Access Consent Policy (ACP) Testing Sub-Workgroup• All pilot participants have completed automated testing with the DIL – December 2014• All pilot supporting materials have been provided to SSA for review and participants are

January 2015• Weekly calls are held every Fri, 12p – 1p ET and will continue thru 1/23/2015

Certificate Installation

• If the subscriber is not managing and installing the certificate, then he can delegate the installation to a proxy

• Please indicate in your certificate issuance request (email) any delegation of installation responsibilities.

• Include Name, email and cell phone number of delegated individual.

• The proxy has to be the individual installing the certificate.

• Both subscriber and proxy must read and acknowledge Questions 40 and 41 from http://ehealthexchange.kayako.com/Knowledgebase/Article/View/7/0/ehealth-exchange-entrust-x509-certificate-faq

Participant Obligations - Handling CodesQuestion 40: How should I handle the Production codes sent by the eHex for my certificate?

Answer: It is important to understand that these codes are the keys to obtaining access to millions of patients’ data, therefore it is extremely important that they are handled correctly. The codes are issued by Healtheway staff directly to, and only to, the x.509 Subscriber or a person named by the Subscriber to act as his/her proxy. These codes must not be shared with anyone; only the Subscriber or the proxy should have them (not both). Also, a reminder that the use of these codes is covered in the Entrust agreements that you or your organization notarized and executed, and the associated Entrust and FBCA policies, and applicable state and federal law and regulations. 16

Participant Obligations - Handling CertificatesQuestion 41: How do I properly handle my x.509 prod cert?Answer: Your production certificate allows your organization to access the network and all of its patients’ data. For this reason it is required that your organization take the necessary precautions to ensure that this certificate remains secure. The following items should be followed (including but not limited to):- Certificate should never be shared.- Certificate should be created on the production server (If not possible reasonable security measures should be in place to transfer certificate).- Certificate should never leave the production server.- Certificate should never be backed up or held by a third party until transactions are final (escrow).- Individuals should become familiar with X.509 key management best practices.- Individuals should be familiar with applicable law and FBCA procedures and policies. 17

Participant Obligations -Monitoring• New participants, or existing participants who retest, are

subject to a probationary period once in production (e.g. 90 days)

• Participant should report issues to Healtheway

• Issues are triaged to assess whether participant is meeting conformance and interoperability requirements

• If all issues resolved, probationary period ends

• Matters may be escalated, including disputes, to the Coordinating Committee for resolution

Participant Obligations - DURSA

• Please become familiar with the eHealth Exchange Operating Policies and Procedures (OPPs ~3mb .zip file) and be aware of all of your obligations under DURSA

• Assure the necessary policies and processes are in place before going live and that staff are appropriately trained to: • Comply with all Applicable Law;• Reasonably cooperate to meet your obligations as an eHealth Exchange

Participant;• Request, retrieve and send data only for a Permitted Purpose (more

restrictive than HIPAA); • Use data received in accordance with the terms and conditions of the

DURSA;• Refrain from disclosing passwords that provide access to connectivity

with other eHealth Exchange participants; • Appropriately protect the certificates issued to you by Healtheway; and• Maintain and manage the security and upkeep of your production

infrastructure.19

• Production outages / downtime, whether planned or unplanned

• Please see this knowledge base article for the SOP

• NOTE: Production outages / downtime that exceed ten (10) consecutive days or more than forty (40) days over the preceding 12-month period will also require Coordinating Committee approval
