzono, la enmienda del Protocolo de Montreal especificada en el anexo Vdel informe de la Undécima Reunión de las Partes/

ENMEENDA DEL PROTOCOLO DE MONTREAL RELATIVO A LAS SUSTANCIASQUE AGOTAN LA CAPA DE OZONO

Artículo 1: Enmienda

A. Artículo 2, párrafo 5

En el párrafo 5 del artículo 2 del Protocolo las palabras:

deberán sustituirse por:

B. Artículo 2, párrafos 8 a) y 11

En los párrafos 8 a) y 11 delartículo 2 del Protocolo las palabras:

deberán sustituirse por:

C. Artículo 2F, párrafo 8

Después del párrafo 7 del artículo 2F del Protocolo se añadirá el párrafo siguiente:

8. Toda Parte que produzca una o más de estas sustancias velará por que en el período de 12 mesescontados a partir del 1° de enero de 2004, y en cada período sucesivo de 12 meses, su nivelcalculado de producción de las sustancias controladas enumeradas en el Grupo I del anexo С nosupere, anualmente, el promedio de:

a) La suma de su nivel calculado de consumo en 1989 de las sustancias controladasenumeradas en el Grupo I del anexo С у el 2,8% de su nivel calculado de consumo en1989 de las sustancias controladas enumeradas en el Grupo I del anexo A;

b) La suma de su nivel calculado de producción en 1989 de las sustancias controladasenumeradas en el Grupo I del anexo С у el 2,8% de su nivel calculado de producción en1989 de las sustancias controladas enumeradas en el Grupo I del anexo A.

No obstante, a fin de satisfacer las necesidades básicas internas de las Partes que operan al amparodel párrafo 1 del artículo 5, su nivel calculado de producción podrá superar ese límite hasta en unacantidad igual al 15% de su nivel calculado de producción de las sustancias controladas enumeradasen el Grupo I del anexo С definidas supra.

D. Artículo 21

Después del artículo 2H del Protocolo se añadirá el siguiente artículo:

Artículo 21: Bromoclorometano

Cada Parte velará por que en el período de 12 meses contados a partir del 1° de enero de 2002, y en cada

período sucesivo de 12 meses, su nivel calculado de consumo y producción de las sustancias controladasenumeradas en el Grupo Ш del anexo С no sea superior a cero. Este párrafo se aplicará salvo en la medidaen que las Partes decidan permitir un nivel de producción o consumo necesario para satisfacer los usosesenciales según lo acordado por ellos.

E. Artículo 3

En el artículo 3 del Protocolo las palabras:

se sustituirán por:

F. Artículo 4, párrafos Iquin. y Isex.

Después del párrafo ícua. se añadirán al artículo 4 los párrafos siguientes:

Iquin. Al 1° de enero de 2004, cada Parte prohibirá la importación de sustancias controladas enumeradasen el Grupo I del anexo С de cualquier Estado que no es Parte en el presente Protocolo.

Isex. En el plazo de un año contado a partir de la fecha de entrada en vigor del presente párrafo, cadaParte prohibirá la importación de las sustancias controladas enumeradas en el Grupo Ш del anexo Сde cualquier Estado que no es Parte en el presente Protocolo.

G. Artículo 4, párrafos Iquin. y Isex.

Después del párrafo 2cua. del artículo 4 se añadirán los párrafos siguientes:

Iquin. Al 1° de enero de 2004, cada Parte prohibirá la exportación de sustancias controladas enumeradasen el Grupo I del anexo С a cualquier Estado que no es Parte en el presente Protocolo.

2sex. En el plazo de un año contado a partir de la fecha de entrada en vigor del presente párrafo, cadaParte prohibirá la exportación de las sustancias controladas enumeradas en el Grupo Ш del anexo Сa cualquier Estado que no es Parte en el presente Protocolo.

H. Artículo 4, párrafos 5 a 7

Artículo 2: Relación con la Enmienda de 1997

Ningún Estado u organización de integración económica regional podrá depositar un instrumento deratificación, aceptación o aprobación de esta Enmienda, o de adhesión a ella, a menos que haya depositadoprevia o simultáneamente un instrumento de ese tipo en relación con la Enmienda adoptada en la NovenaReunión de las Partes celebrada en Montreal, el 17 de septiembre de 1997.

Artículo 3: Entrada en vigor

1. La presente Enmienda entrará en vigor el 1° de enero de 2001, siempre que se hayan depositado almenos 20 instrumentos de ratificación, aceptación o aprobación de la Enmienda por Estados u organizacionesde integración económica regional que sean Partes en el Protocolo de Montreal relativo a las sustancias queagotan la capa de ozono. En el caso de que en esa fecha no se haya cumplido esta condición la Enmiendaentrará en vigor el nonagésimo día contado desde la fecha en que se la haya cumplido.

2. A los efectos del párrafo 1, los instrumentos depositados por una organización de integracióneconómica regional no se contarán como adicionales a los depositados por los Estados miembros de esaorganización.

3. Después de la entrada en vigor de la presente Enmienda, según lo dispuesto en el párrafo 1, laEnmienda entrará en vigor para cualquier otra Parte en el Protocolo el nonagésimo día contado desde lafecha en que haya depositado su instrumento de ratificación, aceptación o aprobación.
