DRAFT PROPOSED CONDITIONS – APP-2000008605.02 Proposed draft conditions, Revised following 26 February 2020 prehearing, Without Prejudice Descriptive Specification 1. Descriptive Specification

1. 5. The discharges authorised by these Consents must not:

a. cause the production of any conspicuous oil or grease films, scums or foams, or floatable or suspended materials; or

b. cause any emission of objectionable odour; or

c. render water unsuitable for consumption by farm animals; or

d. cause any significant adverse effects on aquatic life

in Centre Drain after reasonable mixing defined at the Site 3b Monitoring Point as shown on Plan ATH- 2002008648.02 A.

6. The quality of the treated wastewater discharged to Centre Drain must not:

a. Have a concentration of ammoniacal-nitrogen (NH4-N) exceeding 20 g/m3;b. Have a total CBOD5 (five-day carbonaceous biological oxygen demand) exceeding 70 g/m3;

andc. Have a suspended solids concentration exceeding 150 g/m3.

7. The quality of ammoniacal-nitrogen (NH 4-N) as measured at Site 3B downstream of the wetland must not exceed 0.4 g/m 3 on an annual average and/or 2.1 g/m 3 as an instantaneous maximum .

ADVICE NOTE: Ammoniacal nitrogen toxicity must be assessed after correcting for pH as measured instream at the time of sampling.

ADVICE NOTE: The annual average of ammoniacal-nitrogen (NH 4-N) is based on the last 12 months of data inclusive of those months when there has been no discharge.

Flow Metering & Recording

8. The Consent Holder must ensure that fully operational and calibrated flow meters are maintained at the following locations:

a. On the inlet pipework prior to the oxidation pond (in order to record inflows to the WWTP)b. On the discharge line to Centre Drain.

9. The flow meters specified in Condition 8 must have a pulse counter output traceably calibrated to +/-5% or better. The Consent Holder must arrange for the flow meters to be calibrated annually by an accredited supplier and must provide a copy of the calibration certificate confirming calibration to Manawatū-Whanganui Regional Council within one month of receipt of the certificate. Where the flow meter fails to meet the required calibration standard, the Consent Holder must advise the Regional Council and must undertake remedial works or replacement of the flow meter within two months in order to meet the required calibration standard.

10. Within three months of grant of this consent, the Consent Holder must install and maintain, in fully operational condition, a GPS data logger / telemetry unit compatible with the Manawatū-Whanganui Regional Council's Telemetry System.

Investigations and Improvements

Within three months of granting this permit, the permit holder shall have commissioned a Cultural Impact Assessment on the effects of the WWTP.

11. Within 18 months of commencement of this consent, the Consent Holder must plant a row of trees along the southern boundary of the property, for the length of the boundary that is adjacent to the wastewater treatment facilities for purposes of providing visual screening to the property to the South .

12. Within 12 months of commencement of this consent, the consent holder must provide to MWRC's Regulatory Manager, details of inflow and infiltration investigations undertaken in the previous two financial years. Details of any forward works programme for repairs or upgrades to the Council network must be included. Any such works must be undertaken in general accordance with the principles of the Infiltration and Inflow Control Manual, Water New Zealand, 2015 (or relevant updates).

13. The Consent Holder must undertake and complete specific milestones in preparation for the planned long-term sustainable treatment and disposal of wastewater to land options in order to minimise, as far as practicable, the discharge of treated effluent to surface water. These milestones must include, but not be limited to:

a. A quarterly report provided to the Regional Council and the Tokomaru Wastewater Working Party (TWWWP) regarding the progress of plans and designs for the long-term sustainable treatment and disposal of wastewater and contingency discharge to water processes and

confirm the scope of the Assessment of the Environmental Effects for this planned option to be lodged by 31 December 2022. The update must include progress of plans for storage requirements, procedures to minimise discharge to surface water (Centre Drain), and planned treatment improvements for the site.

14. The Consent Holder must consult with the TWWWP throughout the preparation for the long-term sustainable disposal to land options in accordance with the terms of the reference for the Party.

15. Within 6 months of these consents commencing, the Consent Holder must provide to the Team Leader Compliance for technical certification, a planting and management plan, which must include but is not limited to:

a. demonstrating how the wetland must be managed so as to allow for gradual introduction of the treated wastewater to the wetland to allow for planted seedlings to adapt to the fully saturated conditions,

b. pruning and weeding frequency, including methodology, and

c. Plant replacement

16. Planting in the treatment wetland must be at a density of two plants per square metre and the entire base of the wetland must be planted.

17. Weeding of the Treatment Wetland must be undertaken manually.

18. In-fill planting must be undertaken annually during the management phase to replace gaps formed due to plant mortality and to maintain vegetative cover of 95% in the wetland.

Tokomaru Wastewater Working Party

19. The Consent Holder must establish a Tokomaru Wastewater Working Party (TWWWP). The purpose of the Party will be to:

a. Observe and review management decisions and monitoring results;b. Keep a 'watching brief' on the management of activities at the Tokomaru WWTP; andc. Comment on the planned long-term disposal to land design and application process.

Invitations to join the TWWWP, and activities of the TWWWP facilitated by the Consent Holder must be as per the terms of reference as attached.

20. The Consent Holder must undertake all activities for which it is responsible under the TWWWP terms of reference attached to this consent, specifically:

a. Allow members of the TWWWP to inspect the site at times agreed with the Consent Holder subject to members of the TWWWP complying with all necessary instructions and procedures to meet the Consent Holder's obligations under the Health and Safety at Work Act 2015;

b. Provide the TWWWP members with an email no less frequently than every three months which summarises the activities undertaken as part of the agreed work programme under the Tokomaru WWTP discharge consent;

c. Provide the TWWWP with the results from monitoring undertaken in accordance with the consent conditions; the annual monitoring report prepared in accordance with the consent conditions, and a copy of the Operations and Risk Management Plan;

d. Formally acknowledge and consider any TWWWP member's written suggestions on possible improvements to or concerns about the WWTP operation;

e. Notify Manawatū-Whanganui Regional Council of any issues raised by TWWWP regarding the Operations and Risk Management Plan if the views and comments have not been incorporated and state reasons why;

f. Notify the TWWWP within 20 working days of any breach in consent conditions that has or may be about to occur;

g. Notify the TWWWP of any application made by the consent holder to change or cancel any conditions of this consent;

h. Consult the TWWWP on the preparation of any application for wastewater discharge consent and provide the TWWWP with an opportunity to comment and provide feedback on the application prior to its lodgement.

21. The Consent Holder must convene a meeting of the TWWWP at least three times per year . This must be by way of invitation to those parties named as members of the TWWWP in the terms of reference for the TWWWP with a minimum of 20 working days' notice of the meeting.

Monitoring

22. The Consent Holder must, no less than monthly, collect the following samples and have them analysed for the parameters specified in Condition 25:

a. A representative sample from the inflow to the WWTP (Site 1a);b. A representative sample from within the outflow from the oxidation pond to the Wetland

area (Site 1b) in order to assess the quality of effluent being discharged via the base of the wetland;

c. A sample from Centre Drain downstream of the Dairy Farm West drain discharge point (Site 1d);

d. A representative sample from Centre Drain at the Upstream Site (Site 3a) and the Downstream Site (Site 3b).

23. At times when there is a discharge into the Centre Drain from the Tokomaru WWTP, the Consent Holder must, no less than monthly, collect the following samples and have them analysed for the parameters specified in Condition 25:

a. A representative sample from the WWTP discharge to Centre Drain (Site 1c).

24. At times when there is a discharge flowing into Centre Drain from the Dairy Farm West drain, the Consent Holder must, no less than monthly, collect the following samples and have them analysed for the parameters specified in Condition 25:

a. A sample from the Dairy Farm West drain upstream of the Tokomaru WWTP site (Site 2a); and

b. A sample from the Dairy Farm West upstream of the confluence with Centre Drain (Site 2b).

25. Samples collected in accordance with Condition 22, 23 and 24 must be analysed by an IANZ accredited laboratory (with the exception of field measurements) for the following parameters at the lowest detection limit possible:

26. On a three-monthly basis, the Consent Holder must collect samples from each of the groundwater monitoring bores, Bore 1 (Site 4a) and Bore 2 (Site 4b). The samples collected must be analysed by an IANZ accredited laboratory (with the exception of field measurements) for the following parameters:

a. pH (field measurement)b. Chemical Oxygen Demandc. Total Kjeldahl Nitrogend. Total sCBOD 5

e. sCBOD5

f. Nitrateg. Ammoniacal Nitrogenh. Total Phosphorusi. Dissolved Reactive Phosphorusj. E Coli

ADVICE NOTE: When sampling groundwater it is important to obtain a representative sample of the water in the aquifer and not sample stagnant water that has been sitting within the bore casing. To do this the bore generally needs to be purged of 3 x its volume before taking the water sample.

27. The Consent Holder must provide Manawatū-Whanganui Regional Council with a copy of all monitoring results obtained in accordance with Conditions 22 to 26 within one month of receipt of laboratory results and advise if any breaches of consent conditions have occurred.

Discharge to Air Conditions

28. The Consent Holder must ensure there is no discharge of offensive or objectionable odour beyond the boundary of the property that causes an adverse effect.

ADVICE NOTE: An odour will only be considered objectionable, after a Manawatū-Whanganui Regional Council officer has considered the Frequency, Intensity Duration, Offensive and Location of the odour (i.e. the FIDOL Factors).

29. The Consent Holder must maintain a complaints register for any complaints received as to odour effects including, but not limited to:

a. details of the complaint received; b. wind conditions at the time of complaint; c. activities being undertaken at the time of complaint; andd. actions taken to investigate the complaint and, where there is found to be an offensive or

objectionable odour beyond the property boundary, reasons as to the cause of the odour and actions the Consent Holder will take to prevent a reoccurrence.

Operations and Risk Management Plan

30. Within three months of grant of consent, the Consent Holder must prepare and submit to the Manawatū-Whanganui Regional Council an Operations and Risk Management Plan for the WWTP. The Plan must include, but not be limited to:

a. Roles and responsibilities for the operations and management of the WWTP;b. Actions required to ensure the effective operation of the WWTP, including management of

risks to and achieve compliance with these consent conditions;c. Actions required to manage nuisance pests and wildlife at the site. Proposed management of

nuisance pests and wildlife must be confirmed in consultation with adjoining landowners;d. Measures required to prevent offensive or objectionable odour beyond the property

boundary;e. Actions to be taken in event of any non-compliance with consent conditions including

notification, investigation and remedial works; andf. A maintenance programme for the WWTP including, but not limited to, maintenance of

mechanical equipment (screens, pumps, valves), and plants within the wetland area.

31. The Consent Holder must review the Operations and Risk Management Plan on an annual basis and update the Plan as necessary to ensure it continues to meet the requirements set out in Condition 30. As part of this review, the consent holder must consult with adjoining landowners as to the effectiveness of nuisance wildlife management actions and any changes required to achieve effective management of pest species.

32. Where there are changes made to the Operations and Risk Management Plan as a result of the annual review required under Condition 31, the Consent Holder must provide the Manawatū-Whanganui Regional Council and members of the TWWWP with a copy of the updated Operations and Risk Management Plan within 20 working days of the update being completed.

Annual Report

33. The Consent Holder must provide a report to the Manawatū-Whanganui Regional Council in June every year, commencing June 2020 that includes, but is not necessarily limited to:

a. An assessment against each condition of this consent;b. An interpretation and summary of the monitoring results collected pursuant to this consent;c. An assessment as to the environmental effects associated with the discharge of treated

wastewater from the site;

d. A summary of any non-compliances and / or incidents that have occurred, an explanation for the non-compliances and/or incidents and details of the measures that have been taken to ensure either the same or similar non-compliances and / or incidents do not reoccur;

e. A summary of meetings and consultation with the TWWWP;f. An update on all actions taken towards investigation and assessments required under this

consent; g. Recommendations as to whether or not further improvements/upgrades are required to

ensure on-going compliance with the conditions of consent; andh. Actions taken in the past year to manage pest wildlife species including an assessment of

their effectiveness and outcomes, including details of consultation undertaken with the adjoining landowners as part of the annual review of the Operations and Risk Management Plan

34. The Consent Holder must, on an annual basis, present the report required by condition 33 to the TWWWP at the first Working Party meeting convened following submission of the Report.

Review

35. The Manawatū-Whanganui Regional Council under s128 of the Resource Management Act, may, in July of each year serve notice of its intention to review all conditions of this resource consent for the purpose of reviewing the effectiveness of these conditions in avoiding and mitigating any adverse effects on the environment. The review of conditions must allow for:

a. Deletion or amendments to any conditions of this resource consent to ensure adverse effects are appropriately mitigated; and/or

b. Addition of new conditions as necessary, to avoid, remedy or mitigate any unforeseen adverse effects on the environment; and/or

c. If necessary and appropriate, The adoption of the best practicable options to avoid, remedy or mitigate any adverse effects on the environment.

Duration

36. The resource consent will expire on 30 June 2023.

Consent Attachment 2: Tokomaru Wastewater Working Party

1. GENERAL

This document sets out the terms of reference for the Tokomaru Wastewater Working Party (TWWWP) to enable the Horowhenua District Council (Council) to meet Conditions 13 - 15 of Discharge Consents ATH-2002008648.02 (Water), ATH-2002008649.02 (Wetland), and ATH-2016200987.00 (Air).

Council has sought a five-year term of consent for the Tokomaru Wastewater Treatment Plant (WWTP) discharges in order for improvement and investigation works prior to adopting the planned long-term disposal to land solutions. During the term of consent, the Council will:

Complete works to minimise groundwater entering the treatment plant (lining of oxidation pond);

Undertake investigations and repairs where appropriate to minimise stormwater entering the wastewater reticulation; and

Undertake and complete specific milestones in preparation for the planned long-term sustainable treatment and disposal to land options.

Submitters to the consent process sought a means of effective engagement with the Council during the term of consent in order to have input into the consideration of effects of the discharges and to the selection of a sustainable long-term solution, which has since been confirmed by the Council as a planned long-term sustainable treatment and disposal to land options with contingency disposal to surface water (Centre Drain), to minimise discharge to surface water as far as practicable.

The TWWWP has been established to provide a means for this engagement.

2. MEMBERSHIP

To assist with the functioning of the TWWWP and clarity of recommendations, membership is to comprise of ONE representative (unless specified otherwise) from each of the following:

Horowhenua District Council (HDC)

Manawatū-Whanganui Regional Council [Horizons] (HRC)

Te Roopu Taiao O Ngati Whakatere (NW) – two members

Tānenuiarangi Manawatu Incorporated (TMI) – two members

Tokomaru Village & Community Association – two members

Water & Environmental Care Association (WECA)

Alternative membership of the Group itself must be determined from time to time by the Group, but ultimately at the discretion of the Horowhenua District Council.

The representative selected from each of the above-named parties will support the purpose of the TWWWP and uphold the integrity and intent of the consent conditions.

3. ROLE

The TWWWP role is to:

Observe and review management decisions and monitoring results;

Keep a 'watching brief' on the management of activities at the Tokomaru WWTP; and

Comment on the planned long-term disposal to land design and application process, as well as the ultimate disposal of wastewater from the Tokomaru WWTP.

The TWWWP has the right to:

In accordance with the requirements of the Health and Safety at Work Act 2015 and with the approval of the Council, inspect the site operations on the occasion of group meetings and / or on such other occasions as agreed by the Council.

Be provided by the Council every three months with an email summarising the activities undertaken as part of the agreed work programme under the Tokomaru WWTP discharge consent.

Be provided by the Council with the following documentation:a. Results from the monitoring undertaken in accordance with the consent conditions;b. Annual Monitoring Report prepared in accordance with the consent conditions; andc. The Operation and Risk Management Plan at the time of its formation and at the time of any

review.

Raise with the Council, as necessary, any matters which the TWWWP members believe the Council should address in order to meet the consent conditions.

Have the Council formally acknowledge and consider any TWWWP member(s) written suggestions on possible improvements to or concerns about the operation.

Have the Council incorporate into the Operations and Risk Management Plan the TWWWP views and comments where they are appropriate and practical.

Have the Council notify the Horizons Regional Council Regulatory Manager with issues raised by TWWWP regarding the Operations and Risk Management Plan if the views and comments have not been incorporated and state reasons why.

Within 20 working days, be provided by the Council with notification of any breach in consent conditions that has or may be about to occur.

Notification of any application made by the Council to change or cancel any conditions of this consent.

Be consulted on the preparation of any application for wastewater discharge consent and be provided with an opportunity to comment and provide feedback on the application prior to its lodgement.

4. MEETINGS

The TWWWP is to be convened by the Council and meet at least twice three times per year.

5. FACILITATION

The Council will provide reasonable organisational and administrative support and a place for the group to hold meetings.
