Office Address: National Government Center EDSA, Diliman, Quezon City, Philippines (02) 929-6071 to /8 www.nia.gov.ph MC No. &b s. 2015 Telephone Nos.: Website: MEMORANDUM CIRCULAR TO THE SENIOR DEPUTY ADMINISTRATOR, DEPUTY ADMINISTRATORS, DEPARTMENT / REGIONAL / PROJECT MANAGERS, NIAEASP NATIONAL COUNCIL OFFICERS AND OTHERS CONCERNED SUBJECT GUIDELINES FOR T.iE GRANT OF ADDITIONAL COLLECTIVE NEGOTIATION AGREEMENT (CNA) INCENTIVE FOR CY 2014 1.0 RATIONALE This Circular is being issued to provide rules and regulations for the payment of Collective Negotiation Agreem~ent (CNA) Incentive for CY 2014 pursuant to the NIA Board Resolution No. 7814-a-12, series of 2012 dated 11 December 2012 approving the Collective Negotiation Agreement (CNA), entered into by and between the National Irrigation Administration (NIA) Management and the National Irrigation Administration Employees Association of the Philippines (NIAEASP) for the next three (3) years starting 2012 to 2014 and DBM Circulars and guidelines. 2.0 PAYMENT OF CNA INCENTIVE a. Payment of CNA Incentive shall be in consonance with the provisions of the Public Sector Labor Management Council (PSLMC) Resolution No. 2, series of 2002, Civil Service Commission (CSC) Opinion No. 481, dated November 2005, Malacariang Administrative Order No. 135, dated December 27, 2005, Department of Budget and Management (DBM) Budget Circular No. 2006-1, DBM Budget Circular No. 2014-2 dated December 02, 2014 and all applicable laws, rules and regulations. b. The amount of Three Thousand Pesos (P3,OOQ,QO) CNA ince~tive in addition to the Twenty Thousand Pesos (P20,OOO.00) given on December 2014 and March 2015 per Memorandum Circulars Nos. 59, s. 2014 and 08, s. 2015. However, employees whose separation from the service or whose compulsory retirement falls beyond :31 October 2014 shall be considered to have rendered twelve rnonths of service during the CY 2014. c. The CNA incentive shall be proportionate to the length of service rendered for the CY 2014. (CNA Incentive = No. of months rendered divided by 12 months, multiplied by the amount of CNA Incentive). d. The CNA incentive shall be paid to qualified officials/employees not later than September 4, 2015.

SUBJECT GUIDELINES FOR T.iE GRANT OF ADDITIONAL COLLECTIVENEGOTIATION AGREEMENT (CNA) INCENTIVE FOR CY 2014

1.0 RATIONALE

This Circular is being issued to provide rules and regulations for the payment ofCollective Negotiation Agreem~ent (CNA) Incentive for CY 2014 pursuant tothe NIA Board Resolution No. 7814-a-12, series of 2012 dated 11 December2012 approving the Collective Negotiation Agreement (CNA), entered into by andbetween the National Irrigation Administration (NIA) Management and theNational Irrigation Administration Employees Association of the Philippines(NIAEASP) for the next three (3) years starting 2012 to 2014 and DBM Circularsand guidelines.

2.0 PAYMENT OF CNA INCENTIVE

a. Payment of CNA Incentive shall be in consonance with the provisions ofthe Public Sector Labor Management Council (PSLMC) Resolution No. 2,series of 2002, Civil Service Commission (CSC) Opinion No. 481, datedNovember 2005, Malacariang Administrative Order No. 135, datedDecember 27, 2005, Department of Budget and Management (DBM)Budget Circular No. 2006-1, DBM Budget Circular No. 2014-2 datedDecember 02, 2014 and all applicable laws, rules and regulations.

b. The amount of Three Thousand Pesos (P3,OOQ,QO)CNA ince~tive inaddition to the Twenty Thousand Pesos (P20,OOO.00) given onDecember 2014 and March 2015 per Memorandum Circulars Nos. 59, s.2014 and 08, s. 2015.

c. The CNA incentive shall be proportionate to the length of service renderedfor the CY 2014. (CNA Incentive = No. of months rendered divided by 12months, multiplied by the amount of CNA Incentive).

3.0 COVERAGE

The following are entitled to receive CNA Incentive:

a. All NIA employees holding permanent, temporary, casual/daily, eo-terminous or contractual whose appointments were passed upon by theCivil Service Commission (CSC).

b. Rank-and-file employees who are not members of the accredited sole andexclusive negotiating agent, but enjoy or accept benefits under the CNA,subject to the assessment and collection of agency fee.

c. Those who perform managerial functions.

4.0 EXEM PTION

Those hired through consultancy, contract of service and job order where noemployer-employee relationship exists are not covered by this Circular.

5.0 FUNDING REQUIREMENTS

The herein grant of CNA shall be paid from the Corporate Operating Budget(COB).

6"0 AGENCY FEE CHECK-OFF

Seven percent (7%) of the CNA incentive received by non-union member-employees shall be deducted/checked-off as agency fee in accordance withPSLMC Resolution No. 1, s. 1993 and Memorandum Circular No. 94, s. 2005.Said agency shall be remitted to the NIAEASP District Office or Chapters offoreign/locally funded projects with recognized Union Chapter, as the case maybe.

7.0 RESPONSIBILITY OF AGENCY HEADS

The Chief of Offices shall be responsible for the irnplerhentation of the provisionsof this Circular. They shall be held personally liable for any payment of CNAIncentive not in accordance with the provisions of this Circular without prejudice,however, to the refund by employees/officials concerned of any payment made tothem in case of disallowance.

8.0 SAVING CLAUSE -All questions arising from the implementation of this Circular shall be referred tothe Office of the Deputy Administrator for Administrative and Finance Sector.
