The Head of the Census Resigned. It Could Be as Serious as James Comey
InaweekdominatedbyPresidentTrump'sfiringofFBIdirectorJamesComey,youcouldbeforgivenformissingtheimminentdepartureofanother,lessprominentfederalofficial.YetthenewsthisweekthatJohnH.Thompson,thedirectoroftheCensusBureau,hasabruptlyresignedisarguablyasconsequentialtothefutureofourdemocracy.That'sbecausetheCensusBureau,whilelessflashythantheFBI,playsastaggeringlyimportantroleinbothU.S.electionsandanarrayofstateandfederalgovernmentfunctions."AttheveryheartoftheCensusisnothinglessthanpoliticalpowerandmoney,"saidTerriAnnLowenthal,whoservedasthestaffdirectoroftheHousecensusoversightsubcommitteebeforebecomingaconsultantoncensuspolicyandoperationalissues."Itisthebasis,theveryfoundation,ofourdemocracyandtheConstitution'spromiseofequalrepresentation."

TheresultsofthedecennialCensus—thenextwillbein2020—willdeterminehowstateandfederalpoliticaldistrictsaredrawn;whichAmericansare"counted"forrepresentation;andhowfederaldollars,manyofwhichareallocatedonapercapitabasis,arespent.TheFoundingFathersbelievedsodeeplyintheimportanceofacomprehensivecensusthattheyincludedalegalrequirementforitintheConstitution,aclauselaterunderscoredbytheFourteenthAmendment.WehavecarriedoutanationalCensuseverytenyearssince1790.Thompson'searlydeparturehasthepotentialtounderminethattradition.Thedirector'sfixed,five-yeartermhadbeenextendedthrough2017andhisexitwasasurprise.Someadvocatesspeculatehewaspushedoutforpoliticalreasons,althoughthereisnoevidencetosupportthatclaim.What'sclearisThompson'sresignationleavestheagencyinatoughposition.Duringthecriticalrampupperiodbeforethe2020Census,thebureaunowfacesaleadershipvacuum,adearthoffunding,andapotentiallycontentiouspoliticalfightoverthenominationofthenextdirector."ThetimingofThompson'sdeparturecouldnotbeworse,"saidPhilSparks,co-directoroftheCensusProject,anon-profitcoalitionthatadvocatesforafairCensus."Ifyou'renotonschedulewithfieldtestsin2018,it'sjustnotgoingtogoasplanned."Therearethreebigproblemswithavacuumofleadershipatthebureauatthisparticularpoliticalmoment.Thefirsthastodowithmaintainingthebasicfunctionoftheagency,whichmustfollowastrict,10-yearschedule."TheCensusisonarelentlesscalendar.Youcannotpostponeit,"KennethPrewitt,whowasdirectoroftheCensusBureauduringthe2000Census,toldTIME."There'sahugeamountofplanningandtestingtodobeforehand.Withaleadershipvacuum,thingsslowdown."LowenthalsaysshedoesnotexpecttheTrumpadministrationtonominateareplacementforThompsonthisyear,andevenafterthattakesplace,theSenateconfirmationprocesscouldtakemanymoremonths.Withsomanyothervacanciesinthefederalgovernment,it'spossibletherolecouldremainunfilledforthenextyearormore.Thesecondbigproblemfacingtheagencyhastodowithmoney.WithoutarespecteddirectortopushCongressandtheWhiteHousetogiveadequatefundingtothebureau,theagencyrisksstumblingonashoestringbudget.InApril,Congressallocatedjust$1.47billiontotheagency,roughly$150millionlessthanofficialsbelieveisnecessaryatthisstageinthe10-yearcycle.ThePresident'sproposed2018budgetprovidesjustaminorbump,with$1.5billionnextyear.

Withoutmorefunding,Sparkssays,aninterimleadermaybeforcedtomakegrimchoices.Heorshemaydecide,forexample,torolloutuntestednewinternet-basedprograms,increasingtheriskofafailurein2020(seeHealthcare.gov),ortocannibalizeotherprograms,liketheannualAmericanCommunitySurveyorthisyear'seconomicsurvey,whichisusedtoinformconsequentialdecisionsattheFederalReserve.Aninterimleadermightalsobeforcedtogiveuponanonlinecensusentirely,optinginsteadfortheoldschoolpencilandpaperversionthebureauhasusedfor220years—amovethatwouldsavemoneyintheshortterm,butendupcostingtaxpayers,accordingtotheCommerceDepartment,$5billionmoredowntheroadoverthefull10-yearcycle.Thethirdmainproblemwithavacuumofleadershipatthebureauatthispoliticalmomentisalittlemoreslippery.Ithastodo,watchdogssay,withthevagariesofpublicperception."Itisvital,itiscritical,thatthepublichasconfidenceintheintegrityoftheprocessandfaithintheresults,"saidLowenthal."Anythingthatcompromisesthat,compromisesthewholemission."Prewittwarnedthatiftheagencydoesn'treceivethefundsorpoliticalsupportitneeds,itcouldforceapubliccrisis."Ifyouunderfundthecensus,yougetanundercount,"hesaid."Andifyoudon’tcountpeople,theyarepoliticallyinvisible,ineffect."Ifthe2020Censusappearstoundercountcertainpopulationsordemographicsincertaincitiesorstates,hesaid,thatcoulddiscredittheagency'sperceivedcompetency.Already,theCensusBureauhasscaledbackits2020advertisingbudgetusedtoinformAmericansabouttheCensustakerswhowillbecomingtotheirdoors.ThepubliccouldalsolosefaithinthelegitimacyoftheCensusresultsiftheyareseentobepoliticized,Lowenthalsaid.IfPresidentTrump,forexample,whohasalreadyridiculedfederalstatisticsandattackedfederalinstitutions,wereto"sendoneerranttweetduringtheCensuscallingintoquestiontheintegrityoftheprocess,"shewarned,hecoulddoasignificantamountofdamage,forcingwhatcouldbecomeaConstitutionalcrisis.Ithashappenedbefore.Afterthe1920Census,membersofCongressrefusedtoacceptdatashowingtheincreasingurbanizationofthecountry,andvotednottoreallocateseatsbasedonthatsupposedlyflaweddata.BruceBartlett,aformerRepublicanWhiteHouseandCongressionalaide,saysitwouldn'tbethefirsttimetheagency'sworkbecameapoliticalhotpotato.In2009,TeaPartyRepublicanssoughttounderminethebureau'scredibilitybysuggestingthatitsannualAmericanCommunitySurvey,orACS,wasanunreasonableintrusionintoAmericans’privacy.In2012,aRepublican-ledHousevoted232to190toabolishtheACSentirely.

Singapore Man Sentenced to 40 Months in Prison for Plot Involving Exports to Iran of U.S. Components
LimYongNam,akaStevenLim,43,acitizenofSingapore,wassentencedtodayto40monthsinprisonforhisroleinaconspiracythatcausedthousandsofradiofrequencymodulestobeillegallyexportedfromtheU.S.toIran,atleast14ofwhichwerelaterfoundinunexplodedimprovisedexplosivedevices(IEDs)inIraq.TheannouncementwasmadebyActingAssistantAttorneyGeneralforNationalSecurityMaryB.McCord,U.S.AttorneyChanningD.PhillipsoftheDistrictofColumbia,ActingAssistantSecretaryofExportEnforcementRichardMajauskasfortheU.S.DepartmentofCommerce,ActingDirectorThomasD.HomanofU.S.ImmigrationandCustomsEnforcement(ICE)andAssistantDirectorBillPriestapoftheFBI’sCounterintelligenceDivision.ThesentencewasissuedbytheHonorableEmmetG.Sullivan.Limwasextraditedin2016fromIndonesia,wherehehadbeendetainedsinceOctober2014inconnectionwiththeU.S.requestforextradition.HepleadedguiltyonDec.15,2016,toachargeofconspiracytodefraudtheU.S.bydishonestmeans.Limwillbedeporteduponcompletionofhissentence.LimandotherswereindictedintheDistrictofColumbiainJuneof2010onchargesinvolvingtheshipmentofradiofrequencymodulesmadebyaMinnesota-basedcompany.Themoduleshaveseveralcommercialapplications,includinginwirelesslocalareanetworksconnectingprintersandcomputersinofficesettings.Thesemodulesincludeencryptioncapabilitiesandhavearangeallowingthemtotransmitdatawirelesslyasfaras40mileswhenconfiguredwithahigh-gainantenna.Thesesamemodulesalsohavepotentiallylethalapplications.Notably,during2008and2009,coalitionforcesinIraqrecoverednumerousmodulesmadebytheMinnesotafirmthathadbeenutilizedaspartoftheremotedetonationsystemforIEDs.Accordingtothepleadocumentsfiledinthecase,between2001and2007,IEDswerethemajorsourceofAmericancombatcasualtiesinIraq.Inastatementofoffensesubmittedatthetimeoftheguiltyplea,LimadmittedthatbetweenAugust2007andFebruary2008,heandotherscaused6,000modulestobepurchasedandillegallyexportedfromtheMinnesota-basedcompanythroughSingapore,andlatertoIran,infiveshipments,knowingthattheexportofU.S.-origingoodstoIranwasaviolationofU.S.law.Ineachtransaction,Limandothersmademisrepresentationsandfalsestatementstothe6

MinnesotafirmthatSingaporewasthefinaldestinationofthegoods;atnopointintheseriesoftransactionsdidLimoranyofhisco-conspiratorsinformthecompanythatthemodulesweredestinedforIran.Similarly,accordingtothestatementofoffense,LimandotherscausedfalsedocumentstobefiledwiththeU.S.government,inwhichtheyclaimedthatSingaporewastheultimatedestinationofthemodules.Limandhisco-conspiratorsweredirectlyawareoftherestrictionsonsendingU.S.-origingoodstoIran.ShortlyafterthemodulesarrivedinSingapore,theywerekeptinstorageatafreightforwardingcompanyuntilbeingaggregatedwithotherelectroniccomponentsandshippedtoIran.ThereisnoindicationthatLimoranyofhisco-conspiratorsevertookphysicalpossessionofthesemodulesbeforetheyreachedIranorthattheywereincorporatedintoanotherproductbeforebeingre-exportedtoIran.Accordingtothestatementofoffense,14ofthe6,000modulesthedefendantsroutedfromMinnesotatoIranwerelaterrecoveredinIraq,wherethemoduleswerebeingusedaspartofIEDremotedetonationsystems.ThisinvestigationwasjointlyconductedbyICEHomelandSecurityInvestigations(HSI)specialagentsinBostonandLosAngeles;FBIagentsinMinneapolis;andDepartmentofCommerce,BureauofIndustryandSecurityagentsinChicagoandBoston.SubstantialassistancewasprovidedbytheU.S.DepartmentofDefense,U.S.CustomsandBorderProtection,theStateDepartment’sDirectorateofDefenseTradeControls,theTreasuryDepartment’sOfficeofForeignAssetsControl,andtheOfficeofInternationalAffairsintheJusticeDepartment’sCriminalDivision,particularlytheJusticeDepartmentAttachéinthePhilippines,aswellastheFBIandHSIAttachésinSingaporeandJakarta.U.S.lawenforcementauthoritiesthankedthegovernmentsofSingaporeandIndonesiaforthesubstantialassistancethatwasprovidedintheinvestigationofthismatter.TheprosecutionwashandledbyAssistantU.S.AttorneyAriRedbordoftheDistrictofColumbiaandTrialAttorneyJulieEdelsteinoftheNationalSecurityDivision’sCounterintelligenceandExportControlSection.
