4 3. This Declaration is made pursuant to Santa Clara County Superior Court

5 Complex Civil Guidelines setting forth the meet and confer efforts between counsel

6 regarding JELD-WEN's Demurrer to Defendant/Cross-Complainant WESTERN

7 NATIONAL CONSTRUCTION'S (hereinafter "WESTERN") Cross-Complaint currently set

8 for hearing on September 26, 2014 at 9:00 a.m. in Dept. 1.

9 4. On September 22, 2014, I spoke with Megan Rechberg, counsel for

10 WESTERN, by telephone regarding JELD-WEN's Demurrer to WESTERN's Cross-

11 Complaint. During our telephone conversation , I informed Ms. Rechberg that JELD-WEN

12 had withdrawn its Demurrer as to the First, Second, Sixth and Seventh Causes of Action

13 in WESTERN's Cross-Complaint. We then discussed JELD-WEN's Demurrer as to the

14 Third, Fourth, Fifth, Eighth, Ninth and Tenth Causes of Action. We were unable to reach

15 a consensus regarding those causes of action.

5. I declare I have met and conferred with WESTERN in good faith in an

attempt to resolve the issues surrounding JELD-WEN's Demurrer to WESTERN's Cross­

Complaint, but was unable to resolve the issues and request the court hear JELD-WEN's

Demurrer on September 26,2014
