11thSecond Community Meeting with Davie Town Administrator Scheduled - The next Community Meeting hosted by Town of Davie Administrator Gary Shimun is scheduled for Tuesday, May 11, from 7 to 8 p.m. at the Old Davie School located at 6650 Griffin Road in District 2. Democratic Club Keeps Members Informed of Hot IssuesBy DEBBy TEICH

C ooper City’s Bea Schwartz attended her first Democratic Club meeting more than 22 years ago. It was around the same time she met John Gaudiosi, a candidate for County Court Judge. Schwartz agreed to manage his campaign

and helped him get elected. Schwartz stayed active in the group and eventually joined the Davie-Cooper City Democratic Club, where she has been president for the past 13 years. “The club gives us an opportunity to change things and make a difference,” said Schwartz. “We have accomplished so much over the years.”

The Davie-Cooper City Democratic Club was founded 27 years ago. It currently has 40 members who range in age. Membership typically grows during a national campaign or when controversial local issues arise. Most of the members live in the Davie-Cooper City area, although it is not a requirement. All of the members are staunch Democrats interested in helping party members get elected to local, state and national positions.

The group meets the first Thursday of each month, at 7:30 p.m., at the Bamford Multi-purpose facility, 3801 S Pine Island Rd. Meetings are not as structured as some of the other Democratic clubs in the area. A guest speaker is featured at each meeting. Some of the speakers have included Representative Debbie Wasserman

Schultz, Representative Evan Jenne, School Board Member Robin Bartleman, Broward County Supervisor of Elections Brenda C. Snipes and many others. Democratic candidates that are running for office are also recognized and given an opportunity to speak. Laurie Rich Levinson, non-partisan, who is running for

Broward County School Board, District 6, recently spoke to the group.During the meetings, members discuss issues related to

guns, schools, health care and much more. They have an opportunity to express their different points of view

during a question and answer session. According to Schwartz, members enjoy the discussions so much that the guest speakers frequently have to chase them out.

Cheryl Whiteman has been a member since 1992. She got involved after meeting Bea Schwartz at a

phone bank where they helped Bill Clinton get elected the first time. Whiteman still participates in phone banks and door-to-door canvases for every

election. “The club is a great way for Democratic candidates to get exposure and for members to

discuss important issues,” said Whiteman.

Student Artists Capture the Images of the Everglades By DEBBy TEICH

M uch of Broward County is surrounded by canals and waterways which are home to fish, birds, alligators and an abundance of

wildlife. Last month, students were asked to take a close look at their environment and capture the images on paper for the fourth annual “Everglades Eyes: What Children See” art contest, sponsored by the Old Davie School, in partnership with Central Broward Water Control District.

The contest was open to all 4th and 5th grade public and private school students that live within the CBWCD. There were 118 students, from six schools, who submitted work. They expressed themselves in oil, watercolor, pastel, acrylic, mixed media, photography, collage and other mediums.

“The kids are so gifted at depicting the relationship between nature and animals,” said Patti Koch, director of the Old Davie School. “We hope that the contest will help them appreciate their surroundings and understand the importance of protecting the Everglades in the future.”

The artwork included a wide variety of images from the Everglades. In “Big Eyes,” for example, Franchesca Linares of Gloria Dei Lutheran School mixed colors with depth and dimension to illustrate a fish. In “Mother Guards Her Young,” Felipe Lopez of Griffin Elementary School depicted an alligator guarding her nest. In “Pink Walk,” Natalia Rodriguez of St. Mark’s Catholic School used color and perspective to show the water from a bird’s point of view.

The winners, selected by a distinguished panel of judges, were announced at an awards ceremony last month at the Old Davie School Museum. The following were the winners: 1st Place, Felipe Lopez, Griffin Elementary; 2nd Place, Elissa Lara, St. Mark’s Catholic School; 3rd Place, Emily Suero, St. Mark’s Catholic School; Honorable Mention, Coleman Nelson, St. Mark’s Catholic School; Honorable Mention, Natalia Rodriguez, St. Mark’s Catholic School. Each was presented with a United States Savings Bond.

The CBWCD consists of a 45 sq. mile area that includes more than 100 miles of canals, located within six cities and towns, as well as unincorporated areas of Broward County. The idea for the contest was developed in response to an educational program it offers to 4th and 5th classes at public and private schools within the District’s boundaries. Constance Ruppender, outreach coordinator, visits the schools to teach them about the history of the Everglades; the characteristics of wetlands and what they can do to preserve them; how the Everglades watershed functions and what they can do to prevent pollution; jobs in water management and much more.

After most visits, the students send the CBWCD thank you notes, many of which contain drawings. Ruppender said they decided to sponsor the contest to encourage the students to connect what they learn in the classroom to the real world. “Our water management system is one of the best in the world,” said Ruppender. “We must shape the attitudes of the next generation and encourage them to take care of it.”

Indian Ridge’s Hoops for Heart Raises more than $�0,000 By DEBBy TEICH

W hen Regina Lendinara, athletic director, asked a room full of Indian Ridge Middle School students whether they know someone who has high blood pressure; has had a heart attack or has problems associated with heart

disease, most raised their hands. The students were gathered for a pep rally to kick off the school’s Hoops for

Heart fundraising event, sponsored by the enrichment department, with help from the PTA. “Although the students are all aware of heart disease, most think it does not affect them directly,” said Lendinara. “We want to make sure that they understand the importance of having a healthy heart and know how to keep it that way.”

Indian Ridge has always been a top fundraiser in the Jump Rope for Heart and Hoops for Heart programs, sponsored by the American Heart Association to raise money to support lifesaving heart and stroke research. They continue to raise more money each year, even in a difficult economy.

Last year, Sam Torres, computer science teacher, agreed to shave his head if the students raised more than $20,000. They met their goal, placing 2nd in the state and 7th in the nation for money raised. Students watched on the school’s closed circuit television as Torres shaved the pony tail he

had worn for 20 years. He donated it to Locks of Love, a non-profit organization that provides hairpieces to financially disadvantaged children who are suffering from long-term medical hair loss from any diagnosis.

This year, the students had six weeks to raise funds from family, friends and the community. Once again, they surpassed prior efforts, raising $20,343. Four students raised more than $150 - Joseph DiSalvo ($300), Evan Macak ($200), Reesa Lawrence ($200) and Abigail Freund ($180).

Students who raised money were permitted to skip their two elective classes on March 24 for the Hoops for Heart event. They played basketball, jumped rope and participated in other activities that kept their heart rates elevated. “The idea was to come up with fun activities that would keep them moving and help out a good cause,” said Lendinara.

Lendinara says that this year’s highlight was the dunk tank. For every $5 students raised, they were given a ticket to dunk a teacher. One teacher from

each academic team participated, in addition to the principal, Frank Zagari. The school’s enrichment department is already searching for ways to challenge the students again next year.

having a healthy heart and know how to keep it that way,”

S tudent art work from Nova Dwight D. Eisenhower Elementary School will be on display in an exhibit entitled “Art and Our Schools: Our Marine Life, Our

World”. The exhibit is a fundraiser with proceeds benefitting the Nova Art Fund. The public is invited to view the art work during the opening reception on Friday, May 7th from 3:30 p.m. to 5:30 p.m. at The Art and Frame Shop, 6983 Stirling Road, Davie.

Nova Eisenhower’s art teacher Kristina Caro and gallery curator William Bock are delighted to be able to exhibit the children’s creative and inspiring work. This marks their sixth annual show. The effort of Nova principal Ms. Lesser and assistant principal Mr. Jenkins to create working partnerships between the school and the business community have been instrumental in bringing about these exhibits.

“The Children’s art does justice to the walls of any art gallery,” commented gallery owner and artist William Bock. He is active in his support of Nova Eisenhower Elementary School where his daughter attends 5th grade. In his gallery studio William teaches painting classes for children

ages 5 – 16, on Tuesdays from 5:00 – 6:30 p.m.Born in Chicago, Bock began his professional career

at Indiana University, followed by an apprenticeship at the Johnson Atelier Technical Institute and School of Sculpture in New Jersey. He received his Master of Fine Arts degree at the Maryland Institute College of Art in Baltimore, MD in 1987. As the founder of Our Oceans, Our Children, Our Future, Bock helps promote environmental awareness through art education. He has exhibited extensively throughout the U.S. and has participated in several museum exhibitions, winning numerous awards for his painting.

“The images on display show an exceptional variety of creativity, imagination and talent,” said Bock. “The student’s awareness of environmental concerns is evident in much of their work.”

High School Band & Color Guard Show Guaranteed To Make Audience Want More

T he award winning Cooper City High School Sound of Pride Band and Color Guard proudly presents ENCORE! A musical spectacle of sound and action presented at the Cooper City High School Auditorium on Friday and Saturday,

May 21 and 22 at 8:00 PM and on Saturday, May 21 at 2:00 PM. The show will encompass a broad range of musical styles, from marching band revues to symphonic classics to small group ensembles.

The Cooper City High School Band is the recipient of many major awards, including the prestigious Otto J. Mr. Schletter has many years of experience as a musical educator, Drum Corps member and coach, and Broadway performer.

Sagemont Students Take the StageBy STACEy BOMSER

F or students at The Sagemont School, it’s a compliment to be called “dramatic.” The school’s growing arts department has produced three shows this Spring, one in each division.

Middle School students are busy rehearsing for their performance of J.M. Barrie’s “Peter Pan.” Three performances are scheduled for May 18, 19 and 20 at the Rose and Alfred Miniaci Performing Arts Center on the Nova Southeastern University campus.

That professional venue was the site of the Upper School’s recent production of “The Mystery of Edwin Drood” by Rupert Holmes. The musical comedy is an adaptation of the last novel written by Charles Dickens before his death. He did not finish the work. The play is traditionally performed with multiple endings and the audience participates in picking the outcome. To prepare for their performance, members of the Sagemont High School Drama Club rehearsed a combination of endings and performed several during the course of the musical’s four-day run.

“By having the audience be such a driving force in the outcome of the plot, we had to go back to one of the roots of acting which is improvisation,” explains 11th grader Chris Merlino. “This was a challenge because of the element of the unknown. We couldn’t rely just on the script.”

Even Sagemont’s youngest students got a taste of the limelight this season. The

Lower School performed two sold-out shows of “Disney’s 101 Dalmatians, Kids.” Fifth grader Taylor Shear commanded the stage as Cruella de Vil, but it was the puppies that stole the show, as well as the creatively-costumed cast of Scotties, Chihuahuas, Boxers and Poodles that came to their rescue.

Director Irene Perez, who is also a fourth teacher at the school, says she was very proud of the young actors’ commitment and talent. “I was amazed at how quickly the children learned their lines, the songs and the dances.”

“I thought I would be so nervous, but when the curtain opened, I forget all about that!” shares fourth grader Sage Morris, who made her stage debut in this show.

In addition to theater, Sagemont boasts a successful thespian program. The Sagemont Thespian Troupe returned from April’s annual State Thespian Competition with two Superior rankings and three Excellent rankings. The school was allowed to enter only five of its nine pieces that qualified at Districts.

Tickets are now on sale for The Sagemont Middle School production of J. M. Barrie’s “Peter Pan.” Three performances are scheduled for May 18, 19, and 20 at 7:00pm at the Rose and Alfred Miniaci Performing Arts Center. Community members can call the theater for ticket information.

Knee Problems in Active PeopleBy ELLEN LATHAM, MS

S ometimes called Runners Knee, this painful and sometimes debilitating ailment of the knee occurs in one quarter of all active people. If you do an activity that bends the knee

this can be an issue. The exact cause is still a mystery. In November 2009 The American Journal Of Sports Medicine

followed 1,600 midshipmen from the U.S. Naval Academy for 2.5 years. Each underwent movement analysis during jumping, a lower body strength test and postural assessments. By the end of the study 24 women and 16 men had developed knee problems.

The researchers identified several things that were associated with the condition. Weak hamstrings and quads were a big factor. Also, a smaller knee bend angle was a factor.

Overall the people who developed knee issues did not bend their knees

when running or jumping then those who did not develop the problem. So the area between their kneecap and their thigh bone was smaller and much more pressure was applied. As an instructor I look for knees moving in front of big toe during the

squat, collapsed arches while landing from a jump and barely a bend in the knee when they land from a jump. I know this person has a good chance of developing a knee problem in the future.

Finally — A New Weight Loss Approach For Mother’s DayBy GABRIELA ROSENTHAL, MS

H ow many times during the day do you stop to consider the important role mothers play in society? A mother can influence the lives of numerous others on a daily basis

including their children, spouse, family, friends and teachers. According to the Merriam-Webster’s Dictionary, the word mother is defined as, “a woman who has given birth to a child”. As I am the proud working mother of four great kids, I understand the pressure and importance of being the perfect role model for our

children. As we head into the month of May we pause to reflect and appreciate the upcoming holiday of Mother’s Day. As women, we sometimes lose sight of just how much power we can actually wield when we want to. In between caring for our family, friends and financial needs we often take ourselves for granted and place everyone else’s needs in front of our own. I proclaim that we no longer have to take a back seat to the needs of others. This month I am putting forth a challenge to all women. I want each and every one of you to start taking better care of yourself. Little do you know, but by putting yourself first you will give your children an invaluable gift.

Several years ago I tipped the scale at 260 pounds. At the time, I was completely focused on the wants and needs of my children; I never realized how much undo stress I was placing upon myself, my children and my husband. Considering where I was at during that stage in my life made me realize the following truth. It is nearly impossible for a size 24 woman to maintain an adequate amount of energy, stamina and discipline to be in charge and take control over any situation that may arise from her children. Personally, I was always tired and suffering from relentless back and hip pain. Migraine, headaches and asthma attacks became a routine part of my week. At the onset of my migraine pain, the smallest amount of sound or light made me nauseous. The slightest movement would send my entire body into a panic in anticipation of the discomfort about to befall me. At times, things got so bad for me that my family no longer socialized with any of our friends, and we seldom went outside to do activities because of the embarrassment I felt and the insecurities I carried with me everywhere I went. The thought of going out on a date with my husband would never enter my mind, inevitably resulting in the resentment I felt he held toward me. I was scared and felt very alone in the world. I was unsure what type of future my family, and I were inheriting from my downward spiral of unhappiness.

In reality, what it took was a traumatic experience and 45 seconds of my life to fully understand that I had to change. I could not continue this way any longer. One day, I was driving home from my girlfriend’s house with my four children and I suffered a severe asthma attack. As I gasped for my next breath of air, I reached into my purse and realized I could not find my inhaler. I started to panic, and I pulled over to call my husband on the phone. I struggled to tell him that I could not breathe as it felt like I was suffocating to death. I told him where we were pulled over, and he raced to the scene with my inhaler in hand. After using the inhaler my lungs began to relax and my breathing became normal again. As I pulled into my driveway, I

realized how lucky I was to be home again with my family. This was the moment in my life when I understood how out of control my life had become and how frequent my panic attacks were becoming.

The next day my husband brought me a picture of myself he had just downloaded from the computer. He asked me to keep the picture with me as a reminder of what I was doing to myself. The picture and his words helped me understand the sad and painful truth. The person he had married was now trapped and living inside a shell of a body where it did not belong. It was time to unzip the costume I had been wearing for so long and allow the real Gabriela to return. My personal challenge

to all women is to acknowledge the difficulties in our lives and put ourselves first. Over time I struggled to lose my excess weight but soon after, I immersed myself in the study of bariatric medicine with Elisabeth Cohn-Gelwasser, MD. Today, the knowledge I have gained and the personal experience I possess allows me to successfully teach other people the proper way to get healthy. This can be accomplished by understanding that we all have the inner strength to take care of ourselves and the loved ones in our lives. All that is needed is to align ourselves with the right team to feel empowered. To accomplish this

task I surrounded myself with the leading experts in the weight loss field. Here are a few recommendations I would like to share with you in order to put yourself first and take back control of your life.

Metabolism is a word that everyone talks about. We often times consider what it really means and how it effects our daily lives. Metabolism is the amount of energy (calories) that your body burns while at rest. Your Body Mass Index (BMI) has a direct connection with muscles in your body and is related to your pattern of eating. Our bodies make a natural physiological shift starting in our mid 20’s for women, with men experiencing this shift to a lesser degree. We tend to lose about 10-15 percent of lean body mass every decade. We lose approximately 7 pounds of lean muscle tissue and gain 15 pounds of body fat every decade. Obviously this changes the shape of our body as well as slowing down the way we burn the food we eat. In a woman’s mid 40’s, we may have lost 15 pounds of muscle tissue and replaced it with 30 pounds of fat. Routinely, the scales will tell us that we have gained 15 pounds; however, the situation is actually much worse underneath the surface. Muscle tissue is precious. It is the part of the body that drives that much needed metabolism and its loss leads to a drain of vitality, vigor and energy. Unfortunately, the situation gets worse for women after menopause. Due to dramatic changes in hormones the rate of muscle tissue loss doubles. The risk of osteoporosis greatly increases and bone loss occurs. On a positive note, we have learned that these unhealthy changes are the result of not enough muscle building and maintaining activity. This reality can be altered and reversed by simply putting a proper exercise program in place. Make sure your routine consists of strength training and remember to always eat properly. Keep in mind; it is a well known fact that the body requires less energy as we get on in age.

Unfortunately, after the study the press had grouped all hormones to be alike - synthetic and bio-identical hormones making the public at large believe all hormones were associated with the same negative outcomes studied in the WHI: Premarin and Prempro (synthetic hormones). This conclusion is simply not true. Let me explain…

Fundamental PrinciplesSynthetic vs. Bio-Identical Hormones: Bio-Identical Hormones are usually

derived from plant sources and their chemical structure is biologically identical to the hormones we have in our bodies. The incidence of having a reaction from these Bio-identical Hormones is extremely low or non-existent due to their identical chemical makeup that we have in our own bodies. However, this is unlike their synthetic counterparts the most common being Premarin & Prempro. Premarin (synthetic oral conjugated estrogen) which is routinely prescribed to combat the symptoms of menopause is derived from a pregnant horse’s urine. Premarin is associated with unfavorable side effects to include an increased incidence in breast cancer. Prempro is also derived from a pregnant horses’ urine and combined with progestin which is the most commonly prescribed form of combined HRT that has been shown to be unsafe over the medium term (5 years) in the WHI trial substantially increasing one’s risk of cardiovascular and cerbrovascular disease, breast and uterine cancer and blood clots.

On the other hand bio-identical progesterone unlike progestin has been demonstrated in hundreds of medical journals to have positive natural influences on the body such as: synergy with Estradiol. Progesterone protects the uterine lining from overgrowth/ carcinogenesis caused by estrogen. Progesterone has favorable cardiovascular effects, anti-inflammatory, natural diuretic and bone protection. Bio-Identical Estradiol also has positive cardiac effects to include: vasodilatation, reduction of vascular proliferation and inflammatory response and decreased sympathetic activity which is imperative to maintaining a healthy heart considering cardiovascular disease is the number cause of death in women.

The Truth About Being Overweight

C ardiovascular disease is a leading cause of death in our nation. Over 70% of the US population is overweight and over 30% is considered obese. The combination of obesity

and sedentary lifestyle is now the number 2 preventable cause of cardiovascular disease, second only to smoking. Many believe that it will soon become the number 1 preventable cause of heart disease. Additionally, certain cancers have a higher incidence in overweight people. Being overweight also contributes to a variety

of other medical conditions including adult onset/type-2 diabetes mellitus, high blood pressure, hyperlidemia (elevated cholesterol and triglycerides), sleep apnea, gastroesophageal reflux disease, and degenerative arthritis, just to name a few.

These illnesses adversely affect the quality of our lives as well as drain our personal finances. Medical illness negatively impacts our personal and professional productivity and further depletes our economy because these conditions increase absenteeism and decrease bottom line profits. Health insurance costs keep going up.

Many of the above conditions may be reversed or prevented if you are able to achieve a healthy weight. Despite this, often our health insurance does NOT cover weight loss programs, medically supervised or not. Many employers recognize this huge financial drain that is attributable to increased health insurance costs, as well as diminished employee productivity, and have become proactive by either funding weight loss and wellness programs for their employees directly or by insisting that their health insurance company provide an effective weight loss and wellness program to their employees.

If you are overweight and have struggled to lose weight you are well aware of how difficult it is to lose pounds. Many of us have tried a variety of ‘weight loss programs’ and may have been able to achieve some success, but in all likelihood if you are still reading this, you have not been able to ‘keep it off’. You are not alone; most people share your experience. In fact, the national success rate for sustained weight loss is estimated by some to be less than 10% over time.

Most people inaccurately believe or accept that as one gets older it is natural to get heavier. This makes no empiric sense. As you get older, bone and muscle mass tend to decrease. Why would anyone assume it is natural to gain weight with age as the structures that support our weight are less capable of doing just that? This is one reason why many of us experience the aches and pains of ’getting older’ as we also gain weight. THIS DOES NOT HAVE TO BE SO.

If you think back to your last trip to Disney World, you were able to get a glimpse of middle aged Americans who are typically overweight, in contrast to Europeans and elder Asians, who typically are not. What makes us different? Certainly genetics does in part but it is reported that as Asians move to the USA and adopt a Western lifestyle, their weight increases and so do the illnesses that are associated with a Western lifestyle. If they move back to their native country, their weight comes off. Furthermore, as our Western lifestyle is adopted in China, obesity is increasing and so are the illnesses that are associated with it and are endemic in our country.

These facts provide us with good insight as to what has led us to gain weight and keep us overweight. Only when we begin to understand the root cause of our country’s weight problem and what keeps us there are we able to come up with a true and lasting solution to this problem. In the coming issues I will explain this in terms that are clear and make sense, so you can see how we, as a society and as individuals, have gotten to where we are today, and how we can implement life changing strategies to gain control over food as opposed to food having control over us! You might be surprised, and you will be empowered!

New Collaboration Means Added Comfort and Convenience for Patients of Dr. Gelman

F or years Dr. Kenneth Gelman has taken great pride in providing patients at Infertility and Reproductive Medicine of South Broward with the highest level of service and personalized care. Through his new collaboration with

the prestigious South Florida Institute for Reproductive Medicine he is raising the bar even higher.

Beginning this month, the Cooper City-based practice will be able to offer in-house egg retrievals to all couples undergoing In Vitro Fertilization (IVF). “I am pleased to announce that Dr. Ellen Wood, a reproductive endocrinology and infertility specialist, will be performing this procedure in our new state-of-the-art surgical suite,” states Dr. Gelman, Medical Director of Infertility and Reproductive Medicine of South Broward. “She has extensive experience and a superb reputation. I am confident she will become a valued member of our team.”

In the past, IVF patients had to visit an off-site surgical center to complete the egg extraction process. Now, all of Dr. Gelman’s patients will be able to undergo this procedure in the comfort and convenience of his office. Plus, because the retrieval will now be performed in-house, it will be billed as part of the IVF treatment which will save patients money.

IVF is just one of the many procedures offered by Dr. Gelman. His practice provides a full range of infertility services from simple drug therapies to assisted reproductive technologies such as IVF and Intrauterine Insemination (IUI).

Despite the high-tech nature of this field, Dr. Gelman prides himself on maintaining a personalized, boutique-style practice. He sees all patients and performs all procedures, with the exception of the egg retrieval.

S troke is the third leading cause of death following heart disease and cancer. Every year, more than 795,000 Americans suffer from a new or recurrent stroke episode – that means that a stroke occurs every 40 seconds. Americans

will pay close to $70 billion in stroke-related medical costs in this year alone.

Q: What is a stroke?

A: A stroke or “brain attack” is damage to the brain when blood supply to part of the brain is reduced or completely stopped. Brain cells deprived of blood die and can no longer function because they stop getting oxygen and nutrients they need to function.

Q: What are signs or symptoms of a stroke?

A: Sudden weakness or numbness of the face, arm or legs; sudden confusion, trouble speaking or understanding; sudden trouble seeing in one or both eyes; trouble walking, dizziness, loss of balance or coordination and sudden, severe headaches with no known cause.

Q: What You Can Do To Prevent a Stroke?

I want to share with you a most gorgeous design I recently did for a fun couple. My clients have style and classy taste. Their décor is eclectic and they wanted a softer feel in their

main dining room, minus fuss. Their request was to go neutral but not bland and to use fabric but keep it light on the eyes. The end result was a cozy, elegant retreat to host dinner parties.

I put operable shades made from a soft semi-sheer inside the window frame. The soft folds on the shades follow the folds on the valance and create harmony. For a splash of color, I introduced the merlot in the layering of the side panels. These

panels serve to conceal the walls in between the windows and create continuity in the design. The panels are pouffed for added interest. When designing panels be creative: tied back, hang straight or pouffed as in this case. Embellish by adding trim or banding.

The crowning element is the layered valance which re-introduces the splash of merlot color. The soft folds of the valance flow with the soft folds repeated throughout the overall design. Note how well proportioned the valance is with respect to the height of the windows and the scale of the room. The true beauty of any design is apparent only when the elements of color, pattern, shape and scale work harmoniously together.

How To Avoid Deficiency Judgments After Foreclosure, Deed in Lieu or Short SaleBy OMAR J. ARCIA, ESq., FORECLOSURE DEFENSE AND BANKRUPTCy PROTECTION ATTORNEy

A s terrible as it may seem to lose your home through a foreclosure, most people believe that after the foreclosure, their biggest financial headache is behind them. However, former homeowners may still be on the hook if

there’s a difference between what they owed on the mortgage and what the bank sold the house at the foreclosure auction. This is called a “deficiency judgment.” Deficiency judgments are ticking time bombs that can explode years after borrowers lose their homes.

A lender also has the right to seek a deficiency judgment against homeowners who convinced their bank to approve a short sale and even in cases where the bank takes back the property through a deed in lieu of foreclosure. Releasing title does not necessarily end the debt. A mortgage has two parts: a pledge of collateral (represented by the home), and a promise to pay the loan. Lenders may release property liens to facilitate short sales without releasing borrowers from their obligations to pay.

Lenders or collection agencies may wait until debtors have recovered financially before seeking a deficiency judgment. In Florida, the bank can wait up to 5 years to file. Once the court grants a deficiency judgment, the lender has 20 years to collect it. Moreover, the lender can request your financial records, garnish your wages, repossess your vehicles, and even freeze your bank accounts!

In order to short-circuit lenders’ attempts to seek a deficiency judgment in the future, it is imperative that after the home is sold at foreclosure auction, the former homeowner immediately file for bankruptcy protection. Since the deficiency judgment would be considered an unsecured debt, it will be forever discharged through the bankruptcy proceeding and the bank could never collect it. In “short sale” or deed in lieu scenarios, most lenders are willing to release the deficiency judgment amount. However, many borrowers may not be aware that they have to ask for such a release. If you are pursuing a short sale or a deed in lieu of foreclosure, be sure to ask the bank to release you from any further obligation under the mortgage. If the bank refuses, bankruptcy proceedings can also avoid any liability after a short sale or return of your property to the bank through a deed in lieu.

What you Should Know About MediationBy EVAN H. BARON, PA

M any couples are choosing to attend mediation rather than seek the

representation of an attorney when considering a divorce. So rather than speaking to an attorney to learn about the law, they decide to attend a mediation session, without representation; in the hopes of settling their case quickly and

painlessly. In some cases this could be a good idea, since it probably would be less costly. However, as the saying goes:” penny wise and pound foolish”. You may be successful in saving costs and attorney’s fees, but you may in turn be giving up more than you should. A signed mediation settlement agreement is a binding contract between the parties. If in fact you change your mind about the distribution of property after the agreement is signed, you will generally be “stuck” with your decision. It will not be a defense that

“I didn’t have an attorney”. In addition, the mediator, although usually an attorney, is not playing the role of an attorney and therefore cannot give either party legal advice. Basically you will be on your own.

I am not suggesting that mediation is always the wrong decision. In fact parties who cannot reach a settlement on their own, even when represented by attorney’s, must attend mediation prior to a final hearing being set. So mediation can be a very

successful tool, provided you know the law. If you are aware of what you are either entitled to or what you must give up, then a fair and equitable settlement can be reached. If you enter mediation without any idea of how the law is structured, you run the risk of reaching an unfair agreement.

Perhaps the most important consideration is choosing the correct mediator. Mediators are trained and licensed. I find it very important when hiring a mediator, to make sure his/her personality will be favorable for my client. Each mediator has a different style in the way they approach a case.

Mediators generally charge from $150 to $250 an hour for their time. Most mediations last at least 4 to 5 hours, although some can last a full day. Anything discussed in mediation is confidential and therefore cannot be discussed after the mediation concludes. This is to promote the exchange of settlement offers without the fear that these offers will be used against you, should the mediation not be successful. A successful Mediator will settle between 80 and 90% of their mediations. Those are obviously very good odds for success.

My best advice; go to see an attorney to learn about you rights before going blindly into a mediation. Remember, the agreement you sign can change your life forever!

A s a Real Estate agent for over twenty-six years in South Broward, I find it exciting that I never know what type of day I am going to encounter. Lately, I am baffled regarding the

low inventory in the –$300,000 single-family-home price range. Showing property has become quite a challenge – especially

for the buyers looking in the “under $300,000” price range. If a property is well-maintained, is not a short sale, and is not a

foreclosure, it is a rare treasure. In Davie, there are 45 homes for sale listed under $300,000. Of those 45 homes,

17 are short sales, 6 are REOs, and 22 are non-short sale and non-REO. In Cooper City, there are 62 homes for sale listed under $300,000. Of those 62 homes, 23 are short sales, 7 are REOs, and 32 are non-short sale and non-REO.

Since the first-time homebuyer tax credit ended on April 30, 2010, this does not leave a lot of inventory in which to choose.

Economics 101: Lower inventory = Higher prices. Newsflash: Interest rates are on the rise because the Federal Reserve’s Mortgage

Backed Security buying program is coming to an end. And the resulting volatility for home loan rates that has already begun.

“The Fed did what they set out to do - purchasing $1.25 Trillion in Mortgage Backed Securities, and succeeding in their plan to lower home loan rates and help stabilize the housing sector. And even though they stretched out the length of the program slightly - in order to soften the impact of the end of the program - the training wheels are now off, the safety net is gone, and home loan rates have already

moved higher. In fact - as the Fed will now gradually become a seller of their massive holdings of Mortgage Backed Securities - rates are very likely to continue to move higher still.” MMG Weekly, April 2010.

Therefore, if you have been contemplating selling, you are not in a short-sale or foreclosure situation, and your home is valued at $300,000 or below, you are a hot commodity. With low inventory of non-short sale and non-REO properties, the ending of the new homebuyer’s $8000 tax credit, and the rise in interest rates, this may be your best opportunity to maximize your net proceeds on your existing property and move up to a more desirable residence while interest rates and home prices are historically low. If you are selling a house today that is not a

short sale it must be in good condition and be priced well to be sold in a reasonable amount of time. On average, homes that are priced right and show well are selling within 30 days or less. “Our most recent sales have all sold very quickly, including short sales.” says Bettina.

The New Short Sale ConfusionLast month on April 5th the

new HAFA (Home Alternatives to Foreclosure Act) took effect. There are some great benefits to this program for the homeowner requiring a short sale. If you qualify you can get up to $3000.00 moving money at closing. Your first and second mortgage holders must agree not to pursue a deficiency judgment and you can get an approved price before you list the house making the process much faster. There is a lot of confusion about this program and it is important to have proper information in this process. The Old Short Sale Is Still Available

If for any reason you do not qualify for the new HAFA short sale program. Do not despair. You can still submit a short sale request. Banks will still entertain a short sale under the old guidelines. A homeowner may not be able to get all the benefit of a HAFA short sale but can still sell the house with a short sale. Each bank has its own guidelines and some are not even entertaining HAFA. New Reality Of Short Sales. Do Not Be Afraid.In the last year many banks have streamlined the short sale process and made it

The Swim Academy at Weston Specializes in Water Safety

F or the past 15 years, The Swim Academy has been successfully teaching infants, young children and teens water safety education and survival skills. With multiple locations throughout Broward and Palm Beach counties,

including one right here in Weston, now is the time to enroll your child in The Swim Academy’s nationally-recognized learn-to-swim program.

The Swim Academy’s unique methods are designed to enable children at a very young age to master basic swimming and survival skills. Owner and Director of Program Development, Marcella Miciano, together with Owner and Director of the Swim Academy in Boynton, Gayle Frechette, share their strong swimming backgrounds and love of teaching to develop this successful program.

“Our goal is to teach your child to enjoy the water and to react safely in any emergency,” explains Marcella Miciano, who directs The Swim Academy at Weston, which is located at The Sagemont School’s aquatic complex.

The Swim Academy works with children from six-months-old and up. “The prime age to start babies is between eight and fourteen months of age,” states Miciano. “We have found that at this age the majority of children are very comfortable in the water and strong enough to begin learning basic water safety survival skills.”

These skills include how to hold their breath, roll onto their back and float, and kick to or hold the wall. According to Miciano, “We teach children to save themselves. We give them the skills necessary to get out of the water or stay afloat until help arrives.”

The basic water safety survival skills are all taught as private lessons. Students work one-on-one with an instructor. Instructors at The Swim Academy have extensive training working with young children, including American Red Cross lifeguard certification and Swim America instructional coaching. “Many of our instructors are moms themselves or have worked with kids as teachers, coaches or counselors, so they have experience working with children and can build a loving and trusting relationship during the one-on-one lessons,” explains Miciano.

Once a child has learned the basic water safety skills, they may advance to group lessons to learn beginner stroke techniques and endurance while still reinforcing the

important safety skills. Students progress through four group levels as they learn freestyle, back, breast, and advance strokes.

Miciano points out that even though the preschool and school-age children can participate in group lessons, based on a preliminary swim evaluation, they are still receiving plenty of personal attention. “Preschool classes have no more than three children in a group. Four years and older have no more than five for beginner levels and eight at the pre-team swim level per class.”

The Swim Academy believes swimming is a family affair. Although parents do not go in the water during the lesson, they are encouraged to stay close by to watch the important skills being introduced and to reinforce these at home.

“Every other session we have a ‘Teach the Parents’ class,” says Miciano. “We invite parents into the pool with their child to teach them how to practice the skills their child has been learning. We want parents to be educated, comfortable and confident working in the water with their child.”

More advanced swimmers can join The Swim Academy’s swim clubs. “This is an excellent way for children to work on their swimming strokes in a fun, ‘less-competitive’ way,” shares Miciano, noting that swimmers may take part in developmental swim meets with other teams in the area or sister sites. “Our team is ideal for kids who love swimming but need help with their technique, confidence and endurance. Our coaches actually get in the water with the kids and work with them.”

“Swim lessons are a key component in drowning prevention so ‘get in the swim now’ to make sure the summer will be fun and safe!” says Miciano.

C aring for an aging parent or elderly spouse can present difficult challenges. Many turn to assisted

living facilities, like Azalea Gardens, to help bridge the gap between independent living and nursing homes.

The curriculums are designed by physical therapists and registered occupational therapists and led by a trained motivator. Many of the activities take place outdoors in the gazebo and often include professional entertainers like musicians and comedians. Residents get daily exercise to help them improve their circulation and range of motion. They also play games like Trivial Pursuit to help them sharpen their minds.

The residential suites are available in several different layouts. Each comes with custom furniture and drapery; built in closet organizers; wood vinyl flooring and flat panel televisions. Some residents choose to bring some of their own possessions to remind them of home. Dear Friend,

Iwant to give credit where credit is due. So, perhaps a confession can help clear the air so there’s no misunderstanding.

Before I talk about my confession, though, let me say a few other things first.

Let me start by explaining the photo in this letter. You know, when I meet people in town they usually say, “Oh, yeah, I know you, you’re Dr. Rick. I’ve seen your ad with that picture of you and your family.” Well, I’m the guy on the right.

Twenty years ago something happened to me that changed my life forever. I was a junior in high school and I started getting migraines. I had suffered from intense headaches since childhood. Over the years, I consulted many medical doctors, and specialists. I went through all kinds of tests, MRIs, and treatments. I tried every drug in the market; our medicine cabinet looked like a hospital’s infirmary. And still, nothing helped. But there’s more…

A friend of mine convinced me to give a chiropractor a try. The chiropractor examined me, took X-rays, and then “adjusted” my spine. The adjustment did not hurt; it actually felt good.
