Regulation related to the Principles and Implementation of Organic Agriculture

CHAPTER 1 General Provisions

SECTION ONE Purpose, Scope, Support and Definitions

Purpose Article 1 — The purpose of this regulation is to define the principles and procedures

related to the protection of ecologic balance, implementation of organic agricultural activities, arrangement, development and increase of organic agricultural production and marketing activities.

Scope Article 2 — This regulation includes the conformance of the production or

procurement of inputs to be used in production of any kind of vegetal, animal and aquatic products to the organic agricultural method, picking up the crops from forest and natural areas in accordance with the principles of organic agricultural principles the product, processing, packaging, storing, handling, marketing, inspection, certification, audit of such crops and the technical & administrative procedures related to criminal provisions.

Basis Article 3 — This regulation has been issued in basis of Organic Agricultural law dated

1/12/2004 with no 5262.Definitions Article 4 —In content of this regulation;Ministry: Ministry of Agriculture and Rural Affairs,Province directorate: Province directorate of Ministry of Agriculture and Rural Affairs,Committee: Organic Agricultural Committee,Law: Organic Agricultural Law,Organic Agricultural activities: The production or growing up the organic products or

Organic agricultural method: The method that defines all activities in the course of organic agricultural process,

Conventional agricultural method: All methods except organic agricultural method,Control and inspection institution: The real or corporate bodies who have been

appointed by the ministry to inspect and document all stages of organic crop or input from the production to the consumer,

Inspection institution: The real or corporate bodies who have been appointed by the ministry to inspect all stages of organic crop or input from the production to the consumer,

Certification institution: The real or corporate bodies who have been appointed to document the organic product or input of which all inspections had been completed by considering the control and information & documents issued in respect of such inspection and the analyses carried out when necessary,

Authorized institution: The real and corporate bodies appointed by the ministry as the inspection and certification institution, inspection body or certification body,

Inspection: It defines whether the organic agricultural activities had been carried out conforming to such regulation, the regular records had been kept and the results had been reported, the organic characteristic of the product had been tested in laboratory when deems necessary,

Inspector: The real person who had been appointed by the ministry to control each stage of organic agricultural activities in respect of relevant regulation for and on behalf of inspection and certification body or the inspection body,

Certifier: The real person who has been appointed by the ministry to approve that the controlled crop or the input is in organic characteristic on behalf of inspection and certification body,

Audit: Every kind of audits to be executed to define if the organic agricultural activities had been carried out conforming to this regulation by the authorized institutions, sites, facilities and enterprises, controller and certifiers and the institutions accredited by the ministry,

Facility: Under the supervision of accredited body, the places where the organic products are produced, processed, stored and marketed in respect of the contract to be executed by the mentioned sites,

Enterprise: The real or corporate body dealing with the organic agricultural activities,Organic vegetal production: the human food, animal food, vegetable feeding, obtaining

the increasing substance, organic raw material procurement for the industries where the raw materials are obtained from agriculture, the production activities inspected and certificated by the authorized body in scope of the requirements of this regulation by the purposes of medical and scientific issues,

Organic animal production: Animal production by using breeding animal or sperms, production of animal and vegetal feeding products with the human food from animal products, organic raw material procurement in scientific studies and the industries obtaining the raw material from agriculture, the production activity to be inspected by the authorized body and documented in accordance with the requirements of this regulation,

Organic aquatic products production: The inspected and certified production activities under the supervision of authorized body including the organic raw material procurement for the industries using the raw materials from agriculture, the human foods, stock additives derived from fish, aquatic plants, sponge, mollusk, shelled, mammiferous grown up by using the organic agricultural method in sea, internal waters, pools, net cages, dam, lake, small lakes, fishponds and farms,

Certification: The certification activities of facility, organic product and input in accordance with the provisions of the regulation as a result of implementation of all control methods,

Certificate: The document implying that the facility, organic product and organic input are conforming to the relevant regulation as a result of the inspection,

Working license: the permission to be given by the ministry to the controller, certifier and the appointed institutions to work under the requirements of this regulation,

Organic product: The certified product in form of raw material, semi product or product produced in accordance with the principles of organic agricultural activities,

Conventional product: The products produced by using the conventional agricultural methods,

Transition period: In accordance with the provisions of this regulation, it means the period from starting to the activities to the certification of the product as being organic characteristic,

Organic input: Material used in organic agricultural activity,Organic product label: Every kind of written and printed information and materials such

as picture, symbol, document, advertisement, board or identity card placed on the package, trade mark, registered brand including any word or detail stated on organic product or package,

Organic product logo style: The printed signs taking part on Annex 3 © of this regulation,

Biologic fight: The strategy of biologic fight to keep the harmful factors at a safe level by using the insects, disease, wild plants and other alive organisms,

Biotechnical methods: The fight that is carried out by using the trap and trap systems, pheromones, attracting and removing systems, the systems preventing to invent and to feed,

Organisms with modified genetic structure (OMGS): It means any alive organism that has been created with a new gene material combination taken from microorganisms and various species by using bio technologic methods that are not constituted by mating and/or natural hybridization i.e. gene dealings among the species,

OMGS products: It means the products contenting OMGS, or consisting of OMGS or derived from OMGS.

General Production due to Organic Agricultural Activities General rules of organic agriculture Article 5 — The general rules of organic agriculture are given as follows; a) The organic agricultural method can be applied in any land of the country provided

to apply the rules as defined in this regulation. The inspection and certification body or control agency shall take the decision if the organic agriculture can be done in the lands having the risk of environmental pollution.

b) Organic agriculture shall be based on the contract to be signed between the enterprise and appointed institution. This contract shall define the written agreement implying that the agricultural activity shall be done in accordance with the provisions of this regulation.

c) Organic agriculture is done under the supervision of appointed institution.d) The buildings, equipment and tools used in conventional production are used in

organic production after cleaned properly with the substances as defined in Annex-8 of this regulation.Starting organic agriculture

Article 6 — The rules for starting organic agriculture are mentioned below. a) The enterpriser who wants to get involved with organic agriculture applies to audit

and certification institution or an audit institution. Following the completion of the below information and documentation, an agreement is made. These information and documentation are;

1) Name, address, identity details and documents including T.R. identity card number and tax number,

2) Place and location of the business,3) Land registry for areas where surveying is completed, or cadastral sketch of the

area where the survey is not completed yet,4) Information and documents in regard to the ownership of the area and the right of

use of the area of application,5) If it is a business of food processing, then "Work Permit and Food Registry

Document," also "Production Permit Document." The enterprisers who have signed such an agreement before the publication of this

Regulations have to submit the above mentioned documents and information latest in six months.

b) The audit and certification institution or audit institution decides if the enterpriser is to start production with the method of organic agriculture.

c) The enterpriser who is designated to be suitable for starting organic agriculture signs an agreement with the audit and certification institution or the audit institution. The enterpriser is able to realize the organic agriculture works individually, or with a production group. In this case, the enterpriser signs an agreement with the audit and certification institution or the audit institution on behalf of the production group. The enterpriser also makes contracts with the real and legal persons for services such as commissioner tradesman, warehousing, processing and similar contracted business.

d) The enterpriser who has signed an agreement with authorized institutions and that will harvest products from forests and natural environments will receive a written permit prior to the harvest of these products showing that he has the ownership of these areas and their rights of use. The transition period for the gathered products in such areas will be determined by the authorized institution according to the features of the area.

e) The enterpriser that will manufacture water products will sign an agreement via application to the authorized institution along with a written permit from the relevant institution. The authorized institution will determine the transition period of the water products according to the characteristics of the species.

f) The authorized institution may sign separate agreements for each stage of production by mentioning each activity individually. The authorized institution will provide a code number to the enterpriser either independent or related to a production group, according to a coding system to be provided to the authorized institutions.

Work related with transition period Article 7 — The authorized institution involves the enterpriser that has an agreement and who realizes organic crop production, or production of animals or water products into the transition period. In plantations, the products gathered after twelve months from the start of organic agriculture are attributed to be the product of this transition period. The products of

this transition period are distributed in the market bearing a label that writes, "Product of transition period to organic agriculture."

SECTION TWOCrop Production with the Organic Agriculture Method

Rules for organic crop productionArticle 8 — The rules for organic crop production are given below. a) Organic crop production is carried out in control of the authorized institution through

an agreement. b) The enterpriser who will be involved in organic crop production will be taken into the

transition period. This transition period is two years for crops of one year or meadows and feed grains, and three years for crops of multi years. Date of plantation is taken into account for one-year crops, and the date of harvest is considered for crops of multi years.

c) The audit and certification institution or the audit institution may extend or shorten this transition period based on the previous status of the area in the past years, the carried out applications, the general circumstances in the region and planted crops, risk conditions, examination of the enterprise records related with the subject and reports.

d) The authorized institution may decide that due to the following criteria, the period that incurs the past activities could be accepted as a part of this transition period.

1) In case the input excluding the input stated in Annex-1 parts (A) and (B) were not used for at least the past three years, this period is considered to be a part of the transition period.

2) If there is an official document demonstrating that the production parcels are within the areas related with obligatory environment protection and preservation of rural areas, this period is considered to be a part of the transition period.

e) In case the input that are not included in the Annex-1 parts (A) and (B) and also a part of the organic agriculture or transition period are used in prevention and control of disease and pestilent, the new transition period to be determined may be shortened by the committee through the proposition of the audit and certification or audit.

f) In a business enterprise, the products manufactured with organic agriculture methods and the conventional products, which are the same or cannot be distinguished easily from this product may not be planted together. However, in the production of crops with multi years,

1) If the enterprise commits that the business will convert to organic production through a plan latest in five years,

2) If necessary preventive measures are taken for keeping the harvested products in separate places,

3) If the authorized institution is informed 48 hours before the harvest of each crop, 4) If after the completion of the harvest, the enterpriser informs the authorized

institution about the exact amount of the harvested products and their distinctive qualities, and confirms that the necessary preventive measures are taken for keeping these products away from the others,

then the authorized institution permits that both organic and conventional plantation of the same product can be made in the enterprise.

In areas where agricultural Research is to be made or seeds, vegetative production materials and transplantation materials are to be grown, then the conditions in (f) paragraph and (2), (3) and (4) numbered subparagraphs will be looked for.

Preservation of soil, preparation and fertilizationArticle 9 — The rules for the preservation, preparation and fertilization of soil in

organic crop production are stated below. a) In controls by the authorized institution, a decision is made as to apply any

preventive measures for soil preservation. b) The soil cannot be processed in such a way to cause unnecessary erosion of the soil

in organic crop production.c) The fertility and biological activity of the soil is maintained by the below methods. 1) Within a multi year plantation rotation program, leguminous seeds and deep-rooted

crops should be grown or green fertilization should be made. 2) For one crop, fertilizer from organic animal production should be used in an amount

of 170-kg pure nitrogen per hectare in one year. 3) It is required that the organic materials in combination or not from the areas of crop

production as to the provisions of this Regulation should be used.

d) In areas of organic crop production, if the soil fertility and biological activity is not adequately sustained despite the preventive measures in paragraph (c), the fertilizer and soil improvers in the Annex-1 part (A) of this Regulation may be used.e) For compost activation, suitable mixture of plant source with no genetic intervention or microorganism compositions could be used.

f) In order to enhance the soil conditions and the beneficial qualities of the nutrients in soil or the crop, the microorganism preparations permitted in our country for agricultural production may be used upon receiving the approval of the authorized institution.

g) On the date of the publication of this Regulation, if the fertilizer or soil improver products that are not included in the Annex-1 part (A) do not have infectious or unacceptable implications on the environment during their use for the special nutrient requirements or special soil treatments, then they may be permitted for use by the approval of the committee.

h) Permit is received from the Ministry for the production, importation and exportation of organic fertilizers and soil improvers. Following the receipt of this permit, conformity documentation or certificate is published by the authorized institution for the organic fertilizer and soil improver to be used in organic agriculture.

Plantation and sewingArticle 10 — The plantation and sewing rules for organic crop production are stated

below.a) The qualities of the organic crop reproduction materials should be as follows. 1) The genetic structure of the seed should not be changed, no intervention should

have been made in the DNA sequence of the fertilized cell nucleus, and it should possess a biological feature where no synthetic pesticides, radiation or microwave is used and it should have been planted as to the provisions of this Regulation.

2) The seedling should have been made from organic seed or main plant and as to the provisions of this Regulation, no synthetic nutrients and growth materials or hormones should have been used and it should conform to the soil and climate conditions.

3) Sapling and fruitbearing should have been made from organic materials and as to the provisions of this Regulation, no synthetic nutrients and growth materials or hormones should have been used and it should conform to the soil and climate conditions.

b) The reproduction materials such as seed, seedling, sapling, fruitbearing, misel, shoot and nub should be manufactured through organic agriculture methods. If the reproduction materials other than the seedling are not made through organic methods, then the reproduction materials that have not been subject to any synthetic chemicals or processes other than the ones mentioned in Annex-1 parts (A) and (B) may be used.

c) GDO reproduction materials are not used in organic crop production. Plant protection Article 11 — Plant preservation rules in organic production are mentioned below. a) Following conditions are met for struggling with disease, pestilent and foreign weed. 1) Species and varieties resistant to disease and pestilent should be selected. 2) Proper plantation guard should be prepared. 3) Suitable soil processing methods must be applied.4) Cultural, biological and biotechnical struggling methods must be applied.b) If the above mentioned conditions are not applied or are inadequate against plant

diseases, pestilent or foreign weeds, then the inputs mentioned in the Annex-1 part (B) of this Regulations are used.

c) If the products that are not mentioned in the Annex-1 part (B) of this Regulations will be used in struggling with pestilent, disease, foreign weeds or cleaning and disinfection of animal shelters and buildings, on the condition that they meet the following provisions, these may be added to the Annex-1 part (B) by the approval of the committee.

1) If there are no alternative cultural or biological struggling or cultivation methods for fighting pestilent, disease or foreign weeds,

2) If the plant protection products do not directly contact seeds, plants, crop products or animals and animal products and if they do not remain on the multi year crops as of the period of application,

3) If the use of these products have no negative implications in the environment, The provisions in this paragraph are not applicable to products that were mutually used

before the publication date of these Regulations. d) In the licensing of the pesticides and similar materials permitted for use in organic

agriculture, the Agricultural Struggling and Agricultural Quarantine Law dated 15/5/1957 and numbered 6968 will be applicable as well as the related provisions of the legislation.

e) After the receipt of the permit from the Ministry for the production and importation of the inputs to be used in struggling disease, pestilent and foreign weeds in organic agriculture, the authorized institution provides a documentation or certificate of conformity for using these in organic agriculture.

Irrigation Article 12 — The rules for irrigation in organic crop production are stated below. a) The wastewater from industry or city wastes or from drainage systems cannot be

used in organic agriculture, and if required the conformity of the water will be established through controls by the authorized institution.

b) Irrigation water should not cause environmental pollution. c) Irrigation should not cause destruction or erosion of the soil. HarvestArticle 13 — Rules for harvest in organic crop production are stated below.a) The technical equipment used in the harvesting of organic products should not

cause ecological destruction or pollution. b) The materials for hand harvesting should be in a status that does not harm the

organic qualities of the product. The materials for harvest should be hygienic. c) In the harvesting of the consumable vegetation and parts in the forests, natural

surroundings and areas of agriculture, the following conditions should be met. 1) The area of harvest should not have been processed with products other than the

ones mentioned in the Annex-1 of these Regulations since past 3 years. 2) No fires should have taken place in the area of harvest for the last two years. 3) Stubble should not have been burnt in the area of harvest. 4) Balance of natural surroundings and species should be preserved in the area of

harvest. Organic fungus production

Article 14 — In organic fungus production the farm fertilizers, plantation sourced products received from areas of organic agricultural production like hay, chemically unprocessed torf, chemically unprocessed wood, natural soil, water having qualities for irrigation as mentioned in Annex-1 part (A) of this Regulations will be used. If the farm fertilizers mentioned in the first four sentences of the Annex-1 part (A) of this Regulations are not existing, then the farm fertilizers conforming to these requirements in 25% will be used.

SECTION THREEAnimal Production with Organic Agriculture Method

Rules for organic animal production Article 15 — The rules for organic animal production are as follows.a) In organic animal husbandry, local conditions are considered in the selection of

species and races and attention is given to the selection of the species and races that are resistant to diseases. For the issues which are not explained here, the provisions of the 4631 numbered and 28/2/2001 dated Code of Animal Breeding.

b) Animals which are taken from organic enterprises that have been fed with completely organic feed and had no genetically restructuring, also which are resistant to the environment, climactic conditions and diseases are used to be stallions.

c) Natural seeding is important in organic animal breeding. There is no embryo transfer. Artificial fertilization is carried out with the sperms received, preserved and used from stallions with totally natural methods.

d) The animals that will be used in organic animal husbandry should be able to access feeding grounds or open air platforms and areas, and the number of animals per unit of area should be limited to the capacity to provide animal manure for crop production in the area. The stock capacity of the organic fertilizer or the dispersed amount of nitrogen should not exceed 170 Kg/N/Ha/Year for one product in the cultivation area. If this amount is exceeded, in this case the enterpriser should obtain another area in the same region or provide for this opportunity in neighbouring enterprises with the approval of the authorized institution. The authorized institution has the right of decreasing the stock capacity in order to protect the environment.

e) The entire animals in the same production unit should be bred according to the provisions of these Regulations in organic animal husbandry. However, the animals which

are not bred as to the provisions of the Regulations may stay in the same enterprise only if they are the same species and the buildings and areas where they are bred are distinctively separate from the units where animals are bred according to the provisions in this Regulations.

f) The same species of animals which are not bred according to the provisions of this Regulations should not be in the same feeding grounds with the animals that are bred as to the provisions in this Regulations.

g) The animals bred as to the provisions of this Regulations may be fed on the same grounds on different times with the conventionally bred animals if the following conditions are met.

1) Grounds should have completed the transition period. 2) The animals not bred according to the provisions of this Regulations should be

received from extensive production. 3) The products obtained from the animals bred according to the provisions of this

Regulations will not be regarded to be organic unless there is an approval from an audit or certification institution or audit institution confirming that they were not fed on the same grounds with the animals which are not bred according to the provisions of this Regulations and use mutual grounds.

h) The area where organic feed crops will be produced shall be received in transition period in accord with the following provisions;

1) The areas and grounds where organic animal breeding and animal production will be made shall be taken into 2 years of transition period.

2) The transition period for the grounds which are used by animals that are not herbivores, open shelters and wandering grounds will be decreased to one year. If the subject areas have not been processed with no other products than the ones mentioned in the annex of this Regulations, the transition period is decreased to 6 months by the authorized institutions.

ı ) Transition period for animals and animal products; 1) In meat production, this should be 12 months for cattle and 6 months for

livestock and pigs. However, in cattle breeding for organic milk, this period is the 3/4 of the life span for animals that will be spared from the herd for meat production.

2) It should be 6 months for animals bred for milk production. 3) 10 weeks for poultry not older than three days of age in meat production and 6

weeks for egg production. j) In the selection of species and races for stallions, the adaptation of animals to

local conditions, and their resistance to diseases should be taken into consideration. In addition, only the ones that do not have the distinctive diseases or health problems that occur in stallions of mass production will be used as stallions. The priority is given to local species and races.

k) When a herd is being established for the first time, if the number of animals that are organically bred is not adequate, then conventionally bred animals may be used in the animal husbandry if conforming to the below conditions;

1) Chicks cannot be older than 18 months for egg production.2) Chicks for meat production cannot be older than three days of age at the time of

their separation from the original farm. 3) Calves and colts should be bred as to the provisions of this Regulations as soon

as they are cut off from milk and under all circumstances they should be younger than 6 months.

4) Lambs and goats should be bred as to the provisions of this Regulations as soon as they are cut off from milk and they should not be older than 60 days.

5) Pig young should be bred as to the provisions of this Regulations as soon as they are cut off from milk and they should be less than 35 kilograms.

6) In respect with the approval of the authorized institution, the animals that do not conform to the rules of the provisions of this Regulations in the animal production unit, may be transferred to organic production.

l) While the new herd is being established in enterprises for organic cattle breeding, the animals may be obtained from first the enterprises of organic animal husbandry, if not existing then well-fed cattle that meet the conditions in the provisions of this Regulations may be obtained from enterprises of conventional animal husbandry.

m) If the herd is multiplied and/or there are no organically bred animals to renew the herd, the every year 10% of the adult female cattle, 20% of the female pigs and livestock may be obtained from production locations that are not organically breeding with the approval of the authorized institution.

These percentages may be increased up to 40% with the approval of the authorized institution if the following conditions are met;

1) In a written commitment by the enterprise, the extending of the herd is put under guarantee,

2) Race is changed,3) A new animal production is developed,4) The animal races in the farm is under the threat of extinction, n) The percentages stated in paragraph (m) are not applicable in animal production

of less than 10 cattle, less than 5 livestock and pig. In such units, the renewal procedure mentioned above is limited with maximum 1 animal.

o) Stallion males may be brought from not organic enterprises on the condition they are afterwards bred and fed according to the provisions of this Regulations.

p) If animals are provided from farms where organic animal production is not made, then conditions for the health of animals are to be considered. Control tests are made in relation with private conditions and the quarantine period.

r) Establishments that get involved in organic animal breeding and animal production will keep related and regular records about the entry and exit of all animals and entire treatments.

Animal feed supply and animal feeding in organic animal production Article 16 — The rules for animal feed supply and animal feeding are stated below

for organic animal production.a) Other than animals for their furs and pets, animals should be fed with rough and

consistent feed which is organically manufactured in organic animal husbandry. b) Through this feeding, the nutritional needs of animals in different stages of

development are met and the basic intention should be qualified production rather than increasing production. Feeding animals on force is forbidden.

c) Animals are mainly fed with organic feed maintained from the enterprises where they were bred, if this is not possible, then they are fed with animal feed supplied from other enterprises that act in accordance with the provisions of this Regulations or others mentioned in the Annex-7 of this Regulations.

d) In average, 30% of the dry material in the ration formulations may include materials in the transition period. If the animal feed in the transition period is obtained from the enterprise where the animals are bred, then this rate may increase up to 60%.

e) The feeding of the young should initially be realized through mother's milk. If this is not possible, then they should be fed with the milk received from the same herd. The minimum period of time for milk feeding the young is 90 days in cattle and colt, 60 days in livestock and 40 days in pigs.

f) The system of breeding should provide opportunities for the animals to access feeding grounds in various times of the year. The total of dry material in the daily rough animal feed should at least be 60% including silage, fresh and dry weed in the ration. In addition to this, the authorized institution may permit the reduction of this ratio to 50% for a maximum of 3 months at the commencement of the lactation in animals for milk production.

g) If the farmer is not able to provide the animal feed only from organic production, then conventional materials may be used in limited amounts. The amount of conventional animal feed for every year is 10% in ruminating animals and 20% in others. These percentages are calculated yearly based on the dry content of the animal feed with agricultural origins. Excluding the transfer periods, the conventional feed percentage is approximately 25% based on dry materials in the daily ration. These are applied with the approval of the authorized institution.

h) If animal feed production is decreased due to natural disasters, then for a short period of time, conventional animal feed may be used in feeding animals in the amount specified by the Committee.

ı) Rough feed, fresh or dry weed or silage should be added to pig and poultry rations.

j) Only the products mentioned in Annex-7 of this Regulations may be used as additives and process materials in the silage production.

k) Conventional animal feed materials which are mentioned in the Annex-7 of this Regulations that have agricultural basis where no chemical solvents are used in production and preparation may be used in animal feeding.

l) Animal feeds with animal origins may only be used if existing in the Annex-7 part (B) of this Regulations.

m) The mineral sourced feeding materials that are stated in the Annex-7 part (C) of this Regulations and the trace materials, vitamins, provitamins and chemically identifiable materials with similar effects stated in the Annex-7 part (D) of this Regulations may be used.

n) Enzymes, protective materials, microorganisms, binders, preventive materials against lumps, antioxidants, silage additives, products used in animal feed and supportive materials in feed processing may be used if they exist in the Annex-7 part (D) of this Regulations.

o) Antibiotics, koksidiostatics, yotics, medical materials and other materials that enhance growth or production cannot be used in animal feeding.

p) The animal feeding materials, additives to the feed, supportive materials for feed processing and products used in animal feeding should not have been manufactured from genetically engineered organisms or products from such sources.

r) Conditions sough for in animal feed of organic production or processing: 1) Conventional animal feed and organic animal feed can not be processed in the

same factory at the same time. 2) None of the materials used in the combination of the products or in their

production should not have been processed with ionizing radiation applications. 3) Organic animal feed should definitely be labeled. It should be written on the label

that; The organic material amount in the animal feed should be written based on dry

material. Percentage of the animal feed material obtained through organic production

method should be mentioned. Percentage of the animal feed material obtained from transition period products

should be stated. The total percentage of the agricultural material content of the animal feed should

be written on the label. The name of the authorized institution should be mentioned. 4) The organically manufactured animal feed and conventionally manufactured

animal feed should be kept and stored in separate places. 5) All kinds of equipment used in the preparation of organic animal feed should

definitely be separated in total from all kinds of equipment used in conventional feed manufacturing.

6) Organic animal feed may be prepared in conventional animal feed manufacturing units if the following conditions are met.

In the animal feed preparation unit, conventional and organic animal feeds may not be manufactured at the same time.

Before starting the preparation of the animal feed, the animal feed preparation unit should be cleaned with the materials mentioned in the Annex-8 of this Regulations.

s) Animal feed manufactured organically or products obtained from these may be transported together on the condition that they will not be mixed or contaminated with conventional animal feed. The vehicles used for animal feed transportation will be cleaned with the materials stated in the Annex-8 of this Regulations. It is required that the product amount during the time of transportation and the product amount at delivery should be recorded.

t) According to 29/5/1973 dated and 1734 numbered Animal Feed Law and other related legislation, the animal feed that will be produced organically in animal feed factories will first be confirmed through a certificate by the authorized institution for conformity to organic qualities and then the ration formulations are registered by the Ministry. Only after this step the organic animal feed production may get started in the feed factories under the control of the authorized institution.

Article 17 — The rules for animal health and veterinary intervention in organic animal husbandry are given below.

a) Preventive measures against diseases in organic animal husbandry;1) Selection of appropriate stallion races,2) Providing access to wandering areas and feeding grounds for regular exercises to

enhance natural immunity and use of qualified animal feed,3) Provide reasonable location frequencies to prevent health problems due to

excessive gathering. b) If the animal is sick or injured despite all preventive measures, then if required it

will be sheltered separately and receive treatment immediately. c) The procedure and principles for the use of medicine provided by the veterinary

in organic animal husbandry;1) Instead of the chemically synthesized veterinary medical products, if it has a

curing effect on the animal species or is suitable to treatment conditions, then natural medications such as plant extracts and plant abstracts, probiotics, organic acids, materials of plant, animal or mineral origin, trace elements and products may be used as homoeopath treatment methods.

2) If the use of the above materials do not suffice for combat against the disease or the injury, chemical content medications or antibiotics may be used in controlled amounts with the approval of the authorized institution to prevent pain in the animal.

3) Chemically synthesized veterinary medial preparations or antibiotics cannot be used to prevent diseases.

d) Genetic structure of the animals may not be changed in organic animal husbandry, and genetically engineered organisms may not be used as input in organic animal production. Animal breeding with methods of gene technology is prohibited. The use of materials to enhance growth or reproduction, and the utilization of hormones or other materials to control reproduction or other purposes are prohibited. Yet, hormones may be supplied to the animal for treatment by the veterinary.

e) The diagnosis at the time of the use of veterinary medication, the method of intervention, dosage of the medication, period of treatment and official termination time for the medication should be recorded with the used item.

f) The period between the last application date of veterinary medicine to an animal under normal conditions, and the date of supply of organic product from these animals, that is the official purification period of the medication should be two times of the application in conventional animal breeding or 48 hours if the official purification period is not stated.

g) Other than the vaccination, parasite treatments or other obligatory combat programs for fighting animal diseases and pestilent in our country, if an animal or a group of animals are subjected to chemically synthesized veterinary medical preparations or antibiotics two times a year, then the products from these animals may not be sold as organic products and they are put in transition period with the approval of the authorized institution.

h) Other than national obligatory combat programs, if a definitely infectious and epidemic disease outbreaks in the location of the enterprise, the provisions of the 8/5/1986 dated and 3285 numbered Animal Health and Constabulary will be applied as well as other related legislation while the veterinary may get use of biological materials.

Breeding applications, sheltering and caring conditions Article 18 — Breeding applications, sheltering and caring conditions in organic

animal production are specified below:a) Applications such as attaching elastic tape with the aim of tail cutting in sheep,

tail cutting, teeth cutting, beak trimming and horn dulling cannot be systematically applied in organic animal production. Methods like excoriation cannot be applied. However, some of these applications can be permitted by an authorized body to safety, animal health, comfort and hygiene as in the case of horn dulling in young cattle. Such applications and physical castration applications aimed at increasing the product quality must be carried out by specialist persons without causing any pain to animals when animals are at the suitable age.

b) It is forbidden to keep livestock tied. However, tying can be permitted by an authorized body to maintain animal safety, health and comfort for a limited time on the condition that the entrepreneur is able to evidence the necessity of tying.

c) For livestock groups with 10 animals or less if it is not possible to maintain them within the group in accordance with the behavioral needs, tying can be permitted with the approval of an authorized body on the condition that the access to pasturing areas and open shelter areas or exercise areas is provided minimum twice in a week.

d) In case livestock are bred in groups, the size of the group which is dependent on the growing phases of the animal species and patterns of behavior shall be determined under the light of the opinion of an expert by an authorized body. It is forbidden to maintain conditions that may reinforce anemia in animals or to use dietaries.

e) Animal shelters must be built with a sanitary construction material and the conditions of shelters must satisfy animals’ biological and stock needs. Animals must be able to easily access to feedstuff and water. Isolation, heating and ventilation of buildings must be maintained in a way that flow of air, dust level, relative humidity and gas concentration shall be kept within the limits that may not give any harm to animals. Shelters must ensure ample natural ventilation and entrance of light.

f) Free walking sites, open air walking areas or open shelters must provide adequate protection against rain, wind, sun and excessive heat depending on the local weather conditions and the relevant species.

g) Shelters must be in adequate sizes for providing sufficient space in that animals can freely and naturally stand, easily lie down, clean themselves, stand in all natural positions, and perform all natural movements such as stretching and clapping wings.

h) Minimum areas of roofed shelters and open walking areas and shelter features for various animal species and categories must comply with the criteria specified in the Appendix 6 of this Regulation.

i) Construction of animal shelters is not required for the regions where climate conditions allow animals to live in open air.

j) Feces, urine and poured or scattered foods must be removed from the environment with the aim of decreasing odor in the facilities and responding to insects and rodents. Only in case insects and rodents are not removed from animal shelters and other plants in spite of the above specified measures, the inputs given n the Section B.6 of the Appendix 1 (B) of this Regulation can be utilized.

k) All mammals must be able to access to pasture sites or open air exercise areas or open shelter area and animals must use these areas as long as psychological air conditions and the situation of the area allow. Herbivores must be able to access pastures as long as conditions are convenient.

l) The requirement for providing open walking areas and open areas to animals during winters can be neglected on the condition that herbivores can access pastures during grazing periods and winter shelters can provide ease of mobility to livestock. However, bulls older than one year must access to pasture sites, open walking sites, and open areas. During the final phase of fattening, cattle, pigs and sheep or goats can remain at roofed sites for a period to be determined by an authorized body on the condition that this period shall not exceed 1/5 of their lifetimes.

m) The ground of the animal shelters must be smooth but not slippery. Minimum half of the total ground area must be hard and smooth.

n) Bedding must be composed of stalk and straw or other appropriate natural material. The material used as bedding can be improved and enriched by any mineral matter that is permitted to use as fertilizer in organic agriculture.

o) Calves must be kept at individual separators after 1 week. p) Poultries must be raised at open production conditions and they must not be kept

at cages. Water poultries must be able to access streams, ponds and lakes due to animal comfort and hygiene as long as climate conditions are convenient.

r) The minimum requirements specified below must be satisfied at poultry houses:1) Minimum 1/3 of the ground must be of smooth structure not in parts or grated

structure and its surface shall be covered with materials such as stalk and straw, sawdust, sand or short grass.

2) More than half of the ground must be convenient for collecting feces at egg hen poultry houses.

3) Perch must be available in correlation with the poultry group and sizes. Standards regarding this issue must be in compliance with the section (B) of the Appendix 6 of the Regulation.

4) Entrance/Exit holes must be available in accordance with poultry size and these holes must be totally minimum 4 m length for 100 m2 of poultry house.

5) The number poultry to be kept at each poultry house must not be higher than the ones specified below:

4800 fattened chickens,3000 egg hens,5200 African chickens,4000 female Muskovis or Pekin ducks,3200 male Muskovis or Pekin ducks or other ducks,2500 fattened roosters, geese or turkeys,6) Total usable area of each poultry house established with the aim of fattening

must not exceed 1600 m2.s) The total duration of natural and artificial illumination for egg hens cannot exceed

16 hours per day. A resting period with minimum eight hours is applied without artificial illumination.

t) Poultry animals must be accessible to open air housing during convenient climate conditions and this case must be possibly applied for a period with minimum 1/3 of their lifetime. This open air housings must be mainly coated with plant cover; protective facilities must be available and poultry animals must be able to access to water puddles and feedboxes with enough quantities.

u) Poultry houses must be remained empty between two fattening periods due to health reasons and during this period buildings and installations must be cleaned and disinfected. Furthermore, when any group of poultry fattening is completed, walking sites must be remained empty so that plant cover is allowed to grow again. Authorized bodies define and determine the periods when housings must be empty. These requirements cannot be applied to poultries in small numbers that are not kept within housings and freely walk around during the day.

v) Minimum slaughter ages for poultry are specified below:Chickens 81 days,Fattening roosters 150 days,Pekin duck 49 days,Female muskovi duck70 days,Male muskovi duck 84 days,Wild duck 92 days,African chicken 94 days,Turkey and goose 140 days.Transport and slaughterArticle 19 — Principles and rules for transport and slaughter of organic animals are

specified below: a) Rules to be followed in the transport activities of animals:1) Transport of animals is carried out in a short time without inflicting any stress to

animals.2) Loading and unloading processes must be carried out carefully and any tools for

forcing animals must not be used. No sedative drug can be used during and at the moment of transport.

3) During land transport, a break with the interval of 8 hours for feeding, watering and resting is given.

4) The Law of Animal Health and Police with the issue no 3285 and other relevant regulations are applied during inland and abroad animal transports.

b) Slaughtering animals must be treated in a way that no stress can be inflicted upon them during slaughtering. If available, separate slaughter houses and combines are used. If not available, after slaughtering of animals conventionally bred, slaughter houses and combines are cleaned with the cleaning materials specified in the Appendix 8 of this Regulation and then slaughtering of organic animals is performed.

Animal FertilizerArticle 20 — The rules for using, providing and protecting organic animal fertilizer

are specified below:

a) The total amount of fertilizer to be applied for the areas where organic vegetable production is to be carried out cannot exceed the rate of 170 kg pure nitrogen for each hectare for one product per year. Maximum number of animals in accordance with this amount is specified in the table given in the Appendix 5 of this Regulation.

b) Entrepreneurs that are involved in organic production can be in cooperation with other entrepreneurs involved in production in accordance with the provisions of this Regulation with the aim of distributing the surplus fertilizer of their production. The agricultural site utilized with such a cooperation the part of maximum 170 kg pure per year for each hectare nitrogen obtained from the fertilizer must be calculated.

c) Warehouses for animal fertilizer must bear the feature that any pollution of soil or water due to direct flow or leak is prevented.

d) The place and description of the plant constructed for storing animal fertilizer, plan regarding the spreading of animal fertilizer, and written correspondences with other entities regarding the spreading of animal fertilizer must be included in the contract that is to signed between the entrepreneur and the authorized body.

Organic bee breeding Article 21 — Rules for organic bee breeding are specified below:a) The site where organic bee breeding is to be carried out must have a flight radius

of 3 km beginning from beehives. Organic and conventional bee breeding cannot be carried out simultaneously at this site.

b) Apiculture products can be marketed on the condition that the provisions of this Regulation shall be implemented for a period of maximum one year.

c) While selecting the stock of bees, the capacity of bees in adopting local conditions, their endurance and resistance to diseases must be taken into consideration. Stocks of Apis mellifera species and local ecotypes must be preferred.

d) Capacity increase, separation of colonies can be applied; swarm of bees or beehives can be received from other entrepreneurs.

e) On the condition that permission is issued by the authorized body in advance, conventional bee colonies of the entrepreneur can be used with the aim of transition to organic bee breeding.

f) Swarm of bees supplied from bee breeders that do not produce in accordance with the provisions of this Regulation can be used within the period of 1 (one) year transition.

g) In case of loss of bees in great numbers due to reasons of health and disaster and of lacking convenient beehives in accordance with the provisions of this Regulation, restructuring of beehives can be permitted by the authorized body on the condition that they should be subjected to the transition period.

h) Queen bee and drones can be transferred to the units of organic production With the aim of renewing beehives with the aim of renewing colonies on the condition that with such bees in the rate of 10% for per year shall be placed to the beehives that are not in compliance with the provisions of this Regulation. In this case transition period cannot be applied.

i) The placement of beehives must be done in accordance with the following issues:1) Natural nectar, honey nectar and pollen source in adequate amounts must be

available for bees and the facility of accessing to water must be available.2) Nectar and pollen sources within the production site with a radius of 3 km must

be composed of products organically produced or natural plant cover.j) At the end of the production season, honey and pollen must be left in the

beehives with sufficient amounts for bees during winter. k) Organic honey is used in breeding of bee colonies during spring period. In

circumstances where climate conditions accelerated the crystallization of honey, the use of sugar syrup or organic sugar molasses produced by organic methods rather than the use of honey produced by organic method can be permitted in breeding by an authorized body. Type of the product, application date, application amount and the beehives where the relevant application is used are entered into records regarding breeding. Breeding process is carried out within the period of 15 (fifteen) days prior to nectar and honey nectar period following the last gathering of honey.

l) Preventing diseases in bee breeding the following must be observed:1) Durable, strong and appropriate stocks must be selected.

2) Practices that increase the resistance to diseases and are preventive to infection such as regular renewing of queen bees, systematic control of beehives to monitor anomaly, controlling of young drones in the beehives, regular disinfecting of materials and equipments, destroying polluted materials and sources, regular renewing of honey nectar, leaving enough pollen and nectars in the beehives must be performed.

m) If colonies are infected or damaged by any disease in spite of preventive measures, necessary treatment activities must be implemented at once and if necessary, colonies must be isolated at separate beehives. Veterinary medicines to be used in bee breeding in accordance with this Regulation must be suitable for the following principles:

1) Medicines must be in compliance with Turkish Medicine Codex.2) Fitotherapic and homeopathic treatment methods must be used rather than

medicines with chemical compounds on the condition that their treatment effects are appropriate to the required treatment.

3) If the use of such products specified above is not effective in exterminating diseases or invaders, medicines with chemical compounds can be used within the responsibility of the authorized body. However, the use of medicines with chemical compounds with protective aims is forbidden.

4) Formic acid, lactic acid, acetic acid, oxalic acid and menthol, thymol, eucalyptol or camphor can be used to eliminate Varroa pestilent to bees.

n) If the treatment is carried our by medicines with chemical compounds, colonies under treatment are transferred to an isolated area; honey nectars are removed after treatment and organic honey nectar or empty frames are placed. The transition period with one year is applied to these colonies.

o) When veterinary medicines are applied, type of the product, diagnostics, dose, application type, duration of treatment, half-life of the medicine as well as active phramcological matter must be clearly recorded and the necessary information must be submitted to the authorized body before the products are marketed.

p) Caring, administration practices and records in organic bee breeding are as follows:

1) Destruction of bees within honeycombs during collecting bee breeding products is prohibited.

2) Applications such as cutting the wings of the queen bee are prohibited. While replacing the queen bees, the killing of the ex-queen bee is permitted. Only young drones infected with Varroa are permitted to be destroyed.

3) The use of chemical synthetic fly expellers is prohibited. 4) The areas where beehives are located must be recorder together with beehive

information. Moving of beehives from these places to other ones can be performed within the knowledge of the authorized body.

5) During the activities regarding the production, collecting, processing and storing of bee breeding products, any protective measures and treatments applied to colonies must be registered.

r) Specifications of materials and beehives to be used in bee breeding:1) Beehives must be made of natural materials that do not cause any risk to

environment and bee breeding products. 2) Beehives cannot be painted with chemical paints.3) Hone nectar for a new frame must be supplied from the units that are involved in

organic production. In case where honey nectar organically produced is not available at the market during the initial commence of the bee breeding or the transition period, the use of honey nectar which is not organically produced is permitted by the authorized body upon the results of analysis.

4) Honey from the frames which bear holes cannot be extracted.5) Only the use of products specified in the Appendix 8 of this Regulation is

permitted with the aim of protecting frame, beehive, and honeycomb against pestilent. Physical applications such as vapor and direct flame are also permitted.

6) Only the materials specified in the Appendix 8 of this Regulation can be used in cleaning and transporting of materials, buildings, equipments and vessels or products utilized in bee breeding. During transporting bees, inflicting any stress upon bees must be avoided.

7) Organic bee production cannot be carried out at the areas where quarantine measures are applied and pesticide applied by plane.

8) The provisions of Chapter Four, Section Two of this Regulation are applied in transporting, storing and marketing of beehives, and producing, processing, transporting, packaging, labeling, storing, and marketing organic of bee products.

General Rules regarding Organic Aquatic ProductsArticle 22 — General rules for the production of organic aquatic products are

specified below: a) Characteristics of the water where aquatic production is to be carried are

analyzed by the entrepreneur or an authorized body and the compliance is certified by the authorized body. If there is water pollution, organic aquatic production cannot be carried out unless the pollution problem is solved.

b) The unit of production must be located at any place of settlement where there is a significant source of pollution or stream bed. The ecological balance of the water to be used at the plant shall not be destroyed. For pool type fishery farms, the growth of natural plant cover is allowed with minimum 5% of the production site without any interruption.

c) The entrepreneur that signs the contract with the authorized body with the certificate of permit by the relevant Ministry is accepted to the transition period. The transition period with the aquatic products is defined and determined by the authorized body in accordance with type of the organism, life cycle under consideration, water characteristics, and the previous use of the area where the plant is constructed. Transition period for materials derived from conventional production is at least 2/3 of the lifetime.

d) Production of aquatic products must be in compliance with the environmental protection; wastes will not harm to the environment; biological diversity must be reinforced; capacities and local conditions must be taken into consideration while selecting species and sub species; and all necessary measures must be taken to protect the water infrastructure. All preventive measure must be taken to eliminate escapes to nature from the production site and entrance to the production site from nature. While production sites are protected against wild birds and other animal species, measures that do not physically give any harm to predatory animals must be taken. Equipments and paints utilized in production must be selected in accordance with the principles of organic production. Marking can be carried out on the condition that no harm is inflicted upon the organisms.

e) All production activities at the production sites are carried out under the inspection of the authorized body.

f) Aquatic organisms must be produced in accordance with the rules of the organic agriculture; and organically produced food and food additives must be used in feeding. Foods must not destroy the natural flavor while satisfying nutrition requirements of organism at various phases of growth. Foods espoused to synthetic chemical process such as blood flour and bone flour originated from animals cannot be used. If the producer cannot fully supply feed items from organic agriculture, the use of conventional food is permitted under the control of the authorized body on the condition that the use of such feeds shall not exceed the rate 20%. Synthetic materials that colorize the fish meat and unnatural methods cannot be used.

g) If there is a need for using some additive nutrition in order to satisfy the nutrition requirements for the aquatic products, vitamins and minerals can be used in accordance with the permission to be issued by the authorized body. The use of fresh food is not permitted. .

h) Food additive materials are the ones specified in the Appendix 7 of this Regulation. Food and other nutrition items cannot include genetically modified products or additives and complementary materials partially derived from genetically modified products.

ı) The area where foods are kept must be in compliance with the rules of organic agriculture. Organically produced protective materials and additives specified in the Appendix 7 of this Regulation can be used with foods that are kept in a silo.

j) The use of synthetic matters that reinforce the production and growth is forbidden. However, hypophysis injection in the aquatic production can be applied with the permission to be issued by the authorized body on the condition that the injection must be taken from the same species of organism that is being produced.

k) The selection of species and sub species that are naturally resistant to diseases must be taken into consideration. Species under the threat of extinction may be selected.

l) The density of stocks is defined and determined by the authorized body in accordance with the species to be produced.

m) Production conditions must ensure natural behaviors of fish specific to the relevant species. The use of liquid oxygen is forbidden except for transport stages, unfavorable climate conditions and hatcheries.

n) Genetic structure of animals cannot be modified in the organic aquatic productions. Organisms of which structure is genetically modified and products derived form such organisms cannot be used as inputs.

o) Apart from special intervention specific to some production types, materials that increase the applied production and change reproduction cycles cannot be used. However, applications in the form of increasing or decreasing temperature by means of photoperiod technique can be utilized with the permission to be issued by the authorized body on the condition that the health, balance and behaviors of the organism are not to be affected. Photoperiod cannot be longer than the longest natural daylight duration within the natural life area of the species in a year.

p) All entrepreneurs that are involved in organic aquatic production keep regular and updated records.

r) Methods that do not inflict excessive stress utilized during catching, lining up and cutting of fish organically produced.

s) At least 20% of mature fish available at the production unit is replaced in every year.

t) If available, polyculture shall be preferred. The natural needs of each species of which culture is performed are satisfied.

u) If medicine is applied within the period of 3 (three) months prior to sales of the products, any fish meat and eggs and aquatic organisms or products derived from them cannot be sold as organic products. The use of conventional medicine on spineless organisms is prohibited. Vegetable medicines or homeopathic products can be used rather than medicines with chemical compounds on the condition that they have curative effects and are appropriate to the required treatment conditions.

CHAPTER FOURProcessing, Packaging, Labeling, Storage,

Transportation and Marketing of Organic ProductsProcessing and packaging of organic productsArticle 23 — The guidelines for processing and packaging of organic products are

described below.

a) Appropriate measures are taken during the processing of organic products, to protect the organic nature of the product and to prevent the organic product from mixing with, and contamination by products not in compliance with this Regulation.

b) Only food components listed in Appendix-2 of this Regulation are utilized during the processing of organic product.

c) Ionic radiation method is not applied.d) Organic product must have been produced using no genetically modified

organisms or products obtained from such organisms.

e) The organic nature of vegetable, animal and fishery products and organic products produced through organic farming methods should not be compromised during packaging when in raw material, semi-finished, and finished phases.

Labeling of organic and intermediate productsArticle 24 — The guidelines for labeling of organic products are described below.a) The following information should be specified on the label of finished product:1) The name of the product and certification status.

2) The production, year production date, name of the enterprise, and the statement confirming that it is produced in compliance with this Regulation.

3) Organic product logo, as described in Appendix-3 of this Regulation, should be applied on the organic products sold in domestic market.

4) The name, code number, certificate number and logo of authorized firm.5) The list of the ingredients of the product, in descending order of weight.6) The origin of the product.7) The location and date of production, and date of expiration.8) Label information in Turkish language, on imported products.b) Usage of the word ‘organic’ on the label of the product is equivalent to the usage

of words ‘ecologic’ or ‘biologic’.

c) The label of any product produced not in compliance with this Regulation can not contain any statement to the implicit or explicit effect of that product having been produced, prepared, processed, packaged, or stored in compliance with this Regulation. Non-organic products can not be labeled or packaged to resemble or create an association with the labeling or packaging organic products. Such products can not be granted with a brand, patent, and registration as an organic farming product. ‘Bio’, ‘biyo’, ‘eco’, ‘eko’, ‘org’ prefixes which can create an impression of an organic product and create unfair competition can not be used for non-organic products.

d) A product has to meet the following conditions in order to be labeled as an organic product:

1) In case the product is produced or imported in compliance with this Regulation,2) For processed products, in case the following conditions are met,

A minimum of 95% of the agricultural products or their derivatives in the product should be produced or imported in compliance with this Regulation.

Other substances of agricultural source which are not produced organically should be listed in Appendix-2 (C) of this Regulation.

If the product requires the use of additives of non agricultural origin, it should only contain food additives of non-agricultural origin listed in Appendix-2 (A) of this Regulation.

In case products with agricultural origin or their derivatives must be processed, they must have been processed using the products listed in Appendix-2 (B) of this Regulation.

e) An intermediate product can only be labeled as such, provided that it meets the following conditions:

1) It must be an intermediate product in compliance with this Regulation.2) Intermediate period must be complied with for a minimum duration of 12 months

before harvesting.

3) The phrases of “organic” and “intermediate” in the sentence of “organic farming intermediate product” on the label must be written in the same font, size and color.

f) The label of the processed products containing a minimum of 70% organic products should meet the following conditions:

1) In order to be able to be stated that it is produced vie organic farming methods in the ingredients section, a minimum of 70% of the substances of agricultural origin and their derivatives must be produced in compliance with this Regulation, or should be imported organic products which are produced in compliance with rules similar to those in this Regulation. In the ingredients section, organic ingredients should be stated in the form of “produced using organic farming method”, together with their percentage, and

this statement should be in similar font, size, and color with the other statements in the ingredients section.

2) Other non-organically produced ingredients of agricultural origin should be listed in Appendix-2 (C) of this Regulation.

3) Processed product should only contain food additives of non-agricultural origin listed in Appendix-2 (A) of this Regulation.

4) Products of agricultural origin and their derivatives should be processed using products listed in Appendix-2 (B) of this Regulation.

5) Ionic radiation should not be applied during the processing of the product.

6) Product should be produced by enterprises audited for compliance to this Regulation, by firms authorized by the Ministry for this purpose.

7) Product must be produced without using genetically modified organisms and/or products obtained from such organisms.

8) Products produced during the intermediate period are labeled as a product of intermediate product in compliance with this Regulation.

Storage of organic productsArticle 25 — The guidelines for the storage of organic products are described

below:

a) Storage areas for organic products should be arranged in an appropriate manner to allow the identification of products, and to prevent mixing with, or contamination by, other products or substances not deemed suitable by this Regulation. Selection of insulation material and cooling equipment should be made in accordance with this target.

b) In cases where separate storages are not possible, appropriate measures are taken to prevent mixing organic products with conventional products, and these measures are audited by an authorized agent.

c) Storage applications can be done under controlled conditions in respect of pressure, temperature and gas types approved by the authorized agent.

d) During the storage of organic products, no chemicals or disinfection methods can be used that result in the loss of the product’s organic nature.

e) During the storage of organic products, no synthetic chemicals can be used and no non-natural applications can be made; all these operations are audited by the authorized agent.

f) Records of incoming and outgoing quantities and dates for the stored organic products are kept regularly by the enterprise. Approval for these records is obtained from the authorized agent and both the enterprise and the authorized agent each keep a copy of these tables.

Transportation of organic productsArticle 26 — The guidelines for the transportation of organic products are

described below:

a) Enterprise is under obligation to transport organic products in appropriate package, container, or covered vehicles, in a manner both traceable and preventing the mixing of the contents during transportation to other units, including transportation to and from the wholesaler and retailers.

b) One or more shipments between two enterprises within the control system using non-covered vehicles, containers or packages should be accompanied with documentation showing the required information such as the name and address of the enterprise, name of the product, name of the authorized agent, code number, and should be made within the knowledge and approval of the sender and recipient or the authorized agent.

Marketing of organic productsArticle 27 — The guidelines for marketing organic products are described below:

a) Products produced in accordance with this Regulation and having the “Product Certificate” identifying them as organic raw material and/or organic processed products can be marketed as organic products.

b) Establishments dealing with organic product trade are under obligation to document their sale of each batch with a “Product Certificate”.

c) Organic products are sold by clearly stating that they are organic products. Prevention of mixing of organic products with conventional products and the protection of their organic nature are under the obligation of the selling establishment.

d) In the case of importation, the importer supplies the documents requested by the authorized agent in full. Authorized agent requests the following information and documentation in order to effect re-certification:

1) The import activities of the importer; the name and address of the importer, source country from which the product is imported, the entry point of the products to the country, and detailed documentation showing the suitability of the facilities to be used for the storage of the imported products,

2) The originals or notarized translations of all the information concerning the label and the contents of the products purchased from the other country,

3) Documents showing the manner in which importing will be made and precautionary measures to be taken in case of violations,

4) In the case of any storage facility to be used by the importer being in the other country, documents stating that this facility will be open to the inspection of the other country’s authorized agent,

5) The quantity of the relevant batch, its origin and structure, details of the control mechanism, details of production, processing, packaging, and storage operations, purchasers, product certificate, organic farming establishment certificate, and annual auditing reports pertaining to the product.

Additional information and documentation may be requested by the authorized agent in addition to the information and documentation stated above. All information and documentation is kept available to be presented during the inspections of the Committee.

e) Establishments who wish to import or export apply to the relevant office of the Ministry with the Product Certificate obtained from the authorized agent and other documents needed according to the national legislation.

f) Export of organic products is subject to the procedures applicable to the products listed in the “list of the goods the export of which are subject to registration”, published by Undersecretariat of the Prime Ministry for Foreign Trade. For this reason; enterprises submit copies of the export documentation to Aegean Exporters’ Associations. Aegean Exporters’ Associations submit the exportation data including exporters’ declarations and statement numbers to the Committee, in quarterly periods.

CHAPTER THREEOperation of the Auditing and/or Certification System

SECTION ONEAuditing Principles

Features of the auditing system

Article 28 — The nature of organic production dictates every phase to be under control and the product to be certified. According to this Regulation, two main elements for the assurance of the product are auditing and certification. Auditing and certification can be made by the same agent, as well as separate agents.

Auditing authority

Article 29 — The Ministry can transfer its authority to audit the enterprises to an authorized agent. Agents and auditors authorized in this manner can not transfer this authority to another agent and/or establishment or individual.

Information and documentation required for auditing businesses and enterprises

Article 30 — Information and documentation required for auditing businesses and enterprises are described below:

a) Enterprises are under obligation to submit all information and documentation concerning the organic activities they perform, to the auditing and certification agent or auditing agent with which they have a contract. These information and documentation are registered by the agent. These information and documentation consist of the following:

1) The name and address of the enterprise, its capacity information, information and documentation concerning its legal status, contract date, signed contact text, date of commencement for the transition to organic farming, information about the land until the date of contract,

2) Area of operation,3) Production method previously applied in the enterprise,4) Layout schematics for the enterprise and facilities,5) All plans and cadastral sketches concerning the parcels of land or the area,6) Current machinery and equipment in the enterprise,7) Placement of the enterprise, description and suitability of the warehouses used,8) Product alternation plan,9) Logbooks for all inputs to be used,10) The properties of the enterprise, purchasing and selling records for goods

procured externally,

11) Product exit plan, specifications of the product, inventory status, quantity, packaging type and material,

12) In the case of harvesting from forests and nature, all descriptions concerning the area, official permits, and information concerning all technical interventions made at the area, disasters, and quarantine measures.

b) Enterprise prepares plans for transition to organic farming which contain information about the operation area, and plans for production.

Auditing operation

Article 31 — Auditing operation should cover documents, plans, logbooks, reports, records, inspections and observations concerning the critical points such as the land, operation and storage facilities. Auditing and certification agent audits the enterprise at least annually, with or without prior notice. For this purpose, auditing and certification agent prepares an audit plan, which includes the following information:

1) Name and address of the enterprise,2) Audit date,3) Subjects to be covered by the audit,4) Name of the auditor.All organic farming activities recorded by the enterprise represent the essential

information for the audit reports.

During the audit, auditor fills in the audit forms containing organic farming activities, prepared by the auditing and certification agent or the auditing agent with which the auditor is connected. Auditor supplies to the enterprise a document showing the results of the audit performed, and this document is filed by the enterprise. Auditing and certification agent or auditing agent prepares a report as the result of the audit operation. Audit report contains the audit results concerning the organic farming activities of the enterprise in conjunction with this Regulation.

SECTION TWOCertification Principles

Characteristics of the certification system

Article 32 — Certification is the documentation of the degree to which the enterprise, organic product, or input, as the result of the application of all auditing operations. Auditing and certification agent or certification agent issues organic farming enterprise certificate or product certificate. Certificates should be prepared to include information shown in Appendix-4 of this Regulation. A summary list for the certificates prepared is submitted to the Committee.

The guidelines for the certification system are described below:

a) Certification is made by individual or legal entities authorized by the Committee for this purpose. Certification can also be made by the agent performing the audits; however a separate permission and authorization must be obtained from the Committee for this purpose. A auditing and certification agent or certification agent authorized for certification can not transfer this authority to another agent.

b) Auditing and certification agent or certification agent prepares a certification system and submits it to the Committee. This system includes the tariff used by the auditing and certification agent or certification agent, certificate sample, and information concerning certificate types, test and examination method, analysis method and all techniques used, and documentation system.

c) Certification agent receives all audit information and reports from the auditing agent performing the audit, concerning the enterprise to which a certificate will be issued. Auditing agent is under obligation to transfer this information to the certification agent.

Principles of certification

Article 33 — Auditing and certification agent or certification agent is under obligation to provide the criteria mentioned in this Regulation and the suitability of the principles of certification, in compliance with EN 45011 ISO 65. Auditing and certification agent or certification agent prepares a quality handbook describing the quality system according to the type of the operation performed.

CHAPTER FOURAuthorized agents

SECTION ONEOperational Principles of Authorized Agents, Work Permit, and Sanctions

Operational principles of authorized agentsArticle 34 — Operational principles of authorized agents are described below:

a) Authorized agents are under obligation to receive an authorization for operation from the Committee, to apply for the extension of their authorization period at least one month before the expiration of their authorization period, and to document the extension of their work permits. The work permits of the agents not in compliance with the criteria stated above are suspended by the Committee until they are granted with a new work permit.

b) Authorized agents are under obligation to enforce the use of national organic farming logo on all kinds of organic product packages domestically.

c) Authorized agent can not proceed with product or input certification before setting up an auditing process in compliance with this Regulation.

d) In cases where a doubt exists for the usage of production techniques and inputs which are not in compliance with this Regulation, the authorized agents can obtain product samples for analysis purposes.

e) They submit their report of resolution containing all the discrepancies they have detected, and the commensurate sanctions they propose, to the committee, within twenty days in the case of objection by the enterprise, or in their annual reports otherwise. Furthermore, enterprises expelled from the system by the authorized agent are announced to other authorized agents. In the case of an objection or complaint against the sanctions proposed by the authorized agent, the Committee may request an examination for the case, and additional documentation. Committee examines the information and documentation relative to the objection and complaint, builds a final decision, and announces this decision to relevant parties.

f) Authorized agent inspects and records all information and documentation belonging to the enterprises which are involved in the production of vegetable, animal, and fishery products, harvesting products from forests and nature, processing, packaging, storing, transporting, and marketing products, and with which they have signed a contract. It prepares a detailed report. The reports contain the following information concerning the operation area:

1) Information stated in subparagraph (1) of paragraph (a) of article 6 of this regulation,

2) All information concerning production,3) All information concerning the enterprise,4) All information concerning the audits,5) All information concerning certification,6) All information concerning violations and disputes,7) All information concerning foodstuff registry.Conditions required for authorized agents Article 35 — Conditions required for authorized agents are described below:

a) Authorized agents should have technical and administrative resources adequate to fulfill their duties. Committee has the authority to make inspections to this effect, and to make recommendations and directives. For permission to be granted by the Ministry, the representative and deputy representative of the Turkish liaison office of domestic or foreign authorized agent must hold Turkish citizenship. The number of employees with Turkish citizenship can not be less than 2/3 of the total number of auditors and other employees.

b) Authorized agents must have been accredited according to EN 45011, ISO 65, or standards.

c) Authorized agents prepare all facilities to provide continuous communications.d) Authorized agents can not offer advisory services.

e) Authorized agents can not audit or certify the organic farming activities of their management personnel, shareholders, auditors, employees, and their immediate relatives.

f) The management personnel, shareholders, auditors, and employees of an authorized agent can not also be employed by another authorized agent. However, freelance auditors may perform auditing activities on behalf of different authorized agents simultaneously.

g) The number of auditors at an authorized agent should be commensurate for the number of the projects of the agent and the total area to be audited. The maximum working time for an auditor is 90 audit days annually.

h) A notarized letter of commitment for operation in compliance with applicable organic farming legislation is obtained from the agents authorized by the Ministry.

ı) If necessary, authorized agents may open branches, provided that a minimum of one auditor is employed and permission from the Committee is obtained. Authorized agents are accountable for all activities performed by their branches. The committee is notified in the case of the closure of a branch.

Applications for work permit for an authorized agent

Article 36 — Individuals or legal entities submit their applications duly to the Ministry, in order to perform auditing, certification, or auditing and certification. Committee performs the required inspections, and a reply is issued within 3 month following the application, indicating whether the permit will or will not be granted. An authorized agent obtaining permission from the Ministry performs its activities in compliance with this regulation.

Article 37 — The documents and requirements for obtaining a work permit are listed below:

a) Documents defining the legal structure of authorized agents,1) If the authorized agent is a legal entity, it must be at least a limited company.

2) If the authorized agent is a subsidiary or a liaison office of a foreign agent, it must have completed all legal permit procedures.

3) Individuals must have obtained the required permit to start a business.

b) If the authorized agent is a subsidiary or a liaison office of a foreign agent, it submits its accreditation document at the time of application. If it is a newly formed company, it must submit the accreditation document within two years. If the accreditation document is not submitted within this period, the Ministry suspends the work permit of authorized agent until it is submitted to the Ministry.

c) Documents defining the location and organization of authorized agents,1) Its name, address, all communications information and documents belonging to

its logo, if available,2) Identity information concerning the owner, shareholders, employees, and

auditors of the agent,3) Education information concerning the owner, shareholders, employees, and

auditors of the agent,4) Job descriptions and social security documents of the employees,5) Signature circulars of the authorized personnel,6) Organization diagram of the authorized agent.d) Documents concerning the financial structure of the agent,1) Documents concerning the capital structure,2) Documents concerning the tax type and tax registration number.e) All documents described in this Regulation, concerning the operation area and

operation system of the agent,f) Documents concerning the auditing and certification procedures and quality

handbook in Turkish language.Responsibilities of the enterprise and applicable sanctions

Article 38 — The enterprise is under obligation to supply all the requested documentation concerning organic production to the authorized agent with which it has a contract, and to allow access to the authorized agent all facilities related to organic production, in order to facilitate auditing at every step of its organic farming activities. Authorized agent can audit every phase of the organic farming activity at any time of its own choice.

The enterprise must define its area of operation and notify the authorized agent on the precautions it takes. The enterprise is under obligation to supply a letter of commitment to the authorized agent declaring that it will abide by the rules of this Regulation and will give consent to any audits to be performed.

In case the enterprise has any doubt that the product it produces, processes, imports, or purchases from another enterprise does not comply with this Regulation, it notifies the authorized agent of this issue. The use of the organic product label and logo which will identify the product in question as an organic product is suspended until the situation is cleared. After the clearance of all doubts, the enterprise, within the knowledge of the authorized agent, can process or market the product in question in compliance with this Regulation.

The sanctions applicable by the authorized agent to the enterprise are applied as follows:

a) The enterprise is under obligation to keep all records required by the authorized agent concerning its activities regularly. In the case of the records being kept irregularly or incorrectly, the authorized agents notify the enterprises in writing and in detail, concerning the missing and defective issues. The authorized agent grants a period of one month to the enterprise for the correction of the missing and defective issues. After this period, the audit is repeated. If correction can be achieved, the contract continues without any change. Otherwise, sanctions defined in the quality handbook are applied. In the case of an objection, information and documentation concerning the case are submitted within twenty days to the Committee. The Committee performs the necessary examinations, builds a final decision, and announces this decision to relevant parties.

b) In the case of identification of applications not in compliance with this Regulation during the production phase, if the enterprise is in the transition period to organic production, then this period is extended by the authorized agent, if this period has elapsed, then the transition period is re-entered and the enterprise is notified in writing. The contract of the producing enterprises which repeat the applications not in compliance with this Regulation is canceled and the Committee is notified. In the case of an objection or complaint, request the information and documentation concerning the issue and starts an inspection. If the result of this inspection indicates that the enterprise is intentionally repeating the actions not in compliance with this Regulation, then the Committee prohibits the enterprise from organic production activities for a period of five years, and notifies all authorized agents. Prohibition decision can only be taken by the Committee.

c) If it is determined that an enterprise violating this Regulation in its processing, packaging, labeling, storage, and transportation activities is intentionally continuing its violation, the Committee prohibits the enterprise from organic farming activities for a period of five years and notifies all authorized agents about this verdict.

The information and documentation that the authorized agents are required to supply

Article 39 — The committee may request at any time and in any format, any and all information and documentation from the authorized agent, concerning the enterprise, product, production, the auditing activity, the agent itself, its employees and source. Furthermore, authorized agents are under obligation to notify the Committee within one month, about all modifications made to its structure.

The authorized agent is under obligation to submit a list within one month containing the code number assigned in accordance with paragraph (f) of article 6 of this Regulation, an approved list of enterprises with which it has signed a contract with, location and size of the land, name of the product, quantity, the name of the enterprise and its organic activities to the Committee and the provincial directorate of the Ministry of Agriculture at where organic farming is made. Committee and provincial directorate register the enterprise they are informed about, as “enterprise using organic farming method”.

The length of reduction in the transition period and its reason, or the cases at where the enterprise is re-entered into the transition period are announced by the authorized agent to the provincial directorate at where production is made within one month, and to the Committee by annual reports.

Every year, until the March 31st, authorized agents supply all information concerning their activities for the last calendar year, including product, enterprise, certifications, auditing, production, export, import, and number of employees, to the Committee.

Additionally, they are under obligation to announce to the Committee, the enterprises with which a contract has been recently signed, within one month.

Auditing, authority and responsibility, and on-the-job training for auditors

Article 40 — The inspections of authorized agents, enterprises and facilities are made by Organic Farming Committee Members and Organic Farming Unit formed at provincial directorates, comprising of technical personnel who received training on the subject of organic farming. If deemed necessary by the Ministry, these inspections can also be made by the Inspection Committee Presidency.

Inspection personnel at the provincial directorate comprise of personnel proposed by the provincial directorate, and trained and certified by the Ministry.

The inspections are classified as authorized agent office, enterprise, and facilities inspections, and inspection of the authorized agent is performed by the committee, and other inspections are performed by the provincial directorate. Inspections are performed by a minimum of two personnel having inspection authority. Inspection forms prepared by the Ministry are used during the inspections performed by provincial directorate. An evaluation list of all inspections performed throughout a year is submitted to the Ministry as statistical information, until the January 31st of the following year.

If deemed necessary by the central organization of the Ministry, training is provided aimed at the inspection personnel of the provincial organizations. Training for farmers is performed by the inspection personnel at the provincial organization.

PenaltiesArticle 41 — Fines applicable to enterprises and authorized agents which violate

the law are applied as follows:

a) With the proposal of the provincial directorate of the location at which the violation is detected, or through a complaint made to the Committee, or as the result of the Committee directly determining a violation; the sanctions set in the subparagraphs (b), (c), (d), (e) of the first paragraph of article 12 of the Law are applied by the Ministry. These sanctions are applied after a preliminary investigation by the Committee, and if required, an investigation by the Inspection Committee Presidency of the ministry. During this investigation, authorized agent can not sign new contracts with enterprises. However, it can continue auditing, certification or auditing and certification activities at enterprises with which it has previously signed a contract, subject to the decision of the Committee.

b) An administrative fine is applied by the Ministry or the highest civil authority of the location to the violators of subparagraphs (f) and (k) of the first paragraph of Article 12 of the Law.

c) Other penalties mentioned in Article 12 of the Law are applied by the highest civil authority of the location at where the violation is detected.

d) If, within one year following the finalization of the penalty, the violation is repeated, the clauses in the Law concerning repetition are applied.

Defendant can appeal to the competent administrative courts within seven days after the official communication against fines imposed by the Ministry or the highest civil authority.

Auditor courses, conditions for auditor applications, authority, and principles of operation

Article 42 — If deemed necessary by the Ministry, one training course is opened or arranged annually for auditors, targeting agricultural engineers, veterinary surgeons, fishery engineers, and food engineers. The fees predetermined by the establishment to cover the course expenses are deposited by the participants to the relevant revolving fund account.

The conditions for auditor applications and the authority and operation principles for the auditors are as follows:

a) Conditions for application1) Graduation from one of agricultural, veterinarian, fishery, or food engineering

faculties,

2) Possession of an official document confirming one years knowledge and experience on the subject of organic farming, or a postgraduate diploma related to the subject, or a doctorate diploma related to the subject, or an official document confirming the attendance to an auditor course organized by the Ministry, or having worked in the organic farming committee for the duration of one year, or having worked as an inspector at the Ministry in addition to the possession of an appropriate license diploma and having experience in organic farming.

b) Authority;

1) Individuals submitting the required information and documentation to the Committee are granted auditor authority and authorized auditors are recorded and identification is supplied.

2) They have to be enrolled to the professional society related to their license diploma.

3) Auditors can work on behalf of only one authorized agent, however freelance auditors can perform audits on behalf of more than one authorized agents simultaneously.

c) Principles of operation;1) They work with an authorization document granted by the Committee.

2) They are under obligation to prepare a report for the audit they have performed, to sign this report, and to submit this report to the authorized agent.

3) If the Committee detects that the auditor is violating this Regulation, it can suspend or revoke the authorization.

Conditions for certifier applications, authority, and principles of operationArticle 43 — The conditions for certifier applications and the authority and

operation principles for the certifiers are as:a) Conditions for application;1) Graduation from a minimum of a 4 year higher education agent,

below:

Auditing and certification fee is determined on the contract signed between the authorized agent and the enterprise. In case authorized agent deems necessary the presence of a committee member in the audit activity, it applies in writing to the Committee and provides a per diem the rate of which is similar to the principles it applies to its audit activities.

CHAPTER FIVECommittees

SECTION ONEOrganic Farming Committee

Formation of the Organic Farming Committee, its duties, and its operational guidelines

Article 45 — The principles and framework for the formation of the Organic Farming Committee, its duties, and its operational guidelines are described below:

a) Committee constitution; The committee is constituted by the persons to be appointed by Ministry, Agricultural Production and Development General Directorate, Protection and Control General Directorate, Agricultural Researches General Directorate, Organization and Support General Directorate, Research planning and coordination committee presidency, Foreign Affairs and the European Union Coordination Office subject to the approval of minister or authorized undersecretary or deputy undersecretary. The number of the members is determined by Agricultural production and development general directorate provided at least 1 member from above mentioned authorities is to be included in the committee. If it deems necessary, one each member from Inspection committee presidency and Law consultancy can be included in the committee. The presidency and secretarial works of the committee are carried out by Agricultural Production and Development General Directorate Alternative Production Techniques Agency.

b) The duties of the committee;1) Evaluating Authorized agent applications and granting, extending, or revoking

the work permits,2) Encoding authorized agents, encoding and supplying identification cards for the

auditors and certifiers,3) Granting and revoking auditor and certifier authorizations,4) Performing inspection of authorized agent offices,

5) Proposing appropriate penalties to the Ministry, for authorized agents, auditors, and enterprises violating organic farming legislation,

6) Perform actions to develop, familiarize and extend organic farming in Turkey, to encourage preparation of trainings, seminars, symposiums, meetings, conventions, and fairs, on the subject of organic farming, to participate and provide support for these activities,

7) Tracing International Organic Farming legislation and perform modification activities in order to obtain harmony on this issue.

c) Committee is invited to the meetings by the secretariat. Committee meets with the absolute majority of the membership. Decisions are taken with the absolute majority of the membership.

d) Reporting is performed by the secretary member chosen by the Committee from the representatives of the Directorate for Agricultural Production and Development.

e) Decisions are undersigned by all members participating in that meeting, within one month following the meeting date. After the signatures, decisions are presented to the Minister or the office designated by the Minister, and becomes effective at the date of approval.

SECTION TWOOrganic Farming National Guidance Committee

Formation of the Organic Farming National Guidance Committee, its duties, and its operational guidelines

Article 46 — The principles and framework for the formation of the Organic Farming National Guidance Committee, its duties, and its operational guidelines are described below:

a) Organic Farming National Guidance Committee; This committee is constituted by at least ten persons from the authorized persons from TÜGEM under the presidency of Agricultural Production and development, State Planning Organization Undersecretariat, Foreign Trade Secretariat Customs Secretariat, Ministry of Industry and Trade, Ministry of Health, Ministry of environment and Forest, Export Development Research Center, representative of agricultural researches general directorate, TÜBİTAK, occupation organizations, civil public organizations, representatives of authorized institutions, universities and representatives of private sector and the persons who are recommended to participate to the committee from institution and organizations.

b) Organic Farming National Guidance Committee performs activities for the application and development of organic farming, supports and incentives, raising consumer awareness, domestic and foreign marketing for organic products, identifying defective applications and determining the strategies for these issues, evaluating the project proposals in the field of organic farming, and determining their priorities.

c) Workgroups are formed if deemed necessary by the Organic Farming National Guidance Committee.

d) Regular meetings are held at least once annually. Extraordinary meetings are announced by the secretariat.

e) Decisions are reached with the absolute majority of the participants in the meeting, and they are treated as recommendations to the Committee.

f) Reporting and secretariat is provided by Agricultural Production and Development General Directorate.

g) Decisions are undersigned by all members within 20 days following the meeting date. After the signatures, decisions are forwarded within 30 days to the Committee. Committee evaluates the decisions in its first coming meeting.

CHAPTER SIXMiscellaneous and Final Clauses

Location for resolution of disputes

Article 47 — Each authorized agent is under obligation to define a place of court, to be appealed in the case of a need. This location has to be described in the contract signed between the authorized agent and the enterprise.

Foreign trade arrangements

Article 48 — Arrangements concerning the exportation and importation for organic products are made by the Ministry of Agriculture and Rural Affairs and Undersecretariat for Foreign Trade.

The provisions that are not taken part in regulation Article 49 — In the event of the provisions which are not put in effect in scope of

organic agricultural activities, the effective provisions of the superseded legislation replaced with the regulation of Food production, consumption and audit dated 27/5/2004 with no 5179, Aquatic products law dated 22/3/1971 with no 1380, Animal food law dated 29/5/1973 with no 1734, Agricultural Struggling and Agricultural Quarantine law dated 15/5/1957 with no 6968, law of Preparation and Implementation of Technical regulation for the products dated 29/6/2001 and with no 4703, the law of animal health and inspection dated 8/5/1986 and with no 3285 and the relevant regulations based on this law, Chemical Fertilizers Audit Legislation published on the Official Gazette dated 25/4/2002 and with no 24736, the legislation related to the chemical fertilizers used in agriculture as published on Official gazette dated 18/3/2004 and with no 25406 and the regulations of production, import, export, putting into market and inspection of soil regulators and organic fertilizers contenting organic, organomineral, specific, microbial and enzyme as published on official Gazette dated 4/5/2004 with no 25452 shall apply.

Superseded legislation

Article 50 —The regulation related to the principles and Implementation of Organic Agriculture published on Official Gazette dated 11/7/2002 and with no 24812 were removed.

Effectiveness Article 51 — This Regulation becomes effective on the date it is published.ExecutionArticle 52 — This Regulation is executed by the Minister of Agriculture and Rural

Affairs.

Appendix–1 Fertilizer and Soil Restorative Agents and Vegetable Protective Materials

A. Fertilizers and soil restorative agents

Fertilizers and soil restorative agents that are allowed to utilize in the cultivation of organic vegetable products are given below. Fertilizers and soil restorative agents must be used in accordance with the provisions of this Regulation.

- The species of animals through which the relevant fertilizer is obtained must be specified.-The use of fertilizers obtained from extensive stockbreeding is prohibited.- The approval for its use must be issued by the authorized body.

Liquid faeces of animals (Fresh droppings drippings, urine and etc.)

- It must be used after controlled fermentation and/or dilution.- The species of animals through which the relevant fertilizer is obtained must be specified.- The use of fertilizers obtained from extensive stockbreeding is prohibited.- The approval for its use must be issued by the authorized body.

Vermicompost and insects compostGuano - The approval for its use must be issued by the

authorized body.Foods originated from animals and by-products;-Blood flour-Nail flour-Horn flour-Bone flour or bone flour without gelatin -Fish flour-Meat flour-Feather, hair and chiquette (grinded leather or fur) flour-Wool-Fur-Hair-Dairy products

Composted or fermented mixture of vegetable materials

-Materials obtained from vegetable mixtures by exposing anaerobic fermentation for compost or biogas.- The approval for its use must be issued by the authorized body.

Waste products of agaricus bisporus

-The initial composition of the Substrate must satisfy the requirements of this Regulation specified for fungus production.

Alga and alga materials They must be obtained by utilizing the following methods:1-Physical processes including drying, freezing and grinding,2-Extraction with water or diluted acid and/or diluted alkaline solution,3-Fermantation.- The approval for its use must be issued by the authorized body.

Sawdust and wood pieces - Not exposed to any chemical processes.Composted bark - Not exposed to any chemical processes.Tree ash - Not exposed to any chemical processes.Peat - It must be used in garden plants (i.e. production

unit with small scale, flower and bush or sapling production) with limitations.

Clays (i.e. perlit, vermikülit,and etc.)Soft rock phosphate - This is the fertilizer specified in Appendix 1 to the

Regulation regarding Chemical Fertilizers utilized in Agriculture” issued in the Official Journal of 18/03/2004 with the issue number 25406.- The content of Cadmium must be equal to the rate of 90 mg/kg P2O5 or less than this value.

Aluminum calcium phosphate - This is the fertilizer specified in Appendix 1 to the Regulation regarding Chemical Fertilizers utilized in Agriculture” issued in the Official Journal of 18/03/2004 with the issue number 25406.- The content of Cadmium must be equal to the rate of 90 mg/kg P2O5 or less than this value.-It must be used with limitation in basic soils (pH>7,5).

Basic dross - The approval for its use must be issued by the authorized body.

Raw potassium salts(i.e. kainite, sylvinite, and etc.)

- The approval for its use must be issued by the authorized body.

Potassium sulfate that may contain Magnesium salt,

- Fertilizers obtained from raw potassium salts by means of physical extraction and included with magnesium salts as well.- The approval for its use must be issued by the authorized body.

Sodium chloride -This is only raw Sodium chloride salt.- The approval for its use must be issued by the authorized body.

Grinded conglomerateTrace elements - This is the fertilizer specified in Appendix 1 to the

Regulation regarding Chemical Fertilizers utilized in Agriculture” issued in the Official Journal of 18/03/2004 with the issue number 25406.- The approval for its use must be issued by the authorized body.

Appendix- 3 Logo samples that shall be used in Turkish Organic products

A. Principles of Use:Those who produce or sell organic agricultural products or organic agricultural

materials are required to use the following logo samples on their packages in accordance with this Regulation. Products that do not carry these logos on their packages can not be offered to the domestic market; no promotion or commercial activities can be carried out regarding such products; nor can any patent application with their abbreviations be available.

The authorization for issuing the use of the label is held by the Committee which is the authorized organ of the Ministry. The use of this logo is to be issued by the authorized institution for raw material, semi-finished or finished agricultural organic production materials in accordance with the provisions of this Regulation.

One of the following logo samples given below is used in accordance with the quality and dimensions of the production and the type of its package. The diameters of logos cannot be less than 200 mm and more than 40 mm. No colors or tones can be used except for the ones specified below. Logos must be in the same tones as specified below.
