I. INTRODUCTION

A. BACKGROUND

1. Government of Madhya Pradesh (GoMP) with a sector project loan funding from Asian

Development Bank (ADB) has proposed to implement Madhya Pradesh Urban Services

Improvement Project (MPUSIP), herein after referred as ‘the Project’. Madhya Pradesh

Urban Development Company Limited (MPUDC) shall be the Implementing Agency (IA)

and the State Urban Development and Housing Department (UDHD) shall be the executing

agency for the Project. A project management unit (PMU) created under MPUDC is

implementing MPUSIP.

2. MPUSIP’s physical components include (a) improvements to water in 64 project towns;

and (b) sewage and storm water collection and treatment services proposed in two (2)

identified towns (Khajuraho, and Rajnagar).The project also includes an institutional

strengthening component and a project management and administrative support

component.

3. The Indigenous Peoples Planning Framework (IPPF) for MPUSIP outlines the objectives, policy principles and procedures for compensation and other assistance measures for tribal people who may be displaced/ affected due to project implementation. A detailed description of compensation measures and assistance is provided in the entitlement

matrix..

4. Need of the Sub-project: It is observed that Nagar Parishad is somehow able to supply

only 0.46 MLD water to people of town with the help of 4 tube wells, 30 hand pumps and

1 open wells. There is no proper water supply infrastructure like treatment plant in the

town, also 100% distribution network are not available in the town. Water from the

existing sources like tube wells and open wells are directly supplied to existing OHT.

Around 6 Km of distribution network is being laid down around year 2000 and leads to a

water loss of approximately more than 45%. Sometimes chlorine / bleaching power is

being used for the purpose of treatment. Due to the regular extraction of water, ground

level of water is going down and down. Present ground water level in the Boda town is

approximately 700 feet below the ground level. Since 70 HP pumps are installed in 4 tube

wells, electricity consumption is also very high.

B. PROJECT DESCRIPTION

5. The salient features of the subproject are as below:

• Provision for supply of 1.5 MLD raw water from Kunwar Chain Sagar dam up to WTP for

Boda town.

• Submersible Pumps to be installed on Floating Barge / Contoon. This floating Barge /

Contoon will float on the water in Kunwar Chain Sagar Dam.

• Design, supply, construction, installation, testing, commissioning of 1.5 MLD WTP at

Khasra No – 811/1

• Reconditioning of existing 300 KL OHT and 500 KL OHT in new scheme.

• Laying of Raw Water pumping/ Gravity main from Kunwar Chain Sagar Dam to WTP of

length 12.8 KM

• Lay of clear water feeder main from WTP to OHT of total length 200 M

• Laying of distribution network of total length 9672 M

6. The main objectives of the project are as follows:

• Supplying pure drinking water.

• Promote sustainable measures to increase potable water supply to the population.

• Water supply through future sustainable source developments.

• Water supply through improvements of safe yield of existing water sources.

• Water supply through improvements to water treatment works.

• Drinking water supply contributes towards a sustainable regional development.

• To improve the current state of the water cycle of Boda through improvements in the

separate components of the water supply system in investment program.

C. SCOPE OF THIS REPORT

7. This land acquisition and resettlement due diligence report is prepared for the proposed

Water Supply package for Boda Municipal Parishad, dist. Rajgarh under which

Construction of water treatment plants, new pipe laying or pipe replacement (usually along

public roads). The proposed subproject will focus on metered water supply for domestic,

institutional and commercial users, including water resource identification and treatment,

water storage tanks, distribution pipes and metered connections to each household in the

towns covering a population of 11100 in Boda (population as in 2018) and estimated

population on which it is designed for the year 2048 is 16000. All the municipal wards of

the town are covered in the project.

8. A due diligence process was conducted to examine the land acquisition and resettlement

issues in detail, in line with ADB SPS 2009. This report describes the findings and

provides copies of relevant documents, resolutions, minutes of meetings and photographs.

This land acquisition and resettlement due diligence report needs to be read along with the

Resettlement Framework prepared for MPUSIP.

9. Upon project implementation, the Social Safeguards Personnel at PMU, MPUDC will be

required to undertake a review of this due diligence report, prepare a confirmation letter or

report documenting any modifications for the subproject and submit to ADB; and receive a

'no objection' confirmation from ADB prior to start of construction in the subproject.

II. POLICY FRAMEORK, AND INTITLEMENTS

10. The Resettlement Framework (RF) prepared for MPUSIP sets out the objectives,

principles, eligibility criteria and entitlements for APs, based on ADB SPS, 2009 and

LARR 2013 as well as national and state laws for protection of street vendors. Until

recently, all activities related to rehabilitation and resettlement in the State of MP had been

based on the Madhya Pradesh Resettlement and Rehabilitation Policy, 2002 (MPRR) and

National Rehabilitation and Resettlement Policy, 2007 (NRRP-2007). GoMP adopted

LARR 2013 on 3rd October,

IV. FIELD WORK AND PUBLIC CONSULTATION

13. The Resettlement Plan was prepared in consultation with stakeholders including affected

persons, beneficiaries/local people, and ULB officials. Consultations and focus group

discussions (FGDs) were conducted to seek feedback from local people and other important

stakeholders on the proposed development interventions, perceived impacts and mitigation

measures and their participation.

A. Outline of Fieldwork

14. During the visit, a field inspection of proposed subproject facility locations and pipeline

alignments that had been identified was undertaken. These included field visit to the

identified sites and alignments and stakeholder consultations. The entire land requirement for

the proposed subproject component will be fulfilled by government lands. The details of

selected lands for subproject components are given in the Appendix-1

B. Field work Report

• We met the ULB Officials, Public Representatives, Stake Holder and Prominent People

of Boda Town. A List of officials from whom details of the town for preparation of

water supply scheme is collected during site visit. Held various discussions during the

meeting.

• During the meeting and discussion, we have gathered the present situation of water

supply in the town and the n requirement of the stack holder. Based on present water

supply arrangements and gaps arrives are well documented.

• With the ULB Authorities, we visited all the possible water supply sources and

identified locations for all other the components of water supply scheme.

• We have studied the all the options of possible water supply source, its dependability,

quality assurance of source available and the distance from the town.

• Water from the selected source was collected and tested from the Laboratory of Bhopal

Municipal Corporation Laboratory, Bhopal. Also test report is obtained for designing

purpose.

• We have ensured the water security from the concerned department like WRD etc such

that best chosen water source is made available to ULB for the purpose of water supply

scheme.

• We have contacted revenue authorities to ensure the land acquisition, secured in the

ownership of ULB or Revenue Department Govt. of Madhya Pradesh for WTP and

Service Reservoirs.

• After getting all the required data for the preparation of DPR, we have mobilized the

survey team for the survey work. Focusing road survey for water supply distribution

system. Based on elevation differences in individual command areas and required

pressure conditions at lines near households.

C. Public Consultation

15. Extensive consultations were undertaken with key stakeholders in line with ADB's

requirements pertaining to environment and social considerations. Focus group discussion

(FGD) conducted at nearby locations of Water Treatment Plant sites proposed. The following

outcomes of consultations:

(i) The consultations helped to identify the felt needs /concerns and apprehensions of the

communities related to the project and priorities of concerned stakeholders.

(ii) Consultations revealed that people are aware of the problems of the existing water supply

system in the town and are willing to cooperate in the proposed project.

(iii) Consultations with the key stakeholders revealed that drinking water supply system if a

problem area for the town and they will fully accept the project.

16. The major stakeholders targeted during consultations are:

(a) The municipalities, its elected members and staff who will be required to oversee the

construction of the distribution networks and WTP as well as be directly responsible for the

maintenance of the installations

(b) Local residents who will take initiative to connect their houses with the water distribution

line.

(c) Local business people and traders

(d) School Students and College Students

(f) The opinion makers are intimately acquainted to and well regarded by the community.

They need to be enlisted in spreading environmental awareness within the community as well

as in conveying the benefits of the project.

V. LAND AVAILABILITY AND INVOLUNTARY RESETTLEMENT IMPACTS

A. Water Supply

17. No land acquisition or resettlement impacts are anticipated for any of the proposed civil

works for Boda water supply subproject.

18. WTP capacity is of 1.5 MLD is proposed to be constructed at Khasra No – 811/1 Near 500

KL OHT in Boda Town. The ownership of land is verified and is in possession of Revenue

Department, Govt. of Madhya Pradesh and considered land is ensured for the purposed of

water supply scheme. The process has being initiated for the allocation land for

construction of WTP.

19. There exist 300 KL (OHT – I) & 500 KL (OHT – II) capacities OHTs in the Boda Town.

We have proposed to use these OHTs in new scheme with some reconditioning.

20. As per the design calculations, 1 numbers of Clear Water Feeder Main (CWFM) are

proposed to be laid from Clear Water Sump at WTP. CWFM – I having dia150 mm&

length 200 m DI K9 pipe will feed 300 KL (OHT – I).

21. Separate centrifugal pumps are proposed for each clear water feeder main having capacity

15 Hp along with 100% standby for CWFM – I.

22. House Service connections : Providing house service connection tapping from a

distribution main/ sub-main including one tapping saddles, elbows, service pipe from

tapping point to the chamber near property boundary or inside the property boundary as per

the direction with U-ball valve, using 20mm Medium Density Polyethylene pipes (MDPE)

pipe 5 m long. The work shall include excavation, road restoration, etc complete. The

connection shall have:-

i. Electro fusion Tapping Ferrule shall be provided with a SS-304 Brass cutter with

cutting edges for making hole / tapping on the Mains and Fusion joint in sucha manner

that the 20-63mm diameter outlet depending on requirement of the house service

connections rotatable 3600

to the axis of pipeline. The town is having total number of

household’s 2091 .So all the connections are considered in this project.

ii. Domestic water meters: Supply and installation of AMR compatible water meters for

each house service water connections 2091 nos. 15 mm size, brass body, horizontal

inferential multi jet type, magnetic drive with anti-fraud shield and dry dial with IP 68.

Meter shall be made of copper or any other suitable anti corrosive metallic.

23. Site inspections and transect walk was carried all along the proposed laying of clear water

feeder mains (150mm).The proposed pipeline for clear water feeder mains will be laid

along the tow of the existing town road ROW; the clear water feeder mains to be laid in

Boda will be along the Nagar Parishad roads. The 9672 m distribution network pipelines in

Boda will be laid along the roads of the respective Nagar Parishads. Details of land

ownership for each water works component to be constructed are given in Appendix 1.

Appendix 2 provides the list of stakeholders and community people consulted.

24. Civil works in the project include linear excavation for laying pipes along the roads,

placing pipes in the trench and refilling with the excavated soil. The trenches will be of 0.4

m — 0.7 m wide and 0.8 to 1 m depth. Subsequent to completion of works, road

reinstatement will be undertaken by the contractor as part of the civil works. The roads in

the core city area of both the towns are very narrow and congested with pedestrians and

vehicles, while the roads in outer areas are wide. No necessity for full closure of roads is

identified. Proposed distribution pipe laying on roads in most part of the town will not have

any permanent or temporary IR impact. Hawkers and vendors have been witnessed along

the road side for most part of the distribution network pipe-laying.

25. Laying of transmission mains and distribution network pipelines in the project area has

been carefully planned to minimize disturbance to pedestrians and traffic and avoid income

loss to businesses. Potential temporary impacts to traffic/access to shops and residence due

to digging and excavation for pipe laying are possible during construction; however, these

will be mitigated by ensuring access to properties through provision of pedestrian planks,

provision of adequate signage, and careful traffic management.

VI. CONCLUSIONS

A. Summary and Conclusions

26. No significant IR impacts are assessed at identified sites for sub-project components, as

adequate vacant land is available for the proposed facilities, within the compounds of

government lands. The site for new WTP at Boda was owned by Revenue Department. For

which, NOC is under approval. For linear components (pipe laying) or those proposed

along government road ROWs, temporary disruption to road users, pedestrians and

community members will be avoided In the most congested zones of Boda Safety measures

and mitigated during construction by the contractor through simple measures such as

provision of planks for pedestrian access to shops and traffic management.

27. A budgetary provision is made for costs likely to be incurred for updating of this Project
