(A) Yes, the proposed Development will permit a use that is suitable in view of the use and development of adjacent and nearby property. The proposed hotel use is suitable given the tnixed-use character of the area.

(B) No, the proposed Development will not adversely affect the existing use or usability of any of the nearby properties. Rather, the proposed hotel use will complement existing uses on nearby properties.

(C) Applicant submits that the property does have not reasonable economic use as currently zoned.

(D) No, the proposed Development will not result in an excessive or burdensome use of the infrastructure systems.

Mahaffey Pickens Tucker, LLP submits this Letter of Intent and attached change in the

conditions application (the "Application") on behalf of Sugarloaf Hotel Group, LLC (the

"Applicant"), for the purpose of requesting a modification of existing zoning conditions related

to an approximately 2.148 acre tract of land (the "Property") located on North Brown Road at its

intersection with Cash Back Bonus Boulevard at the Sugarloaf Mills shopping mall. The

Property is currently zoned C-2 pursuant to RZC200 1-00028 (the "Current Zoning"). The

Applicant is proposing to develop the Property for use as a luxury boutique hotel.

The Property was included in the original Discover Mills mall rezoning and initial

development which was approved by the Gwinnett County Board of Com1nissioners in 1998

pursuant to RZC 1998-00166. Since that time, the Property has been graded, but remains vacant.

The Applicant is requesting to modify the existing conditions in order to allow the development

of the Property for use as an Aloft luxury boutique hotel as depicted on the site plan and building

elevations submitted with the Application. The proposed hotel would include approximately 110

roon1s on five stories. The proposed hotel building would be approxi1nately 72 feet tall and the

exterior fa9ade would include attractive, modern finishes and designs. Guests would be able to

enjoy 1nodern an1enities on the hotel property, but would also have quick pedestrian access to the

Sugarloaf Mills n1all across the street with its ample shopping and entertainment options. Guests

would also have convenient access to the Sugarloaf Mills Park & Ride with express service to

the Civic Center MART A station and Georgia State Capitol. Guests would also have convenient

access to the Infinite Energy Center and its associated office, commercial, and entertainment

options.

The Current Zoning encompassed the approximately 1 00-acre mall site and includes

conditions which are 1nostly applicable to that larger development. Moreover, development has

not occurred on the Property although the Current Zoning conditions were adopted nearly twenty

years ago . The Applicant submits that a luxury boutique hotel use is appropria

given its proximity to the interstate and the fact that it is adjacent to a large shopping mall. The

proposed hotel use would complement the surrounding commercial uses by increasing the

potential customer base. The proposed hotel would also increase the utility of nearby office uses

by providing increased lodging options for business travelers and complement existing and

proposed entertainment uses by providing convenient, upscale lodging for patrons.
