DONNER LAKE PROPERTY OWNERS' ASSOCIATION August 2003 PRESIDENT’S MESSAGE Once again the dog days of August are upon us, but it seems only yesterday that a group of generous and energetic members showed up to clean the beach on Memorial Day weekend so as to insure its enjoyment - and early opening - for the rest of us. Thanks to you who did so. For those unable to visit the beach this summer, Greg Henderson had the basketball court repaved (and made level) and he installed a new pole and hoop and lowered the older hoop so that kids could enjoy the court as well. He also rebuilt the horseshoe area to competitive standards. Mike Lewis and our beach employees helped with Greg in the labor for these types of projects, so thanks to Mike and his crew as well. We also purchased and installed racks for kayak and canoe storage and located them near the cove. On the failure side, Scott Denny, Greg, and I failed in our good intentions to do some pipe work ourselves, so now we plan to bring in a contractor this month to hook up the drinking fountain as well as the faucets down by the volleyball courts. Sometimes our plans just fail us. I want to also acknowledge the work done by Tom Murphy: Tom had to resign as Secretary- Treasurer in 2002 because he sold his property, but as immediate family of another member, he chose to continue to work with the Board on numerous levels. He has been involved in the search and interviewing of Beach Manager and Chief of Operations candidates, and with Sam Levin he has worked with our Chief of Operations in updating the computerized membership records and the software used in maintaining and writing financial spread sheets. With Robert Spies, he helped write a manual on preparing for and conducting our board elections so that when others become responsible for doing so, a roadmap now exists to show the way. Tom worked with a vendor to design the flag and banner layout and production. And he has spent considerable time and energy this past year helping Juanita Schneider, who you elected as Secretary Treasurer to replace him, write and finalize the minutes of meetings so that DLPOA records continued to be well written and accurate. As a ghostwriter of sorts, his work in that regard went largely unrecognized; but I think it should be acknowledged, as I am grateful for his assistance, as I know Juanita is as well, in enabling her to now do that work herself. The Board will be meeting this fall to set up procedures and a budget for next year; certainly, boat storage will be discussed and so if you have some thoughts and ideas beyond simply clear-cutting the trees for more room, let us know. Cutting down healthy trees to make a parking lot will not be an option, unless someone puts something funny in the drinking water during the meeting… If you want to become more involved, please send me an email and I will happily put you on one of our standing committees. Lastly, I receive many emails from members; some complain of the way things are---or appear to be; others, and happily more of you, compliment us on the way things are (or, maybe there too, appear to be). as it provides you instant access to me or to other board members for whatever questions you have, at any time of the year. And if you want to “speak” to other DLPOA members, use BeachTalk, which is intended to promote better communication within the membership and enhancing our sense of community, both within DLPOA and between DLPOA and the Truckee community. It’s good to see so many members and their guests enjoying the beach. It was NOT good to see many members engaged in a land rush in the early morning of July 4; that was one ugly demonstration of greed: using the keys to get in before the beach was open---or simply climbing the fence---and then roping off large areas of beach, chaining and locking ice chests to picnic tables, only to then triumphantly leave the beach for several hours with the expectation that others, of greater good will, should honor and respect that “land claim.” And then insist later that it was OK because there are no DLPOA rules against it. Do we really need to set forth rules of common decency and cooperation that seem so obvious? I doubt it. I don’t think it will happen again. DON’T LOSE YOUR MEMBERSHIP! PAY YOUR DUES—AND LATE FEE

For those few who still have not paid their dues, a registered letter will soon be mailed reminding them that: A failure to pay your dues by October 1, 2003, will act to revoke your membership without further action by the Board or notice to you. An initiation fee shall thereafter be required for you to become a member; if the membership cap has been reached, you will not be able to become a member until your name has reached the top of the wait list. (See Association Bylaws, Article IV, Sections 1,2; Article X, Section 6; Article III, Section 6.)

FIRE DISTRICT CHIPPING PROGRAM This note came to us from the fire district:

Please let everyone know they can have free chipping if they call 582-7850, M-F 8-5. They need to have the material where we can reach it from the vehicle, we do not have a way to haul so we chip in place and it needs to be clean (free of dirt, etc.) We take about 2-3 weeks to get there due to backlog. We can handle up to 10-11 inches in diameter. When they call they will be asked a few questions so we can get the correct info.

Notice to Boat Owners This year the beach closes on September 14, 2003, and all boats and trailers are to be removed by the close of day. However, in response to some who would like to continue to keep boats and trailers stored beyond that date and/or use the ramp for day use launching, the Board of Directors last year initiated the following policy, which will continue this year as well: DLPOA members may continue to keep their boats---but not trailers--- stored at the beach beyond September 14, but only in the following manner:

• The boats MUST be stored in the water in the cove at the southern end of the beach, behind the tire wave breakers; no trailers are allowed and no dry land storage is allowed.

• The member must have purchased a key to the gate, since the gate is to

remain closed and locked at all times except when you are entering or exiting.

• The member must have on file a signed Waiver of Liability.

Check with the Beach Manager before September 14 to be sure you have complied with these requirements; otherwise, pursuant to Rule 2000-2, a $10.00 per day fine will be levied upon the member whose boat and/or trailer is left beyond September 14.

Be certain you lock the gate behind you after you enter as well as after you drive out; this is to not only prevent nonmembers from using the beach but also to prevent a member who has no key, but comes in upon seeing the gate open, from being locked inside when yet another member does what you should have done: locks the gate behind him.

After September 14, there is no beach staff to monitor the beach and thus it is up to you to make this work.

ANOTHER DUMPSTER WEEKEND COMING UP

On the weekend of August 23, 24, you will have your last chance this summer to make your neighbors happy and get rid of the toilet and the piles of drywall and lumber scraps that you tossed out back earlier this summer. There will again be two (2) 30-yard garbage bins (the large ones) at the beach for MEMBERS to dump their junk. There is no charge to dump and you can make as many trips as you need, but you MUST have your membership card with you and show it to the gate person each time you come in. Secondly, you will need to toss the stuff into the dumpsters yourself and because the sidewalls of the bins are six feet high, you may need the assistance of friends or neighbors. Beach staff is specifically prohibited from assisting you. The following items are NOT ALLOWED: Hazardous and /or toxic materials such as paint, anti-freeze, oil, gasoline, batteries, insecticides, etc. Refrigerators, freezers, and air conditioners must have their motors and freon removed before dumping them, but you can dump the motors in separately. You can dump your own construction materials, such as drywall, lumber, etc, but keep in mind this is a service for DLPOA Members, not your contractors.

2003 SAND CASTLE/SCULPTURE CONTEST The Burden Family would like to thank all the volunteers, participants and local merchants who helped us with this year's Sand Castle/Sculpture Contest. We are greatly appreciative of Bruce Johnson who has volunteered for the past four years to help set up and judge. We truly enjoy his sense of humor at that hour of the morning! Also, great kudos go to our other outstanding and "courageous" judges: Fran Macomber, Leslie Prentice, Karen Rutledge and Bob Solazzi. A special "thank you" to the beach staff for seeing that the beach was ready for us after the Fourth of July Fireworks. We were pleased to have 51 young people and 12 adults participate in this year's contest (please refer to the DLPOA Web Page for photographs). Barbara Green, Supervisor July 11, 2003 Nevada County, 5th District 15374 Donner Pass Road 950 Maidu Avenue Truckee, CA 96161-3669 Nevada City, CA 95959 (530) 550-0882 Dear Barbara: Thank you for returning my telephone call and updating me on the status of the title search and survey of Old Highway 37, Stock Trail. The 700 members of the DLPOA are supportive of clearing the blockage of the Stock Trail for public use. This has been blocked for over a decade. I can assure you that if agreement can be reached with Mr. Frank Cadjew to open the trail for public use, I will personally see that proper signage and trail education will be provided. I respect private property rights, and at the same time want to protect and maintain public property. An alternative for Mr. Cadjew is to donate his 200 acres to the Truckee Donner Land Trust and take an income tax deduction as a charitable gift to shelter his other assets. I mentioned a 23 page report that may be of some help to the surveyors. This report was prepared as a part of a cultural resource inventory brought about by a breech in a Santa Fe Pacific pipeline discovered in February 1997. The report was prepared by Leon C. Schegg in November 1997. The report includes:

1. Historic Road Study Area 2. History and Significance of the Dutch Flat and Donner Lake Wagon road 3. Location of the Dutch Flat and Donner Lake Wagon Road. Including

topographical map of historic road segments 4. Present condition of the Dutch Flat and Donner Lake Wagon Road – Field

review on July 29, 1997. Class A – Pristine Original Roadbed Class B – Used Original Roadbed Class C – Verified original roadbed Class D – Impacted original roadbed Class E – Approximate Original Roadbed

5. Nevada County Survey Records, Road from, Summit to Truckee – Rod and chain method was used and reported with 120 stations

4th of July Picnic

Thank you to all the DLPOA volunteers who helped make our annual 4th of July picnic a success. We had an excellent turnout. All the potluck dishes were delicious. Thanks to all of you who brought hot dishes, salads and desserts. I especially want to thank the following people:
